School Curriculum and Standards Authority Regulations 2005

The Regulations revolve around a small set of recurring legal and administrative concepts, each of which is defined or operationalised in the text.

• Unique reference number: The Authority must establish arrangements to allocate a unique reference number to each student whose record is opened under Part 3A of the Act (regulation 4(1)). The person required to open the student record must allocate that number (regulation 4(2)); the number is expressly prescribed for the purposes of section 19E of the Act (regulation 4(3)). The unique reference number is also the authorised identifier for practical examination material (regulation 24(2)).

• Student record and Part 3A reporting: The Regulations implement the Act’s Part 3A obligations by prescribing who must open student records and when (regulation 7(1)), what information principals and non‑school providers must supply (regulations 5 and 6), and precise timeframes for initial reporting, corrections and cessations (regulation 7(2)-(6)). The Authority has power to extend time for compliance in particular cases (regulation 7(7)).

• Australian resident: For fee‑setting purposes, the term “Australian resident” is defined in regulation 3 by reference to Commonwealth Acts, namely the Australian Citizenship Act and the Migration Act (regulation 3). This definition distinguishes fee regimes for residents and non‑residents (regulations 10-11).

• Fees and Ministerial determination: Schedule 1 prescribes fees and charges for certification, assessment and examination for Australian resident students (regulation 10). For non‑residents, the Minister may publish a determination, and may set different fees according to multiple specified criteria (course category, school provider, country of origin, prior education, and any other cost‑relevant criteria) (regulation 11(1)-(3)). The Minister also may determine charges for publications supplied by the Authority (regulation 12(2)-(3)).

• Examination administration and security: The Regulations define “examination”, “candidate”, “supervisor” and “examination centre” and allocate responsibilities for notifying candidates (regulation 15), issuing identification documents (regulation 16), appointing supervisors and securing materials (regulation 17), and supervising candidate behaviour and permitted materials (regulation 18). Prohibitions and requirements are spelled out, including language of answers (regulation 19), consumption of food and drink (regulation 20), communication between candidates (regulation 21), removal of materials (regulation 22), and leaving the centre (regulation 23).

• Practical examinations: Practical examination material must be identified only by the unique reference number (regulation 24(2)). Student submissions must carry a signed declaration witnessed by the supervising teacher and principal confirming sole authorship; private candidates must provide a statutory declaration (regulation 24(3)-(4)). This embeds an identity and authenticity control regime tied to the unique reference number.

• Misconduct, sanctions and appeals: Misconduct is defined by reference to non‑compliance with a set list of examination rules (regulation 26(1)). A “relevant committee” may recommend and the Authority may reduce a candidate’s marks (including to zero) (regulation 26(2)). A candidate has a seven‑day window to appeal in writing, and the Authority must appoint an appeals committee within specified timeframes, which must decide and notify the candidate before publication of results (regulations 26-27).

• Disclosure of relevant information for research: Part 5 introduces procedures the Board must apply when considering requests under section 32B of the Act to disclose relevant information for research. Requests must be in writing, include sufficient methodological detail and indicate whether human research ethics committee approval has been obtained (regulation 31). The Board must appoint at least one committee to review non‑government requests and the committee must advise on privacy/security and harms/benefits (regulation 32). The Board must maintain a register of requests and report them in the Authority’s annual report (regulations 33 and 35). The register is constrained not to include personal information but must record whether particular types of personal information were disclosed (regulation 33(4) and (3)).

• Cross‑referenced statutory material and standards: The Regulations repeatedly reference other laws and standards which shape interpretation and implementation, most notably the School Education Act 1999 (SE Act) via section 11B references (regulation 9(2)), the National Statement on Ethical Conduct in Human Research (regulation 30), the Public Sector Management Act (regulation 32(1) definitions), Migration Act and Australian Citizenship Acts for residency (regulation 3), and the Financial Management Act 2006 for reporting obligations (regulation 35).

These concepts form the operational architecture by which the Authority collects, identifies and protects student information, administers high‑stakes external assessment, levies fees, and governs third‑party access to student data for research.

The Regulations allocate duties, rights and procedural expectations across a defined set of participants. Identify who pays, who decides and what behaviours change.

