#### 100 Establishment assistance—funding determination Scope (1) This section applies if, in 2008, the relevant Minister varied the former list of non‑government schools in relation to a school in a State because the school was covered by paragraph (c) of the definition of new school proposal in the former Act. Funding determination (2) If the school is a non‑systemic school, the Minister may make a determination authorising payment of financial assistance to the State to provide establishment assistance for the school for the 2009 program year. (3) If the school is a member of an approved school system, the Minister may make a determination authorising payment of financial assistance to the State to provide establishment assistance for the approved school system for the 2009 program year in relation to the school. Maximum amount (4) An amount determined under subsection (2) or (3) in relation to a school must not be more than the amount worked out using the formula:
