43 Offences involving assault

(1) For the Act, section 16(1)(a), an offence under the law of an Australian or overseas jurisdiction involving assault of any description, being an offence in which the penalty imposed includes one or more of the following, is prescribed—

(a) a term of imprisonment, whether or not suspended,

(b) an intensive correction order,

(c) a community correction order,

(d) a conditional release order,

(e) a good behaviour bond,

(f) a community service order,

(g) a penalty of $200 or more.

(2) For the Act, section 16(1)(b), an offence under the law of an Australian or overseas jurisdiction involving assault of any description is prescribed if the offence involves an assault of a serious nature.
