Seafarers Rehabilitation and Compensation Levy Collection Regulations 2018

This instrument (the Seafarers Rehabilitation and Compensation Levy Collection Regulations 2018) prescribes procedural and record‑keeping rules that sit alongside the primary levy legislation referenced by the instrument. Mechanically, it does the following.

• Prescribes the Authority as the entity to receive returns and other information for the purposes of section 6 of the Seafarers Rehabilitation and Compensation Levy Collection Act 1992 (reg 6).
• Specifies the acceptable payment channels for levy receipts, limiting payment to cheque payable to the Authority or electronic funds transfer, for the purpose of paragraph 16(2)(a) of the Levy Act (reg 7).
• Confirms that the Authority may recover levy on behalf of the Commonwealth (reg 8), and that the Authority may refund any overpayment of levy on behalf of the Commonwealth (reg 9), pursuant to the relevant paragraphs of the Levy Act cited in the instrument.
• Imposes a specific register and record‑keeping obligation on employers: on the first day of each quarter the employer must record the name of each prescribed ship for which the employer employed or engaged seafarers, and the number of seafarer berths on each of those prescribed ships; records must be kept for five years from the day on which the employer became liable to enter the record (regs 10(1)-(2)).
• Confers a production power on the Authority to request, in writing, a copy of a required register and sets a minimum period of at least 14 days for compliance with such a request (regs 11(1)-(2)).
• Creates criminal liability for non‑compliance with the records and production requirements, with fixed penalties of 5 penalty units for failing to enter or keep records as required (reg 10(3)) and for failing to comply with a production request (reg 11(3)). The instrument states that strict liability applies to the element that a person is required to keep a register (reg 10(4)).
• Limits admissibility of information obtained from produced registers against an individual in criminal proceedings, except where the proceedings are for the record‑keeping or production offences created in the instrument or for specified offences in the Criminal Code (regs 11(4)-(5)).
• Repeals the Seafarers Rehabilitation and Compensation Levy Collection Regulations 2002 (Schedule 1), but saves particular old regulatory provisions for levy payable for quarters ending before commencement and maps old registers and pending requests into the new regime (regs 12-15, Schedule 1).

The instrument therefore does not restate levy incidence, rate structures, or substantive entitlement rules. Instead it prescribes who receives levy payments, how payments are to be made, who must keep what register information and for how long, how the Authority may demand production of those records, and transitional arrangements for moving from the 2002 collection regulations to this instrument (regs 3, 6-11, 12-15, Schedule 1).

The instrument introduces and operationalises a narrow set of administrative concepts tied to levy collection. Key concepts and their immediate operation under the instrument are as follows.

• Authority: The instrument prescribes "the Authority" for the purposes of section 6 of the Seafarers Rehabilitation and Compensation Levy Collection Act 1992 (reg 6). The instrument does not define the Authority further; it is an administratively central node under these regulations for receiving returns and handling payments, recovery and refunds (regs 6-9). The Authority is repeatedly specified as acting on behalf of the Commonwealth when recovering or refunding levy (regs 8-9).
• Levy payment channels: The instrument narrows acceptable payment mechanics to two methods: cheque payable to the Authority, or electronic funds transfer (reg 7). The regulation ties payment mechanics to the referenced paragraph of the Levy Act (paragraph 16(2)(a)).
• Recovery and refund powers: The Authority is explicitly empowered to recover levy payable under the Levy Act on behalf of the Commonwealth (reg 8), and to refund any overpayment of levy on behalf of the Commonwealth (reg 9). The instrument makes these administrative functions explicit without prescribing recovery procedures beyond granting the power.
• Register and record‑keeping: Employers must maintain a register identifying, for the first day of each quarter, the name of each "prescribed ship" for which they employed or engaged seafarers, and the number of "seafarer berths" on each of those ships (reg 10(1)). The instrument itself does not define "prescribed ship" or "seafarer berths"; those terms are used as operative inputs in the register requirement and will be defined elsewhere in the statutory architecture (reg 10).
• Retention period: Entries must be retained for five years after the day on which the employer became liable to enter the record (reg 10(2)). The instrument thereby ties record retention to the employer’s liability date rather than to the date of the entry itself.
• Production power and timing: The Authority may, by written request, require an employer to provide a copy of the register within a period specified in the request; the instrument mandates that the period be at least 14 days after the request is given (reg 11(1)-(2)).
• Offences and evidentiary rules: Failing to keep the register or failing to comply with a production request are criminal offences carrying a penalty of 5 penalty units (regs 10(3), 11(3)). The instrument asserts strict liability applies to the factual element that a person is required to keep a register (reg 10(4)). It also removes the right to refuse on self‑incrimination grounds for producing the register (reg 11(4)), while limiting admissibility of such material against an individual in criminal proceedings other than certain exceptions (reg 11(5)).

