Second-hand Dealers and Pawnbrokers Regulations 2013

The regulations centre around a small set of legal and administrative concepts that determine scope and procedure.

Prescribed goods (r 3). A long enumerated list defines "prescribed goods". It includes gemstones and precious metals; jewellery containing those materials; watches; many categories of sporting and recreational equipment (excluding clothing and footwear); watercraft and parts; most musical instruments (excluding standard pianos except electric/electronic); portable powered tools; tool kits; photographic and video equipment; computer hardware, interactive game consoles and software; a broad list of electric or electronic goods (televisions, radios, CD/DVD players, mobile phones and microwaves, but excluding large household appliances such as refrigerators, washing machines, clothes dryers, dishwashers, stoves and ovens); CDs and DVDs; non‑motor vehicles (bicycles, caravans, trailers); motor vehicles; and specified motor vehicle components (a detailed itemised list at r 3(p)). The list therefore concentrates regulatory attention on goods likely to be higher value or easily re‑sold.

Identity and close associates (r 3 and r 9). The regs define "close associate" (r 3(3)) broadly, family, household members, partners, related corporate entities, profit‑sharing relationships or positions of control/significant influence. "Domestic partner" is also defined. Regulation 9 prescribes how to verify a customer’s identity: either a single government/statutory authority issued card with name, residential address, signature and photo, or two documents (at least one government issued and the other(s) issued for an official purpose) that between them show name, residential address and signature. The verifier must check for forgery, matching names/addresses/signatures and photograph likeness for single documents, and must record issuer details, identifying numbers or issue dates (r 9(3)-(4)).

Application and carve‑outs (r 4). The regs limit where certain Act provisions apply. Sections 8 and 9 of the Act (record keeping and verification duties) are restricted to goods received under pawn (r 4(1)(a)) and prescribed goods (r 4(1)(b)). Section 10 (retention of goods and notification obligations) applies only to prescribed goods (r 4(2)), and in some categories (gemstones, precious metals, jewellery, watches) section 10(2) does not apply (r 4(3)). Sections 6-10 of the Act do not apply to certain businesses: licensed second‑hand vehicle dealers under the Second‑hand Vehicle Dealers Act 1995, businesses repairing prescribed goods, or businesses acquiring prescribed goods for metal recycling and selling scrap (r 4(6)). The regs also exclude charity sales under Part 2 and second‑hand markets run by charities from Part 4 in some circumstances (r 4(8)-(9)).

Abandoned goods (r 5). Where a dealer removes abandoned goods at the request or with authorisation of a council or Crown agency, record requirements are modified. Records need not contain all s 8(4) information, but must record the council/agency name and address, description of goods, place removed from and date removed (r 5(1)(a)). On sale, the dealer must record purchaser name and address and date of sale and, where purchaser is not another dealer, verify identity and record the verification methods (r 5(1)(b)). Sections 8(5), 9 and 10 of the Act do not apply to those goods (r 5(1)(c)).

Auctioneers and second‑hand markets (r 6, 13-14). Auctioneers selling prescribed goods must add auction date, place and sale outcome/price to the second‑hand dealer records; if the auctioneer is not a dealer they must keep records as if a dealer (except identification codes) and also record auction details (r 6). Operators of a second‑hand market must notify the Commissioner and keep daily records listing sellers of prescribed goods and verify their identity under the verification rules (rr 13, 14).

Pawn tickets and sale records (rr 11-12). Pawn tickets must include pawner’s full name, address and signature, item descriptions and serial numbers, unique identification code, pawn and redemption dates, statement about extension procedures, statement about sale of unredeemed goods to secure best price, storage address, redemption separability, the periodic and equivalent annual interest rate, and disclosure of fees not treated as interest (r 11). Sale of unredeemed pawns must record date and sale amount (r 12).

Disqualification offences (rr 7-7A). Regulation 7 prescribes that offences against sections 8, 10 or 16 of the Act are "offences of a prescribed kind" for s 6(2)(b) of the Act. Regulation 7A prescribes for s 6A(1)(c) a list of offences (selected Summary Offences Act 1953 Part 3A offences except two exceptions, serious and organised crime offences, certain controlled substances offences, indictable offences involving violence, particular firearms offences, attempts and equivalent foreign offences).

Claim process and police interaction (r 10; Sch 1). The Schedule 1 claim form is prescribed and dealers must give claimants a copy, notify the local police officer with a copy of the notice and keep a copy at the premises (Sch 1 Information). The dealer must not sell or part with possession of claimed goods without written authority of a police officer (Sch 1(3)). The Magistrates Court may order return or compensation for unlawfully sold goods (Sch 1(4)).

