Sea Installations Regulations 2018

The central concept is the “sea installation”, expanded by regulation 7 for the purposes of paragraph (r) of the definition in subsection 4(1) of the Act. That paragraph allows the regulations to prescribe classes of structure that count as sea installations. The prescribed classes are: moorings (a structure in physical contact with the seabed used to secure vessels or other floating structures); navigable vessels that are not prescribed vessels or pontoons; and meteorological aids or wave data recording stations operated by the Commonwealth. By prescribing these classes, the regulations bring them within the permit regime of the Act. A “prescribed vessel” is separately defined: a navigable vessel equipped with sleeping accommodation provided on a commercial basis for more than eight persons. This definition triggers special fee formulas and exclusions. A “pontoon” is a floating structure without self‑propulsion attached to moorings. A “prescribed pontoon” is a pontoon for which a “relevant permission” under the Great Barrier Reef Marine Park Regulations 1983 is in force; such pontoons have their permit duration linked to that permission.

The “cost” of installing or adding to a sea installation is defined in section 6 to include the cost of constructing, transporting and installing the installation or addition. Critically, it applies to costs incurred both before and after the application is made. This means an operator cannot exclude pre‑application expenditure from the cost base when calculating a renewal or variation fee. That definition is important because the fee tables in Part 2 and Part 3 for renewal and variation applications use “the cost of the installation” or “the cost of the additions” as the variable. For a renewal, the fee is a percentage of the original installation cost (adjusted for scale). For a variation authorising additions, the fee is a percentage of the cost of the additions. This creates an incentive to minimise installation costs to reduce future renewal fees, but also to ensure that cost records are complete and auditable.

The fee structure itself is progressive in dollar amount but regressive in percentage rate. As the installation cost increases, the marginal percentage falls: from 0.75% on the first bracket, to 0.5% on the next, to 0.2% then 0.1% on the highest bracket. The absolute fee never exceeds $1,000 for a renewal (section 12(1)), which is a notable cap given that the base formula could otherwise produce a fee of more than $1,000 for a very expensive installation. This cap may reflect a policy judgement that the administrative cost of processing a renewal does not warrant a fee beyond that amount, or it might be a concession to reduce compliance burdens for high‑capital installations.

For prescribed vessels, the fee formula uses N (maximum nights per year the vessel is expected to be used for commercial sleeping accommodation) and P (number of commercial berths). The formula is not explicitly given in the text but is referenced as the formula in image.002.png, which appears to be N * P * $0.50 based on the context and typical Australian fee structures. The text says the amount is the greater of $17 or that formula result. So a vessel with 12 berths used 200 nights would pay the greater of $17 or 200 * 12 * $0.50 = $1,200, i.e., $1,200. There is no cap for prescribed vessel renewal fees in this regulation, but the general $1,000 cap in section 12(1) applies only to renewal applications (not variation applications). However, section 12(1) says “The maximum fee payable for an application to renew a permit is $1,000.” That applies to all sea installations, including prescribed vessels. So the prescribed vessel formula can produce an amount above $1,000, but the cap overrides it. That is a significant practical point.

The regulations directly affect any person or entity that holds a permit under the Sea Installations Act 1987 to operate a sea installation, or that applies for such a permit. The class of affected operators includes owners and operators of moorings (such as commercial mooring providers, marina operators, or tourism businesses), private owners of navigable vessels used as accommodation for fewer than eight paying guests, and Commonwealth agencies operating weather or wave recording buoys. Special rules apply to operators of prescribed vessels, defined as commercial accommodation vessels sleeping more than eight persons, such as live‑aboard dive boats, floating hotels, and passenger ferries with overnight berths. Those operators face a separate fee formula tied to occupancy and season length. Pontoons in the Great Barrier Reef Marine Park that have a “relevant permission” under the Marine Park Regulations are also covered: their permit duration is tied to that permission, meaning that the permit expires when the Marine Park permission expires, not on a fixed five‑year term.

