Second-Hand Dealers and Pawnbrokers (General, Exemption and Record-Keeping) Regulations 2018

The Regulations deploy a small set of recurrent legal and operational concepts, each defined or specified by the Regulations and linked to the Act. These are the core concepts you will need to apply in practice.

Scrap metal and non‑scrap metal: The Regulations prescribe a material threshold to exclude things from the statutory definition of scrap metal. Anything containing more than 2 per cent by weight of gold or silver or more than 80 per cent by weight of copper is treated as not scrap metal for the purposes of the Act (reg 6). That allocation matters because scrap metal attracts separate recording rules under reg 15 and enjoys a distinct exemption treatment in reg 10(4)(f).

Exemptions: The instrument is precise about circumstances in which the Act, or particular provisions of it, do not apply. Examples:

• Second‑hand dealers acting exclusively for or on behalf of charitable, benevolent or philanthropic organisations are exempt from the whole Act while acting in that role, and similarly for antique fairs run exclusively for or on behalf of such organisations (reg 7(1)).
• Electronic purchase arrangements can modify the s 19(1) identity requirements where the dealer requires provision of an identity document copy, either one listed in s 19 of the Act or one from categories prescribed in reg 12 (reg 7(3)).
• Corporate sellers can be treated differently where a certificate of registration or incorporation is supplied (reg 7(4)).
• Financial sector entities and authorised deposit‑taking institutions are exempt from s 3(2) of the Act (reg 8(1)), and the Act does not apply to goods sold by those institutions when sold in the course of rental businesses or to enforce securities (reg 8(2)).
• The Regulations identify named corporate entities and specify which parts of the Act do not apply to them (reg 9).
• Schedule 1 lists classes of goods exempt from the whole Act (reg 10(1)), and reg 10 contains a number of additional goods‑specific exemptions including rental business goods, certain low value furniture items, certain motor vehicles with evidentiary requirements, and scrap metal (reg 10(2)-(4)).

Record‑keeping: The concept of a record is narrowly defined in terms of permitted media and precise fields. Records must be kept in a bound record book or a computerised record‑keeping system (reg 13). The Regulations explicitly list the particulars that must be recorded for ordinary second‑hand goods (reg 14), scrap metal (reg 15), pawns (reg 16), auction purchases (reg 17) and goods received at alternative premises (reg 18). For scrap metal the Regulations require a copy of the cheque or electronic transfer receipt for the transaction to be kept (reg 15(1)(f)), and where scrap metal is exported in shipping containers there are extra fields (reg 15(3)(g)).

Identification: The Regulations prescribe categories of documents for the purposes of s 19(1) of the Act, listing specific documents such as birth certificates, certificates of Australian citizenship, specified Commonwealth concession cards, tertiary ID cards and Firearms Act licences (reg 12). Those categories operate both as stand‑alone permitted evidence and as a recognised class where the dealer is operating under the s 19(1) electronic communication exemption (reg 7(3)).

Forms and typographical requirements: The Regulations prescribe the content of pawn tickets (Schedule 2), consumer notices (Schedule 3), notice of sale (Schedule 4), embargo notices (Schedule 5) and the verifying statement used in police production demands (Schedule 6). The consumer notices include mandatory font sizes and bolding for headings (reg 20(2)), and Schedule 4 repeats similar typographic requirements for notice of sale (reg 24(2)). Pawnbrokers are forbidden from charging for issuing pawn tickets (reg 20(3)).

Enforcement concepts: The Regulations provide stringed administrative enforcement tools:

• Embargo notices follow the form in Schedule 5 and the Schedule reproduces the criminal sanctions tied to sections 26P and 26ZK of the Act including penalties not exceeding 50 penalty units for dealing with embargoed items (Schedule 5).
• A set of specified Act provisions and Regulations are identified as infringement offences for which infringement notices may be issued (reg 26(1)). The instrument then supplies an infringement penalty schedule tied to each infringement offence, expressed in penalty units (reg 26(2) table).
• For police requests for electronic records, a prescribed verifying statement must accompany the production (reg 27 and Schedule 6).

Consumer protection mechanics: The Regulations prescriptively set out the customer information requirements relating to pawns and sales of unredeemed goods including the content of notices, the requirement that pawnbrokers attempt to secure the best price reasonably obtainable on sale of unredeemed goods, and the borrower’s right to redeem at any time prior to sale including after expiry of the loan period (regs 20-24 and Schedules 2-4).

Inter‑legislative references: The Regulations rely on statutory cross‑references to the Act and to external statutes for evidentiary or content rules, for example the Electronic Transactions (Victoria) Act 2000 for electronic receipts (reg 17(2)), the Road Safety Act 1986 for written‑off vehicle status (reg 10(4)(d)(i)), and the Firearms Act 1996 for a firearms licence as an identity document (reg 12(g)).

Together these concepts structure compliance obligations, evidentiary proofs, permitted exclusions and the enforcement architecture that will be used by the Authority and police in administering the Act.

The Regulations distribute costs, duties and decision rights among a defined set of actors. The principal groups affected are:

Second‑hand dealers and pawnbrokers: These are the primary regulated parties. The Regulations impose detailed record‑keeping obligations (regs 13-16), identification duties when acquiring goods (reg 12, reg 14(1)(c)-(d)), an obligation to ensure identifying marks remain affixed to second‑hand goods until sale or disposal (reg 19), and numerous procedural requirements for pawn transactions including pawn ticket content, notice formats and prohibition on charging for pawn tickets (regs 20-24). They are also subject to the infringement penalty regime (reg 26).