Transitional requirement and penalty. The 2016 Variation Regulations (Sch 1 transitional provision) required existing dealers to supply a set of additional details within one month, with a maximum penalty of $2,500 for non‑compliance.

Collectively these concepts focus compliance on a defined set of items and activities, prescribe identification and record formats, and create administrative triggers for police notification and possible disqualification.

Primary payers and record‑keepers. The immediate compliance burden falls on second‑hand dealers, pawnbrokers, auctioneers who handle prescribed goods, and operators of second‑hand markets. Each of those actors must create and retain records, verify and log identities, and make statutory notifications to the Commissioner of Police or local police officers in prescribed circumstances (rr 6, 8, 9, 10, 13, 14; Sch 1).

Dealers and pawnbrokers. Natural person dealers, partnerships and bodies corporate carrying on second‑hand dealer businesses are required to lodge prescribed notices before operating and to give updates within 14 days of specified changes (r 8(1)-(2)). Pawnbrokers have additional ticketing obligations (r 11) and recordkeeping of sale of unredeemed pawns (r 12). Dealers that handle goods under a contract of pawn or deal in prescribed goods are the principal objects of rr 4(1) and 4(2).

Auctioneers. Auctioneers who sell prescribed goods are required to make lot‑level records. If an auctioneer is a second‑hand dealer they must add auction date, place and sale result to their s 8 record; if not a dealer they must keep s 8‑style records as if a dealer (except identification codes) and also log auction details (r 6).

Second‑hand market operators. Persons or bodies corporate operating second‑hand markets must give prescribed notice about market operation (r 13) and keep day‑by‑day registers of sellers of prescribed goods and verify identity in accordance with r 9 (r 14).

Police, Commissioner of Police and courts. The Commissioner of Police is the central recipient of notices (rr 8(2), 13(2)) and has powers under the Act to disqualify persons; the regulations prescribe which offences are to be treated as triggering disqualification considerations (r 7; r 7A). Local police stations must be notified of claim notices for alleged stolen goods (r 10(2); Sch 1). The Magistrates Court is the statutory venue for disputes about possession and compensation where goods alleged to be stolen are, or have been, in dealer possession (Sch 1(4)).

Councils and Crown agencies. Councils and Crown agencies that authorise or request removal of abandoned goods are named in the abandoned goods regime (r 5). Dealers removing abandoned goods for councils/Crown agencies follow a modified record regime that requires the council or agency name and the place/date removed to be logged (r 5(1)(a)).

Excluded businesses and parties. The regulations exclude certain businesses from Parts of the Act: licensed second‑hand vehicle dealers under the Second‑hand Vehicle Dealers Act 1995 are exempt from ss 6-10 (r 4(6)(a)); businesses repairing prescribed goods for customers are excluded (r 4(6)(b)); businesses acquiring prescribed goods for metal recycling and selling scrap are excluded (r 4(6)(c)); and charity organisations selling only donated goods may be excluded from Part 2 or Part 4 where proceeds go to the organisation (r 4(8)-(9)).

Close associates and corporate directors. The regulations impose notification and disclosure duties that reach close associates of dealers and directors of corporate dealers or market operators (r 8(1)(a)-(b); r 13(1)(b)). Close associates must be disclosed with name, residential address and date of birth. When associates change, dealers must notify the Commissioner within 14 days (r 8(2)(a)-(c)).

Consumers and purchasers. Purchasers of abandoned goods must have their identity verified by dealers unless the purchaser is another second‑hand dealer (r 5(1)(b)(ii)). Buyers of pawnbroker unredeemed goods are affected indirectly: pawnbrokers must disclose sale date and sale price for unredeemed pawns (r 12), and pawn tickets must disclose interest rates and fees (r 11).

Transitionally affected existing dealers. Dealers operating at the commencement of the 2016 variation were required to provide additional contact and close associate details within one month, under a maximum penalty of $2,500 (Transitional Sch 1).

In summary, the regulations allocate record, identity‑verification and notification duties across dealers, pawnbrokers, auctioneers and market operators; police and the Commissioner act as the recipients and enforcers of information; charities, vehicle dealers and recyclers are carved out in defined circumstances; and close associates and directors are swept into the disclosure net.

Notification duties. Prospective and existing second‑hand dealers and second‑hand market operators must provide detailed notices to the Commissioner of Police. Regulation 8 prescribes the information required in a notice under s 7(1) of the Act: for natural persons this includes full name, residential address, telephone number, email, close associate identities and dates of birth, business addresses where applicable, trading names, addresses where records and goods will be kept, a description of the proposed business and an address for service (r 8(1)). Regulation 13 does the same for market operators (r 13(1)). Both regs require written notice to the Commissioner within 14 days of specified changes (rr 8(2), 13(2)).

