Seafarers Rehabilitation and Compensation (Catastrophic Injury) Rules 2018

The instrument rests on three core conceptual building blocks: statutory definitional power, categorical medical thresholds, and reliance on a recognised functional assessment tool.

1. Statutory definitional power. The instrument is made under section 144 of the Act (s 3) and expressly operates “for the purposes of the definition of catastrophic injury in section 3 of the Act” (s 6). In short, the rules are subordinate-legislation that populate the statutory definition with concrete criteria rather than leaving “catastrophic” to be decided case-by-case without guidance.

2. Categorical medical thresholds. The instrument splits “catastrophic” into five discrete injury types and lists the clinical or anatomical findings required for each type:

   • Spinal cord injury: a lesion of the spinal cord or cauda equina resulting in sensory deficit, motor deficit, bladder dysfunction or bowel dysfunction (s 7).
   • Brain injury: impairment of cognitive, physical or psychosocial functions, plus a FIMTM assessment of 5 or less on any item, and either post traumatic amnesia (PTA) of at least 7 days or a “significant brain imaging abnormality” (s 8).
   • Amputation injury: precise anatomical losses, percentage-length thresholds for femur/tibia, thumb loss thresholds, and rules for combining multiple injuries (s 9).
   • Burn injury: FIMTM impairment to 5 or less on any item and either full thickness burns meeting TBSA thresholds or to specified body parts, or inhalation injury producing FVC or FEV1 <50% predicted (s 10).
   • Blindness: corrected visual acuity <6/60 in both eyes, constriction to within 10 degrees of fixation in the better eye, or a combination producing equivalent impairment (s 11).

3. Reliance on FIM as functional measure. For brain and burn injuries the instrument requires an assessment using the FIMTM score sheet at Schedule 1 and predicates catastrophic status on a score of 5 or less on any of the items on that sheet (ss 8(b), 10). The schedule reproduces the FIM items and levels and records whether the assessor is FIM credentialled; it also includes a question whether a score is “due to the injury”, signalling that attribution is part of the assessment record (Schedule 1).

Other structural points: the instrument applies to any qualifying “injury” as defined in the instrument (s 5 defines “injury” as an injury for which compensation is payable under the Act), and it applies retrospectively and prospectively to injuries suffered before, on or after commencement (s 4). The instrument expressly notes the FIM trademark and that AROC holds the licence for FIM in Australia (Schedule 1 note), which the instrument brings into the administrative record.

The instrument explicitly applies to an injury suffered by “an employee” and defines “injury” as one for which compensation is payable under the Seafarers Rehabilitation and Compensation Act 1992 (s 4; s 5). Therefore the primary affected parties are:

• Employees who are covered by the Act and who have sustained injuries: their injuries will be classified as catastrophic or not according to the thresholds in ss 6-11, and that classification will determine how the Act operates in their case (the instrument itself does not set entitlements but feeds into the Act’s operation; see s 6 linking to s 3 of the Act).

• Employers, insurers and the administrative authority that administers the Act (not named in the instrument): these actors must apply the rules when determining whether an injury meets the catastrophic threshold set by the Act. Application will require access to medical records, FIMTM assessments and other diagnostic data specified in the rules.

• Medical assessors and rehabilitation professionals: the schedule requires a FIM assessment and records whether the assessor is FIM‑credentialled (Schedule 1). The instrument thus affects how assessments are prepared, what tests are required (for example PTA duration, brain imaging, pulmonary function tests for inhalation burns, ophthalmologic measures for blindness, and anatomical measurements for amputations), and the documentation required by administrative decision‑makers.

• Past-injury claimants: because the rules apply to injuries suffered before commencement as well as on or after it (s 4), claimants with older injuries may be re‑classified under the new thresholds. That creates a documentary and evidentiary burden to produce historical medical data (PTA duration, imaging, functional measures, pre-existing injury records for multiple‑injury amputation assessments).