Customers and sellers: Persons selling second‑hand goods to dealers, and persons pawning goods, are affected by the ID documentary requirements (reg 12 and s 19(1) of the Act as qualified by the Regulations), the requirement to provide addresses and identification for pawned goods (reg 16(e)-(f)), and the remedies available after sale of unredeemed goods (Schedule 3 and Schedule 4). Persons who lose pawn tickets must provide a statutory declaration plus identification to obtain a duplicate ticket (reg 21).

Charitable, benevolent or philanthropic organisations and antique fairs: The Regulations exempt second‑hand dealers who act exclusively for or on behalf of such organisations from the whole Act (reg 7(1)). This exempts both the dealer and the specific event circumstances identified.

Financial sector entities and banks: Regulation 8(1) removes the application of section 3(2) of the Act to goods received by financial sector entities as defined by Commonwealth law, authorised deposit‑taking institutions and certain banks. Regulation 8(2) excludes from the Act goods sold by those institutions in the course of rental businesses or to enforce securities. This reallocates compliance duties away from those institutions in the specified circumstances.

Named companies: The Regulations single out specific corporate entities by ACN and name in regulation 9 and exempt them from particular parts of the Act. For example, AKN Pty Ltd ACN 120 745 851 is exempted from the whole Act (reg 9(2)). These are narrow, entity‑specific exemptions.

Police and inspectors: The Regulations provide forms and procedures for police and inspectors, notably an embargo notice form (Schedule 5) and a verifying statement that business operators must use when producing electronic transaction records to a member of the police force (reg 27 and Schedule 6). The Schedule 5 form recites criminal penalties for dealing with embargoed items and identifies the inspector or officer authorised to issue the embargo.

The Authority: The regulator that maintains the register of second‑hand dealers is assigned mandatory particulars to record under reg 11. The Authority is the decision maker for registration and suspension (reg 11(c)). The Regulations also create reporting and evidence obligations that will be processed by the Authority and by police when exercising search or production powers under the Act.

Overseas buyers, shipping companies and ports: Where scrap metal is removed by shipping container, the record fields require the name of the shipping company, the overseas port destination and any container identifier (reg 15(3)(g)). These provisions affect businesses that export scrap metal and interact with international shipping logistics.

Consumer Affairs Victoria: The consumer notices (Schedule 3 and Schedule 4) reference Consumer Affairs Victoria as the body to contact for complaints and advice. While the Regulations do not create statutory duties for Consumer Affairs Victoria, the notices assign it a consumer support role.

Suppliers and intermediaries (auctioneers, transporters): Auctioneers who sell second‑hand goods to dealers are required to supply a receipt with prescribed information to permit the dealer to satisfy record‑keeping duties where goods are bought at auction (reg 17(1)). Transporters and shipping companies appear indirectly where shipping container details must be recorded for exported scrap metal (reg 15(3)(g)).

Who bears the compliance costs: Operationally the regulated second‑hand dealers and pawnbrokers bear the direct compliance cost of the record‑keeping and identity verification rules, plus the administrative burden of providing prescribed notices and meeting typographical requirements. Financial institutions and certain named corporations have had obligations removed in the enumerated circumstances, shifting compliance obligations away from them. Police and the Authority bear enforcement and inspection costs to the extent they exercise embargo, production and infringement notice powers provided by the Act and the Regulations.

Who decides and who pays: The Authority decides registration matters and will record particulars as prescribed (reg 11). Second‑hand dealers and pawnbrokers decide how to meet the record‑keeping requirements (bound book or computerised system per reg 13), how to mark goods (reg 19), and how to run pawn transactions consistent with the content and timing obligations prescribed in regs 20-24. Dealers pay for the ongoing costs of record systems, staff time to capture the prescribed fields, and any penalties or infringement fines if they fail to comply. Police and authorised inspectors decide when to issue embargo notices and may require production of electronic records using the prescribed verifying statement in Schedule 6.

In short, the Regulations concentrate enforcement and record‑keeping obligations on second‑hand dealers and pawnbrokers while creating specific carve outs for certain institutional sellers and identified entities.

The Regulations translate the Act’s broad obligations into concrete duties for regulated persons and stated rights for customers. The following are the principal duties and rights as set out in the instrument.

Duties on second‑hand dealers

• Registration particulars: The dealer must ensure the register maintained by the Authority contains specified particulars, including registration number, business name, addresses of premises, director names and dates for corporations, ABN and internet site addresses (reg 11). This is a duty on the registered entity to supply accurate data to the Authority.

• Record‑keeping media: Records must be kept in either a bound record book or a computerised record‑keeping system (reg 13). This prescribes the two acceptable formats; it does not mandate a retention period in the Regulations but requires the records to be produced when demanded under the Act.

• Records for second‑hand goods (excluding scrap metal): For every acquisition the dealer must record an accurate description of the goods, any identifying mark or label, the dealer’s identifying mark or number assigned to the goods, the full name and address of the person from whom the goods were received, details of identification provided, date and time of receipt, price paid if any, and the name of any agent acting on behalf of the dealer (reg 14(1)(a)-(g)). Lot recording is permitted where each item is valued under $100, allowing aggregated entries in such circumstances (reg 14(2)).

• Records for scrap metal: For every receipt of scrap metal the dealer must record an accurate description and quantity or weight, vehicle identifier where the scrap metal is a motor vehicle, full name and address of the seller, identification details, date and time of receipt, a clear copy of the cheque or electronic transfer receipt, and agent name where applicable (reg 15(1)). Disposals of scrap metal also require detailed fields and if exported by container, shipping company and port information (reg 15(3)(d)-(g)).

