Second-hand Dealers Regulation 2002

The regulation operates through a small set of interlocking concepts: the categorical definition of second‑hand goods, prescribed identity documents and particulars, mandatory transaction records, verification standards, record storage format, and police‑directed disclosure. Each is defined or given operational effect in specific provisions.

• Second‑hand goods. Section 5 and schedule 1 list the kinds of goods treated as second‑hand goods for the Act. Schedule 1 is itemised; items exclude certain subcategories (for example sporting goods excludes clothes and shoes, item 5; electrical/electronic goods exclude refrigerators, washing machines and other whitegoods, item 11). Several schedule items expressly exclude goods sold by the Defence Force (items 5, 9, 10), creating definitional boundaries within the list (s 5; schedule 1).
• Exempt entities. The term "exempt entity" is defined by reference to the Traders (Licensing) Act 2016, section 21 (dictionary). Section 5(2) also excludes from the second‑hand goods definition goods taken as trade‑in by a person (other than a licensed second‑hand dealer) as part of the sale of goods that are not second‑hand goods.
• Photo and non‑photo identification. Sections 6 and 7 define "photo identification document" and "non‑photo identification document" respectively, and schedule 2 sets out the permitted documents and the precise particulars to be recorded from them. Photo ID examples: current Australian driver licence, external driver licences, passports, proof of identity card, Australian student ID card (s 6; schedule 2 part 2.1). Non‑photo examples: birth certificate, citizenship certificate, extract from the electoral roll, records about land titles, entitlement card, credit/debit card, documents issued by financial institutions, service bills and documents issued by the Territory (s 7; schedule 2 part 2.2).
• Verification standard. Section 8(3) sets the verification test: a person’s name is verified if they show at least one photo identification document, or at least three non‑photo identification documents that each show the person’s name and where the name is the same on each document. Section 8(2)(e)(ii)(A) requires that one of the three non‑photo documents show the person’s home address.
• Mandatory transaction records. Sections 8-10 specify the fields a dealer must record when buying, receiving, selling, or disposing of goods, and the circumstances in which those records are required (including the $50 threshold for disposals and sales in s 9 and s 10(3)).
• Record keeping organisation. Section 11(1) requires records be kept so transactions are identifiable by both date and the kind of goods, a structural requirement on how records must be indexed or stored.
• Police direction and disclosure. Sections 11(2) and 12(1) give the chief police officer power to issue directions about keeping records and giving records to police. These directions are ordinarily notifiable instruments and, additionally, must be given public notice on an ACT government website or in a daily newspaper circulating in the ACT (s 11(2)-(4); s 12(2)-(3)). If a direction is addressed only to a named licensed second‑hand dealer, the notification and public notice requirements do not apply (s 11(5); s 12(4)). The Legislation Act definitions (dictionary) are relevant to the operation and publication of notifiable instruments.

Auxiliary concepts in the dictionary affect practical operation: "proof of identity card" is defined to include cards issued under the Liquor Act 2010 or corresponding state laws, a birth certificate includes certified extracts under the Births, Deaths and Marriages Registration Act 1997, and "document issued by a financial institution" is defined to be from the institution's records about the person's account (dictionary). The regulation therefore ties identification particulars to source documents that themselves are defined across multiple statutes, creating cross‑document consistency and reliance on other registers.

Mechanically, therefore, the concept set transforms routine second‑hand transactions into information events that must be captured, indexed by date and good type, and made available to police under prescribed directions.

Primary affected parties

• Licensed second‑hand dealers. The regulation’s obligations fall directly on persons who are "licensed" under the Second‑hand Dealers Act 1906 (dictionary note). These dealers must collect, verify and keep the records specified in sections 8-11, and must comply with any directions by the chief police officer about the form, keeping and giving of records (s 8-12). The obligations apply to purchases, receipts, sales and disposals that involve second‑hand goods as defined in schedule 1.
• Sellers/suppliers of second‑hand goods who are not exempt. Individuals or entities selling or otherwise giving second‑hand goods to a licensed dealer (unless they qualify as an “exempt entity”) are affected in that they must produce the identity documents necessary for the dealer to verify name and record particulars (s 8(2)-(3); schedule 2). The regulation sets the acceptable identity documents and the particulars that must be recorded (s 6-7; schedule 2).
• Purchasers of second‑hand goods worth more than $50. When a licensed dealer sells or disposes of goods valued over $50, the dealer must record the purchaser’s full name and home address (s 9(1)-(2); s 10(3)). That creates an expectation that buyers will supply identity and address details to receive goods above the monetary threshold.