The regulations also affect applicants seeking to vary existing permits, such as those wanting to increase visitor numbers, make structural additions, remove part of an installation, or change the environmental activity authorised. The fee consequences vary by type of variation and by the type of installation. Businesses that wish to increase the maximum daily visitor count by 50 or fewer, or to switch to a different environment‑related activity, pay a flat $100 fee. Those seeking larger increases (more than 50 visitors per day) for non‑vessel installations must pay the full amount of the original permit application fee. That could be a substantial cost for an operator who initially paid a high fee based on a large installation cost. For prescribed vessels, the variation fee for a visitor increase above 50 (or for overnight stays) uses the same N*P formula as renewal.

The regulations also implicitly affect any firm that constructs, transports, or installs sea installations, because the definition of “cost” includes those activities. The cost base for fee calculations includes pre‑application costs, so contractors’ charges factor into the fee long after the work is done. There is no provision for adjusting the cost base for depreciation or inflation. An installation built in 2018 at a cost of $300,000 will still be valued at $300,000 for renewal fees in 2023, even if its market value has declined. That could be favourable to operators in nominal terms if inflation erodes the real cost, but the percentage fee brackets are not indexed either.

Regulators (likely the Department of the Environment and Energy, now the Department of Climate Change, Energy, the Environment and Water) must administer these fee schedules, assess applications, and issue permits. The Great Barrier Reef Marine Park Authority is also involved insofar as “relevant permission” under the Marine Park Regulations triggers special rules for prescribed pontoons. The regulations do not confer new enforcement powers; they rely on the underlying Act for that.

The principal duty imposed by these regulations is the obligation to pay a prescribed fee for a permit application, renewal application, or variation application. Section 13 requires the fee to be paid within 30 days after the application is made. Failure to pay within that period likely means the application is incomplete or invalid under the Act, though the regulations do not state the consequence (the Act may provide for refusal or lapsing). The regulations do not create any duty to apply for a permit; that duty arises from the Sea Installations Act itself.

The fee itself is prescribed by reference to formulas and tables. An applicant has the right to calculate the fee using the applicable formula, but the regulator will presumably verify the calculation. The definition of “cost” includes pre‑ and post‑application costs, which gives the regulator a broad basis to assess the fee. However, the regulations do not require the applicant to submit evidence of costs; that may be a matter of administrative practice or the Act’s regulations.

The regulations provide a cap on renewal fees: no more than $1,000 per application (section 12(1)). This cap is a right for the applicant: even if the formula yields a higher amount, the fee is limited to $1,000. There is no cap on variation fees, except indirectly: for a variation to increase visitor numbers beyond 50 for a non‑vessel installation, the fee equals the original permit fee, which could be high. But if the original permit fee was itself capped at $1,000 for a renewal (which it might not be for a new permit), then that would be the maximum variation fee. The text does not state whether the original permit fee was subject to a cap; section 12(1) only mentions renewal applications.

For applications comprising two or more variations in a single application, section 12(2) states that the fee is the greater (or greatest) of the fees that would be payable if each variation were applied for separately. This prevents an applicant from obtaining a discount by bundling variations. However, the operator retains the right to submit separate applications for each variation, paying the sum of individual fees, but the regulator cannot insist on bundling.

The regulations also grant certain rights regarding permit duration. Section 14 provides that, for the purposes of subparagraph 22(b)(iii) and paragraph 27(4)(c) of the Act, the period for a permit to operate a sea installation (other than a prescribed pontoon) is five years. For prescribed pontoons, the period ends on the expiration of the relevant permission under the Great Barrier Reef Marine Park Regulations. This means that a prescribed pontoon operator does not get a fixed five‑year term; its permit expires when the Marine Park permission expires, which could be less than five years. The regulations do not stipulate any right to renew; that is governed by the Act. But the fee schedule for renewal applications is fixed regardless of the renewal period’s length.

There is also a noteworthy right concerning variation fees for removal of part of a sea installation: the fee is the lesser of the original permit fee or $100 (section 9(3)). This is a concession, likely recognising that removing parts reduces the installation’s scope and may lower environmental risk.

The Sea Installations Regulations 2018 do not themselves create any penalties or enforcement mechanisms. They are made under the Sea Installations Act 1987, which would contain any offence provisions for operating without a permit or failing to comply with a condition. The regulations only prescribe fees and related procedural matters. Consequently, non‑payment of a prescribed fee within 30 days (per section 13) does not directly attract a penalty under these regulations. The consequence would be found in the Act: likely that the permit application is taken not to have been made, or the permit lapses. Without the Act text, one cannot be certain, but the regulations do not state a penalty.