Identity verification and recordkeeping. Where the Act or these regulations require identity verification the procedure and the data to be recorded are specified in r 9. Verification must be by either a single government/statutory photo ID displaying name, residential address, signature and photograph, or by two documents including at least one government‑issued document; the verifier must check for forgery, matching names and addresses and signature likeness; and must record identifying numbers or issue dates and issuer identity (r 9(2)-(4)). Regulation 14 requires that operators of second‑hand markets verify the identity of each person who sells prescribed goods at the market and record details of the means used to verify (r 14(1)-(2)).

Pawn ticket and pawn regulation duties. Pawnbrokers must include a prescribed set of data on pawn tickets (r 11). Mandatory elements include pawner’s full name, residential address and signature, detailed item description and serial numbers, a unique identification code, pawn and redemption dates, a statement about extension procedures, a statement that unredeemed goods must be sold as soon as reasonably practicable in a way reasonably likely to secure the best obtainable price, address where goods are stored, statements about separate redemption for multiple items, the periodic interest rate and an equivalent annual interest rate, and disclosure of fees not treated as interest (r 11(a)-(k)).

Sale records. Sale of unredeemed pawns must be recorded with date and the amount for which goods were sold (r 12). Auctioneers must record for each lot the auction date, place and sale outcome/price and, where the auctioneer is not a dealer, keep records as if one (r 6). Vendors at second‑hand markets selling prescribed goods must be recorded daily, with date and place of market and the seller’s full name and residential/business address (r 14(1)).

Treatment of abandoned goods. Dealers removing abandoned goods at the request or authorisation of councils or Crown agencies follow modified record obligations: they need not include the full s 8(4) information but must record the council/agency name and address, description of goods, place removed from and date. On sale, dealers must record purchaser name and address and, where purchaser is not another dealer, verify identity and record the means used (r 5(1)(a)-(b); r 5(1)(c) disapplies some s 8(5), 9 and 10 obligations for those goods).

Rights and procedural protections. The regulations prescribe procedural rights for claimants and dealers where goods are claimed as stolen. Schedule 1 prescribes the claim form and sets obligations: the dealer must give the claimant a copy of the completed notice, notify the police and give a copy to the police, and keep a copy at the premises; the dealer must not sell or part with the goods without written authority of a police officer (Sch 1 Information). The Magistrates Court has the power to order return of goods or payment of value where the dealer has unlawfully sold or parted with the goods, and to make other compensation orders (Sch 1(4)).

Disqualification and criminal consequences. The regulations feed into policing and disqualification mechanisms under the Act. Regulation 7 prescribes that offences against sections 8, 10 or 16 of the Act are "offences of a prescribed kind" for s 6(2)(b). Regulation 7A prescribes categories of criminal offences (including specified Summary Offences Act 1953 offences, serious and organised crime offences, certain controlled substances and firearms offences, indictable offences of violence and attempts) that the Commissioner may rely on for disqualification under s 6A(1)(c).

Transitional compliance penalty. The 2016 variation introduced a transitional requirement for existing dealers to provide updated contact and close associate details within one month, with a maximum penalty of $2,500 for non‑compliance (Transitional Sch 1).

Practical duty structure. In practice, the regulations translate into: initial notification to the Commissioner with specified contents before or on commencing business; continuous recordkeeping for each prescribed good and pawn; strict identity verification at acquisition and at sale in certain contexts; pawn ticket disclosure duties; daily market registers for markets; auction lot records; police notification and retention of goods where a claim is made; and disclosure of close associates and director details. These duties are allocated to the commercial operator (dealer, pawnbroker, auctioneer, market operator) as the actor who must collect and hold the records, and to the Commissioner and police as the recipients and potential enforcers.

Statutory enforcement architecture within the regulations. The regulations themselves do not set a comprehensive schedule of penalties for every breach; they instead (1) designate certain infractions as prescribed kinds for purposes of the Act’s disqualification regimes (r 7), (2) prescribe criminal categories that may trigger disqualification by the Commissioner (r 7A), and (3) specify procedural obligations backed by explicit prohibitions (Schedule 1(3) prevents dealing with claimed goods without police authority). For some compliance defaults the Act itself will contain the substantive offence and penalty; the regulations supply the operational matrix for those offences.

