Seafood Safety Regulations 2024

The Regulations turn on three main legal concepts: (1) exemption from a statutory licensing requirement, (2) the species‑and‑activity linkage, and (3) condition of compliance with Fisheries Act 1995 licences or permits.

1. Exemption from Part 3 of the Seafood Safety Act 2003. The Regulations’ primary legal effect is to exempt certain persons from the operation of Part 3 of the Seafood Safety Act 2003 (regulation 1). The instrument does not repeal Part 3; it disapplies its operation to defined activities undertaken in circumstances set out in regulations 6-8. The text uses the phrase "exempt from the operation of Part 3 of the Act" (regulations 6(1), 7(1), 8(1)).

2. Species and activity lists. For each species group the instrument specifies a closed list of activities which, if undertaken, may be exempted: aquaculture (yabbies only), harvesting, collecting, maintaining live for later processing, and packaging, storing and transporting live product either for later processing or, for yabbies, for retail sale at the place of aquaculture production (regulations 6(2), 7(2), 8(2)). The lists are the operative boundaries of the exemption: a person’s activities must match the enumerated activities to rely on the exemption.

3. Condition of Fisheries Act authority. Each exemption is conditional on carrying out the relevant activities "in accordance with" a particular Fisheries Act 1995 instrument. For yabbies the condition is a "licence or permit" under the Fisheries Act (regulation 6(1)); for abalone and rock lobster the condition is an "access licence" under the Fisheries Act (regulations 7(1) and 8(1)). The phrasing "in accordance with" links the validity of the exemption to the scope and terms of the Fisheries Act instrument; the Regulations do not define those licence types or their terms, but make the exemption contingent on compliance with them.

Ancillary interpretive entries are in the Endnotes. The instrument notes it was made by Governor in Council under the Seafood Safety Act 2003 (Endnotes, General information) and that standard interpretive rules under the Interpretation of Legislation Act 1984 apply to style and headings (Endnotes, Interpretation of Legislation Act 1984). The instrument has a fixed sunset date: ten years after making (Endnotes, General information).

The Regulations affect persons conducting seafood businesses in relation to three specified types of live seafood: yabbies, abalone and rock lobster. The relevant persons are those whose operations involve the enumerated activities in each species schedule and who operate under a Fisheries Act 1995 licence, permit or access licence that covers those activities.

• Yabbies. The Regulation expressly affects persons who conduct a seafood business "in relation to live yabbies" and who carry out one or more of the activities in regulation 6(2). The exemption applies only where those activities are carried out in accordance with a licence or permit under the Fisheries Act 1995 (regulation 6(1)). The yabbies group includes aquaculture operators, harvesters and collectors, and persons who maintain, pack, store or transport live yabbies either for later processing or for retail sale at the place of aquaculture production (regulation 6(2)).

• Abalone and rock lobster. The Regulations affect persons conducting seafood businesses in relation to abalone or rock lobster who perform the listed activities , harvesting, collecting, maintaining live for later processing, packaging, storing and transporting live product for later processing , and who do so in accordance with an access licence under the Fisheries Act 1995 (regulations 7(1)-(2), 8(1)-(2)). The instrument therefore targets fishers and other operators who hold an access licence under the Fisheries Act 1995.

Who does not obtain an exemption under these Regulations? The instrument itself creates no exemption outside the enumerated species and activities. Persons conducting seafood businesses involving other species, or involving retail sale of abalone or rock lobster (the Regulations do not include retail sale at place of production for those species), or undertaking activities not listed (for example, processing for retail sale rather than later processing) are not addressed by the exemptions in regulations 6-8 and therefore remain subject to Part 3 of the Seafood Safety Act 2003 unless another exemption applies.

Indirectly affected parties include regulators and compliance officers under both Acts: the Fisheries Act 1995 licensing authorities will be the instrument that determines whether a person is "in accordance with" the required licence; the Seafood Safety Act 2003 regulators will need to recognise the exemption in enforcement decisions concerning Part 3 obligations. The Endnotes indicate the instrument will sunset in ten years, which affects long‑term planning for the regulated sector (Endnotes, General information).

Duties and rights created or altered by the Regulations are expressed as negative obligations (exemptions) conditional on compliance with Fisheries Act instruments and on confinement to enumerated activities.

• Duty to hold or comply with Fisheries Act licence/permit. The Regulations grant the exemption only if the person "carries out those activities in accordance with" the relevant Fisheries Act licence, permit or access licence (regulations 6(1), 7(1), 8(1)). That creates a practical duty on the person to hold and act consistently with the terms of the Fisheries Act instrument that is specified. The Regulations do not define the content of that duty; the detail will derive from the Fisheries Act 1995 authority.