Secondary or conditional affected parties

• Exempt entities. The regulation distinguishes purchases from "exempt entities" (dictionary cross‑reference to Traders (Licensing) Act 2016, s 21). If a dealer buys goods from an exempt entity for the purpose of resale, a reduced record set applies (s 10). Exempt entities themselves are affected in that their transactions trigger a different compliance pathway for dealers.
• The chief police officer and police agencies. The regulation explicitly empowers the chief police officer to issue directions concerning record keeping and disclosure, and requires public notification of those directions (s 11-12). Police are therefore primary intended recipients of the records and the principal enforcement interlocutor.
• Territory entities and registries. The regulation references documents issued by the Territory and by registrars (for example, certified land title records), creating interactions for those agencies when their records are relied upon as identification (schedule 2; dictionary).
• Financial institutions and billers. Documents issued by financial institutions and service billers are accepted non‑photo identification documents (schedule 2 part 2.2). Those institutions therefore indirectly participate in the identification ecosystem created by the regulation.

Who does not bear the same burden

• Consumers selling goods as trade‑ins as part of a sale where the goods received are not second‑hand goods; section 5(2) says such goods are not second‑hand goods and therefore fall outside the regulation’s record obligations in those circumstances.
• Defence Force vendors for specified items. Several schedule 1 items exclude goods sold by the Defence Force (items 5, 9, 10), so dealers buying those particular categories from Defence Force sellers do not treat them as second‑hand goods under this schedule.

Distribution of costs and benefits

• Costs are concentrated on licensed dealers, who must capture and store specified data fields, verify identity against prescribed documents, index records so transactions are retrievable by date and kind, and respond to police directions. Dealers also bear the risk of individual directions addressed to named dealers (s 11(5); s 12(4)).
• Benefits (explicitly channeled by the instrument) are concentrated to police and the public interest in tracing stolen property: the structure creates traceability and an evidentiary trail. The regulation does not itself quantify benefit but furnishes information flows for law enforcement.

Timing and applicability

• The regulation has been in place since 2002 with amendments up to 2025 (endnotes and amendment history). The obligations apply whenever a licensed dealer buys/receives/sells/disposes of second‑hand goods as defined; the $50 threshold applies to sales/disposals record duties (s 9(1), s10(3)).

Practical point: licensed dealers who rely on online sales channels, auction platforms, or informal markets must adapt processes to capture required identification and preserve records in a way that supports retrieval by date and good category (s 11(1)). The regulation does not specify formats or retention periods, which shapes implementation choices and potential legal uncertainty (see “Gotchas” and “How to comply”).

Duties imposed on licensed second‑hand dealers

• Record‑making when buying/receiving from non‑exempt persons. Section 8 requires dealers to make a record of: date and time of transaction; a description of the goods including colour, brand and serial number and any hallmark/inscription/engraving; the person’s verified full name; the person’s home address, home telephone number and date of birth; identity document particulars (either at least one photo ID or three non‑photo IDs with particulars prescribed in schedule 2); the amount paid or consideration given; and the stock number assigned by the dealer (s 8(2)(a)-(h)).
• Verification duty. Under s 8(3) the dealer must verify the person’s name by obtaining at least one photo ID or three non‑photo IDs that all show the same name. When using non‑photo IDs, one must show the person’s home address (s 8(2)(e)(ii)(A)).
• Record‑making for sales/disposals over $50. Section 9 obliges dealers who sell or otherwise dispose of second‑hand goods with value over $50 to record date/time of sale/disposal; purchaser’s full name and home address (or disposal details if not to a person); and the dealer’s stock number (s 9(2)(a)-(c)).
• Record‑making for purchases from exempt entities. Section 10 establishes a separate duty where dealers buy goods from exempt entities for resale: record date/time/place of purchase; description; amount paid; and the dealer’s stock number (s 10(2)(a)-(d)). If those goods are later sold/disposed of for more than $50, the dealer must also record sale date/time, purchaser’s name and home address and stock number (s 10(3)).
• Records organisation. Section 11(1) requires that records be kept in a way that allows transactions to be identified by both date and kind of goods. This is an organisational duty; format is not mandated, but retrievability by the two axes is required.
• Compliance with police directions. Sections 11(2) and 12(1) allow the chief police officer to issue directions about keeping records and the giving of records to police; dealers must comply with any direction that applies to them.