Disqualification levers. Regulation 7 makes offences against sections 8, 10 or 16 of the Act "offences of a prescribed kind" for s 6(2)(b) of the Act. This feeds into the Act’s disqualification framework: a person convicted of a prescribed kind of offence may be disqualified from carrying on business as a second‑hand dealer (the operative provisions of the Act are referenced in the regulations). Regulation 7A prescribes categories of offences relevant to s 6A(1)(c), listing a set of criminal offences (selected Summary Offences Act 1953 Part 3A offences except two exceptions, serious and organised crime offences, specified controlled substances offences excluding mere possession, indictable violence offences, certain firearms offences, attempt offences and equivalent foreign offences). The practical effect is that a range of serious criminal convictions can be positioned as grounds upon which the Commissioner may decline to license or may disqualify a person from the trade.

Police notification and retention of goods. Where goods are claimed as stolen, Schedule 1 requires the dealer to notify the police officer in charge of the nearest police station or a designated officer and give a copy of the notice to the officer (r 10(2); Sch 1 Information). Schedule 1(3) prohibits selling or parting with claimed goods without written authority from a police officer. The Magistrates Court is identified as the forum that, on application, may order return of goods or compensation where the dealer has unlawfully sold or parted with them (Sch 1(4)). Those mechanisms place police and courts at the centre of dispute resolution and enforcement of possession claims.

Recordkeeping and verification breaches. Regulation 9 prescribes the precise form of identity verification and the record entries required. Where the Act makes failure to comply with s 8 (records) or s 10 (retention and notification) an offence, breach of the procedural standards in r 9, r 11, r 12 or r 14 will be evidence of non‑compliance feeding into criminal or administrative processes specified in the Act. Regulation 7 specifically flags sections 8, 10 and 16 as prescribed offences for disqualification purposes (r 7).

Transitional penalty. The only explicit monetary maximum penalty contained in the provided regulations is in the transitional provision that accompanied the 2016 variations: a maximum penalty of $2,500 applies if a person carrying on business as a second‑hand dealer failed to give the Commissioner of Police certain details within one month of commencement (Transitional Sch 1). The regulations’ legislative history records commencement and variation dates but does not itself list other monetary penalties; those are contained in the Act and elsewhere.

Administrative compliance exposure. The regulations create many time‑bound notification obligations (for example, r 8(2) and r 13(2) require notice to the Commissioner within 14 days of specified changes). Late or missing notifications, improper pawn ticket content, failure to verify identity as prescribed, incomplete auction or market day records, or failure to notify police under the claim process can be expected to trigger enforcement under the Act’s penalty regime or administrative disqualification procedures. The Commissioner’s power to disqualify is linked to breaches and to certain conviction categories set out in the regulations (rr 7-7A).

Enforcement actors. Primary enforcement actors identified in the regulations are the Commissioner of Police (recipient of notifications and decision‑maker under the Act), local police officers (to whom claim notices must be given and who must authorise release of claimed goods), and the Magistrates Court (remedies for claimants under Sch 1(4)). The regulations also reference other statutes for offence categories relevant to disqualification (Summary Offences Act 1953, Criminal Law Consolidation Act 1935, Controlled Substances Act 1984, Firearms Act 1977), aligning criminal law enforcement outcomes with administrative disqualification.

In practical terms, the enforcement regime is a mix of administrative bailiwick (notifications, disqualification) and criminal/legal sanctions (where the Act or other statutes create offences). Dealers should treat the regulations as setting the documentary fingerprints that enforcement agencies will examine when assessing compliance or disqualification risk.

Cross‑referenced statutes and regulatory instruments. The regulations explicitly interact with multiple other statutes and subordinate instruments. They import definitions and meanings by reference and carve out parallel regulatory domains.

Corporations and family law context. The definition of "close associate" in r 3(3) includes "related bodies corporate (within the meaning of the Corporations Act 2001 of the Commonwealth)" and the regs extend family relationships (r 3(2) treats step‑relationships as parents, brothers, sisters or children). The Second‑hand Dealers and Pawnbrokers Regulations therefore pick up corporate and family law constructs in determining disclosure obligations for associates and directors (r 8(1)(b), r 13(1)(b)).

Motor vehicles regime. "Written‑off vehicle" and "written‑off vehicle notice" are given the same meanings as in Part 7 of the Motor Vehicles Regulations 2010 (r 3). Regulation 4(5) excludes sections 9 and 10 of the Act for written‑off vehicles or components if the dealer records the serial number of a written‑off vehicle notice affixed to the vehicle. This creates an interface with the motor vehicle write‑off and salvage regime administered under the Motor Vehicles Regulations 2010, allowing a specific vehicle registration/notice number to stand in for other retention or verification obligations.