• Students and candidates: All students for whom a record is opened under Part 3A of the Act are affected by the URN system (regulation 4), by the requirement that some students in their final year must sit examinations unless exempted (regulation 14(2)), by rules governing conduct in examinations (regulations 16-23), by practical examination identification and declaration requirements (regulation 24), and by potential administrative penalties for misconduct (regulation 26). Disabled or ill students must be accommodated under the Authority’s special arrangements regime but must apply in writing and supply evidence (regulation 25).

• Principals and schools: A school principal must inform the Authority of the results a student achieved in accordance with requirements established by the Authority when the student was enrolled at year‑end (regulation 5(2)). Principals must submit applications and supporting evidence for students seeking special arrangements or special consideration; regulation 25(5) requires applications by students who are students to be submitted to the Authority by the principal. Principals are also required to sign witnessing statements accompanying student practical examination submissions (regulation 24(3)). Schools must open student records and allocate URNs in accordance with Authority arrangements (regulation 4 and reg 7(1)).

• Non‑school providers, employers, apprentices and trainees: Persons defined in the provider table in the Act (including those providing training to apprentices, trainees or other students) must supply particulars of final results and, where applicable, notify the Authority of enrolments or employment status within prescribed timeframes (regulation 6(2)-(3) and regulation 7(3), (6)). Providers mentioned in section 19F(2)(b) or (3) must give specified information within 14 days unless an exception applies; providers mentioned in section 19F(5) must notify cessation within 7 days (regulation 7(3) and (6)).

• The Authority and Board: Decision‑makers include the Authority and the Board. The Authority administers URNs, issues candidate identification documents (regulation 16), designates examination centres and managers (regulation 15), appoints supervisors (regulation 17), determines special arrangements and consents for language or materials (regulations 19 and 25), determines fees for residents via Schedule 1 and oversees implementation (regulation 10). The Minister, however, may determine fees for non‑residents and publication charges (regulations 11 and 12). The Board decides whether to disclose relevant information for research under s32B of the Act but must follow the procedural steps in Part 5 (regulations 29-35).

• The Minister: The Minister has delegated regulatory power to determine fees for non‑residents (regulation 11(2)) and charges for publications supplied by the Authority (regulation 12(3)). The Minister can set differential fees under criteria listed in regulation 11(3).

• Researchers and third parties: Any person or body seeking disclosure of relevant information for research must apply in writing and include information about objectives, methodology and whether HREC approval has been obtained (regulation 31). Non‑government applicants face additional scrutiny and referral to a Board committee where the Board believes personal information may be required (regulation 32).

• Associations and education system administrators: The Director of Catholic Education and the Association of Independent Schools of Western Australia are recipients of annual data extracts specified at length in regulation 9, meaning those bodies receive aggregate and some disaggregated data about enrolment types, age distributions and participation in SE Act section 11B options.

Who pays: students, candidates or applicants pay fees under Schedule 1 (certificates, appeals, enrollment, non‑school candidate fees etc) (regulation 10 and Schedule 1). Private candidates must pay prescribed fees and, for some activities, higher fees apply for late entry or taking exams without enrolment (regulation 14(3) and Schedule 1 items 6-9). The Authority funds administration but must include disclosure request activity in its annual report (regulation 35).

Who decides: the Authority and Board exercise most decision‑making authority; supervisors enforce exam rules at the centre; the Minister sets certain fees; Board committees advise on non‑government requests (regulations 15, 17, 11, 32).

Behaviour changes required: schools and providers must maintain timely administrative reporting systems to meet narrow windows (14 days, 7 days, 31 December, end of first term) (regulation 7); candidates must comply with identity and conduct rules and time‑limited appeals and special consideration processes (regulations 16, 18, 25-27); researchers must structure and document applications to satisfy Board procedural requirements including HREC status and methodology detail (regulation 31).

The Regulations divide duties and procedural rights across participants; this section lists the most operationally relevant ones with citations.

Duties imposed on schools and principals

• Provide student results to the Authority for any student in any school year from the first year of the relevant education period to the final year of compulsory education, in accordance with Authority requirements (regulation 5(1)-(2)).

• Witness and sign student declarations for practical examination material submitted by school students (regulation 24(3)).

Duties imposed on non‑school providers, employers and other providers

• Give particulars of final results for a student, apprentice or trainee when the final result is assessed (regulation 6(2)).