The instrument names four principal actor types and assigns discrete roles and obligations to each.

• Employers: Employers are the primary class of regulated persons under the instrument. An employer must keep a register recording, for the first day of each quarter, the name of each prescribed ship for which the employer employed or engaged seafarers, and the number of seafarer berths on each of those ships (reg 10(1)). Employers must retain those register entries for five years after the day on which the employer became liable to enter the record (reg 10(2)). Employers who fail to enter or retain records, where they are required to do so, commit an offence punishable by 5 penalty units (reg 10(3)). Employers may also be required to provide a copy of the register to the Authority on written request (reg 11(1)).
• The Authority: The instrument prescribes the Authority for purposes of receiving returns and other information (reg 6). The Authority is the designated recipient of levy payments by cheque or electronic funds transfer (reg 7). The Authority may recover levy payable under the Levy Act on behalf of the Commonwealth (reg 8) and may refund overpayments on behalf of the Commonwealth (reg 9). The Authority has the power to make written requests for copies of registers and to set the compliance period (subject to the minimum 14‑day requirement) (reg 11(1)-(2)).
• The Commonwealth: The instrument repeatedly frames recovery and refund powers as being exercised by the Authority on behalf of the Commonwealth (regs 8-9). The Commonwealth is therefore the ultimate beneficiary of recovered levy receipts and the party on whose behalf refunds are disbursed.
• Individuals (as distinct from corporate employers): The instrument treats individuals differently for evidentiary purposes when produced register material is concerned. While a person cannot refuse to provide a copy of the register on the basis that it might incriminate them (reg 11(4)), the instrument states that, in the case of an individual, the information contained in the copy, the giving of the copy, and any information obtained as a direct or indirect consequence of giving the copy is not admissible against the individual in criminal proceedings other than proceedings for an offence against section 10 or 11 of the instrument, or sections 137.1 or 137.2 of the Criminal Code in relation to giving the copy (reg 11(5)). Thus individuals have a limited evidentiary shelter in criminal proceedings, subject to specific exceptions.

Collateral impact: The instrument also has indirect impacts on any entity or person covered by the Seafarers Rehabilitation and Compensation Levy Act 1992 and the Seafarers Rehabilitation and Compensation Levy Collection Act 1992 because it defines collection mechanics and evidentiary rules underpinning levy enforcement (regs 3, 6-9). The instrument repeals the 2002 collection regulations and migrates ongoing registers and pending production requests into the new framework (regs 12-15, Schedule 1), so parties formerly operating under the old instrument are directly affected by the transitional mapping.

The instrument imposes specific duties and confers narrow rights. Below are the operative obligations and procedural rights, stated with the regulation references.

Primary duties on employers

• Maintain a quarterly register: An employer must keep a register that records, for the first day of each quarter, (a) the name of each prescribed ship for which the employer employed or engaged seafarers; and (b) the number of seafarer berths on each of those prescribed ships (reg 10(1)). That is a continuing duty tied to quarterly points in time.
• Retention: Record entries must be kept in the register for five years after the day on which the employer became liable to enter the record (reg 10(2)). The five‑year retention clock is expressly linked to the date of liability to enter the record, not to the date of the quarter or date of entry as written.
• Production on request: If the Authority issues a written request to an employer, the employer must provide a copy of the register within the period specified in the request, and the instrument requires that the period specified be at least 14 days from service of the request (regs 11(1)-(2)).
• Payment mechanics: Levy must be paid to the Authority by cheque payable to the Authority or electronic funds transfer (reg 7). While the instrument does not set who is liable to pay the levy in substantive terms, it prescribes the mechanics by which levy payments must be made.