Rights and administrative protections

• Notice and publicity requirements for directions. The regulation requires that directions issued by the chief police officer be notifiable instruments (s 11(2); s 12(2)) and, in addition to being notified on the legislation register, receive public notice on an ACT government website or in a daily newspaper (s 11(4); s 12(3)). These provisions create procedural visibility for directions addressed generally, supporting transparency for dealers and the public.
• Exceptions for named directions. If a direction is addressed only to a named licensed second‑hand dealer, the notifiable instrument and public notice requirements do not apply (s 11(5); s 12(4)). This preserves operational flexibility for targeted instructions but reduces public transparency for those targeted directions.
• Cross‑referenced definitional protections. The schedule and dictionary tie the allowed evidence to statutory documents (e.g. birth certificates under Births, Deaths and Marriages Registration Act 1997, proof of identity cards under Liquor Act 2010), which provides clarity about acceptable source documents (dictionary; schedule 2).

Information fields and required particulars

• The particulars to be recorded from each accepted ID type are prescribed in schedule 2, columns 2 and 3 (photo documents in part 2.1; non‑photo documents in part 2.2). For example, from a current Australian driver licence the dealer must record issuing jurisdiction and licence number (schedule 2 part 2.1 item 1); from a birth certificate the issuing jurisdiction, registration number and date of issue (schedule 2 part 2.2 item 1). The regulation therefore restricts the permissible field set that dealers may rely upon.

Record disclosure and police access

• The chief police officer’s directions may specify which records must be given to police and how they are to be provided (s 12(1)). The directions mechanism gives the police practical control over the timing, format and scope of disclosure subject to the notifiable instrument and public notice regime for general directions (s 12(2)-(3)).

Liability and penalties

• The regulation does not itself set specific fines, but the front material records penalty unit values for offences against this law at the republication date: $160 per penalty unit for an individual and $810 per penalty unit for a corporation. Dealers should assume contraventions of obligations created by the regulation may attract penalty units as specified under the relevant Act or offence provisions that apply to this regulation.

Operational consequences

• Dealers must implement intake processes that capture all specified fields at the point of acquisition, enforce document standards for verification, tag stock numbers consistently, and index and store records to meet the double‑axis retrievability requirement. Dealers must also have procedures for responding to general and targeted directions from the chief police officer.

Statutory penalty framework and values

• The regulation itself does not specify separate offence provisions or fines within its text, but its front matter recorded the value of a penalty unit applicable to offences against this law at the republication date: $160 for an individual and $810 for a corporation (front material). Any offence against obligations created under the Second‑hand Dealers Act 1906 and this regulation will therefore be quantified using those penalty unit values as applicable at the time of prosecution, subject to the penal provisions in the parent Act.

Enforcement mechanisms provided in the regulation

• Chief police officer directions. Sections 11(2) and 12(1) place operational enforcement power in the hands of the chief police officer. The police can issue directions about how records must be kept and what records must be given to police. Those directions are the regulatory lever for operational compliance and for the police’s access to transactional data (s 11(2); s 12(1)).
• Notifiable instrument and public notice requirements. General directions issued by the chief police officer are notifiable instruments (s 11(2); s 12(2)). The regulation requires additional public notice beyond register notification , specifically, notice on an ACT government website or in a daily newspaper circulating in the ACT , for directions of general application (s 11(4); s 12(3)). This procedural requirement supports transparency and gives dealers notice of obligations applicable to the industry as a whole.
• Exceptions for targeted directions. If a direction is addressed only to a named licensed second‑hand dealer, the notifiable instrument and public notice requirements do not apply (s 11(5); s 12(4)). This permits the police to target enforcement or investigatory measures at a particular dealer without broad public notification.
• Record disclosure. Section 12 empowers the chief police officer to regulate which records must be given and how dealers must give them to police. That is the mechanism by which enforcement agencies obtain transactional information needed for investigations (s 12(1)).