• Copyright and licensing holders: the schedule identifies the FIMTM as a trademark of Uniform Data System for Medical Rehabilitation and records that AROC holds the territory licence for FIM in Australia (Schedule 1 note). While the instrument does not expressly impose licence obligations, it flags that a widely used proprietary assessment tool is central to statutory determinations.

Who does not get affected by the instrument on its face: the instrument does not itself confer, vary or remove monetary entitlements, impose criminal penalties or change employer obligations outside the Act. Those consequences, if any, flow from application of the Act once an injury is classified under these rules (s 6).

The rules are primarily definitional and do not, on their face, create novel statutory duties or monetary rights; instead they impose an evidential and decision‑making framework that decision‑makers and medical assessors must apply when classifying an injury as “catastrophic” for the Act’s purposes.

Specific operational duties implied by the instrument’s text are:

• Apply the listed criteria. Decision‑makers and assessors must apply the category‑specific tests in ss 7-11 to determine whether an injury satisfies any of the listed conditions. The instrument leaves no open‑ended standard for “catastrophic”: a listed condition must be satisfied (s 6).

• Use the FIMTM score sheet where required. For brain injuries (s 8(b)) and burn injuries (s 10) the instrument requires an impairment assessed at a score of 5 or less on any item on the FIMTM score sheet at Schedule 1. The schedule sets out the item list, FIM levels, administration fields, and a field that asks whether the score is “due to the injury” (Schedule 1). Practically, an assessor preparing evidence for a catastrophic classification must administer and document a FIM assessment consistent with the schedule.

• Document causation. Schedule 1 includes the column “Is score due to the injury?” which directs assessors to record whether the functional limitations recorded in the FIM are attributable to the workplace injury. The instrument therefore channels decision making towards causation as part of the record used to determine catastrophic status.

• Compile and use diagnostic evidence required by the categories. For brain injuries, in addition to FIM 5 or less, the rules require a period of PTA of at least 7 days or a “significant brain imaging abnormality” (s 8(c)). For burns, the rules require TBSA measurements and/or pulmonary function testing (s 10(a)(i)-(ii) and s 10(b)). For amputations, assessors must establish percentage loss of femur/tibia length or specific anatomical amputations (s 9). For blindness the instrument specifies corrected acuity thresholds and field constrictions (s 11). These are concrete evidential duties placed on the assessor and the administrative decision‑maker.

What the instrument does not do:

• It does not itself set or alter compensation payments, award procedures, review rights, enforcement mechanisms, or penalties. Those matters remain within the Act and associated instruments. The instrument is silent on monetary entitlements and administrative review (compare s 6, which explicitly ties the instrument to the Act’s definition rather than to any payment clause).

• It does not mandate who within the administrative apparatus must make the classification; the rules are standards to be applied under the Act (s 6). The identity of the decision‑maker, avenues of review, or procedural timelines are not specified here.

In short, the key operational duty created by the instrument is an evidentiary and assessment duty: assemble and apply the medical, functional and imaging evidence specified in ss 7-11 and record it (Schedule 1) so that the administering authority can determine whether the Act’s catastrophic definition is satisfied.

The instrument contains no provisions that create offences, monetary penalties, criminal sanctions, or a separate enforcement regime. It is a rules instrument that supplies definitional criteria for the Act’s “catastrophic injury” concept (s 6). There are no sections in the instrument that prescribe fines, imprisonment, administrative sanctions, or compliance notices. The only enforcement‑relevant text is the formal authority and commencement: the instrument is “made under section 144 of the Act” (s 3) and commences the day after registration (s 2).

Consequently:

• Any enforcement mechanisms, penalties or sanctions for non‑compliance with the classification, or for related disputes about entitlement, must be found in the Seafarers Rehabilitation and Compensation Act 1992 itself or in other instruments made under that Act. This instrument is silent on appeal rights, reviewing decisions, or sanctions for false statements.

• Administrative reliance on the instrument will depend on the Act’s broader machinery for decision‑making, review and enforcement. The instrument supplies criteria that administrative decision‑makers must apply; how those decisions are enforced, reviewed, or challenged is a matter for the underlying Act and not these rules.

