Seamen's Act 1958

The Act defines several key concepts that structure its operation. “Seaman” under Part II (s 5) includes every person except masters, pilots and apprentices who is employed or engaged in any capacity on board any vessel. This is a broad definition that would encompass cooks, cleaners, engineers and deckhands, but does not cover passengers or stowaways not employed. “Foreign vessel” means all vessels not belonging to any British possession , a pre-Federation and pre-Commonwealth formulation that now effectively means vessels registered in any country other than Australia, given that Victoria is a state of the Commonwealth of Australia and Australia is not a British possession. “Vessel” itself is defined expansively as any navigable ship or boat of whatever construction, whether moved by wind, steam or any other power, covering everything from sailing yachts to modern motor vessels. “Consul” under Part II includes consul, vice-consul, or other consular officer or agent (s 5). The Act does not define “runaway seaman”, “deserter”, “absconded”, or “absented himself from duty”, leaving those terms to ordinary meaning. Part I does not define “seaman” at all; its prohibition on obstructing a search for “any seaman or other person on board or reasonably suspected to be on board such vessel” suggests a broader class than the Part II definition.

A central concept in Part II is the requirement of consul consent or reciprocal proclamation for enforcement. Section 10 provides that no warrant may be issued and no offence prosecuted under Part II unless the consul of the vessel’s nation has instigated or assented in writing, or unless the Governor in Council has three times notified in the Government Gazette that the foreign government has requested that the Part be enforced against its crews. This creates a reciprocity condition: unless the foreign state has formally requested enforcement, its consuls must be the moving party. This avoids a situation where Victoria unilaterally polices foreign labour contracts without the foreign state’s cooperation. The “three several notifications” condition provides an alternative path in case the foreign government has indicated its desire in a general diplomatic note.

The concept of “harbouring” under s 11 is broad: it covers not only physical concealment but also employment, retention, and any act of causing, inducing or persuading a seaman to violate his agreement. The words “by words or by any other means whatsoever” extend liability to verbal encouragement. The provision catches both harbourers and those who assist in desertion, even if they do not personally hide the seaman. The Act does not define “desertion” but it appears to mean leaving the vessel without authorisation and with the intention of not returning.

The evidentiary provisions in s 12 are notable for relaxing common law rules. The list, roll, articles or agreement are central to proving the seaman’s contract. The consul-certified copy is prima facie evidence, and the consul’s certificate on foreign law is also prima facie evidence. Moreover, the court may admit proof that would not be admissible under strict rules of law. This lowers the bar for consuls and masters seeking enforcement, reducing the need to produce original documents or call attesting witnesses. The expenses concept in s 13 places the financial risk on the complainant, not the state. The “apprehension, confinement and removal” costs are to be paid by the consul, master, mate or other person at whose instance the seaman was apprehended. This reduces the incentive to use the process frivolously and ensures that the state does not bear the cost of enforcing private foreign maritime contracts.

The Act directly affects several classes of persons. Water police officers, superintendents, and members of the police force are the primary enforcers under Part I; they are given a warrantless power of entry and search over vessels in Victorian ports and harbours. Masters of vessels are the most directly burdened: under s 4 they face liability for resisting or obstructing a search, and under Part II they may be the applicant for a warrant (s 9) or the subject of a search if their vessel is suspected of harbouring a runaway seaman. Masters of foreign vessels may also be the person at whose instance a seaman is apprehended, making them liable for expenses under s 13. Seamen themselves are the object of the Act: they may be searched for, apprehended, and brought before a court. The Act does not confer any positive rights on seamen, though the requirement that an apprehended seaman be brought “with all convenient speed before a bail justice or the Magistrates’ Court to be dealt with according to law” (s 9) implies a right to a hearing. Foreign consuls are central to Part II: they must give written assent for warrants and prosecutions (s 10), they may certify documents (s 12), and they may be liable for expenses (s 13). The Act effectively deputises consuls as gatekeepers for enforcement. Anyone who harbours, conceals, employs, retains, or assists a foreign deserting seaman is caught by s 11: this includes employers (including shipowners, stevedores, and shore-based employers), boarding-house keepers, family members, and even friends who knowingly provide shelter or employment. The broad language also catches those who “by words” induce a seaman to leave his vessel, which could include union organisers, lawyers, or activists who advise a seaman that he has grounds to break his contract. The Magistrates’ Court and bail justices are the judicial bodies that issue warrants and hear matters. The Governor in Council is involved in the reciprocity mechanism under s 10, by publishing notifications in the Government Gazette. The Police Superannuation Fund receives penalties from Part I (s 4). The Act implicitly affects ship owners and charterers who may lose crew members to desertion and who rely on the state to recover them. It also affects the maritime industry more broadly by imposing a compliance burden on any business that might unknowingly employ a foreign deserting seaman.