Practical enforcement implications

• The primary enforcement lever is administrative rather than criminal in form: police directions define how compliance is operationalised and how records are disclosed. Criminal liability (and penalty unit calculation) will arise under the applicable offence provisions in the parent Act or other enabling statutes; the regulation establishes the duties whose breach may trigger enforcement.
• Transparency vs targeted enforcement. The notifiable instrument/public notice regime applies only to general directions; targeted directions to named dealers can be private. The dual pathway gives police discretion to choose between broad rules and case‑specific requests.
• Evidentiary consequences. The prescriptive list of fields and the particulars required from identity documents (schedule 2) create an evidentiary baseline. A dealer’s failure to capture the required particulars may be relied upon by investigators or prosecutors as evidence of non‑compliance, potentially engaging the penalty regime under the parent Act.

Limits and gaps in the regulation’s enforcement design

• The regulation does not specify retention periods, minimum formats, encryption or security standards for records. Enforcement therefore focuses on whether required fields were recorded and whether records are retrievable by date and kind of goods (s 11(1)), rather than mandating particular storage technologies or retention durations.
• The regulation gives the chief police officer the power to specify how records must be given (s 12(1)), but until such a direction is made there is some operational uncertainty about format and secure transmission. Dealers must be prepared to comply with directions that could, in practice, require rapid production of records in particular file formats or physical form.

Summary

• Enforcement rests on a combination of statutory duties, police administrative directions and the penalty framework in the parent Act applied using penalty‑unit values published in the republication. The most direct enforcement instrument in day‑to‑day operation will be police directions about record keeping and disclosure (s 11-12), backed by criminal or civil sanctions available under the enabling legislation where breaches are pursued.

This regulation interlocks with multiple Commonwealth and Territory statutes through definitional cross‑references and by allocating roles to police and registries. The cross‑references determine what documents are acceptable, how certain terms are interpreted, and which entities are exempt.

Primary legal cross‑references in the regulation

• Second‑hand Dealers Act 1906. The regulation is made under that Act. Terms from the Act such as "licensed" and "second‑hand dealer" apply to the regulation by signpost (dictionary note), and offences and licensing mechanisms are determined at Act level.
• Legislation Act 2001. The dictionary and notes repeatedly rely on the Legislation Act for interpretative principles, definitions (for terms like "home address", "chief police officer", and "notifiable instrument"), and for the legal status of notes (s 3; notes). The notifiable instrument and public notice obligations (s 11(2)-(4); s 12(2)-(4)) refer explicitly to obligations under the Legislation Act.
• Traders (Licensing) Act 2016. The definition of "exempt entity" is by reference to that Act, section 21 (dictionary). Changes to the Traders (Licensing) Act therefore affect who qualifies as an exempt entity for the purposes of the Second‑hand Dealers Regulation and which transactions attract simplified record obligations under s 10.
• Australian Consumer Law (ACT). The regulation uses the Australian Consumer Law (ACT), section 2(1) as the source for definitions such as "credit card" and "debit card" (dictionary signpost). That affects what is permissible as non‑photo identification under schedule 2 (part 2.2).
• Road Transport (Driver Licensing) Act 1999 and Road Transport (Driver Licensing) Regulation 2000. External driver licences and the concept of an "official English translation" and "international driving permit" are sourced from those instruments, which determine when external licences are acceptable and what complementary documents are required (s 6(c); schedule 2 part 2.1 items 2-3).
• Births, Deaths and Marriages Registration Act 1997. The definition of birth certificate in the dictionary refers to that Act (dictionary). That links the acceptability of birth certificates as non‑photo identification to the registries and certification standards in that Act.
• Liquor Act 2010. The definition of "proof of identity card" includes cards issued under the Liquor Act 2010, section 210, or corresponding state laws (dictionary), so proof of identity cards used under that Act are acceptable photo ID under s 6 and schedule 2 part 2.1.
• National Consumer Credit Protection Act 2009. The definition of "financial institution" references authorised deposit‑taking institutions and credit providers registered under that Act or corresponding laws, which affects what financial documents count as non‑photo identification (dictionary).
• Australian Citizenship Act 2007 and Australian Citizenship Act 1948. The definition of "citizenship certificate" references these Commonwealth Acts (dictionary).
• Births, Deaths and Marriages Registries and land title registries. The schedule and dictionary permit certified extracts from electoral rolls and land title records (schedule 2; dictionary "record about land titles"), which require engagement with those registries for verification.