• For practitioners and administrators, the practical enforcement issue is evidentiary and procedural rather than punitive under these rules: accuracy and completeness of medical and functional assessments will determine whether an injury meets a listed criterion. The schedule’s requirement to record whether a FIM score is “due to the injury” (Schedule 1) and to state whether the assessor is FIM‑credentialled is relevant for evidentiary integrity; however, the instrument does not state consequences for an assessor who misrecords or misattributes scores.

• Intellectual property/licence compliance risk: the schedule identifies FIMTM as a trademark and notes that AROC holds the territory licence in Australia (Schedule 1 note). The instrument does not itself require licence fees or create offences for unlicensed use of FIM; nevertheless, use of a proprietary tool in a statutory setting may create an operational requirement for administrators or health services to ensure licence compliance outside the statutory instrument.

In summary, enforcement and penalties are not contained in this instrument. The instrument's practical enforcement effect is to constrain decision‑makers to the defined criteria; any procedural remedies, sanctions for incorrect classification, or obligations to maintain records will derive from other parts of the Act or administrative law avenues, not from these rules themselves.

The instrument is expressly designed to operate together with the Seafarers Rehabilitation and Compensation Act 1992. Section 6 states that “for the purposes of the definition of catastrophic injury in section 3 of the Act, an injury is a catastrophic injury if…” and then lists the five categories (s 6). Thus the instrument supplies the content of a statutory term used in the Act. The immediate statutory interaction points are:

• The instrument is subordinate legislation made under s 144 of the Act (s 3). That means the rules are an instrument exercising a power granted by the Act to make rules concerning aspects of the Act’s operation. The instrument does not alter the Act itself; it furnishes details that the Act references (s 6).

• The instrument defines “injury” in terms of compensable injury under the Act (s 5): “injury means an injury for which compensation is payable under the Act.” Therefore, the interplay is two-way: the instrument’s application is limited to injuries that are compensable under the Act, and the Act’s operation for catastrophic injuries depends on the instrument’s definitions.

• Administrative and evidentiary interactions. The schedule requires use of the FIMTM score sheet with fields that are relevant to medical evidence, such as method of administration, whether the FIM assessor is credentialled and whether the score is due to the injury. These documentation requirements will interact with administrative law principles and privacy and health records laws when gathering and sharing medical evidence. The instrument, however, does not itself set privacy or evidence‑handling rules; those will be supplied by the Act and any general privacy or health records legislation.

• Intellectual property/licensing: Schedule 1 records that FIMTM is a trademark and that AROC holds the territory licence for FIM in Australia. While this instrument merely notes the trademark and licence holder, it signals an interaction between the statutory assessment process and intellectual property/licensing regimes applicable to proprietary assessment tools. The instrument does not itself impose licensing obligations or grant licences.

• Medical testing and professional standards: the criteria require PTA duration, brain imaging, pulmonary function tests, visual acuity and field testing, and precise anatomical measurements for amputations. Those requirements interact with clinical practice standards, diagnostic codes, credentialling frameworks (the schedule records “FIM™ credentialed: Yes/No”) and potentially professional regulation, but the instrument does not change clinical regulatory frameworks; it simply requires particular types of evidence to be produced or recorded.

• Temporal interaction: the instrument applies to injuries before the commencement date as well as on and after it (s 4). That creates a retrospective application to earlier compensable injuries within the Act’s scope, which may interact with settled administrative decisions or past medical records. The instrument itself does not prescribe transitional procedural rules; transitional questions will turn on the Act’s provisions and administrative practice.

The instrument does not reference other statutes directly and contains no savings, transitional or conflict clauses beyond the invocation of the Act. Practitioners should therefore treat it primarily as an interpretive/definitional layer sitting under the Act and consider other statutory or regulatory regimes only insofar as they affect the production and use of the medical and functional evidence specified by the rules.

The instrument records its making and date: it is signed by the Minister, Craig Laundy, dated 22 August 2018 (front page). It states that it “commences the day after it is registered on the Federal Register of Legislation” (s 2). The instrument identifies the statutory authority under which it is made, section 144 of the Seafarers Rehabilitation and Compensation Act 1992 (s 3).