Part I imposes a duty on every master and other person not to resist or wilfully obstruct a water police officer or assistant while searching for or endeavouring to secure any seaman or other person on board a vessel, or in any house or place on shore, and not to rescue or attempt to rescue or assist any such seaman or other person (s 4). This duty is backed by criminal penalty. The water police have a right to board and search vessels on reasonable grounds (s 3). There is no duty on the water police to obtain a warrant, nor any requirement to give reasons, though the reasonableness standard provides a limited check.

Part II imposes duties on persons not to harbour, conceal, employ, retain or assist foreign deserting seamen, and not to induce or cause such a seaman to violate his service agreement (s 11). This duty is also criminal. A master of a foreign vessel has a right to apply to a magistrate for a warrant to search for a runaway seaman (s 9). The master must provide evidence on oath, affirmation or affidavit that he has “good cause for suspecting” that the seaman is harboured, secreted or concealed on a vessel or in a house or place. The magistrate then has discretion to issue a warrant. The consul of the vessel’s nation has a right to consent or withhold consent for enforcement (s 10), which effectively gives consuls a veto over Part II proceedings unless reciprocal arrangements are in place. The consul also has a right to certify documents as true copies and to provide certificates on the meaning of foreign law, which are then admissible as evidence (s 12).

The apprehended seaman has a right to be brought with all convenient speed before a bail justice or the Magistrates’ Court (s 9). The Act does not specify what happens after that: “to be dealt with according to law” presumably refers to the general law of desertion, which may involve returning the seaman to the vessel or imposing penalties. The seaman has no right under the Act to contest the consul’s certificate or the master’s evidence, though the court’s discretion to receive evidence not admissible under strict rules (s 12) could work either for or against him. The person at whose instance the seaman is apprehended has a duty to pay all incidental expenses of apprehension, confinement and removal (s 13), and no right to seek reimbursement from the state or from the seaman. Service of proceedings may be effected by leaving the summons or other matter on board the vessel with the person appearing to be in command or charge (s 14); the person served does not have a right to personal service only.

Penalties under the Act are modest by modern standards. For a first offence of resisting or obstructing a search, or of rescuing a seaman, the penalty is not more than $40 (s 4). For a second or subsequent offence, the penalty is not less than $20 and not more than $100. In default of payment, imprisonment for a term of not more than six months is available. All penalties under s 4 are paid to the Police Superannuation Fund. For harbouring, concealing, employing, retaining, inducing or assisting a foreign deserting seaman (s 11), the penalties are identical: not more than $40 for a first offence, and not less than $20 nor more than $100 for a second or subsequent offence, with default imprisonment of up to six months. These amounts were originally in pounds and were converted to dollars under the Decimal Currency Act 1965; they have not been increased since the 1960s, so their real value has eroded substantially. The maximum fine of $100 is trivial by current standards. The imprisonment sanction in default provides some teeth, but even six months is a relatively short term.

Enforcement is primarily through the police (water police and general police) who can initiate searches and arrests under Part I, and through magistrates who issue warrants under Part II. Private prosecutions by masters or consuls are theoretically possible under Part II, given that s 10 restricts prosecutions but does not specify who may prosecute. The venue is the Magistrates’ Court. There is no provision for jury trial. The burden of proof is criminal (the Act creates offences), though the evidentiary relaxations in s 12 assist the prosecution. The Act does not create any civil liability or private right of action; remedies are limited to criminal penalties.

Enforcement under Part II is conditional on consul involvement or reciprocity. Without the consul’s written assent or a Gazette notification, no warrant may be issued and no offence prosecuted (s 10). This is a significant procedural barrier. In practice, many foreign states may not have requested enforcement, so desertions from their vessels may go unpunished. The expense provision in s 13 also deters enforcement: the applicant must pay the costs of apprehension, confinement and removal. This shifts the financial burden from the state to the private party (consul or master), which may discourage trivial or speculative applications. The scheme is thus a cost-recovery model: the state provides the legal machinery, but the complainant bears the cost.

The Seamen’s Act 1958 is a state law operating in the field of maritime affairs, which is predominantly regulated by the Commonwealth under section 51(i) of the Constitution (trade and commerce with other countries and among the States). To the extent of any inconsistency, the Commonwealth Navigation Act 2012 and the Seafarers Act 1975 would prevail. The Act does not explicitly refer to any Commonwealth legislation, so its continued operation depends on the absence of direct inconsistency. Since the Act deals with policing in ports and harbours and with foreign seamen deserting in Victoria, it may be complementary to Commonwealth laws rather than conflicting. The Act also interacts with Victorian criminal law generally: for example, a person who obstructs a water police search under s 4 could also be charged with common law obstructing police, though the specific provision would likely be preferred. The penalty amounts are low and may not be updated, which could create disparity with more recent offences.