Local government and abandoned goods. Regulation 5 imports definitions from the Local Government Act 1999 for "council", "local government land", "public place" and "road" and sets a modified recordkeeping regime for goods removed at the request or authorisation of councils or Crown agencies. That channels interactions between dealers and local government authorities and creates a distinct compliance pathway for reclaimed or abandoned materials.

Criminal law and disqualification. Regulation 7A references offences in other statutes,Part 3A of the Summary Offences Act 1953 (with two exclusions), the Criminal Law Consolidation Act 1935 (serious and organised crime offences), the Controlled Substances Act 1984, and the Firearms Act 1977,importing criminal-law outcomes into the administrative disqualification regime under the Act. Convictions under those statutes are treated in the regulations as relevant predicates for s 6A(1)(c) disqualification by the Commissioner.

Second‑hand vehicle dealer regulation. Regulation 4(6)(a) excludes the business of selling second‑hand vehicles carried on by a person licensed as a dealer, or exempt from licensing, under the Second‑hand Vehicle Dealers Act 1995, from ss 6-10 of the Act. That creates a deliberate regulatory boundary between the two licensing regimes: a person regulated under the vehicle dealer regime is not subject to certain dealer/pawnbroker obligations under the Second‑hand Dealers and Pawnbrokers Act as modified by these regs.

Charities and community sales. Regulation 4(8) and 4(9) exclude, in limited circumstances, sales by organisations formed for religious, educational or other charitable or beneficial community purposes, where goods are donated and proceeds go to the organisation, from Part 2 and, for markets, Part 4 of the Act. This produces a statutory carve‑out for genuine charitable operations and identifies an interaction between charity law / community organisation practice and second‑hand dealer regulation.

Court jurisdiction. Schedule 1 places disputed possession and compensation actions in the Magistrates Court. This links the regulations to the State’s court architecture and remedies for conversion/return of stolen goods.

Administrative law and disclosure obligations. The regulations require notices and updates to the Commissioner of Police, thereby engaging administrative decision‑making under the Act (licensing, disqualification). The Commissioner’s exercise of discretion under the Act will be informed by the data collected under these regulations.

In short, the regulations do not operate in isolation. They import definitions and carve‑outs from vehicle regulations and local government law, incorporate corporate and family relationship definitions from the Corporations Act and family law framework, draw on criminal statutes to specify disqualification criteria, and set interfaces with the Second‑hand Vehicle Dealers Act 1995 and the court system for remedies. Practitioners must therefore map a dealer’s regulatory exposure across multiple statutes when advising clients or designing compliance systems.

Enabling instruments and commencement. The regulations were made as the Second‑hand Dealers and Pawnbrokers Regulations 2013 and commenced on 1 September 2013 (Legislative history: 2013 No 213, Gazette 29.8.2013 p3653, r 2). Subsequent variations were made by the Second‑hand Dealers and Pawnbrokers Variation Regulations 2016 (No 42 of 2016), which commenced on 1 July 2016 for the varied provisions (Legislative history: 2016 No 42, Gazette 2.6.2016 p2012, r 2).

Key 2016 amendments. The 2016 variation introduced several structural and substantive changes reflected in the consolidated text provided:

• Redesignation and insertion of r 3(2) and (3); the definition of "close associate" was inserted and the "domestic partner" definition was added by r 4(1) (commencement 1.7.2016). Close associate became a defined concept with multiple relational tests (family, household, partnership, related bodies corporate, profit participation or control influence).
• Regulation 7A was inserted by r 5 of the 2016 regulations (commencement 1.7.2016), creating a new list of offences that the Commissioner can treat as grounds for disqualification under section 6A(1)(c) of the Act.
• Regulation 8 was substituted by the 2016 variation (r 6), expanding and clarifying the content of notices and the timing of updates required to be given to the Commissioner (commencement 1.7.2016).
• Redesignation of r 3 as r 3(1) and insertion of new subregulations (r 4(2) relabelled provisions).
• The transition schedule required existing dealers to provide information within one month and carried a maximum penalty of $2,500 for non‑compliance (Transitional Sch 1 to the 2016 Variation Regulations).

Revocation of earlier regulations. The 2013 regulations revoked the Second‑hand Dealers and Pawnbrokers Regulations 1998 (Legislative history: "Legislation revoked by principal regulations"). The 2016 variation omitted certain provisions under the Legislation Revision and Publication Act 2002 (for example, r 2 omitted), reflecting statutory housekeeping and consolidation.