The instrument itself contains no internal amendment history: there are no later amendment clauses, no “as amended” notes within the text, and no schedule of past versions included in the instrument as presented. The text does not record earlier instruments it replaces or revokes, nor does it include savings or transitional modifications beyond the application clause that extends its operation to injuries before commencement (s 4). The schedule references FIM trademark and AROC licence but does not record changes to the schedule since enactment.

Given the absence of any amendment notes in the instrument, the only recorded provenance within the document is the date of execution (22/8/18), the Minister who made the instrument and the commencement mechanism. Any subsequent amendments, revocations or consolidations are not recorded within the provided instrument and would have to be checked against the Federal Register of Legislation or the Act’s legislative instruments register to identify later changes. The instrument as provided should therefore be read as the instrument made on 22 August 2018 with the commencement mechanism specified in s 2.

Practitioners relying on these rules to advise clients should, as a matter of ordinary administrative practice, check the Federal Register of Legislation and the Act’s statutory instrument history for any later amendments, disallowances, or replacement rules, because the instrument itself does not contain a legislative history beyond its making date and commencement rule.

The instrument contains no references to case law, litigation, judicial interpretation or precedent. It does not name or refer to any judicial decisions, administrative tribunal decisions, or appeals processes. The instrument is a statutory rules instrument that defines criteria; it does not include examples, interpretive guidance derived from cases, or a register of legal challenges.

Because the instrument itself does not provide a litigation history, any authoritative judicial treatment or administrative decisions that interpret these definitions will be found outside the document in court or tribunal records. The text does not indicate whether the instrument was subject to parliamentary disallowance, litigation, or administrative review at the time it was made. Likewise, there are no notes on legal challenges to the FIM as an assessment tool in this instrument.

In practical terms, the likely litigation loci (noting this instrument does not itself identify cases) are disputes under the Act where parties contest whether an injury satisfies one of the listed thresholds. Those disputes would be resolved through the Act’s decision‑making and review procedures and, if litigated, by courts or tribunals applying the criteria in this instrument together with medical evidence. However, the instrument itself contains no litigation history and names no cases; any report on case law would require searching the decisions under the Act and is not contained within this instrument.

The instrument contains several technical features and drafting choices that can produce unexpected outcomes or create practical pitfalls for assessors, employers, insurers and claimants. These are not interpretive judgements so much as close readings of the text that identify evidential and procedural friction points:

• “Any of the items” on the FIMTM score sheet. For brain injuries (s 8(b)) and burn injuries (s 10) the instrument requires an “impairment assessed at a score of 5 or less on any of the items on the FIMTM score sheet”. That means a single item at level 5 or below can satisfy the FIM element; the rules do not require a low aggregate or total FIM score. Practically, one moderately limited function recorded as supervised or dependent (score 5 or less) on one item is sufficient for the FIM limb of the test, provided other category prongs are met. Assessors must therefore record individual-item scores carefully and justify attribution to the injury (Schedule 1’s “Is score due to the injury?” field).

• Attribution requirement surfaced in the schedule. The schedule’s FIM sheet asks “Is score due to the injury?” That field directs assessors to make a causation notation. A claimant with pre‑existing functional limitations risks failing the “due to the injury” question; the instrument therefore channels decision‑makers toward attributing impairment to the workplace injury rather than to comorbidity.

• Brain injury has conjunctive requirements. Section 8 requires: impairment of cognitive, physical or psychosocial functions (s 8(a)); a FIM item score of 5 or less (s 8(b)); and one or both of PTA ≥7 days or “significant brain imaging abnormality” (s 8(c)). All three limbs must be satisfied. Thus, a claimant with FIM ≤5 alone will not qualify unless the additional PTA or imaging criterion is also met. This is an important evidentiary tripwire: the absence of documented PTA duration or significant imaging may be determinative.

• PTA threshold is specific. The brain injury PTA threshold is “at least 7 days” (s 8(c)(i)). Shorter PTA periods are not specified and therefore do not meet this part of the rule. Assessors must ensure records capture PTA duration where relevant.

