What it does
This legislative instrument, the Self-managed Superannuation Funds (Assets Acquired on Marriage Breakdown) Repeal Determination 2011, is a short, single-purpose repeal instrument made by the Deputy Commissioner of Taxation. It records three operative matters. First, it gives the instrument its formal name (clause 1). Second, it states an effective commencement date: the instrument is "taken to have commenced on 17 November 2010" (clause 2). Third, it expressly repeals one earlier instrument, the Self-managed Superannuation Funds (Assets Acquired on Marriage Breakdown) Determination 2006, identified as F2006L02884 and registered on 30 August 2006 (clause 3). The instrument is signed and dated 14 October 2011 by the Deputy Commissioner of Taxation and is made under paragraph 66(2)(d) of the Superannuation Industry (Supervision) Act 1993, as stated at the head of the instrument.
Mechanically, the instrument performs a repeal. From the commencement date the legal force of the 2006 Determination is removed by operation of clause 3; the instrument itself declares that repeal and fixes the commencement date. The instrument does not contain qualifications, savings or transitional provisions; it does not restate or re-enact any substantive provisions that may have been in the 2006 Determination. The instrument gives no explanation or rationale for the repeal. It therefore operates as a clean removal of the earlier Determination from the body of legislative instruments to which it belonged, subject to the legal effect of its chosen commencement date.
Two timing features require attention. The instrument is dated 14 October 2011, but clause 2 treats it as having commenced on 17 November 2010. The text therefore asserts retrospective commencement, that is, an operative date predating the instrument's signature. The repealed Determination is identified by its title and by register details, F2006L02884, registered on 30 August 2006. The instrument does not state whether the repeal is intended to operate with prospective or retrospective effect beyond the single commencement date it specifies, nor does it include any savings for actions taken in reliance on the 2006 Determination.