• Identifying marks: The dealer must ensure the identifying mark or number they assign to goods remains affixed to the goods at all times until sold or otherwise disposed of (reg 19). The text immediately following reg 19 in the instrument includes the line "1. 20 penalty units." which attaches an express penalty at or near this provision in the printed instrument.

• Auction and import documentation: When goods are bought at auction, the dealer must obtain a receipt signed by the auctioneer and enter a reference to it in the records; an electronic receipt is acceptable under the Electronic Transactions (Victoria) Act 2000 (reg 17). For imported goods dealers must keep consignment and customs documents and record a reference to identify them (reg 17(3)).

Duties on pawnbrokers

• Pawn ticket and notices: A pawn ticket must contain the particulars in Schedule 2 and a written notice in the form of Schedule 3 must be provided to the pawner, with prescribed typographical requirements for headings and text sizes (reg 20(1)-(2), Schedule 2, Schedule 3). Pawnbrokers are prohibited from charging a fee to issue a pawn ticket (reg 20(3)). Failure to comply with the prohibition is a penalty provision (reg 20(3) provides "Penalty: 20 penalty units").

• Duplicate tickets: If a pawn ticket is lost, a duplicate must be issued on production of a statutory declaration and identity evidence as set out in s 19(1) of the Act (reg 21, penalty attached in text).

• Loan period: The pawnbroker must fix the period of the loan at the time the goods are pawned and the loan period commences the day the goods are pawned (reg 22(1)-(2)). There is a penalty for failing to fix the period as noted in the instrument.

• Records for pawn transactions: Pawnbrokers must record transaction number, a description of goods including identifying marks, full name and address of pawner, ID details, addresses for notices, date pawned, amount advanced, charge imposed, payments made and dates, period of any loan, redemption date if redeemed, and sale or disposal details if unredeemed (reg 16(a)-(m)).

• Sale of unredeemed goods: Pawnbrokers must offer unredeemed goods for sale as soon as practicable after the loan period expires and must obtain the best price reasonably obtainable (reg 24(1)). They may not purchase goods pawned with them that have not been redeemed at or after expiry (reg 24(3)). There are prescribed notice content and typographic requirements where the sale produces money left over for the pawner (reg 24(2), Schedule 4).

Identification duties and permissions

• For acquisition of goods or redemption of pawned goods, the prescribed categories of identity documents are set out in reg 12. These include birth certificate, certificate of Australian citizenship, marriage certificate, specified Commonwealth concession cards, tertiary institution ID and a Firearms Act licence (reg 12(a)-(g)). The Regulations also permit, in electronic purchase contexts, reliance on copies of these documents where a copy is supplied (reg 7(3)). Where sellers are bodies corporate, a certificate of registration or incorporation satisfies the identity requirement (reg 7(4)).

Consumer rights

• The person who pawned goods has the right to redeem at any time prior to sale even after the loan period has expired (reg 23(2)). Schedule 3 and Schedule 4 also set out consumer information rights on pawn charges, repayment, lost tickets and money left over after sale, including a right to claim money left over from a sale within 12 months of the sale (Schedule 3; Schedule 4).

Enforcement and procedural duties for police

• The Regulations prescribe a verifying statement that must accompany production of electronically kept transaction records to a member of the police force (reg 27 and Schedule 6). The verifying statement is a declaration that the document produced is a true record of transaction records for a specified period.

Infringement and penalties

• The Regulations list which offences under the Act and which regulations are eligible for infringement notices and provide a table assigning infringement penalty amounts in penalty units for each such offence (reg 26(1)-(2)). Several contraventions carry specific penalty unit levels and the instrument cross‑references the Sentencing Act 1991 and Monetary Units Act 2004 for calculation of dollar equivalents (Endnotes).

These duties are precise and prescriptive, with many duties linked to specific record fields, required documentary proofs, typographical form content and explicit criminal or infringement penalties for contravention. The practical effect is to convert compliance into a regimented administrative regime that can be audited, policed and fined.

The Regulations set out an administrative and criminal enforcement architecture that operates in tandem with the Act. Enforcement mechanisms and the applicable penalties are specified in both procedural form and numerical terms in penalty units.

Infringement offences and penalties

• Regulation 26(1) identifies a list of Act provisions and Regulations that are offences in respect of which an infringement notice may be issued. The list includes numerous sections of the Act (for example sections 5(1), 5(1A), 11B, 11C(4), 17, 19A-19B and 26(4)) and regulations 19, 20(3), 21, 22(1) and 24(3) (reg 26(1)(a)-(b)). This operates as the gatekeeper for the application of the infringement notice regime.

• Regulation 26(2) contains a table matching specific offences with specified infringement penalties expressed in penalty units. For example, an offence against section 5(1) or 5(1A) of the Act is specified at 10 penalty units (items 1 and 2). An offence against section 19A(1) or 19A(2) is listed at 12 penalty units (items 14 and 15). Many recordkeeping and procedural contraventions are assigned low single digit penalty units (1-5 penalty units) while more significant offences attract larger penalty units as set out in the table.

• The Regulations reference the Sentencing Act 1991 and the Monetary Units Act 2004 in the Endnotes for calculation of dollar equivalents. The Endnotes provide the penalty unit value for the 2017-18 and 2018-19 financial years as $158.57 and $161.19 respectively. The instrument therefore expects enforcement agencies to convert penalty units to dollar amounts using the statutory mechanism.