• For certain employer relationships (item 5 in the provider table), inform the Authority on 1 December that the employee was employed on that day (regulation 6(3)).

• Give initial enrolment/employment information to the Authority not later than 14 days after enrolment or employment (regulation 7(3)), unless exceptions apply.

• Notify the Authority within 7 days that a student ceased to be enrolled or employed by the provider (regulation 7(6)).

Duties imposed on the Authority and Board

• Establish administrative arrangements for allocating unique reference numbers and ensure persons opening records allocate URNs in accordance with the arrangements (regulation 4(1)-(2)).

• Issue written notice to candidates of examination centre, date and latest attendance time (regulation 15(1)) and issue identification documents to each candidate including URN (regulation 16(1)).

• Appoint supervisors, ensure security of examination papers and appoint committee(s) for misconduct and appeals (regulations 17, 26-28).

• Receive and consider written requests for disclosure of relevant information, refuse incomplete requests, and follow mandatory committee referral procedures for non‑government requests likely to involve personal information (regulations 31-32).

• Establish and maintain a register of requests, and include specific details about each request and whether particular personal information types were disclosed (regulation 33).

• Include in the Authority’s annual report a report on requests accepted by the Board under regulation 31 (regulation 35).

Rights and procedural protections for candidates and applicants

• Candidates have a right to be notified of the time and place of examinations (regulation 15(1)).

• Candidates may be excluded for late arrival but have access to an appeals process if marks are reduced for misconduct. A candidate subject to mark reduction may appeal within 7 days and must be provided an appeals committee decision before publication of results (regulations 26(3)-(5), 27(1)-(5)).

• Candidates with disability or acute illness/injury may apply for special arrangements or special consideration; applications must be in writing and supported by evidence (regulation 25(1)-(4)). For students, principals must submit such applications (regulation 25(5)).

• Applicants requesting disclosure for research must have their request in writing, include objectives and methodology and state whether HREC approval exists; if a request is refused the Board must provide written notice and reasons (regulation 31(c), regulation 34).

Ministerial and procedural authorities

• The Minister may determine fees and charges for non‑residents and publications, including differential fees by course, subject matter, school provider, country of origin, level of prior education, or any other criteria relevant to cost (regulations 11(2)-(3), 12(3)).

Administrative enforcement and sanctioning powers

• Supervisors may exclude late attendees and inspect materials; they may require candidates to comply with inspections and directions (regulation 18(1)-(4)).

• The Authority may reduce marks, including to zero, if a relevant committee is satisfied the candidate engaged in fraud, collusion or misconduct (regulation 26(2)).

• Appeals committees may increase marks up to but not beyond the marks before reduction (regulation 27(4)(b)) and are bound by time limits for appointment and decision (regulation 27(2), (5)).

Data governance and disclosure duties

• The Board must not accept a disclosure request unless it is in writing and contains sufficient information to understand objectives, methodology and identify requested information, and indicates HREC approval status (regulation 31).

• The Board must appoint a committee to review non‑government requests where personal information might be involved and obtain advice about security, compliance, harms and benefits (regulation 32(2)-(4)).

• The register of requests must contain applicant name, date, whether accepted and approved or refused, and, where personal information was disclosed, which types (regulation 33(2)-(3)); the register must not itself include personal information (regulation 33(4)).

These duties and rights set clear operational checkpoints: reporting and timing obligations for providers and schools; identity and conduct requirements for candidates; procedural transparency and internal review for misconduct and disclosure decisions; and ministerial discretion over discrete fee settings.

The Regulations create an administrative enforcement framework rather than a catalogue of criminal offences. Enforcement mechanisms are primarily administrative controls that affect examination access, assessment outcomes, fees and disclosure decisions. Key enforcement levers and procedural penalties are:

Examination and misconduct enforcement

• Exclusion from examinations: A supervisor may exclude a candidate from an examination centre if the candidate attends later than the notified latest attendance time (regulation 18(1)). Supervisors may also enforce inspection of candidate materials and compliance with directions (regulation 18(3)-(4)).

• Administrative reduction of marks: If a “relevant committee” is satisfied that a candidate engaged in fraud, collusion or other misconduct (as defined in regulation 26(1)), the Authority may reduce marks (including to zero) for the whole or any part of the examination (regulation 26(2)). The power is specific and quantifiable: mark reduction, not a separate fine or criminal sanction, is the primary remedy in the Regulations.