Transitional provisions. The 2016 variation included a transitional requirement (Sch 1,Transitional provision) that required persons who were carrying on business as a second‑hand dealer at the commencement of the 2016 regulations to provide the Commissioner with specified contact and close associate details within one month. Failure attracted a maximum penalty of $2,500. The transitional provision thus tightened the disclosure net for incumbents and created a compliance deadline.

Textual changes. The legislative history records redesignations, insertions and substitutions of several of the key defined terms and notification requirements, notably the expansion of notice contents (rr 8 and 13), creation of r 7A, and insertion of the close associate definition. These changes increase the granularity of required disclosures (dates of birth for close associates, email and telephone contacts, addresses where records and goods are kept).

Stability and scope. Since the 2016 variation the consolidated text provided shows a settled set of operational obligations: detailed identity verification, prescribed pawn ticket content, explicit auctioneer obligations, and a clear abandoned goods regime. Any practitioner should check for further variations or repeals post‑2016, but the legislative history printed in the regulation indicates the principal changes up to 2016 and the transitional impact on incumbents.

Source limitation: the regulations do not list adjudicated cases. The text of the regulations and the accompanying legislative history do not name any decisions or report litigation under the Act or these regulations. The only adjudicative reference in the regulations is to the Magistrates Court as the statutory forum for remedies in relation to claims for goods allegedly stolen that have been in the possession of a second‑hand dealer (Schedule 1(4)).

What the regulations record about dispute resolution. Schedule 1(4) prescribes the relief a Magistrates Court may make on application by a person entitled to possession of stolen goods that are or have been in a dealer’s possession: the Court may order return of the goods, or if the goods have been unlawfully sold or parted with, order the dealer to pay the value of the goods; and the Court may make other orders for compensation for damage or otherwise as it thinks fit. That provision frames the civil remedy route and indicates that disputes over possession and the consequences of unlawful disposal are to be litigated in the Magistrates Court.

Implications for evidence and records. Because the regulations prescribe specific forms of record and identification verification (r 9, r 11, r 14, Sch 1), the primary evidentiary disputes in litigation are likely to relate to whether the dealer complied with those recordkeeping and notification requirements. The regulations thus create the documentary standard against which a dealer’s conduct will be judged in court, but the regulations themselves contain no reported judgments.

Practical absence of reported litigation in the instrument. Given the source document’s silence on case law, practitioners should not infer the absence of litigation in practice, only that no cases are cited in these regulations. For any litigation history of administrative decisions, prosecutions or Magistrates Court orders involving breaches of the Act or these regulations, one must search case law databases and administrative tribunal records external to this instrument.

Conclusion on litigation record provided here. The regulations provide the administrative and procedural template that courts will apply, and Schedule 1 identifies the Magistrates Court as the principal judicial venue for restitution or compensation claims. Any concrete litigation precedents, enforcement outcomes, or judicial interpretations of these regulations are not set out in the instrument and require an independent case‑law search.

Narrow but specific list of prescribed goods. The prescribed goods list (r 3) includes some surprising inclusions and exclusions. For example, interactive game consoles and computer programs (r 3: "interactive game console" and prescribed goods items (j) and (k)) and mobile phones and microwaves (r 3(l)(ii), (iii)) are regulated, whereas common household whitegoods such as refrigerators, washing machines, clothes dryers, dishwashers, stoves, and ovens are explicitly excluded (r 3(l) note). The detailed motor vehicle component list (r 3(p)(i)-(xix)) captures many parts that some operators might assume are low‑risk. Misapplying the list risks unnecessary compliance or, conversely, missing obligations.

Transfer chain documentation requirement. Regulation 4(4) exempts a transferee dealer from section 10 obligations if the transferor dealer retained the goods in accordance with section 10 and the transferee keeps a copy of a certificate signed by the retaining dealer certifying that retention. Practically this means dealers in a chain must exchange and retain certificates; failing to obtain or keep the transferor’s certificate creates exposure to section 10 obligations and attendant offences. The certificate, and a retained copy, is the chain evidence that cuts compliance burden for subsequent dealers.

Written‑off vehicle narrow carve‑out. Regulation 4(5) excludes sections 9 and 10 for written‑off vehicles or components from written‑off vehicles if a dealer records the serial number of a written‑off vehicle notice affixed to the vehicle. If a dealer fails to record that serial number, the normal verification and retention obligations apply. Dealers handling salvage need to ensure they log the written‑off notice serial number precisely, technical errors in recording could reimpose full obligations.

