### 33 Possession of motor vehicles
> [*\[Section 33 Amended by No. 58 of 2005, s. 28, Applied:01 Jan 2006\]*](/view/html/inforce/2006-01-01/act-2005-058#GS28@EN) A commercial agent, or a commercial sub-agent, undertaking any activity of a commercial agent or any person referred to in [section 41(1)(k)](#GS41@Gs1@Hpk@EN) who takes possession of a motor vehicle within the meaning of the [Vehicle and Traffic Act 1999](/view/html/inforce/2026-04-12/act-1999-070) that is subject to a security interest must –

> > > (a) inform a police officer; and
> >
> > > (b) deliver or send by post, within 24 hours, to the nearest police station written particulars in duplicate of the motor vehicle.
>
> Penalty: In the case of –
>
> > > (a) a body corporate, 500 penalty units; and
> >
> > > (b) a natural person, 200 penalty units.