Criminal sanctions and embargo power

• Schedule 5 reproduces the embargo notice form and recites the criminal sanctions linked to sections 26P(2) and 26ZK(2) of the Act. Those sections provide that a person who knows an embargo notice relates to an item and who sells, leases, moves (without written consent of the inspector or police officer who issued the embargo), transfers or otherwise deals with the thing or any part of it is guilty of an offence and liable to a penalty not exceeding 50 penalty units (Schedule 5, paragraph 2). The Schedule also notes the statutory defence where the movement was for the purpose of protection and preservation (Schedule 5, paragraph 3).

• Schedule 5 further records that a sale, lease, transfer or other dealing in contravention is void despite anything in any other Act (Schedule 5, paragraph 4). That is an express statement that offending dealings will be treated as nullities under the Act’s embargo provisions.

Penalties attached to specific Regulations

• Several Regulations carry express penalties in the printed instrument. For example:

  • Regulation 20(3) (prohibition on charging a fee to issue a pawn ticket) is followed by an express "Penalty: 20 penalty units".
  • Regulation 21 (lost pawn ticket duplicate requirement) is followed in the instrument by "1. 20 penalty units." immediately after the text.
  • Regulation 22(1) (duty to fix loan period) is followed by "1. 20 penalty units."
  • Regulation 24(1) (duty to offer unredeemed goods for sale as soon as practicable and to obtain the best price reasonably obtainable) is followed by "Penalty: 20 penalty units."
  • Regulation 24(3) (prohibition on pawnbroker purchasing unredeemed goods) similarly carries "Penalty: 20 penalty units."

• The printed table in reg 26(2) identifies a wide range of specific Act offences eligible for infringement with their assigned penalty units. Several key recordkeeping offences under the Act and these Regulations are given low infringement penalties, but statutory penalties for conviction may remain larger where applicable.

Production of electronic records and police powers

• Regulation 27 prescribes the form of a verifying statement (Schedule 6) that must accompany production of electronic transaction records to a member of the police force under section 25(2B) of the Act. The Schedule contains an attestation by a person named in the business that the produced document is a true record of transaction records for a specified period. The existence of this prescribed form imposes a procedural requirement and establishes admissible verification for production demands.

Administrative remedies and civil process

• Schedule 3 notes an expressed consumer remedy where a pawnbroker refuses to pay money left over after sale of unredeemed goods; the aggrieved person may apply to the Magistrates’ Court for an order that the pawnbroker pay the money. This is not a penalty clause but is an express procedural civil enforcement route embedded in the consumer notices required by the Regulations (Schedule 3, "If the pawnbroker refuses to pay you, you may apply to the Magistrates' Court").

Operational enforcement implications

• The Regulations have been drafted to create observable, auditable fields and documentary hooks for enforcement. Record‑keeping fields, the requirement to retain copies of cheque or electronic transfer receipts for scrap metal, the requirement to retain customs or consignment documents for imported goods, and the prohibition on pawnbrokers buying unredeemed goods all produce documentary traces that enforcement agencies can inspect.

• The infringement notice regime in reg 26 allows agencies to issue penalties administratively for many contraventions. The schedule shows a gradation of penalty units across offences, enabling tailored enforcement responses by regulatory agencies.

In sum, the Regulations combine administrative (infringement notices and forms), criminal (embargo breaches and specified penalties), procedural (verifying statements and documentary requirements) and civil avenues (Magistrates' Court remedy for recovery of sale proceeds) to create a multi‑modal enforcement architecture. Penalties are expressed in penalty units and require conversion to dollar amounts under the Monetary Units Act 2004 and the Sentencing Act 1991 as explained in the Endnotes.

The Regulations operate as subordinate legislation under the Second‑Hand Dealers and Pawnbrokers Act 1989 and explicitly cross‑reference and interact with a number of other Commonwealth and Victorian statutes. The interaction patterns are principally evidentiary, definitional and procedural.

Primary relationship with the Act

• These Regulations are made under s 31 of the Second‑Hand Dealers and Pawnbrokers Act 1989 (reg 2). They are therefore subordinate to the Act and supplement, specify and operationalise the Act’s requirements. The Regulations frequently refer to particular sections of the Act (for example, s 19(1) relating to identity documents, s 20 for record keeping, s 23 for pawn ticket requirements and s 26P/26ZK for embargo powers), thereby relying on the Act to confer substantive powers while furnishing procedural detail.

Cross‑references to other Victorian Acts

• Road Safety Act 1986: The Regulations treat certain motor vehicles entered on the register of written‑off vehicles as statutory write‑offs in accordance with Division 3 of Part 2 of the Road Safety Act 1986 and permit exemptions where that status is recorded and vehicle registration searches and photographic evidence are retained (reg 10(4)(d)). Thus the Regulations rely on the Road Safety Act’s vehicle write‑off scheme as an evidentiary basis for treating written off vehicles as exempt in specified circumstances.

• Firearms Act 1996: A licence issued under the Firearms Act 1996 is an accepted category of identity document for the purposes of s 19(1) under reg 12(g). This permits firearms licence holders to satisfy identity checks when selling or pawning goods.

• Electronic Transactions (Victoria) Act 2000: The Regulations permit electronic receipts and communications to satisfy some documentary obligations, for example an auction receipt obtained by electronic communication may satisfy reg 17(1)(a) and is explicitly validated under the Electronic Transactions (Victoria) Act 2000 (reg 17(2)). This allows digital processes to be used for compliance where they meet the Victorian electronic transactions statute.