Abandoned goods modification pitfalls. Where a dealer removes abandoned goods at council or Crown agency direction, record obligations are modified (r 5). However r 5(1)(b) requires the dealer to verify and record purchaser identity on sale unless the purchaser is another second‑hand dealer. Dealers may mistakenly assume full exemption; in fact the dealer must still record purchaser details and identity verification methods when purchaser is a non‑dealer. The modified regime also disapplies s 8(5), 9 and 10 for those goods (r 5(1)(c)), but only after the modified records specified in r 5(1)(a) are kept.

Identity verification detail and evidential standards. Regulation 9 requires either a single government‑issued photo ID with name, residential address, signature and photograph, or two documents including one government‑issued document and other official documents, collectively showing name, residential address and signature. The verifier must check forgery, matching names/addresses/signatures and photograph likeness (r 9(3)). The reg also requires logging card/document identifying numbers, or issue dates where no number, and issuer details (r 9(4)). Practically, poor handwriting, failure to log identifiers, or accepting non‑compliant documents can expose dealers to record offences and weaken their defence in disputes.

Pawn ticket disclosure complexity. Pawn tickets must show periodic interest rate and an equivalent annual interest rate and disclose any fees not treated as interest (r 11(j)-(k)). Calculating and presenting an accurate equivalent annual rate and distinguishing fees that are interest from other charges requires financial literacy. Errors in calculation or disclosure may create consumer claim exposure and regulatory enforcement.

Auctioneer record obligations even if not a dealer. Auctioneers who are not second‑hand dealers must nevertheless keep s 8‑like records (except identification codes) and add auction date/place/outcome (r 6(b)(i)-(ii)). Auctioneers who conduct more than six auctions in 12 months may be presumed to be conducting business as a second‑hand dealer (note to r 6 referencing s 24(1)(c) of the Act). Auctioneers should track aggregate auction counts to avoid inadvertently triggering dealer status.

Notification timeframes. Many notices require updates within 14 days of specified changes (r 8(2), r 13(2)). The transitional 2016 provision gave incumbents one month to supply missing details and threatened a $2,500 maximum penalty for non‑compliance (Transitional Sch 1). Practically, businesses must maintain a calendar and internal process to identify reportable changes promptly.

Disqualification scope and criminal history. Regulation 7A prescribes a range of criminal offences that may support disqualification (r 7A(a)-(g)). Dealers need to be aware that certain convictions, even if not directly concerning second‑hand trade, can be grounds for administrative disqualification under the Act because the regulations fold in categories of serious criminal conduct.

Charity sales can be excluded but beware the conditions. Charity sales where all goods are donated and proceeds go to the organisation are excluded from Part 2 and, for markets, excluded from Part 4 if no prescribed goods are sold (r 4(8)-(9)). If a charity sells some non‑donated goods or sells prescribed goods, the exemptions do not apply. Operators of charitable markets must ensure their intake and proceeds structure match the exemptions precisely.

Record retention and discoverability. The regs require copies of notices and claim forms to be kept at premises (Sch 1 Information) and records for each day of market operation (r 14(1)). These stored records are discoverable and will be scrutinised by police and courts. Inadequate organisation, loss of records or ambiguous record formats increase enforcement and litigation risk.

In sum, the main "gotchas" arise from detailed lists and forms, tight timing for notifications, cross‑reference dependencies (e.g. written‑off vehicle notices), chain documentation needs, and the operational burden of accurate financial disclosure on pawn tickets. Compliance requires both administrative controls and technical knowledge.

Establish a compliance playbook that maps duties to daily operations. Below is a practical checklist grounded in the regulations to convert statutory obligations into a defendable compliance system.

1. Read and classify stock against the "prescribed goods" list (r 3).

   • Maintain an internal catalogue that tags each incoming item as "prescribed" or "not prescribed". The catalogue should include the motor vehicle components list (r 3(p)), interactive game consoles and software (r 3(j)-(k)), and the excluded whitegoods (r 3(l) note).
   • For written‑off vehicles or components, log the written‑off vehicle notice serial number immediately on receipt (r 4(5)).

2. Initial notifications and ongoing notices to the Commissioner of Police (rr 8, 13).

   • Before commencement, or as required by the Act, give the Commissioner the full prescribed notice content (r 8(1) for dealers; r 13(1) for market operators): full names, residential addresses, telephone numbers, emails, date of birth for close associates, addresses where records and goods are kept, business/trading names, nature of business and an address for service.
   • Implement an internal trigger and calendar for 14‑day update obligations (r 8(2), r 13(2)) covering changes in names, addresses, close associates, partnership entries/exits and directors.