Operational interactions and dependencies

• Identification system. The regulation’s identity verification system depends on the integrity and availability of documents governed by other statutes: driver licences and translated licences, passports and translations, birth and citizenship certificates, electoral roll extracts, land title certificates, financial institution documents, and service bills. Changes in those source regimes (for example, different data on driver licences or new formats for documents) will directly affect compliance practice for dealers.
• Exempt entity rules. The treatment of purchases from exempt entities depends on the Traders (Licensing) Act definition of "exempt entity" (dictionary). If that definition changes (e.g. statutory or administrative amendments), dealers’ obligations under s 10 will be affected.
• Enforcement and administrative law. Notifiable instrument requirements and public notice obligations are governed by the Legislation Act 2001. Directions under s 11 and s 12 are administrative instruments subject to the Legislation Act’s processes (notification, public notice) unless they are targeted to a named dealer.
• Privacy and information law. The regulation requires dealers to collect personal data (names, addresses, DOB, ID numbers). Although the instrument does not cross‑reference privacy legislation, the interaction with applicable privacy and data‑protection laws (e.g. Territory or Commonwealth privacy regimes) is an operational factor dealers must assess when determining storage and disclosure practices. The regulation does not specify security standards or retention periods; other statutes and common law obligations will bear on those areas.
• Defence Force sales carve outs. Several schedule 1 items exclude goods sold by the Defence Force. That creates an interface with Commonwealth arrangements for disposal of Defence goods and signals an inter‑jurisdictional carve‑out. The regulation does not further specify how such goods are identified or proven, so dealers should look to the form of documentation used when buying from Defence sources.

Consequences of interdependence

• The regulation centres on documentary verification drawn from a larger legal ecosystem. Practical compliance is therefore sensitive to administrative changes in those source systems. Where the regulation prescribes that a document must show certain particulars (schedule 2), dealers must rely on the issuing body or registry to supply that document and data.
• Administrative risk arises where directions from the chief police officer require particular formats or immediate disclosure; those directions will interact with law enforcement practices and privacy rules. The regulation builds formal channels to police but leaves technical details to either directions or other legal instruments.

This regulation was originally made in 2002 and has been amended multiple times. The republication and endnotes provide a chronological record of key amendments affecting definitions, record obligations and the schedule of identification documents.

Key legislative milestones

• 2002: Second‑hand Dealers Regulation 2002 notified (LR 15 April 2002), with the main body commencing 16 April 2002 (legislation history).
• 2002-2017: Multiple amendments across years including Justice and Community Safety Legislation Amendment Acts, Statute Law Amendment Acts, and Red Tape Reduction amendments, which generally updated administrative elements, definitions and the record‑keeping framework (legislation history; endnotes 3).
• 2009 and 2010: Statute Law Amendment Acts and other Acts amended parts of the regulation, including schedule 2 (photo and non‑photo identification) and the dictionary, reflecting changes in identification practices and cross‑referenced obligations (amendment history).
• 2012-2016: Amendments updating references and definitions, including the definition of "financial institution" and the insertion of proof of identity/proof of age card cross‑references; changes adjusted by the Justice Legislation Amendment Act 2016 and the Traders (Licensing) Act 2016 (amendment history).
• 2016: Section 6 (meaning of photo identification document) was amended by A2016‑7 (amdt 1.19); proof of identity card was inserted in the dictionary (A2016‑7 amdt 1.22) while proof of age was amended/omitted as part of Liquor Act consequential amendments (amendment history; dictionary).
• 2016-2017: Traders (Licensing) Act 2016 and related amendments affected the definition and status of exempt entities, with s 5A inserted in 2002 later omitted in 2016 and the definition of "exempt entity" amended across those Acts (amendment history).
• 2025: Justice and Community Safety Legislation Amendment Act 2025 (No 2) A2025‑3, sch 1 pt 1.9, notified 14 March 2025, with relevant parts commencing 21 March 2025 (legislation history). The 2025 amendment included an amendment to the definition of "extract from the electoral roll" (amendment history).