• Appeal and review timing: Candidates whose marks are reduced may appeal in writing within seven days (regulation 26(3)-(5)). The Authority must appoint an appeals committee within five days after appeal receipt (or within five days after receipt of additional evidence), and the committee must notify the candidate of its decision before results publication (regulation 27(2), (5)). These timing mandates limit procedural delay as part of the enforcement architecture.

Fees and monetary charges

• Recovery of fees: Schedule 1 prescribes fees for certification, assessment and examination services (regulation 10 and Schedule 1). The Regulations empower the Minister to determine different fees for non‑residents and publications (regulations 11 and 12). The Regulations do not specify enforcement mechanisms for unpaid fees, but the practical effect is that fees are payable for specified services; recovery and collection mechanisms would rely on the Authority’s administrative processes or other statutory collection powers not detailed in these Regulations.

Disclosure refusals and reporting

• Disclosure refusal: If the Board refuses a request it has accepted under regulation 31, it must provide written notice to the applicant with reasons (regulation 34). The Regulations require transparency of refusal but do not create a statutory right of appeal within the Regulations; any external remedies (for example, Judicial Review) are outside the Regulations and not specified in the text.

Limits of penalties in the Regulations

• No criminal penalties specified: The Regulations do not themselves create criminal offences or specify monetary penalties as fines for non‑compliance with reporting timelines, except in the indirect sense that certain services require payment of fees (Schedule 1). Regulatory enforcement is therefore administrative: exclusions, mark adjustments, refusal of requests, and financial charges.

• Delegated enforcement: Supervisors, committees, and the Authority perform enforcement functions under the Regulations: supervisors manage conduct and security at centres (regulations 15, 17-18), relevant committees investigate misconduct (regulation 26(1)-(2)), appeals committees hear appeals (regulations 27-28), and the Board and its committees govern disclosure (regulations 31-34).

Administrative discretion and procedural safeguards

• Authority discretion is present in multiple places: the Authority may give written exemptions from examination requirements (regulation 14(2) - “Unless given a written exemption by the Authority”), may approve or require exceptions to language of answers (regulation 19), may make special arrangements for disabled candidates or those with illness/injury (regulation 25(1)), and may extend time for providers to comply with reporting requirements (regulation 7(7)). These discretionary powers are accompanied by procedural requirements such as documentation and time limits for appeals or applications.

In short, enforcement under the Regulations is administrative, centring on control of access to examinations, adjustment of assessment outcomes, imposition and collection of fees for specified services, and procedural controls on disclosure decisions. The Regulations do not create new criminal offences or criminal fines; any such penalties would need to be found in the Act or other statutes, which the Regulations reference but do not reproduce.

The Regulations frequently incorporate or reference other statutes and national standards, creating cross‑cutting compliance and interpretive linkages. The principal interactions apparent in the text are:

References to the Act and School Education Act

• The Regulations implement and operationalise specific sections of the School Curriculum and Standards Authority Act 1997. Several regulations are expressly drafted as prescriptions for the purposes of identified Act sections (for example, regulation 4 cites Act s. 19E, regulation 5 cites Act s.19G, regulation 9 cites Act s.19P and several others reference Part 3A of the Act). The Regulations therefore must be read in the statutory context of the Act: the Regulations supply detail and timing where the Act delegates that function.

• The Regulations reference the School Education Act 1999 in regulation 9 by referring to section 11B(1) categories (regulation 9(2)(c)-(j)). The data the Authority must supply to Catholic and Independent education bodies under regulation 9 are explicitly staged to correspond to the options listed in SE Act s. 11B(1).

Commonwealth migration and citizenship law

• The definition of “Australian resident” in regulation 3 is by reference to the Australian Citizenship Act and the Migration Act (regulation 3). This cross‑reference determines which fee schedule applies (regulations 10-11) and therefore engages Commonwealth visa and citizenship categories in the application of a State regulatory charging regime.

Public Sector Management Act and National Statement

• Regulation 32(1) borrows the definitions of “agency” and “non‑SES organisation” from the Public Sector Management Act 1994 to classify applicants seeking data (regulation 32(1)). This determines whether a request is a “non‑government request” subject to mandatory committee review.