• Right not to need a seafood licence under Part 3. The primary legal right established by the Regulations is that, when the conditions are met, the person is not required to obtain a seafood licence under Part 3 of the Seafood Safety Act 2003 (regulation 1 and regulations 6-8). This is a removal of an obligation that would otherwise apply under Part 3; the right applies only to the specific activities and species listed.

• Boundaries of permitted activities. The Regulations enumerate the permitted activities for each species group. For yabbies the enumerated activities include aquaculture, harvesting, collecting, maintaining live yabbies for later processing, and packaging, storing and transporting live yabbies either for later processing or for retail sale at the place of aquaculture production (regulation 6(2)). For abalone and rock lobster the enumerated activities are harvesting, collecting, maintaining live for later processing, and packaging, storing and transporting live for later processing (regulations 7(2) and 8(2)). Rights under the exemption do not extend beyond these activities.

• Interaction with other statutory duties. The Regulations do not state that other obligations under the Seafood Safety Act 2003 or other laws are removed. The text confines the exemption to "the operation of Part 3 of the Act" (regulation 1 and repeated in regs 6(1), 7(1), 8(1)). That implies that duties located in other Parts of the Seafood Safety Act or obligations under other laws are not displaced by these Regulations; the instrument contains no express modification of other duties.

• Temporal limits. The exemption is effective from commencement (22 September 2024) and, as a subordinate instrument, will sunset on 17 September 2034 unless remade or otherwise extended (Endnotes, General information). That creates a timebound right to operate without a seafood licence under Part 3, contingent on maintaining Fisheries Act compliance throughout.

• Revocation of earlier instruments. The Regulations revoke the Seafood Safety Regulations 2014 and the Seafood Safety Amendment Regulations 2018 (regulation 4). Any rights or duties that flowed specifically from those earlier Regulations are therefore removed and replaced by the current instrument; the text contains no transitional provisions.

The Regulations themselves do not create new offences, penalties, or explicit enforcement mechanisms. They function by excluding the operation of Part 3 of the Seafood Safety Act 2003 for specified persons and activities where the condition of Fisheries Act authorisation is met (regulations 6(1), 7(1), 8(1)). The statutory text therefore has a negative enforcement footprint: rather than imposing additional criminal or civil penalties, it removes an existing licensing requirement for qualifying persons.

Practical enforcement consequences flow from that design:

• Enforcement of Part 3 obligations. Where a person fulfils the conditions of an exemption, regulatory action under Part 3 of the Seafood Safety Act 2003 (for failure to hold a seafood licence) will not apply. The Regulations do not specify how regulators are to determine whether the person is "in accordance with" a Fisheries Act instrument; that determination is likely to be made against the Fisheries Act licence terms and records, but the Regulations themselves do not state an evidentiary or enforcement standard.

• Fisheries Act enforcement. Because the exemptions are expressed as conditional on compliance with Fisheries Act instruments, compliance and enforcement in practice will be tied to the Fisheries Act 1995 licensing regime. The Regulations indicate no power to enforce Fisheries Act licences; those powers remain with the Fisheries Act framework. The Regulations do not cross‑reference specific enforcement provisions of the Fisheries Act 1995; they merely make the exemption contingent on being in accordance with the relevant licence or permit (regulations 6(1), 7(1), 8(1)).

• Absence of penalty provisions in the Regulations. There is no penalty listed in the Regulations for carrying out non‑enumerated activities or for operating without the Fisheries Act instrument but purporting to rely on the exemption. Instead, absence of the required Fisheries Act licence or failure to carry out activities "in accordance with" the Fisheries Act instrument will mean the person cannot claim the exemption and so remains subject to Part 3 of the Seafood Safety Act 2003; any penalties would therefore be those provided by the Seafood Safety Act 2003 and the Fisheries Act 1995 where applicable, but those are not reproduced or altered in the Regulations.

• Administrative enforcement risk and evidentiary burden. Regulators applying Part 3 obligations or checking entitlement to the exemption will need to establish whether activities match the enumerated list and are "in accordance with" the Fisheries Act instrument. The Regulations do not prescribe recordkeeping, reporting or proof standards to demonstrate that a person is compliant with Fisheries Act licence terms; establishing compliance will rely on the general enforcement mechanisms of the Fisheries Act 1995 and the Seafood Safety Act 2003 as they stand.

• Revocation and sunset. The Regulations revoke earlier subordinate legislation (regulation 4) and will sunset ten years after making (Endnotes). Temporal limits can affect enforcement planning for agencies, which must track the instrument’s lifecycle.