• Imaging is not defined. Section 8(c)(ii) requires a “significant brain imaging abnormality” but does not define “significant”. That leaves evaluative judgment to clinicians and decision‑makers and may become a focal point in disputes.

• Burn rules combine FIM and anatomical/functional thresholds. Section 10 requires both a FIM item score ≤5 and that the burn be one or both of: full thickness burns meeting TBSA thresholds or location criteria, or inhalation burns with FVC/FEV1 <50% predicted. Thus a large TBSA burn without documented functional impairment on FIM would not qualify under these rules; conversely a low TBSA burn but with FIM ≤5 and full thickness to hands/face/genitals would qualify. Note separate adult and child TBSA percentage thresholds (s 10(a)(i)-(ii)).

• Pulmonary function thresholds for inhalation burns are numerical and require predicted values. Section 10(b) requires vital capacity or FEV1 less than 50% of predicted for age, height and ethnicity. That imposes a concrete testing standard (predictive equations) and therefore requires quality pulmonary function testing with predictive norms recorded.

• Amputation rules are technical and cumulative. Section 9 sets out single‑injury and multiple‑injury tests. Single‑injury catastrophic status can be achieved either by a list of major proximally located amputations or by at least two of specific losses (e.g. loss of 50%+ tibia of left leg and right leg counts as two). Multiple injuries require the earlier injury to be to a different limb and that the earlier injury satisfy subsection (1) or itself be another qualifying loss as set out in s 9(2)-(3). The drafting creates potential counterintuitive outcomes: an earlier one‑leg loss that does not meet the subsection‑(1) threshold will not combine with a later loss unless the earlier loss itself results in a specified loss (s 9(3)). Assessors must track prior injury records precisely.

• Percentage‑of‑length thresholds require anatomical measurement methods. The rules rely on loss of a percentage of the femur or tibia. The instrument does not specify measurement technique or reference length; assessors and administrators must therefore set and record a consistent measurement method to apply the percentages.

• Blindness criteria require corrected acuity and field testing. Section 11 specifies corrected visual acuity less than 6/60 in both eyes or constriction to within 10 degrees of fixation in the better eye, or a combination producing equivalent impairment. These require up‑to‑date ophthalmological testing and highlight the significance of “after correction by suitable lenses” (s 11(a)).

• Retrospective application creates evidentiary burdens. Because the rules apply to injuries “whether the injury was suffered before, on, or after the commencement” (s 4), older claims may require reconstructing PTA durations, prior imaging, pulmonary tests, functional assessments and previous amputations’ details. Missing historical records may impede classification.

• FIM credential question does not mandate credential. Schedule 1 records “FIM™ credentialed: Yes/No” and invites a qualification field. The instrument does not expressly require that the assessor be credentialled, but including the credential field signals that credentialling is material to the record. Administrative practice may therefore favour credentialled assessors even though the rule does not impose an express statutory prerequisite.

• Trademark and licence note. The schedule notes that FIM is a trademark and that AROC holds the territory licence. The instrument does not explain the legal consequences, but the note can prompt administrative checks on licence compliance when using the FIM as part of statutory determinations.

Those are the principal operational “gotchas” that can produce unexpected classification outcomes or evidentiary disputes. They flow directly from the instrument’s text and its reliance on discrete medical markers and the FIMTM assessment structure.

Compliance with these rules is primarily an evidential and procedural task: produce, document and apply the medical and functional evidence specified in ss 7-11 and the FIMTM score sheet in Schedule 1, and ensure records show attribution to the compensable injury.

Actionable steps for administrators, employers, insurers and practitioners:

1. Identify whether the claimant is an “employee” and whether the injury is compensable under the Act. The instrument applies only where the injury is “an injury for which compensation is payable under the Act” (s 5). Confirm coverage under the Act before applying these rules.

2. Determine which catastrophe category is relevant. The instrument sets separate tests for spinal cord (s 7), brain (s 8), amputation (s 9), burns (s 10) and blindness (s 11). Apply only the relevant section(s) and record findings against each statutory element.