• For research disclosure requests, the Regulations require applicants to indicate whether their research has been approved by a “human research ethics committee” constituted in accordance with the National Statement on Ethical Conduct in Human Research (regulations 30 and 31(c)). The “National Ethical Statement” itself is the NHMRC National Statement, and it is incorporated by reference in the procedural gatekeeping for disclosure.

Financial Management Act and reporting

• The Authority’s annual report obligations are linked to the Financial Management Act 2006 Part 5; regulation 35 requires the annual report prepared under that Act to include a report on the number, nature and outcome of disclosure requests accepted by the Board (regulation 35). This creates a statutory transparency channel in Government reporting.

Gazette and ministerial determinations

• The Minister’s power to determine fees for non‑residents and publication charges requires publication in the Western Australian Government Gazette (regulations 11(2) and 12(3)). Those determinations can set differential fees by course, provider or country of origin, thereby interacting with administrative law principles on delegated rule‑making and with principles of transparency and procedural publication.

Privacy, data protection and research ethics

• While the Regulations set in detail the operational processes for disclosure, they do not themselves specify privacy legislation compliance such as the Privacy Act 1988 (Commonwealth) or State privacy regimes. Nonetheless, regulation 32(4)(b)(i)-(iii) requires committees evaluating non‑government requests to advise on recipients’ ability to ensure the security of personal information and to comply with conditions that might be imposed under s32B(4) of the Act and any written law, guideline or policy that applies to the research (regulation 32(4)). This cross‑links the Authority’s disclosure decisions to privacy and research ethics frameworks.

Evidence and statutory declaration requirements

• The Regulations invoke statutory declaration evidence for private candidates submitting practical examination material (regulation 24(4)). Statutory declarations are governed by other statutory regimes (e.g. Oaths, Affidavits and Statutory Declarations Acts) and thus intersect with those procedural statutes on form and legal effect.

Implications of cross‑references

• The Regulations’ multiple references mean that compliance requires operators to track not only the Regulations but also the Act and several other legislative instruments and national standards. For example, whether a provider must report within 14 days will depend on how the Act defines the provider table items (regulation 6 refers to that table in section 19A(2) of the Act). Similarly, whether a research request has HREC approval requires familiarity with NHMRC processes and standards.

• Ministerial discretions and Gazette determinations give effect to variable fees and charges (regulations 11 and 12) and hence require monitoring of Gazette notices for the applicable fee schedules for non‑residents and publications.

Overall, the Regulations are a node in a network of State and Commonwealth instruments and national standards; effective compliance requires reading the Regulations in conjunction with the Act, the SE Act, Commonwealth migration and citizenship legislation, the Public Sector Management Act, the National Statement and relevant reporting and finance legislation.

The compilation table and marginal notes in the Regulations document the legislative amendment history. Key amendments and insertions are visible from the compilation materials and marginal notes attached to specific regulations:

• Original instrument and commencement: The instrument initially appeared as the Curriculum Council Regulations 2005 and commenced 1 January 2006 (regulation 2 notes). The citation was later changed to the School Curriculum and Standards Authority Regulations 2005 (see the compilation table and note under regulation 1).

• 2006 amendments: The Curriculum Council Amendment Regulations 2006 were published 18 October 2006 and amended the Regulations (see compilation table). Regulation 3 shows an amendment date of 18 Oct 2006 in its marginal note.

• 2009, 2012 and 2013 amendments: The compilation table lists amendment instruments in 2009 (6 March 2009 publication) and 2012 (14 August 2012 and 7 December 2012 instruments). The 14 August 2012 and 7 December 2012 instruments resulted in multiple insertions and structural changes; for example, numerous marginal notes in the body show [Heading inserted: Gazette 7 Dec 2012 p. 5984], and regulation 4 was amended with a Gazette note dated 14 Aug 2012 p. 3833. Regulation 8 was deleted by Gazette 7 Dec 2012 p. 5985.

• 2013 and 2014 amendments: The compilation table records School Curriculum and Standards Authority Amendment Regulations 2013 (published 6 Sep 2013) and 2014 (published 26 Aug 2014), with commencement dates in 2013 and 2014 respectively for different parts.

• 2017 amendment: The Regulations were amended by School Curriculum and Standards Authority Amendment Regulations 2017 (published 24 Nov 2017).