• Sentencing Act 1991 and Monetary Units Act 2004: The Endnotes instruct that monetary equivalents of penalty units are calculated under these Acts. The Regulations refer to penalty units in the infringement schedule and elsewhere, and the Endnotes provide the applicable penalty unit value for the financial years mentioned ($158.57 for 2017-18 and $161.19 for 2018-19). The calculation and publication mechanisms for penalty unit values are governed by the Monetary Units Act 2004 and the Treasurer’s determinations, with cross‑reference to the Sentencing Act 1991 for the definition of penalty units (Endnotes).

• Interpretation of Legislation Act 1984: The Endnotes include interpretative guidance and style provisions per the Interpretation of Legislation Act 1984 that the Statutory Rule incorporates. That Act governs headings, examples, punctuation and other interpretative matters for the Regulations.

Cross‑references to Commonwealth legislation

• Financial Sector (Collection of Data) Act 2001 and Banking Act 1959: Regulation 8(1) refers to a "financial sector entity within the meaning of the Financial Sector (Collection of Data) Act 2001 of the Commonwealth" and to "an authorised deposit‑taking institution within the meaning of the Banking Act 1959 of the Commonwealth". Those definitions are imported to define which institutions are exempt from s 3(2) of the Act. The Regulations therefore depend on Commonwealth definitions to delimit scope of exemptions.

• Corporations Act: The Regulations refer to the meaning of "related body corporate within the meaning of the Corporations Act" when specifying limited exemptions for IBM Australia Ltd acquiring second‑hand goods from related bodies corporate (reg 9(4)(a)). The Corporations Act thus supplies a technical corporate law meaning used to operationalise that exemption.

Administrative law and enforcement interaction

• The Regulations prescribe forms and procedures (for example the verifying statement in Schedule 6) that police and inspectors will rely on when exercising powers under the Act to obtain or embargo records and property. Those enforcement actions will be governed by the Act itself, criminal procedure rules and administrative law principles in Victoria.

Concurrent obligations and devolved responsibilities

• Where a transaction involves cross‑border elements such as imported goods (reg 17(3)) or exported scrap metal in shipping containers (reg 15(3)(g)), the dealer’s record‑keeping duties intersect with customs and export control obligations managed by other statutory regimes. The Regulations require dealers to keep consignment and customs documents where goods are imported and to collect shipping and port information where scrap metal is exported. This creates a compliance overlap: the dealer must hold documents under the Act and related regulations while also complying with national customs documentation rules.

• For motor vehicles, the requirement to carry out a vehicle registration search to verify a vehicle is not reported stolen interacts with the vehicle registration systems maintained under other road transport statutes. The Regulations do not create or govern the search mechanism but require the result to be recorded and retained as a preventive evidentiary measure (reg 10(4)(c)(ii), reg 10(4)(d)(ii)).

In sum, the Regulations are deliberately integrative: they import definitions and evidentiary devices from Commonwealth statutes and other Victorian statutes, they formalise interactions with consumer protection mechanisms (Consumer Affairs Victoria is referenced in notices), and they create documentary hooks for inter‑agency enforcement. These interactions oblige regulated persons to coordinate compliance across multiple statutory regimes and to retain documentary evidence derived from those other statutory systems.

The Regulations are a consolidated Statutory Rule made on 22 May 2018 and in operation from 30 May 2018 (reg 3 and Endnotes). The Endnotes provide the official record of revocations and modifications at the time of making.

What was revoked on commencement

• Regulation 4 lists the instruments revoked when these Regulations were made. That list includes selected regulations and parts of the Second‑Hand Dealers and Pawnbrokers Regulations 2008 and various exemption regulations and amendment regulations from 2008 to 2016. Specifically the instrument revokes Regulations 1(b) to (g) and 7, Parts 3 and 4 of, and Schedules 2 to 6 to, the Second‑Hand Dealers and Pawnbrokers Regulations 2008, the Second‑Hand Dealers and Pawnbrokers (Exemption) Regulations 2008 as amended, the 2009 and 2011 amendments, and the 2012 and 2016 amendment regulations as listed in reg 4(a)-(f). The explanatory details in the Endnotes itemise the revoked instruments and their prior S.R. numbers.

Amendment record as at publication

• The Endnotes state in the Table of Amendments section that "There are no amendments made to the Second‑Hand Dealers and Pawnbrokers (General, Exemption and Record‑Keeping) Regulations 2018 by statutory rules, subordinate instruments and Acts." The "Amendments Not in Operation" section likewise states there are no amendments not in operation at the date of publication. Therefore the instrument as published is the original 2018 version without subsequent amendments as recorded in the Endnotes.

Sunsetting

• The Endnotes note that the Regulations will sunset 10 years after the day of making on 22 May 2028 pursuant to section 5 of the Subordinate Legislation Act 1994. This means that absent renewal, replacement or revival, the provisions will lapse on that date.

Transitional or temporary provisions

• Regulation 7(5) contains a temporary exemption: it exempts a second‑hand dealer from the application of section 5 of the Act until 1 September 2018 if the dealer deals exclusively in scrap metal. This is a time‑limited transitional measure contained in the substantive text of the Regulations themselves and will have expired after 1 September 2018.

Drafting and style changes

• The Endnotes explain that the Regulations incorporate style changes authorised by the Interpretation of Legislation Act 1984 and state how certain textual or formatting items in the Statutory Rule are to be interpreted. These are housekeeping matters that may affect how future amendments are drafted.