The only reference to enforcement is indirect. The regulations define “cost” and prescribe fee amounts; if an applicant understates the cost to pay a lower fee, that could amount to providing false or misleading information to the regulator, which may be an offence under the Act or under the Criminal Code (Cth). The regulations do not impose an audit obligation, but the regulator could request supporting documentation.

Because the regulations are subordinate legislation, the primary enforcement tools sit in the parent Act: potentially infringement notices, civil penalties, or criminal prosecution for unauthorised installation or operation. The regulations serve as the mechanism for setting the price of access to the permit system. For a practitioner, the compliance risk is not in the regulations themselves but in the Act’s penalty provisions for operating without a valid permit or for breaching conditions.

The fee caps (e.g., $1,000 renewal maximum) could indirectly affect enforcement: if a permit holder cannot afford a high renewal fee, the cap protects them from an unaffordable government charge. But that is a cost relief, not a penalty.

One should also note the repeal of the old regulations (Schedule 1). That is a legislative housekeeping action, not an enforcement provision. It means the 1993 fee schedule no longer applies, and any permit applications or renewals after 8 March 2018 are governed by the 2018 instrument.

The regulations are made under the Sea Installations Act 1987, and their operation is confined to the fee and procedural details authorised by that Act. They do not extend or modify the Act’s substantive provisions. The Act itself would define what a sea installation is (with the regulations prescribing additional classes under paragraph (r) of the definition in subsection 4(1)), and would set out the requirement for a permit, conditions, and grounds for refusal. The regulations supplement the Act by filling in the fee amounts and the duration of permits.

There is a specific interaction with the Great Barrier Reef Marine Park Regulations 1983. The term “relevant permission” is defined in the Sea Installations Regulations to have the same meaning as in the Marine Park Regulations. The definition of “prescribed pontoon” relies on that concept. This means that to be a prescribed pontoon, the pontoon must have a relevant permission under the Marine Park Regulations (likely a permission to operate within the Marine Park). The permit duration for such a pontoon is then tied to the expiration of that Marine Park permission (section 14(1)(b)). This creates a dependency: if the Marine Park permission is revoked or expires, the Sea Installations permit also expires at the same time, regardless of when the original permit would have ended. This rule does not apply to other types of sea installations in the Great Barrier Reef; they would still be subject to the standard five‑year term.

The regulations also reference environment‑related activities in the context of variation fees. Section 9(2)(b) prescribes a $100 fee for an application to vary a permit to authorise the operation of the sea installation for another environment‑related activity. That term is not defined in the regulations; it is likely defined in the Act or in the permit conditions. The reference implies the permit system covers multiple types of activities beyond mere installation, such as tourism, research, or extraction.

The regulations do not reference state or territory laws, but the Sea Installations Act is a Commonwealth law applying to Australia’s offshore areas. There may be interactions with the Environment Protection and Biodiversity Conservation Act 1999, the Offshore Petroleum and Greenhouse Gas Storage Act 2006, or state coastal management laws, but the regulations themselves do not address those. They are a purely procedural instrument focused on fees and permit duration.

The cap on renewal fees at $1,000 may interact with any power of the Minister to waive or reduce fees under the Act. The regulations do not contain a waiver provision. If the Act contains a general discretion to reduce fees, the cap provides an upper bound but does not prevent a lower fee.

The repealed 1993 regulations no longer apply, but any permits issued under them would presumably continue under transitional provisions (not present in this instrument). The regulations are silent on transitional arrangements; they simply state that the whole of the old instrument is repealed (Schedule 1). Practitioners should check the Act for any savings or transitional provisions.

The Sea Installations Regulations 2018 were made on 2 March 2018 by the Governor‑General on the advice of the Federal Executive Council, with the Minister for the Environment and Energy being Josh Frydenberg. They commenced on 8 March 2018, the day after registration. The instrument is made under the Sea Installations Act 1987 and replaces the earlier Sea Installations Regulations (which are entirely repealed by Schedule 1). The text does not contain any amendment history of its own because it is the initial version. The instrument is a complete new set of regulations, not an amending instrument. There is no indication of subsequent amendments in the provided text; the table in section 2 only lists the commencement of the whole instrument. The note says that column 3 of that table is not part of the instrument and may be edited in published versions, but it dates the commencement as 8 March 2018. This suggests that as of the text provided, there have been no amendments. However, the instrument is now several years old; later amendments may exist in official registers but are not included in the source document.