Criminal offences and evidentiary constraints

• Offences for record‑keeping and production failures: An employer commits an offence if they are required to keep a register and fail to (i) enter a record as required or (ii) keep a record as required (reg 10(3)). The penalty is 5 penalty units (reg 10(3)). Failure to comply with a written request for production of a copy of the register is an offence with the same penalty (reg 11(3)).
• Strict liability: The instrument stipulates that strict liability applies to the element that a person is required to keep a register under subsection 10(1) (reg 10(4)). In practice, that reduces the prosecution burden on fault for the factual element of being required to keep the register.
• Self‑incrimination and admissibility: A person cannot decline to produce the register on the ground that doing so might incriminate them or expose them to a penalty (reg 11(4)). However, for individuals only, the instrument prevents admissibility of the information in criminal proceedings except for prosecutions under the instrument’s record‑keeping and production offences or specified Criminal Code offences related to giving the copy (reg 11(5)).

This instrument establishes a compact enforcement architecture consisting of criminal offences with fixed monetary penalties, an administrative production power, a strict liability rule for a specified element, and administrative recovery and refund powers exercised by the Authority.

Penalties

• Record‑keeping offence: Where a person is required to keep a register under reg 10(1), failure to either enter the required record or to keep the record as required is an offence carrying a penalty of 5 penalty units (reg 10(3)). The instrument does not set the monetary value of a penalty unit; that is supplied elsewhere in Commonwealth law.
• Production offence: Failure to comply with a written request to give a copy of a required register within the specified period is an offence carrying a penalty of 5 penalty units (reg 11(3)).

Enforcement mechanisms

• Production requests: The principal non‑coercive enforcement tool is a written request from the Authority requiring an employer to provide a copy of the register (reg 11(1)). The instrument mandates a minimum compliance period of 14 days after service of the request (reg 11(2)). The instrument does not include administrative search, seizure or warrant powers; it relies on statutory duty to produce and criminal penalties for non‑compliance.
• Recovery and refund operations: The Authority is expressly able to recover levy payable under the Levy Act on behalf of the Commonwealth (reg 8). It is also empowered to refund any overpayment on behalf of the Commonwealth (reg 9). The instrument does not prescribe the recovery mechanisms or administrative processes; it allocates the recovery and refund functions to the Authority and links them to the Levy Act provisions cited.
• Strict liability: The instrument applies strict liability to the element that a person is required to keep a register under reg 10(1) (reg 10(4)). As drafted, strict liability does not apply to the entire offence wording in reg 10(3) but to the factual predicate set out in reg 10(3)(a). That means in prosecutions for failing to enter or keep records, the Crown does not need to prove fault as to the factual question of whether the person was required to keep a register; other elements remain subject to normal criminal proof requirements.
• Evidentiary limitation and compelled production: The instrument removes the right to refuse production on self‑incrimination grounds (reg 11(4)). For individuals, the instrument protects against admissibility of the information in criminal proceedings except where the proceedings are for the instrument’s own offences (regs 10-11) or for specified Criminal Code offences in relation to giving the copy (reg 11(5)). That creates a narrowly framed compelled‑production regime with limited protections for individuals against use of the material in criminal proceedings.

The instrument is an ancillary, collection‑oriented regulation and expressly interacts with several external statutory texts; it also leaves substantive elements to those texts.

Statutory base and cross‑references

• Primary enabling Acts: The instrument is made under the Seafarers Rehabilitation and Compensation Levy Collection Act 1992 (reg 3). It also repeatedly references the Seafarers Rehabilitation and Compensation Levy Act 1992 (defined in reg 5 as the "Levy Act"), linking its collection mechanics to substantive levy provisions in those Acts.
• Specific cross‑references to the enabling legislation: The instrument prescribes the Authority for the purposes of section 6 of the Collection Act (reg 6), and it implements the payment method requirement under paragraph 16(2)(a) and recovery/refund powers under paragraphs 16(1)(b) and 16(2)(b) of the Levy Act (regs 7-9). The instrument therefore functions as a procedural implementation instrument for particular paragraphs of the Levy Act cited in the regulations.
• Criminal Code references: The instrument limits admissibility of information derived from produced registers in criminal proceedings except for proceedings under the instrument’s sections 10 or 11, or for offences under sections 137.1 or 137.2 of the Criminal Code in relation to giving a copy of the register (reg 11(5)). Those Criminal Code sections are referenced as exceptions to the evidentiary protection provided to individuals.