3. Use the Schedule 1 FIMTM score sheet where required. For brain and burn categories a FIMTM item score of 5 or less on any item is required (ss 8(b), 10). Administer the FIMTM using the Schedule 1 form, complete the administration fields (patient details, type of injury, date of assessment, method of administration), record item scores, and answer “Is score due to the injury?” Practically, use an assessor who is familiar with the FIM and document whether they are FIM‑credentialled (Schedule 1).

4. Capture category‑specific diagnostic evidence:

   • Brain injury: document impairment of cognitive, physical or psychosocial functions (s 8(a)), FIM item score ≤5 (s 8(b)), and either PTA ≥7 days (s 8(c)(i)) or a “significant brain imaging abnormality” (s 8(c)(ii)). Ensure PTA documentation (clinical notes, rehabilitation records) and imaging reports are in the file.
   • Burn injury: document FIM item score ≤5 (s 10), and then either full thickness burns meeting TBSA thresholds (>40% total body surface area for employees aged 16 or above; >30% for under 16) or full thickness burns to hands, face or genital area (s 10(a)(i)-(iii)), or inhalation burns with vital capacity or FEV1 <50% of predicted (s 10(b)). Ensure TBSA calculations and pulmonary function test results and the predictive norms used are recorded.
   • Amputation: document precise anatomical loss (s 9). For femur/tibia percentage thresholds, document measurement methodology and pre‑ and post‑injury limb length or imaging record. For multiple injuries, establish date and nature of prior limb injuries and whether those earlier injuries satisfied the instrument’s own thresholds (s 9(2)-(3)).
   • Spinal cord: document lesion of the spinal cord or cauda equina and resulting deficits: sensory, motor, bladder or bowel dysfunction (s 7). Clinical neurology, imaging and functional documents should be in the file.
   • Blindness: document corrected visual acuity in both eyes and visual field testing, ensuring use of “suitable lenses” and standard field testing that can show constriction to within 10 degrees (s 11).

5. Ensure tests use appropriate standards and predictive norms. For pulmonary function thresholds (s 10(b)) the rule refers to predicted values for age, height and ethnicity; therefore the testing laboratory should record the predictive equation used. For visual acuity and field testing, record correction used and testing method.

6. Record causation and pre‑existing conditions. Schedule 1 asks whether FIM scores are “due to the injury.” For claimants with pre‑existing impairments, document baseline function and distinguish impairment attributable to the workplace injury from other causes.

7. Preserve historical records for pre‑commencement injuries. Because the instrument applies retrospectively (s 4), for older injuries assemble relevant contemporaneous medical records (PTA notes, imaging, early FIM assessments if any, pulmonary function tests, ophthalmology reports). Absence of historic evidence may impede classification.

8. Credentialling and assessor selection. Although the instrument does not explicitly require FIM‑credentialled assessors, Schedule 1’s credential field and the trademark/licence note indicate that credentials and licence considerations are material. Use assessors who are experienced with FIM administration and retain records of qualifications.

9. Document measurement methodology for anatomical percent thresholds. For amputation percentage calculations (s 9), adopt a standardised, documented method for measuring femur and tibia lengths, including whether measurements are anatomical length, radiological length, or other standard.

10. Coordinate with the administering authority under the Act. The instrument supplies criteria but not the decision procedure. Practitioners should ensure that the compiled evidentiary file is formatted and presented in the manner the relevant compensation authority requires and be prepared to supply medical experts and witness statements to substantiate items such as “significant brain imaging abnormality” or PTA duration.

11. Check intellectual property and licensing practice for FIM use. The schedule’s note that AROC holds the territory licence suggests administrators should confirm that their use of the FIM instrument complies with any applicable licence terms in Australia.

Following these steps will align the evidentiary and procedural practice with the instrument’s textual requirements. The central compliance task is to ensure the administrative record contains the precise clinical and functional evidence the rules demand so the administering authority under the Act can apply the statutory definition in s 3 of the Act as populated by these rules.