In sum, the instrument delegates regulatory primacy for the specified activities to the Fisheries Act licensing architecture by making the exemption contingent on fisheries authority; the Regulations do not add stand‑alone penalties or enforcement rules.

The Regulations are explicitly designed to operate alongside the Seafood Safety Act 2003 and the Fisheries Act 1995; they also sit within the subordinate legislation architecture governed by the Subordinate Legislation Act 1994 and are subject to interpretive conventions under the Interpretation of Legislation Act 1984.

• Seafood Safety Act 2003. The Regulations are made under sections 8(3) and 61 of the Seafood Safety Act 2003 (regulation 2) and they explicitly exempt qualifying persons from the operation of Part 3 of that Act (regulation 1; regulations 6(1), 7(1), 8(1)). The Regulations therefore alter the application of the Seafood Safety Act for certain activities and species, rather than amending the Act. They do not purport to alter or remove obligations located outside Part 3; the text confines the exemption to "the operation of Part 3 of the Act" (regulation 1).

• Fisheries Act 1995. The exemptions are conditional on compliance with Fisheries Act 1995 authorization. Yabbies: "in accordance with a licence or permit under the Fisheries Act 1995" (regulation 6(1)). Abalone and rock lobster: "in accordance with an access licence under the Fisheries Act 1995" (regulations 7(1) and 8(1)). This creates a cross‑statutory dependency: the availability of the exemption depends on the existence and terms of Fisheries Act instruments. The Regulations do not define the terms of those licences or permits; they import that normative content by reference.

• Subordinate Legislation Act 1994. The Endnotes note the instrument will sunset ten years after making under section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). That statutory framework imposes a temporal constraint on the Regulations, requiring review or remaking if they are to persist beyond the sunsetting date.

• Interpretation of Legislation Act 1984. The Endnotes set out that style changes authorised by the ILA and certain interpretive rules (headings, examples, punctuation and provision numbering) apply to the Statutory Rule (Endnotes, Interpretation of Legislation Act 1984). That means the form and structure of the Regulations should be read with those interpretive conventions in mind.

• Revoked subordinate instruments. The Regulations revoke the Seafood Safety Regulations 2014 and the Seafood Safety Amendment Regulations 2018 (regulation 4). Any regulatory interaction that arose from the revoked instruments ceases; the current instrument replaces them. The Explanatory details at the end of the text list the revoked instruments and their SR numbers.

• Unchanged statutory regimes. The Regulations do not expressly modify the enforcement, offence or penalty schemes of either the Seafood Safety Act 2003 or the Fisheries Act 1995. They operate by disapplying Part 3 to qualifying persons; consequential regulatory responsibilities (inspections, compliance actions) remain with the competent statutory regimes referenced, although the Regulations do not cross‑reference the substantive enforcement provisions of those Acts.

In short, the Regulations create a bridge: they shift the compliance gatekeeping for specified live seafood activities from Part 3 permitting under the Seafood Safety Act to the Fisheries Act licence architecture, but leave the substantive Fisheries Act and Seafood Safety Act provisions otherwise intact.

The instrument is a replacement for earlier subordinate rules and carries a simple amendment history in the text.

• Revocation of prior instruments. Regulation 4 revokes: (a) the Seafood Safety Regulations 2014 (S.R. No. 136/2014 as amended) and (b) the Seafood Safety Amendment Regulations 2018 (S.R. No. 51/2018). The Explanatory details at the end identify those SR numbers in the footnotes (Explanatory details 1).

• No subsequent amendments. The Table of Amendments (Endnotes, Table of Amendments) records that there are no amendments made to the Seafood Safety Regulations 2024 by statutory rules, subordinate instruments or Acts. That means, as of the consolidated version dated 22 September 2024, the instrument has not been amended since it was made.

• Making and commencement dates. The Endnotes record that the Regulations were made on 17 September 2024 by the Governor in Council under sections 8(3) and 61 of the Seafood Safety Act 2003 and came into operation on 22 September 2024 (Endnotes, General information). Regulation 3 also records the commencement date as 22 September 2024.

• Sunset provision. The Endnotes state the Seafood Safety Regulations 2024 will sunset 10 years after the day of making on 17 September 2034 under section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). That sunset requirement is a function of the Subordinate Legislation Act rather than of the Regulations themselves, but it affects the lifecycle and any future amendment or remaking timetable.

• Style and interpretive updates. The Endnotes include material about the Interpretation of Legislation Act 1984 and the application of style changes and interpretive conventions. Those are not amendments to content but affect how the Regulations are to be read and printed.