Interaction with prior regulations

• Repeal and savings: The instrument repeals the Seafarers Rehabilitation and Compensation Levy Collection Regulations 2002 (Schedule 1). However, regulations 4, 5 and 7 of the old regulations are preserved in relation to levy payable for a quarter ending before commencement (reg 13). The instrument maps registers kept under the old regulations into the new regime and carries over pending requests (regs 14-15). Practitioners must therefore consult the old regulations for the saved items where they concern pre‑commencement quarters; the instrument does not reproduce the content of the saved old regulations.

Division of substantive and procedural content

• The instrument does not set levy incidence, rates, thresholds, or definitions of "prescribed ship" or "seafarer berths". Those substantive matters are for the Levy Act and the Collection Act (reg 5, definitions). Consequently, the instrument interacts with the substantive Acts by prescribing collection mechanics and record duties that presuppose definitional and liability content found elsewhere.

This instrument is self‑contained within the text supplied. The document records its making, commencement arrangements, and the repeal of its predecessor, but contains no subsequent amendment entries or later amendment notices in the supplied material.

Key dated events and structural points in the instrument

• Dated signature and making: The instrument includes the formal preamble showing it was made on 21 June 2018 (prefatory material). The document records the Governor‑General’s signature and the Minister responsible at the time, reflecting the usual formalities for Commonwealth subordinate legislation.
• Commencement: The instrument’s commencement is conditional and synchronised with related subordinate legislation. The commencement table states that "the whole of this instrument" commences "at the same time as the Seafarers Rehabilitation and Compensation Levy Regulations 2018 commence" and that the combined commencement date is 1 July 2018; however, the instrument expressly provides that the provisions do not commence at all if the companion instrument (Seafarers Rehabilitation and Compensation Levy Regulations 2018) does not commence (reg 2, commencement table). The note beneath the table indicates the table relates only to the provisions as originally made and will not be amended in the instrument to deal with later amendments.
• Repeal of the 2002 instrument: Schedule 1 repeals the Seafarers Rehabilitation and Compensation Levy Collection Regulations 2002 (Schedule 1, Item). The instrument then contains transitional provisions that preserve some regulatory effects of the old instrument for levy periods and requests that straddle commencement (regs 13-15).
• Transitional and savings: The instrument includes transitional provisions: definitions for "commencement day" and "old regulations" at reg 12; savings of specified old regulations for levy payable for quarters ending before the commencement day at reg 13; treatment of registers and entries under the old regulations as having been kept under the new instrument at reg 14; and conversion of pending requests under the old regulation regime to requests under the new regime at reg 15.

Absent amendment history in the instrument

• The supplied text contains no subsequent amendment items, legislative history entries, or notes indicating later amending instruments. It therefore presents the rules as originally made and commencing in 2018. The instrument’s commencement mechanism ties it to the companion Levy Regulations 2018; any later changes to the collection mechanics or to the payment or records duties would appear only in amending instruments not included here.

The supplied instrument contains no litigation history, no case law references, and no recorded judicial interpretations within its text. The document does not cite any court decisions, does not include examples of disputed provisions, and makes no references to past litigation under the 2002 regulations or any other instrument.

What the instrument does include that may be litigated in future

• Questions likely to generate litigation could include interpretation disputes around the statutory terms the instrument relies on but does not define (for example, "prescribed ship" and "seafarer berths") and the temporal point at which the five‑year retention period begins ("the day on which the employer became liable to enter the record") (reg 10(1)-(2)). The instrument specifies the retention anchor but not how to determine the liability date; that could be contested in practice.
• The strict liability statement (reg 10(4)) may raise litigation questions on how it applies in relation to other elements of the offence in reg 10(3). Prosecutors may rely on the strict liability clause for the factual predicate that an employer was required to keep a register; defendants may challenge other elements or the interplay with fault elements if relevant.
• The instrument’s limited evidentiary protections for individuals (reg 11(5)) may give rise to procedural disputes about admissibility and exception scope, particularly where prosecutions for offences under the instrument are concerned.
• Transitional matters, where levy quarters straddle commencement and old regulations 4, 5 and 7 remain saved for certain quarters (reg 13), could give rise to litigation over which regulatory regime controls for a particular levy period or entry.