Specific amendment map for core provisions (selective)

• s 6 (photo identification): amended by A2016‑7 (amdt 1.19) to modernise photo identification categories and tie specifics to schedule 2. Schedule 2 itself has been amended on multiple occasions (A2009‑49; A2012‑21; A2015‑15; A2016‑7), adjusting the list of acceptable documents and the particulars required.
• s 8, s 9, s 10: these record‑making provisions were subject to earlier amendments around 2002 (A2002‑27) that refined the fields to be recorded and differentiated goods bought from exempt entities (s 10 header substituted and s 10 amended).
• s 11 and s 12: keeping records and giving records to police were amended by A2009‑20, A2015‑15 and A2015‑33 to clarify the role of the chief police officer and to create the notifiable instrument/public notice regime for directions (amendment history).
• Dictionary: multiple amendments (A2009‑20, A2009‑49, A2010‑54, A2015‑33, A2016‑46) amended definitions such as credit card, debit card, financial institution, and proof of identity card; the dictionary changes reflect evolving identification instruments and the shift in proof of identity regimes (amendment history).

Practical takeaways from amendment history

• The regulation has evolved to reflect changes in identification documents and administrative practice (e.g. inclusion of proof of identity cards, student ID, translations for foreign documents).
• The record‑keeping and police‑direction mechanisms have been progressively clarified and consolidated, with a clear move to integrate the directions regime with the Legislation Act’s notifiable instrument and public notice processes (s 11-12 amendments).
• The definition of exempt entities has moved across statutes and amendments (Traders (Licensing) Act 2016), making it important for dealers to monitor amendments to connected legislation as they affect obligations under s 10.

Where to look for the precise amendment text

• The endnotes and amendment history included in the republication identify the amending Acts and dates (endnotes 3 and 4). For drafting or compliance purposes, practitioners should consult the specific amending Acts listed in the legislation history to see the exact textual changes and any transitional provisions.

The republication contains no case law or judicial decisions interpreting the Second‑hand Dealers Regulation 2002. The document’s endnotes and legislation history set out statutes and amending Acts but do not list any litigation or judicial consideration of the regulation’s provisions.

What the absence of recorded litigation in the republication means for practitioners

• No reported judicial interpretations are included with this republication. Practitioners seeking precedent on the construction or enforcement of the regulation should search court databases and tribunals for decisions that post‑date or are not recorded in the republication.
• Administrative or enforcement disputes may exist outside of reported judicial decisions; however, none are annotated in this republished text. For matters where statutory duties intersect with privacy, evidence, or police powers, practitioners should treat the regulation as specifying duties and rely on the enabling Act and subsequent case law (if any) for interpretation.

Practical recommendation

• If a client requires advice on enforcement risk or likely judicial interpretation, they should commission targeted searches of Territory tribunal and court decisions, prosecutions under the Second‑hand Dealers Act 1906 and related administrative determinations. The regulation itself contains no litigation citations or reported cases.

This section highlights operational traps and counterintuitive points that arise directly from the text.

1. Verification: one photo ID or three non‑photo IDs

• A common mistake is to assume a single non‑photo document suffices. Section 8(3) requires either at least one photo identification document or three non‑photo identification documents that each show the person’s name and display the same name on each document. If using three non‑photo IDs, one of them must show the person’s home address (s 8(2)(e)(ii)(A)). Dealers who accept fewer documents risk non‑compliance.

2. Particulars are strictly prescribed

• Schedule 2 prescribes the particulars to record for each kind of document. For example, for a current Australian driver licence the dealer must record the issuing jurisdiction and licence number (schedule 2 part 2.1 item 1). Recording only a photocopy without extracting the required particulars or failing to record the exact fields required is non‑compliant.

3. Non‑English licences and passports

• An external driver licence not written in English is acceptable only if accompanied by an international driving permit or an official English translation (s 6(c)). Similarly, passports not written in English require an English translation (s 6(e)). Dealers relying on undocumented translations or informal translations will not meet the regulation’s standards.

4. Exempt entities and the resale condition

• Section 10 applies only if a dealer buys second‑hand goods from an exempt entity and buys them for the purpose of selling or disposing of them to someone else (s 10(1)(b)). If the purchase is for another purpose, or if the seller is not an "exempt entity" per the Traders (Licensing) Act 2016, the full s 8 recording obligations apply. The identity of the exempt entity is dependent on another Act, so dealers must verify exempt status.