3. Identity verification procedure (r 9).

   • Adopt an ID verification SOP: Accept either a single government/statutory photo ID (with name, residential address, signature and photograph) OR two documents including at least one government/statutory document plus an official second document, ensuring that together they show name, residential address and signature (r 9(2)).
   • Train staff to check for forgery/tampering, matching names/addresses/signatures and photograph likeness (r 9(3)).
   • Require staff to record, for each document used, the identifying number if present, or the issue date if no number, and issuer details (r 9(4)). Use standard fields in an electronic or paper log.

4. Records to be kept under s 8 and r 14 (dealers, pawnbrokers, market operators).

   • For each prescribed good acquired, record the entries required by section 8 of the Act (as modified by these regs), and for market days keep the date, place, and full names and addresses of each person who sells prescribed goods (r 14(1)(a)-(b)).
   • Ensure identity verification of sellers at markets and record the means used (r 14(2)).
   • For auctioneers, record auction date, place and whether the lot sold and the sale amount against the s 8 entry (r 6). If not a dealer, keep s 8 style records as if a dealer (r 6(b)(i)).

5. Pawn tickets and pawn sale records (r 11, r 12).

   • Use a pawn ticket template that includes pawner’s full name, address and signature; precise item descriptions and serial numbers; unique identification code; pawn and redemption dates; extension procedure statement; statement about sale of unredeemed goods to secure best price; storage address; separability for multiple items; periodic interest rate and equivalent annual interest rate; and disclosure of fees not treated as interest (r 11(a)-(k)).
   • Keep records of sale of unredeemed pawns with date and sale amount (r 12). Integrate these with accounting systems for auditability.

6. Abandoned goods handling (r 5).

   • Where removing abandoned goods at council or Crown agency request/authorisation, record the council/agency name and address, description of goods, place removed from and date (r 5(1)(a)). On sale, record purchaser name and address and verify purchaser identity if purchaser is not another dealer (r 5(1)(b)(i)-(ii)).
   • Note that s 8(5), 9 and 10 do not apply to these goods (r 5(1)(c)), but the modified records are required.

7. Claim procedure for alleged stolen goods (r 10; Sch 1).

   • Keep supply copies of Schedule 1 claim form; on receipt of a claim complete the form with claimant and dealer signatures, give claimant a copy, notify and give copy to the local police officer in charge or designated officer, and retain a copy at the premises (Sch 1 Information; r 10(2)).
   • Do not sell or part with possession of the claimed goods without written authority from a police officer (Sch 1(3)).

8. Chain transfers and retention certificates (r 4(4)).

   • Where acquiring goods from another second‑hand dealer, ensure the transferor retained the goods in accordance with section 10 and obtain, and keep, a copy of the certificate signed by the retaining dealer certifying retention (r 4(4)(c)). Store the certificate as a record for s 8 purposes.

9. Disqualification risk management (rr 7, 7A).

   • Maintain a procedure to screen management and key personnel against the disqualification categories set out in r 7A (summary offences, serious and organised crime offences, specified drug and firearm offences, indictable violence offences, attempts and comparable foreign offences).
   • Keep records of convictions or events that would constitute a disqualification trigger and provide immediate notification to the Commissioner where an event occurs that disqualifies a person under s 6 (r 8(2)(f)).

10. Systems, retention and audit.

    • Use structured electronic records with backups for s 8 entries, pawn tickets, ID verification logs, market day registers and auction lot records. Ensure retention periods comply with the Act (check the Act for retention period).
    • Set internal audit cycles to verify compliance with r 9, r 11 and r 14 and correct errors promptly.

11. Staff training and operational manuals.

    • Train staff to recognise prescribed goods, use the pawn ticket template, follow ID verification SOPs, complete Schedule 1 claim notices, and escalate police notifications.
    • Keep written instructions for auctioneers and market operators about their special obligations under r 6 and r 14.

12. Transitional and incumbent compliance.

    • If operating prior to 1 July 2016 (transitional provision), ensure the Commissioner has received the additional telephone, email and close associate details required within the transition timeframe; note the transitional penalty of up to $2,500 for breach (Transitional Sch 1).

Practical notes on data privacy and risk. The regulations require the collection and storage of personal data (names, addresses, dates of birth, signature images and ID card numbers). Ensure data handling complies with privacy laws and that records are secured and access‑controlled. Where police notification is required, maintain templates to ensure timely and consistent reporting.

Finally, integrate compliance cost into pricing and cashflow: ID verification, recordkeeping, and reporting take staff time and systems. Pricing models should account for this overhead where market dynamics permit. Establish a designated compliance officer or point of contact for the Commissioner and police to avoid missed 14‑day notifications and to maintain a defensible audit trail.