The Act’s provisions on evidence in s 12 are less restrictive than the Evidence Act 2008 (Vic). Section 12 allows the court to receive proof that would not be admissible under strict rules of law, and allows consul certificates as prima facie evidence. This may override the general rules of evidence in proceedings under Part II. There is no conflict provision, so the court would likely treat s 12 as a special evidentiary regime for these specific proceedings. The Act also interacts with the Magistrates’ Court Act 1989 (Vic), which governs the jurisdiction and procedure of the Magistrates’ Court. References to “Magistrates’ Court” in the Act (ss 9, 12) are to the court as constituted under that Act. The Act’s removal of the requirement to call attesting witnesses (s 12) overrides the common law best evidence rule.

The definition of “foreign vessels” as “all vessels not belonging to any British possession” (s 5) is anachronistic. Since the Statute of Westminster 1931 and the Australia Act 1986, Australia is not a British possession. Vessels registered in Australia are not within that definition, so Part II does not apply to desertions from Australian-flagged vessels. For vessels from other non-British countries (i.e., almost all countries), the definition covers them. The reciprocity mechanism under s 10 likely interacts with international consular conventions and bilateral agreements, though the Act itself does not refer to any. The Governor in Council’s power to notify in the Gazette that a foreign government desires enforcement is a form of executive act giving effect to diplomatic arrangements.

The Act received assent on 30 September 1958 and commenced on 1 April 1959. Since then, it has been amended by five Acts, none of which made substantial substantive changes. The Decimal Currency Act 1965 (No. 7315) converted monetary penalties from pounds to dollars, resulting in the present amounts of $40 and $100. The Seamen’s (Amendment) Act 1972 (No. 8242) repealed sections 6, 7 and 8 in their entirety and amended section 10. Sections 6‑8 are not reproduced in the current version, and their content is lost from the published text. The 1972 amendment also modified the restriction on warrants in s 10. The Penalties and Sentences (Amendment) Act 1983 (No. 9945) amended sections 4 and 11, likely to standardise penalty language or amounts, though the effect is not detailed in the table. The Magistrates’ Court (Consequential Amendments) Act 1989 (No. 57/1989) updated references from “Police Magistrate” or “Justice” to “Magistrates’ Court” and “magistrate” throughout the Act, reflecting the restructuring of the Victorian court system. This Act also removed the term “bail justice” from s 9. The Honorary Justices Act 2014 (No. 32/2014) amended s 3, presumably to update references to honorary justices or water police. The Oaths and Affirmations Act 2018 (No. 6/2018) amended s 9 by adding “or by affirmation or by affidavit” to the evidence on which a magistrate can issue a warrant, aligning the Act with modern oath and affirmation laws. All amendments are in operation; there are no amendments not in operation at the date of publication (1 March 2019). The Act remains substantially as enacted in 1958, with only cosmetic, decimal-currency, court-name and procedural updates. No substantive modernisation of penalties, definitions or enforcement mechanisms has occurred.

The Act itself contains no references to case law, and no reported decisions are cited in the endnotes or explanatory details. The short, antiquated nature of the statute suggests it has seldom been litigated. Part II, in particular, appears to be a relic of an era when deserting foreign seamen were a common concern in Victorian ports; modern port security and Commonwealth maritime regulation may have rendered it largely unused. The requirement of consul consent and the expense burden under s 13 further reduce the incentive to invoke the Act. There is no recorded constitutional challenge to the Act’s validity. The absence of litigation history may also reflect the low penalties: parties have little incentive to appeal or seek judicial review. The evidentiary relaxations in s 12 have not been interpreted by any superior court, so their meaning remains untested. The interaction with Commonwealth law has not been resolved in litigation. Overall, the Act is a dormant statute that has generated no significant case law. Practitioners should be aware, however, that absence of reported decisions does not mean the Act is unenforceable; it means that any prosecution under it would likely be a matter of first impression for the relevant court.

Several features of the Act can trap the unwary. First, the definition of “foreign vessel” (s 5) refers to “all vessels not belonging to any British possession”. Under current law, Australia is not a British possession, so vessels registered in Australia are not foreign vessels. However, vessels registered in the United Kingdom are: the United Kingdom is not a British possession either (it is the former colonising power), so the phrase “British possession” is ambiguous. The term historically meant any colony or territory under British sovereignty. Since the UK is not a possession but the sovereign itself, UK-registered vessels may or may not be caught. The safer view is that the definition was intended to cover all non-Australian vessels, but that is not what the text says. A vessel registered in a British Overseas Territory might be a “British possession”. This uncertainty could lead to jurisdictional disputes.