Practical notes on amendment history

• Because the instrument was created to replace earlier regulations and numerous past exemption instruments, its initial drafting consolidated prior regulatory detail into a single rule. The revocations listed in reg 4 and the explanatory details in the Endnotes record that consolidation. At the date of the published version there were no subsequent amendments recorded. Practitioners should consult the Endnotes in any current version and the Victorian legislation website to verify whether amendments have been made after the date of the version printed here.

Overall, the amendment history embedded in the instrument shows a consolidation exercise in 2018, a limited transitional exemption for scrap metal dealers up to 1 September 2018, and a ten year statutory sunset. No subsequent changes are recorded in the Endnotes to the version provided.

The Regulations themselves, as printed, do not record any court decisions, judicial interpretations or litigation history. The instrument contains no case citations and the Endnotes do not list any litigation outcomes. Therefore the published text supplies no direct litigation history to cite.

What the absence of litigation references means in practice

• The Regulations function primarily as prescriptive administrative rules rather than as interpretive statements of legal principle that typically attract early litigation. Enforcement under these rules will generally be regulatory rather than adversarial, consisting of inspections, production demands, embargo notices, infringement notices and, where appropriate, prosecution under the Act. The instrument provides forms and infringement mechanisms that enable administrative enforcement rather than litigation as the first line of response.

• Where disputes do arise they can proceed through administrative review, civil proceedings (for example the remedy identified in Schedule 3 where a pawnbroker refuses to pay money left over after sale, in which the aggrieved person may apply to the Magistrates’ Court), or criminal prosecution under the Act for specified offences. The Regulations themselves do not create novel private rights of action; they create procedural obligations and public enforcement mechanisms.

Anticipated litigation topics given the provisions

• If litigation were to proceed, likely contested issues would include the interpretation of record‑keeping obligations (for example whether a computerised system’s export can be treated as a compliant record), the sufficiency of identification evidence supplied by sellers, the legality of aggregated lot entries under reg 14(2) and reg 15(2), the sufficiency of photographic evidence and vehicle registration checks relied upon for motor vehicle exemptions under reg 10(4)(c)-(d), and challenges to embargo notices and the exercise of inspection powers where the statutory form or content requirements are argued to be defective.

• The Regulations’ detailed typographic requirements for consumer notices (reg 20(2) and reg 24(2)) could give rise to technical compliance disputes where the precise font size or bolding is not adhered to, and questions may arise about whether technical typographical non‑compliance amounts to an offence for which infringement notices or penalties are appropriate.

Procedural recourse

• The Regulations incorporate the Act’s existing enforcement architecture. Any litigation history that emerges would therefore be tied to how courts interpret obligations, divides of discretion between the Authority and enforcement agencies, and how strictly courts construe procedural requirements when imposing penalties.

Because the instrument contains no reported litigation, practitioners should monitor enforcement actions and any administrative decisions from the Authority or prosecutions in the Magistrates’ Court or higher courts for emerging authorities that interpret the Regulations in practice.

The Regulations are detailed and prescriptive; several features can produce practical pitfalls for regulated persons and advisers. The following are concrete operational "gotchas" grounded in the text.

Aggregated lot entries reduce traceability but are permitted

• Reg 14(2) and reg 15(2) permit a single entry for a lot or parcel where each item in the lot is valued at less than $100. That reduces record‑keeping burden, but it also reduces traceability and evidentiary value for each item in the lot. Dealers who rely on aggregated entries will have less granular records for tracing individual items if a dispute or police inquiry arises. The text explicitly allows the aggregated entry where the value threshold is met; the practical effect is a tradeoff between administrative efficiency and forensic traceability.

Typographic requirements are mandatory and specific

• The Regulations impose precise typographic specifications on consumer notices under reg 20(2) and reg 24(2), including minimum font sizes and bolding for headings and subheadings. Failure to match the prescribed typographical standards could be a formal non‑compliance. The Regulations treat signs showing maximum pawnbroker charges as a required element and restrict pawnbrokers from charging more than the maximum unless the consumer agrees in writing and receives a copy of that agreement (Schedule 3). These form and signage requirements are technical and easily overlooked.

Pawn ticket fees and duplicate ticket process

• Pawnbrokers must not charge to issue a pawn ticket (reg 20(3)). The Regulations attach an express penalty for charging a fee. Yet they also require duplicate tickets to be issued upon a statutory declaration and identity evidence if a ticket is lost (reg 21). Practitioners must ensure internal processes for duplicate ticket issuance are streamlined and do not generate informal fees or delays that contravene the ban on charging for the ticket itself.

Identifying mark obligation and impracticality

• Regulation 19 requires that the dealer ensure the identifying mark or number assigned to goods remains affixed to the goods at all times until sale or disposal. For some goods (for example textiles, small parts, or porous materials), affixing a durable mark that remains through handling, cleaning or minor wear may be practically difficult. The Regulation nonetheless mandates the mark remain affixed and the printed instrument includes a penalty notation immediately after reg 19. Dealers should adopt robust marking systems that are compatible with the nature of the goods to avoid contraventions.

Scrap metal thresholds and evidence obligations

• Under reg 6, anything containing more than 2 per cent by weight of gold or silver or 80 per cent by weight of copper is not scrap metal. However reg 10(4)(e) allows a second‑hand dealer to treat an item as non‑scrap metal as a result of containing copper if the dealer records and retains photographic evidence of the thing, including identifying marks. This requires both a material assessment and evidentiary retention. Dealers trading in metal must be able to demonstrate how they assessed percentage thresholds and retain photographic evidence where appropriate. The Regulations do not prescribe testing methodologies, so practitioners should document internal assessment protocols to justify classifications.