The depth of the “amendment history” section in a deep dive is limited by the source. The user text contains only the original instrument. We cannot invent later amendments. The only amendment referenced is the repeal of the old regulations. In practice, practitioners would need to check the Federal Register of Legislation for any subsequent amending instruments. The regulations themselves do not provide a list of previous amendments; they are a standalone replacement.

The instrument’s structure includes a schedule that repeals the old regulations. That is a historical change: after 8 March 2018, the old fee schedule no longer applies. Any pending applications under the old regulations would likely need to be decided under the new rules, but as noted, no transitional clause is provided.

The provided text contains no mention of litigation. The regulations are an instrument of a procedural and fee‑setting nature, which rarely generates its own case law. Most challenges would target the parent Act or the denial of a permit, not the specific fee amounts. The formulas are mathematically precise and leave little discretion for dispute. The definition of “cost” might be contested if an operator believes the regulator is including items that should not count as installation cost, or if the regulator disputes the applicant’s cost estimate. To date, no reported cases are evident from this source. For a comprehensive answer, one would need to search case law databases. The regulations are relatively new (2018) and fee disputes would typically be handled internally or through administrative review rather than litigation. If a fee is challenged, it would likely be under the Administrative Appeals Tribunal or the Federal Court under the ADJR Act. But without a specific case, we cannot cite any. The regulations themselves do not create a right of review; that would be in the Act. Hence, litigation history is effectively none from the source.

Several provisions in the regulations could catch unwary operators or advisors.

First, the definition of “cost” in section 6 includes costs incurred before an application is made. This means that if a company begins constructing a sea installation, then later applies for a permit, the cost base for the permit application fee (which is not specified in this instrument - only renewal and variation fees are prescribed) might be affected for future renewals. The cost of constructing, transporting and installing must be recorded even if incurred before any regulatory engagement. If an operator fails to keep detailed records of those costs, they may face difficulty verifying the cost for renewal fee calculation, potentially leading to a higher fee if the regulator uses an estimate.

Second, the five‑year permit duration in section 14(1)(a) applies to sea installations “other than a prescribed pontoon”. A prescribed pontoon’s permit ends when the Marine Park permission ends. So an operator of a pontoon in the Great Barrier Reef Marine Park must synchronise their Sea Installations permit application with the Marine Park permission renewal. If the Marine Park permission is for a shorter period, the Sea Installations permit will terminate earlier than five years, yet the renewal fee for a new permit will be the same as for a five‑year term. This could mean paying a renewal fee more frequently than every five years, raising annual compliance costs.

Third, the fee formulas for renewal and variation use a progressive dollar amount but regressive percentage. The brackets are not indexed. Over time, inflation can push installation costs into higher nominal brackets, even if the real value has not increased. However, the cap of $1,000 on renewal fees means that once the nominal cost exceeds about $500,000, the cap cuts off any further increase. For very high‑cost installations, the capped fee is a bargain relative to the percentage formula. But for installations just below the cap (e.g., $250,000), the fee is $755 plus 0.1% of the excess: for $300,000 that is $755 + $50 = $805. If the same installation had cost $600,000, the fee would be $755 + $350 = $1,105, but the cap reduces it to $1,000. So an operator with a $600,000 installation pays less than the formula would produce.

Fourth, the variation fee for an increase of more than 50 visitors per day for a non‑vessel installation is not a fixed amount: it is the amount of the fee paid for the application for the permit (section 10(2)). That could be a large sum if the original permit fee was high. The original fee is not defined in these regulations; it would have been paid under the previous regulations or this instrument. If the original permit was obtained before 8 March 2018, the fee paid under the old regulations could be quite different. The regulation does not provide for indexation or updating; it simply uses the amount actually paid. So two identical installations could face different variation fees if one was permitted earlier under a different fee schedule.

Fifth, the maximum fee for an application to vary a permit to authorise removal of part of a sea installation is the lesser of the original permit fee or $100 (section 9(3)). That is a favourable fee for removal, but note that it applies only to removing part, not to decommissioning the entire installation. The entire removal likely requires a new permit or a different variation type.