The instrument does not include transitional provisions, savings clauses, or staged implementation steps; it simply revokes the earlier subordinate instruments and establishes the new scheme effective from the commencement date. The absence of recorded amendments to date means the text in force is the original SR No. 87/2024 text as at 22 September 2024.

The text contains no references to court decisions, judicial interpretation, or any ongoing litigation concerning these Regulations. The Explanatory details and Table of Amendments contain only legislative and administrative metadata and do not cite case law. The instrument does not identify any legal challenges, declaratory proceedings, or tribunal matters.

Practically, given the instrument came into operation on 22 September 2024 and revokes earlier subordinate instruments, any litigation history related to the subject matter would need to be sought in public law or regulatory enforcement records under the Seafood Safety Act 2003 and the Fisheries Act 1995. The Regulations themselves do not record or instantiate such history.

If a practitioner needs to assess current litigation or precedent that might affect interpretation of what it means to conduct activities "in accordance with" a Fisheries Act licence, or to determine the boundary between Part 3 obligations and the exemptions, that material is not present in the instrument and must be sourced from judicial or tribunal authorities and the statutory text of the Acts referenced.

The Regulations are tightly drafted and several precise limitations and conditions can be operationally significant. These are the main practical traps to watch for when advising clients or assessing compliance risk.

1. Exemption is conditional, not automatic. The Regulations exempt only persons who carry out the enumerated activities "in accordance with" the specified Fisheries Act instrument (regulations 6(1), 7(1), 8(1)). That phrase imports the terms, scope, limitations and conditions of the Fisheries Act licence or permit. Holding a Fisheries Act licence that does not authorise the particular activity, or acting outside the licence conditions, will mean the person cannot rely on the exemption.

2. Narrow activity lists. The exemption applies only to the listed activities. For example, the abalone and rock lobster exemptions cover packaging, storing and transporting live product "for later processing" but say nothing about packaging, storing or transporting for retail sale at the place of production (regulations 7(2)(d), 8(2)(d)). By contrast, the yabbies exemption expressly covers retail sale at the place of aquaculture production (regulation 6(2)(e)(ii)). The asymmetry matters: a business that wishes to sell live abalone or rock lobster at the place of production may not be covered by these exemptions and could still need a seafood licence under Part 3.

3. Species limitation to "live" product. The Regulations frame the exemptions in relation to "live yabbies" (regulation 6 heading and text) and specify maintaining live abalone and rock lobster for later processing (regulations 7(2)(c), 8(2)(c)). If a business deals in processed or dead product, the text does not expressly extend the exemption. The instrument therefore appears targeted at the live product supply chain.

4. No express transitional arrangements. Regulation 4 revokes earlier subordinate legislation but the text contains no transitional or savings provisions. Operators transitioning from the old regulatory regime to this one should not assume automatic continuance of prior approvals or conditions; they must check whether their operations now sit within the new exemptions and ensure Fisheries Act licensing alignment.

5. No express evidentiary or recordkeeping requirements. The Regulations do not prescribe what evidence demonstrates that activities are being carried out "in accordance with" a Fisheries Act instrument. That creates an evidentiary risk: in enforcement or dispute contexts, a regulator may require proof from the operator, but the Regulations do not state what form that proof should take. Practitioners should therefore expect to rely on Fisheries Act licence documents, logs and other operational records when demonstrating entitlement to the exemption.

6. Revocation of prior instruments. The revocation of the 2014 Regulations and the 2018 amendment (regulation 4) means any regulatory concessions or processes that existed under those instruments may no longer apply. The Regulations do not reproduce any prior policy detail that those instruments contained; operators must verify the content of the new instrument against any long‑standing compliance arrangements.

7. Temporal risk from sunset. The Endnotes specify a sunset date of 17 September 2034. That creates medium‑term regulatory uncertainty for businesses whose operational models depend on the exemption, as the exemption will cease unless remade or otherwise preserved. Long‑term contractual commitments relying on the exemption should account for this limit.

8. No change to other Parts of the Act. The exemption is expressly limited to Part 3 of the Seafood Safety Act 2003 (regulation 1 and repeated in regs 6-8). Any obligations in other Parts of the Seafood Safety Act, or in other statutes (for example, food safety, biosecurity, workplace safety), are not addressed and may continue to apply.

9. Differences between "licence or permit" and "access licence". The instrument treats yabbies differently by requiring a "licence or permit" under the Fisheries Act for yabbies (regulation 6(1)), whereas abalone and rock lobster require an "access licence" under the Fisheries Act (regulations 7(1) and 8(1)). Practitioners must verify which Fisheries Act instrument is relevant to the operator’s activities; a mismatch may mean no exemption applies.