Cashless payment proof for scrap metal

• Reg 15(1)(f) requires a clear and legible copy of the cheque or electronic transfer receipt relating to the scrap metal transaction. That creates an exposure where cash payments are made and no cheque or electronic transfer exists. The Regulation thus creates an incentive to avoid cash payments for scrap metal or to produce contemporaneous electronic payment evidence; failing to hold such proof risks non‑compliance.

Auction receipts and electronic references

• Reg 17(1) allows a dealer to satisfy reg 14 by obtaining a receipt signed by the auctioneer containing specified fields and entering a reference to identify the receipt in the dealer’s records. The receipt may be obtained electronically under reg 17(2) pursuant to the Electronic Transactions (Victoria) Act 2000. Dealers must therefore ensure the auctioneer’s receipt contains the specified fields and that the dealer’s record system reliably references the receipt. Discrepancies between the receipt and the dealer’s entry can create enforcement exposure.

Motor vehicle exemption evidentiary burden

• Reg 10(4)(c)-(d) creates exemptions for certain motor vehicles if the dealer records vehicle registration searches verifying the vehicle is not reported stolen and retains photographic evidence showing the vehicle identifier or another identifying mark. The practical gotcha is the need both to perform a vehicle registration search and to retain photographic evidence; failure in either will foreclose the exemption. Dealers must also be alert to the different conditions for vehicles older than 15 years and for statutory write‑offs.

Prohibition on pawnbroker purchasing unredeemed goods

• Reg 24(3) prohibits a pawnbroker from purchasing goods pawned with the pawnbroker that have not been redeemed at or after the expiration of the loan period, with an express penalty attached. A pawnbroker that sources goods for resale must ensure internal compliance controls prevent the business or associated parties from purchasing such goods, either directly or indirectly.

Verifying statement requirement for police production

• Regulation 27 prescribes a verifying statement (Schedule 6) that must accompany production of electronic transaction records to a police officer under the Act. Producing electronic records without the prescribed verifying statement may constitute a procedural defect in the police production process or expose the dealer to further administrative scrutiny. Dealers with computerised record systems should implement production protocols that include the Schedule 6 statement.

Entity‑specific exemptions require careful mapping

• Regulation 9 provides exemptions for named companies with specific ACNs. These exemptions are narrow and tailored. Organisations must not infer a wider corporate exemption simply because a related body corporate is referenced in reg 9(4). Practitioners should map corporate structures carefully to avoid incorrect application of the listed exemptions.

Penalties expressed in penalty units

• The Regulations frequently use penalty units rather than dollar values. The Endnotes supply the monetary values for the 2017-18 and 2018-19 financial years, but penalty unit values change annually under the Monetary Units Act 2004 as determined by the Treasurer. Practitioners must use the current published penalty unit value to compute dollar amounts for infringement notices and fines.

These are procedural and operational traps that arise from the Regulations’ prescriptive drafting. The obligations are detailed and can produce unexpected compliance exposures if dealt with in a routine or informal way.

This section sets out a practical compliance checklist based on the Regulations’ text. The approach is prescriptive and operational: match the Regulations’ fields, forms and procedures and document internal process steps so an inspector or police officer can verify compliance.

1. Registration and public particulars (reg 11)

• Ensure the Authority’s register includes the prescribed particulars: registration number, business name, date of grant or suspension, registration conditions, address and telephone number of each premises, director names and appointment/cessation dates for corporations, ABN if any, and any internet sites used in the second‑hand business. Confirm the register entry with the Authority periodically and on any change.

2. Choose an approved record‑keeping medium (reg 13)

• Decide between a bound record book or a computerised record‑keeping system. If electing a computerised system, ensure the system can produce electronic documents and exports that can be accompanied by the Schedule 6 verifying statement required by police (reg 27, Schedule 6). Implement secure backups and an index to link any external receipts or photographs to the main transaction record.

3. Identity verification procedures (reg 12, reg 7)

• Adopt an identity verification policy specifying acceptable documents per reg 12: birth certificate, Australian citizenship certificate, marriage certificate, Commonwealth seniors health card, health care card, pensioner concession card, other Commonwealth department health concession cards, tertiary ID cards, and Firearms Act licences.
• For purchases arranged by electronic communication where reg 7(3) applies, require provision of a copy of one of the prescribed documents or of a document listed in s 19 of the Act. For corporate sellers, accept a certificate of registration or incorporation per reg 7(4).
• Maintain a checklist for staff to capture and record the identification details required by reg 14(1)(d), reg 15(1)(d) and reg 16(d).

4. Transaction recording templates and mandatory fields

• Second‑hand goods (reg 14): For each transaction record the accurate description, any identifying marks or labels, the dealer’s identifying mark/number, full name and address of the seller, identification details provided, date and time received, price paid, and agent name if applicable. For lots where each item is valued under $100, use the permitted aggregated lot entry but note reduced item granularity (reg 14(2)).
• Scrap metal (reg 15): Record accurate description and quantity/weight, vehicle identifier if applicable, full name and address of seller, identity details, date and time, and a clear copy of the cheque or electronic transfer receipt. For disposals also record buyer details, date, time, method and location of disposal, payment evidence, and shipping container details for exports (reg 15(3)). Implement a mandatory cashless policy or electronic acknowledgement for scrap metal payments to ensure payment evidence is captured.
• Pawn transactions (reg 16): For each pawn record transaction number (matching pawn ticket), description of goods including identifying marks, full name and address, ID details, service addresses for notices, pawn date, money advanced, charge, payment dates and amounts, loan period, redemption date if applicable, and sale/disposal details if unredeemed.
• Auction or import purchases (reg 17): Obtain an auctioneer’s receipt with the specified fields (reg 17(1)(a)) and enter a reference in your records; for imports keep consignment and customs documents and enter a reference to them. Ensure auctioneer receipts (including electronic receipts) contain the required fields.