• 2020 insertion of Part 5 (procedures for disclosure): SL 2020/233 (4 Dec 2020) inserted Part 5 and corresponding regulations 29-35, as shown by the marginal note [Heading inserted: SL 2020/233 r. 4.] and the inserted text for regs 29-35. This is the instrument that added the procedures governing Board disclosure of relevant information for research, the requirement for written requests with HREC information (regulation 31), committee review of non‑government requests (regulation 32), and the register and reporting obligations (regs 33-35).

• 2022 and 2023 fees and charges amendments: The compilation table records instruments in 2022 and 2023 amending fees and charges. Schedule 1 has a marginal note [Heading inserted: SL 2023/67 r. 8.] indicating its most recent insertion or update by SL 2023/67 (published 16 Jun 2023) with commencement 1 Jul 2023. The Education and Training Regulations Amendment (Fees and Charges) Regulations 2022 (SL 2022/61) also appear in the compilation table with commencement 1 Jul 2022 for those amendments.

• Specific inserted provisions: Many individual regulations carry marginal notes indicating they were inserted by particular Gazette publications. Examples include regulation 5 (inserted Gazette 7 Dec 2012 p. 5984), regulations 13-28 inserted Gazette 7 Dec 2012 p. 5986-5992, and regulations 29-35 inserted SL 2020/233 r.4.

• Deleted provisions: Regulation 8 is marked “Deleted: Gazette 7 Dec 2012 p. 5985.”

For practitioners this means the framework has evolved in stages: early operational rules from 2006 and later structural changes in 2012 consolidated examination and student record rules; a notable policy insertion in 2020 added detailed processes for research disclosure; and fee schedules were updated in 2022-23, with Schedule 1 reflecting current fees as at the 2023 instrument. Users should consult the Gazette instruments listed in the compilation table for the precise texts and commencement dates of each amendment, and check for any subsequent instruments beyond those in the compilation table.

The Regulations as compiled do not record case law or judicial decisions. The text of the Regulations contains no citations to judicial authority nor any marginal notes identifying judicial consideration. The compilation and “Other notes” sections similarly do not list litigation.

Practical implication: the Regulations themselves are administrative rules and much of their operation will produce administrative decisions (for example, decisions to reduce marks, refuse disclosure requests, or impose fees). Any litigation examining those decisions would appear in separate judicial or tribunal records, not in the Regulations. The Regulations require internal administrative review mechanisms (for example, the appeals committee procedure in regulations 26-28), and do not create a statutory private right of action or internal statutory appeal route beyond those prescribed processes. If a party seeks external judicial review, they would need to rely upon general public law remedies such as judicial review in the Supreme Court, but that possibility is not addressed or limited in the Regulations themselves.

Because the Regulations reference other statutes (including the Act and provisions about disclosure under s32B, and ministerial determinations), disputes about interpretation or validity could, and in practice might, arise from those interactions. However, the Regulations do not include a litigation history appendix, and the only court or tribunal authority to cite would have to be identified from external legal research beyond the text of these Regulations.

The Regulations contain multiple operational and timing traps for the unwary. The following are concrete high‑risk items to watch for and why they matter, with regulation citations.

Timing and reporting windows

• Opening student records by end of first term: A student record must be opened under section 19C not later than the end of the first term of the relevant school year (regulation 7(1)). Missing this window could mean non‑compliance with Part 3A obligations and downstream data gaps.

• Annual data deadlines: Principals and providers must give information relating to a year not later than 31 December in that year (regulation 7(2)). The Authority must provide data extracts as at 31 December and supply them by 28 February in the following year (regulation 9(2A), (2) and (3)). These are strict annual cut‑offs; administrative calendar alignment is necessary.

• Short notice enrolment notifications: Providers mentioned in section 19F(2)(b) or (3) must notify the Authority within 14 days after enrolment (regulation 7(3)). Providers mentioned in section 19F(5) must notify cessation within 7 days (regulation 7(6)). Failure to set up systems to meet these narrow windows will create compliance risk.

Correction windows and exceptions

• Corrections deadlines: If information given under Part 3A is found incorrect on or before 31 March, corrected information must be supplied by 30 April (regulation 7(4)). For certification for final year students, if changes are discovered after 31 March and on or before 23 November, corrected information must be supplied by 1 December (regulation 7(5)). These two overlapping correction pathways create different remedial obligations depending on timing.