10. No penalty provisions in these Regulations. Because the Regulations do not set out offences or penalties, the enforcement consequences of non‑compliance will arise from the Seafood Safety Act 2003 and the Fisheries Act 1995 as applicable, which are not reproduced in the subordinate instrument. That can complicate assessments of liability and remedies if a person incorrectly relies on the exemption.

Each of these "gotchas" follows directly from the precise wording of regulations 1 and 6-8 and the Endnotes; they are practical points arising from the narrow scope, conditionality and structural design of the exemptions.

Compliance under these Regulations requires a twofold approach: (1) confirm that the enterprise and its activities fall squarely within the enumerated species and activities; and (2) ensure that those activities are carried out in accordance with the appropriate Fisheries Act 1995 instrument. The Regulations create no separate documentation or reporting regime; compliance will therefore follow from adherence to the Fisheries Act licence terms and careful internal recordkeeping aligned to the exemption conditions.

Practical steps:

1. Map species and activities to the Regulations. Identify whether the business deals in live yabbies, abalone or rock lobster and whether the specific operational activities match the lists in regulation 6(2), 7(2) or 8(2). Pay attention to the precise scope: for yabbies, packaging, storing and transporting live product is included for later processing or for retail sale at the place of aquaculture production; for abalone and rock lobster, packaging, storing and transporting live product is limited to the purpose of later processing (regulations 6(2)(e), 7(2)(d), 8(2)(d)). Document the mapping.

2. Verify Fisheries Act instrument type and terms. For yabbies, confirm there is a licence or permit under the Fisheries Act 1995 that covers the activities as conducted (regulation 6(1)). For abalone and rock lobster, confirm there is an access licence under the Fisheries Act 1995 authorising the activities (regulations 7(1) and 8(1)). Review the Fisheries Act licence conditions and ensure operational practices do not contravene them. Where the Fisheries Act licence imposes restrictions, ensure internal procedures enforce those restrictions.

3. Maintain contemporaneous evidence. Because the Regulations make entitlement conditional on acting "in accordance with" the Fisheries Act instrument, retain copies of the licence/permit/access licence, related correspondence with fisheries authorities, catch/harvest logs, transport and storage records, and processing schedules showing the product remains live until processing where applicable. The Regulations do not prescribe evidentiary standards; adequate records will reduce disputed compliance risk.

4. Segregate exempt and non‑exempt activities. If the business performs activities both covered and not covered by the exemptions (for example, processing seafood for retail sale where the exemption only covers later processing), operate separate workflows, facilities or documented controls to demonstrate which activities fall within the exemption and which remain subject to Part 3 licensing. The Regulations’ narrow lists mean mixed operations can create compliance friction.

5. Monitor licence currency and scope. Ensure Fisheries Act licences and permits remain current, renewed and updated as required. The exemption depends on acting "in accordance with" those instruments; expiry, suspension or variation of a Fisheries Act licence will affect entitlement to the exemption.

6. Check regulatory overlaps. Confirm obligations under other statutes and regulatory regimes (for example, food safety, biosecurity, workplace health and safety, transport rules) that apply irrespective of the Seafood Safety Act exemption. The Regulations only disapply Part 3; they do not remove other duties.

7. Plan for the sunset. The instrument will sunset ten years after making (Endnotes). For longer‑term investments or contractual commitments tied to the exemption, include contingency clauses or review timelines that account for the sunsetting of the Regulations on 17 September 2034 unless remade.

8. Seek clarity where licence scope is unclear. If it is uncertain whether a Fisheries Act licence authorises a particular activity, seek an administrative ruling from the fisheries authority or obtain legal advice. The Regulations do not provide a mechanism for resolving disputes about licence scope; practical compliance requires clarity on the Fisheries Act instrument.

9. Update internal compliance manuals and training. Embed the regulatory map, licence checklist and recordkeeping steps into the business’s compliance manual. Train staff responsible for harvesting, packing, transport and on‑site retailing (yabbies) to observe the difference between activities covered by the exemption and those which are not.

10. Consider contractual and supply‑chain implications. Where the business supplies processors, retailers or exporters, ensure counterparties understand whether the supplier relies on the exemption and can provide documentary proof of Fisheries Act authorisation. The Regulations do not affect third‑party obligations, but commercial counterparties may require assurances.

These compliance steps derive from the Regulations’ structure: the exemptions are conditional and narrowly defined in regulations 6-8, and the instrument contains no standalone procedural or evidentiary rules. Operators must therefore rely on the Fisheries Act licensing regime as the operative compliance gateway and ensure their activities match the enumerated list.