5. Marking goods and photographic evidence (reg 19; reg 10(4))

• Implement a robust system for assigning and affixing identifying marks or numbers to goods that will remain affixed until sale or disposal, per reg 19. For goods where attachment is impracticable, document the mitigating measures and photographic evidence linking marks to the goods.
• For motor vehicle exemptions, make vehicle registration searches and save and retain the results plus photographic evidence showing the vehicle identifier or other identifying marks (reg 10(4)(c)(ii)-(iii), reg 10(4)(d)(ii)-(iii)).

6. Pawn ticket and consumer notice compliance (reg 20, Schedule 2 and Schedule 3)

• Use the pawn ticket template in Schedule 2 and ensure all fields are included. Do not charge a fee for issuing pawn tickets (reg 20(3)).
• Provide the consumer notice in the form of Schedule 3 with the typographic requirements specified in reg 20(2). Maintain templates and evidence of provision to the pawner.

7. Lost pawn tickets and duplicate issuances (reg 21)

• Establish a standard process to accept a statutory declaration and ID as proof before issuing a duplicate pawn ticket. Retain a copy of the statutory declaration and the ID evidence in the transaction record.

8. Loan periods and redemption rights (regs 22-23)

• Fix and record the loan period at pawn time and enter the loan commencement date as the pawn date (reg 22). Accept redemption at any time prior to sale, even after expiry of the loan period, and record all payments on the pawn ticket and transaction record (reg 23).

9. Sale of unredeemed goods (reg 24 and Schedule 4)

• If goods are unredeemed by the end of the loan period, offer them for sale as soon as practicable and seek the best price reasonably obtainable. Prepare and send notice of sale in the Schedule 4 form where the sale produces funds that may be claimed by the pawner, observing the typographic requirements in reg 24(2). Record sale price, outstanding loan amount, accrued charges and reasonable costs of sale as required by Schedule 4.

10. Prohibitions on pawnbroker purchases of unredeemed goods (reg 24(3))

• Put in place internal controls that prevent the pawnbroker or associated entities from purchasing unredeemed goods pawned with the pawnbroker. This includes monitoring third party sales and related party transactions.

11. Embargo handling and police requests (reg 25, Schedule 5 and reg 27, Schedule 6)

• Train staff to recognise embargo notices in the form of Schedule 5 and the legal consequences of dealing with embargoed items. Do not move, transfer, sell or otherwise deal with embargoed items unless written consent is obtained from the issuing inspector or police officer.
• Maintain procedures for producing electronic transaction records to police that include attaching the Schedule 6 verifying statement signed by the authorised person.

12. Scrap metal handling and exports (reg 6, reg 15)

• For metal items, apply the scrap metal thresholds in reg 6 and record the basis for classification. Keep photographic evidence for items treated as non‑scrap metal due to copper content per reg 10(4)(e). For scrap metal exports, capture shipping company name, intended overseas port and container identifiers as required by reg 15(3)(g).

13. Computerised systems and evidentiary integrity

• If using a computerised system ensure it can: (a) present or print records in the formats and fields prescribed; (b) retain audit trails and timestamps for entries made during or immediately after transactions as required by regs 14-16; (c) export electronic receipts and attach verifying statements for police production; and (d) secure backups in case of inspection.

14. Infringement exposure management (reg 26)

• Map your internal controls to the list of infringement offences in reg 26(1) and to the penalty schedule in reg 26(2). Prioritise controls on high penalty exposures such as failure to issue pawn tickets, failure to offer unredeemed goods for sale, or charging for pawn tickets. Remember to use the current penalty unit value when calculating dollar equivalents.

15. Documentation and retention policies

• Although the Regulations do not specify a universal retention period, many fields require the dealer to "record and retain" documents (for example reg 10(4)(c)(ii) and reg 10(4)(d)(ii) for vehicle registration searches). Adopt a conservative retention policy aligned with other regulatory or commercial obligations (for example retaining records for a minimum period that will support investigations and claims), and ensure records can be located and produced promptly.

16. Staff training and auditable checklists

• Implement an auditable transaction checklist for staff to complete for each acquisition and pawn transaction that maps directly to the prescribed fields in regs 14-16 and to the pawn ticket fields in Schedule 2. Maintain training records to demonstrate staff competency and compliance procedures.

17. Periodic internal audits and remediation

• Conduct periodic audits of records against the prescribed fields, the presence and legibility of photographic evidence where required, and the adequacy of ID verifications. Implement corrective action plans where gaps are identified.

18. Liaison with the Authority and Consumer Affairs Victoria

• Engage with the Authority for registration updates and confirmations of compliance requirements. Use the consumer complaint and advice channel referenced in Schedule 3 as appropriate to resolve consumer issues proactively.

This checklist mirrors the Regulations’ prescriptive language. The consistent theme is to map each statutory field and form to an internal documented step, to retain documentary evidence, and to ensure the chosen record medium reliably produces the fields and outputs required by the Regulations.