5. Stock number required at acquisition

• Section 8(2)(h) requires recording the stock number given to the goods by the dealer. Dealers who wait to assign stock numbers post‑entry or use inconsistent stock numbering may breach s 8 because the stock number must be part of the purchase/receipt record.

6. $50 threshold for sale/disposal records

• For sales or disposals, the record duty under s 9 applies only when the value of the goods is more than $50 (s 9(1)(b)). The same threshold applies to sales of goods bought from exempt entities (s 10(3)). Dealers must have consistent valuation processes; conflicts over valuation may create compliance questions.

7. Record format: retrievability axes mandated, format not mandated

• Section 11(1) requires records be kept so transactions can be identified by date and kind of goods. However, the regulation does not specify electronic formats, security measures, or retention periods. This lack of prescriptive format creates practical uncertainty (for example about whether ledger books, spreadsheet files, or database entries suffice) and places the burden on dealers and potentially on police directions to set specifics.

8. Police directions can be non‑notified if targeted

• If the chief police officer addresses a direction only to a named dealer, the notifiable instrument and public notice rules do not apply (s 11(5); s 12(4)). That means dealers may be subject to private, targeted directions without broader public visibility. Dealers should expect that they may receive bespoke directives.

9. Some goods are specifically excluded or limited

• Schedule 1 excludes clothes and shoes from the definition of sporting/recreational goods (item 5), and excludes refrigerators, washing machines and other whitegoods from electrical/electronic goods (item 11). Several items exclude goods sold by the Defence Force. Dealers should not assume all household goods are within scope; the schedule is specific.

10. Identification documents tie to external statutes and registries

• Acceptability of ID documents relies on other statutes and registries (e.g. birth certificates under the Births, Deaths and Marriages Registration Act 1997; proof of identity cards under the Liquor Act 2010; credit/debit cards per the Australian Consumer Law (ACT)). If practitioners or dealers accept documents without recognising their statutory provenance, they may fail to capture the "required particulars" that the regulation specifies.

11. No retention period specified

• The regulation does not set a retention period for records. That may create uncertainty about how long dealers must keep transaction data. Absent a statutory retention period in this regulation, other laws or directions (including police directions under s 12) may impose retention obligations, raising a compliance risk for dealers who destroy records too early.

12. Personal information implications

• The regulation requires capture of personal data (names, home addresses, birth dates, ID numbers). It does not prescribe security or privacy safeguards. Dealers must therefore assess obligations under applicable privacy laws when storing or disclosing information; the regulation does not itself define privacy protections.

These "gotchas" are direct inferences from the statutory language and scheduling; they identify points where operational practice commonly diverges from the letter of the regulation.

This section sets out concrete, source‑grounded steps a licensed second‑hand dealer should take to meet the regulation’s obligations. Each step references the regulatory provision that creates the duty.

1. Identify covered goods and transactions (s 5; schedule 1)

• Map your inventory and purchase channels against schedule 1. Only goods listed in schedule 1 are captured as second‑hand goods for the regulation, with specified exclusions (e.g. clothes, whitegoods, certain Defence Force sales). Ensure intake procedures flag items in schedule 1 so the correct record set will be applied.

2. Implement intake checklist for purchases from non‑exempt persons (s 8)

• At the point of acquisition, record:
  • Date and time of purchase/receipt (s 8(2)(a));
  • Description of goods including colour, brand, serial number or other identifiable number, and any hallmark/inscription/engraving (s 8(2)(b));
  • Person’s full name verified per s 8(3) (see step 3);
  • Person’s home address, home telephone number and date of birth (s 8(2)(d));
  • Identity document particulars per schedule 2 (s 8(2)(e));
  • Amount paid or consideration given (s 8(2)(f)-(g));
  • Stock number assigned by the dealer (s 8(2)(h)).