Second, the penalty amounts are extremely low and have not been adjusted for inflation since the 1960s. A $40 fine today is trivial, which may lead to under-deterrence or to a perception that the Act is a dead letter. However, the imprisonment in default (up to six months) is still real, and a person could theoretically be jailed for non-payment of a tiny fine. This creates a risk of disproportionate enforcement.

Third, the harbouring offence under s 11 is very broad. It covers “causes, induces or persuades any such seaman by words or by any other means whatsoever to violate any agreement”. This could catch a lawyer who advises a seaman that he is free to leave a dangerous work environment, or a community organiser who assists a seaman seeking asylum. The provision has no exception for good faith advice or humanitarian assistance. The phrase “knowingly” provides some protection, but it only requires knowledge that the seaman is a foreign seaman who has deserted or absconded; it does not require knowledge that the advice will violate an agreement.

Fourth, the search power under s 3 is warrantless. Water police may board and search any vessel on “reasonable ground for believing such search to be necessary in the execution of his duty”. This is a subjective standard that could be abused. There is no requirement to specify which seaman is sought or to limit the scope of the search. This power could be used to search vessels for any seaman-related purpose, potentially without clear cause.

Fifth, s 12 allows the court to receive evidence “not admissible according to the strict rules of law”. This is a drastic relaxation that could permit hearsay, opinion, or even illegally obtained evidence. While it assists enforcement, it raises fairness concerns for the seaman.

Sixth, s 13 makes the applicant (consul, master, etc.) liable for all expenses of apprehension, confinement and removal. This includes not only police costs but presumably also food, lodging and transport. The cost could far exceed the penalty, creating a disincentive to invoke the Act but also potentially trapping a master who genuinely needs a seaman returned.

Seventh, service under s 14 is good if left on board the vessel with the person appearing to be in command or charge. This could be effective even if that person is not the master and even if the summons is not passed on. A seaman could be convicted in his absence.

Eighth, the Act does not specify a limitation period for prosecutions. The general six-month limit for summary offences under the Criminal Procedure Act 2009 (Vic) would likely apply, but this is not stated.

Compliance with the Act depends on one’s role. A water police officer or police member should ensure that any boarding or search under s 3 is based on “reasonable ground” that it is “necessary in the execution of his duty”. This is a lower threshold than probable cause but must be more than a hunch. The officer should document the grounds contemporaneously. An officer should not use the power for unrelated purposes such as customs inspections. A master or any person on board a vessel should not resist, obstruct, or interfere with a lawful search under Part I. The penalty for obstruction applies even if the search later turns out to have been unlawful; the correct course is to protest and challenge later.

A master of a foreign vessel who believes a seaman has deserted and is being harboured should first contact the consul of the vessel’s flag state. The consul must give written assent (s 10) before a warrant can be sought. The master should then provide the magistrate with evidence on oath, affirmation or affidavit of “good cause” to suspect the seaman is in a particular place (s 9). The master should also be prepared to pay all expenses under s 13, including police costs, prison costs, and removal costs. The master should have the ship’s list, roll, articles or agreement ready, and a consul-certified copy would be helpful.

A person who encounters a foreign seaman who appears to have left his vessel should exercise caution. Knowing employment, harbouring, concealment, or assistance in desertion is an offence. The safest course is to contact the local police or the consul of the flag state and avoid any act that could be construed as encouraging the seaman to violate his agreement. This includes verbal encouragement; even words of sympathy could be caught. If the seaman is in distress, humanitarian assistance that does not involve harbouring (e.g., calling an ambulance) may be defensible, but the Act provides no explicit exemption. Legal advice should be sought before providing accommodation or employment.

A consul seeking to enforce a master’s request should provide written assent and ensure the master’s evidence is sufficient. The consul should also certify documents under s 12 to facilitate proof. The consul should verify the reciprocity status: if the consul’s country has not requested enforcement and no Gazette notification exists, the warrant cannot be issued. The consul should also be prepared to pay expenses, though reimbursement from the shipowner may be arranged separately.

A court or bail justice receiving an application under s 9 should verify that the consul’s assent or Gazette notification exists (s 10) and that a warrant is justified. The court can admit relaxed evidence under s 12 but should be mindful of fairness to the seaman. The court should ensure the seaman is brought before it promptly.

A person who is being served under s 14 should note that service is valid if left with the person “appearing to be in command or charge” of the vessel. If served, the person should respond and not ignore the proceedings.

Overall, because the Act is old and rarely enforced, the most pragmatic compliance advice is to be aware of its existence and to consult experienced maritime counsel before engaging in any conduct that could intersect with its provisions.