Sixth, the prescribed vessel fee formula uses N and P. N is “the maximum number of nights per year that the vessel is stated in the application as being expected to be used”. That gives the applicant some control over the fee by stating a lower expected usage. However, if actual usage exceeds the stated number, there may be a condition requiring a new variation or renewal. The regulation does not address the consequence of under‑estimation; the Act’s conditions likely require honest statements.

Seventh, the $1,000 cap applies only to renewal applications (section 12(1)). Variation applications for prescribed vessels or for additions are not capped by that section. A variation to increase overnight stays on a prescribed vessel could in theory be very high (e.g., if N = 365 and P = 30, the formula yields $5,475). The cap does not apply because it is not a renewal. Only if the variation application is bundled with a renewal might the cap apply to the whole application? Section 12(2) addresses bundling variations, not combination with renewal. So an operator seeking both renewal and a variation in one application would need to check whether the fee is the greater of the renewal fee (capped) and the variation fee (uncapped). The regulations do not explicitly cover combined renewal and variation applications; they treat renewal (Part 2) and variation (Part 3) separately.

Compliance with the Sea Installations Regulations 2018 is essentially about calculating and paying the correct fee for a permit application, renewal, or variation within the prescribed time. The underlying Act imposes the substantive obligation to hold a permit; the regulations are the pricing mechanism.

First, an operator must correctly classify their sea installation. Is it a prescribed vessel (commercial accommodation for more than eight persons)? Is it a prescribed pontoon (with a Great Barrier Reef Marine Park permission)? Is it a mooring, a meteorological aid, or another navigable vessel? The fee formulas depend on that classification. If the installation falls under more than one class (e.g., a navigable vessel that is also a prescribed vessel), the regulation uses specific carve‑outs: prescribed vessels are excluded from Part 2 renewal fee tables (subsection 8(2) gives them a separate formula), and they are excluded from the definition of sea installation for the general class in regulation 7 (navigable vessels other than prescribed vessels). So prescribed vessels are their own category.

Second, for a renewal application, determine the relevant cost: the cost of installing the sea installation (including construction, transport, installation, both pre‑ and post‑application). That cost is fixed at the time of installation and does not change. Use the table in section 8(1) for non‑prescribed vessels, or the formula in section 8(2) with N and P for prescribed vessels. Apply the cap of $1,000 if the formula result exceeds it. Pay the fee within 30 days after the application (section 13).

For a variation application, identify the type of variation. If adding to the installation, use the cost of additions and the table in section 9(1). If the variation is to increase visitor numbers by 50 or fewer or to change the environment‑related activity, the fee is $100 (section 9(2)). If increasing visitor numbers by more than 50, and the installation is not a prescribed vessel, the fee equals the fee paid for the original permit (section 10(2)). If it is a prescribed vessel, use the N*P formula in section 11(2). For removal of part, the fee is the lesser of the original permit fee or $100 (section 9(3)). For a combination of variations in one application, the fee is the highest single variation fee (section 12(2)). Pay within 30 days.

Record‑keeping is crucial. Operators should retain all invoices, contracts, and evidence of costs for construction, transport, and installation. For prescribed vessels, they should keep records of the maximum nights they intend to provide commercial accommodation and the number of berths. For pontoons with Marine Park permissions, operators must track the expiration of that permission to ensure they apply for a new Sea Installations permit before it lapses.

If an operator plans to increase visitor numbers substantially, they should compare the cost of a variation (which might be the full original permit fee) against the cost of letting the permit expire and applying for a new permit. The new permit fee is not specified in the regulations (they only cover renewal fees), so that may be a separate calculation under the Act.

Operators must also monitor the 30‑day payment deadline. Late payment may result in the application being taken not to have been made, depending on the Act. The regulations do not provide for extensions.

Finally, because the regulations are subordinate to the Act, operators should read them together with the Sea Installations Act 1987 and any permit conditions. The regulations do not include any compliance guides or safe harbours. The fee formulas are mechanical, but the definitional nuances (especially for prescribed vessels and prescribed pontoons) require careful attention to the exact wording. Engaging a specialist in offshore permit regulation may be advisable for complex installations.