3. Apply verification rules strictly (s 8(3); s 6; s 7; schedule 2)

• Accept only identification documents listed in schedule 2 parts 2.1 (photo IDs) and 2.2 (non‑photo IDs). Verify name by:
  • Collecting at least one photo identification document that contains a recent photograph and shows the required particulars in schedule 2 part 2.1 (s 6; s 8(3)(a)); or
  • Collecting at least three non‑photo identification documents that each show the person’s name and the same name appears on each document, with at least one of the three showing the person’s home address (s 8(2)(e)(ii); s 8(3)(b); schedule 2 part 2.2).
• Where documents are in languages other than English, obtain the documentary supplements required by s 6(c) and s 6(e): an international driving permit or official English translation for external driver licences not written in English, and an English translation for passports not written in English (s 6(c)-(e)).

4. Record required particulars from ID documents (schedule 2)

• For each accepted document, capture the particulars specified in schedule 2 column 3. For example, from an Australian driver licence record issuing jurisdiction and licence number (schedule 2 part 2.1 item 1); from a birth certificate record issuing jurisdiction, registration number and date of issue (schedule 2 part 2.2 item 1). Build form fields to match schedule 2.

5. Assign and record stock numbers at intake (s 8(2)(h); s 10(2)(d))

• Allocate and record a dealer stock number at the time of purchase/receipt. Ensure the stock number is used consistently across purchase, storage and sale records so s 11(1) requirements (identifiability by date and kind) are met.

6. Sales and disposals process for >$50 items (s 9; s 10(3))

• For sales or disposals exceeding $50, record date/time of sale, purchaser’s full name and home address, and the stock number (s 9(2)). For goods bought from exempt entities and later sold for more than $50, record the sale/date/time and purchaser details per s 10(3).

7. Record organisation and retrieval (s 11(1))

• Keep records so that transactions are retrievable both by date of transaction and by kind of goods. This requires an indexing or filing system with at least two searchable axes (date and goods category). Ensure the system can produce records swiftly in response to police directions.

8. Prepare for police directions and disclosure (s 11(2)-(4); s 12(1)-(3))

• Monitor the ACT legislation register and ACT government websites/daily newspapers for general directions from the chief police officer that will be notifiable instruments with public notice. Implement procedures to comply promptly with general directions and to receive and act on targeted directions delivered directly to the business. Keep copies of any directions received and records of actions taken.

9. Privacy, security and data protection

• The regulation requires collection of personal data (s 8(2)(c)-(d)). Although the regulation does not specify security or retention standards, dealers should adopt reasonable data security measures and document them. Be prepared to justify practices in case of enforcement or data breach. Where police directions specify transmission formats or secure channels, comply promptly (s 12(1)).

10. Staff training and form design

• Train staff to:
  • Identify schedule 1 goods;
  • Use the intake checklist and capture schedule 2 particulars;
  • Assess whether a seller is an "exempt entity" under the Traders (Licensing) Act 2016;
  • Assign stock numbers and index transactions for retrieval by date and kind;
  • Respond to police directions for records.
• Create standardised forms (digital/electronic or paper) that mirror the statutory field set (s 8-10; schedule 2) to reduce the risk of omissions.

11. Audit and compliance checks

• Regularly audit records to ensure required fields are captured and that retrieval by date and kind is possible (s 11(1)). Test the speed of response to hypothetical police directions and the completeness of ID fields relative to schedule 2.

12. Legal monitoring

• Monitor amendments to:
  • The Second‑hand Dealers Regulation itself (endnotes and amendment history);
  • Traders (Licensing) Act 2016 (to track exempt entities);
  • Cross‑referenced statutes that define ID documents (Road Transport Acts, Births/Deaths/Marriages Acts, Liquor Act, Australian Consumer Law (ACT)).
• Changes to these statutes will alter what documents are acceptable or who counts as an exempt entity.

13. Handling acquisition from exempt entities (s 10)

• When buying from an exempt entity for resale, you may use the lighter record set in s 10(2). Still record date/time/place, description, consideration, and stock number. If you later sell for more than $50, capture purchaser details per s 10(3).

14. If in doubt, seek direction from police or legal advice

• Because the chief police officer may issue directions that affect format and disclosure (s 11-12), if a dealer is unsure about compliance practices they should request clarification from police or seek legal advice to manage enforcement risk.

These steps exhaustively follow the regulation’s prescriptions. The regulation leaves several technical choices (record format, retention period, security standards) unspecified; where the regulation is silent, the dealer must either await police directions (s 11-12) or make reasonable, documented decisions that demonstrate good faith compliance.