Absence of prior cases in the text

• Because the instrument does not contain any litigation history, practitioners must rely on primary legislation, subsequent court decisions, and administrative guidance outside this instrument to understand how the instrument’s provisions have been interpreted in practice. The instrument itself does not supply that interpretive material.

This instrument contains a number of drafting and practical features where routine compliance will encounter traps. The following are concrete, source‑grounded points to watch.

1. The record requirement is quarterly, and anchored to a specific point in time: the first day of each quarter (reg 10(1)). That is not an "as at" rolling month or a continuous log; it is a snapshot requirement. Employers who record at other points are not meeting the literal requirement in reg 10(1).

2. The register must record the number of "seafarer berths", not the number of seafarers actually employed or engaged (reg 10(1)(b)). The regulation therefore requires capacity information rather than crew numbers. If an employer records crew numbers rather than berth counts, the register could be non‑compliant even if the underlying commercial data is accurate.

3. Retention period tied to liability date: Records must be kept for five years after "the day on which the employer became liable to enter the record" (reg 10(2)). That phrase can create uncertainty. Is the liability date the first day of the quarter, the date the obligation to keep registers first arose under the law, or the date the employer physically entered the record? The instrument does not define "became liable to enter", so employers should document the administrative event that gives rise to liability. Transitional reg 14(3) clarifies that nothing in the section is intended to change the time at which a register was required to be kept, but it does not resolve the "became liable" question for fresh obligations (reg 14(3)).

4. Strict liability is limited and specific: The instrument applies strict liability to paragraph 10(3)(a),that the person is required to keep a register, rather than to the whole offence (reg 10(4)). That means the prosecution does not need to prove fault about whether the person was required to keep a register but must still establish failure to enter or keep a record per reg 10(3). Practically, this shifts an evidentiary burden onto the defendant to show they were not required to keep a register, but it does not eliminate other standard proof requirements.

5. Self‑incrimination and admissibility are narrow: While a person cannot refuse to produce the register on self‑incrimination grounds (reg 11(4)), the instrument limits admissibility of the produced material against an individual in criminal proceedings except for prosecutions under the instrument’s record‑keeping or production offences or for specified Criminal Code offences (reg 11(5)). That protection is limited to criminal prosecutions and does not extend to civil proceedings, administrative penalties, or other uses unless otherwise provided by law. The instrument also makes the protection applicable only to individuals, not entities; corporate defendants have no parallel evidentiary shield under reg 11(5).

Compliance with this instrument requires aligning internal registers, payment procedures and document‑handling practices to the precise requirements and timelines the regulations set. The following operational checklist is drawn from the instrument’s text and designed for employers, compliance officers and in‑house counsel.

Registers and entries

• Quarterly snapshot: Ensure you maintain a register that records, for the first day of each quarter, the name of each "prescribed ship" for which the employer employed or engaged seafarers and the number of seafarer berths on each ship (reg 10(1)). Treat the first day of the quarter as a mandatory snapshot date; capture and archive that data on that date every quarter.
• Track definition sources: Because the instrument does not define "prescribed ship" or "seafarer berths", identify the definitions and coverage in the Levy Act or other primary legislation. Make an internal note of the legal definition so your register records the correct class of vessels.
• Record format and traceability: Maintain registers in a format that can be copied and produced, and that clearly timestamps the entry as being for the specified first day of the quarter. If entries are electronic, ensure the export produces an unambiguous copy that corresponds to what the Authority will expect.

Retention and provenance

• Retention clock: Retain each register entry for five years after the day on which the employer became liable to enter the record (reg 10(2)). Maintain a separate, auditable log recording the date the employer became liable to enter each record so that the retention period can be calculated precisely.
• Transitional mapping: If you maintained registers under the 2002 regulations, note that such registers are taken to be kept under the new instrument from commencement (reg 14). Preserve older registers in a manner that evidences continuity and provenance.

Responding to production requests

• Administrative readiness: Designate a central point of contact to receive written requests from the Authority and to coordinate production. The Authority must give at least 14 days for compliance, so plan for immediate triage of any request (reg 11(1)-(2)).
• Compliance calendar: When a written request arrives, log the service date and calculate a compliance deadline that is at least 14 days from the request date. Ensure a process to collate and produce the register copy within that period to avoid the production offence carrying a 5 penalty unit sanction (reg 11(3)).
