36DAdditional functions and powers

##### 36D Additional functions and powers (1) In addition to the legal capacity and powers that it has by virtue of section 67 of the Companies Act 1981, the Exchange: (a) has such functions and powers as are conferred on it by a relevant Act; and (b) shall perform any functions, and may exercise any powers, that are conferred, or expressed to be conferred, on it by a State Act or by a regulation or other instrument made under, or by virtue of, a State Act. (2) Section 68 of the Companies Act 1981 does not apply in relation to a function or power conferred, or expressed to be conferred, as mentioned in paragraph (1)(a) or (b) of this section. (3) Except so far as the contrary intention appears, a reference in this Act to functions or powers of the Exchange includes a reference to functions or powers conferred, or expressed to be conferred, as mentioned in paragraph (1)(a) or (b).