Unique reference numbers and identity control

• URN is mandatory and used for practical submissions: The Authority allocates URNs and those numbers are the prescribed identifier for students (regulation 4(1)-(3)). Practical examination materials may be identified only by URN (regulation 24(2)). Schools must ensure URNs are recorded and used consistently; failure can lead to anonymous or unmatchable submissions.

Declarations and statutory declarations

• Declarations for practical assessments: Student practical material must be accompanied by a written statement signed by the student and witnessed by both the supervising teacher and the principal (regulation 24(3)). A private candidate must supply a statutory declaration (regulation 24(4)). These are formal documents; improper witnessing or unsigned declarations may render submissions non‑compliant.

Private candidates and residency

• Private candidates must be residents of the State and pay fees: A non‑enrolled person may be a private candidate only if resident of the State, applies in writing within Authority timeframes, and pays the prescribed fee (regulation 14(3)). The definition of “Australian resident” matters for fee categorisation (regulation 3).

• Fees differential risk: For non‑residents, the Minister may set different fees by course, school, country of origin or other criteria (regulation 11(3)). International students and providers should monitor Gazette determinations because fees may vary and be applied retrospectively only as determined and published.

Examination procedure pitfalls

• Identification documents must be produced: Candidates must produce the identification document issued by the Authority if requested by a supervisor (regulation 16(2)). Centres must issue documents (regulation 16(1)). Logistics: missing IDs can lead to exclusion or misconduct findings.

• Strict rules on English language answers: Answers must be in English unless Authority approval to the contrary is given (regulation 19). Candidates working in languages other than English must secure prior authority.

• Limited food and water allowances: Consumption of anything other than water in an approved container is prohibited unless written exemption is given (regulation 20(1)-(2)). Health accommodations must be requested in advance under the special arrangements regime.

Discipline and appeals procedural deadlines

• Short appeal window: A candidate subject to mark reduction has only seven days after notification to appeal, and the appeals committee must be appointed within five days after appeal receipt or receipt of evidence (regulation 26(3), 27(2)). Appeals must be in writing with stated grounds and supporting evidence (regulation 26(4)-(5)). Administrative agility is required to mount an appeal.

Disclosure requests for research

• Written and specific form required: The Board will not accept a request unless it is in writing, contains sufficient information to understand objectives and methodology and identify the requested information, and indicates whether HREC approval has been given (regulation 31(a)-(c)). Incomplete or generic research proposals risk refusal.

• Non‑government review and security questions: Non‑government requests that may require personal information must be referred to a committee that will advise on whether the recipient can secure the personal information and comply with conditions (regulation 32(3)-(4)). Researchers must provide robust security and legal compliance plans.

Register and transparency traps

• Register must not include personal information but must record whether personal information types were disclosed: The Board’s register must not itself include personal information (regulation 33(4)(a)), yet if personal information was disclosed the register must record which types (regulation 33(3)). Proper redaction and recordkeeping are therefore crucial to meet both transparency and privacy constraints.

Administrative discretion and delegation exposure

• Authority discretion to extend time: The Authority may extend time for compliance with reporting obligations (regulation 7(7)). Providers should not assume extensions will be granted and should apply formally.

• Ministerial discretion on fees: The Minister’s broad criteria under regulation 11(3) mean fee exposure for non‑resident students can vary and is subject to Gazette instrument publication. Institutions recruiting overseas students should monitor and budget for fee changes.

Overall, the “gotchas” are concrete timing deadlines, formal documentary requirements (signatures, statutory declarations, HREC approvals), identity infrastructure (URN), and the interplay of disclosure transparency and privacy constraints. Administrative systems must be aligned to narrow windows and formal processes defined in the Regulations.

This section sets out a practical checklist and operational steps for the main stakeholders to achieve compliance with the Regulations. The steps reproduce procedural requirements in the Regulations and cite the relevant provisions.

For schools and principals

1. Open student records on schedule: Ensure student records are opened under the Act not later than the end of the first term of the relevant school year (regulation 7(1)). Put this deadline into the school’s enrolment processing calendar and allocate responsibility.

2. Obtain and use URNs: Use the Authority’s administrative arrangements to allocate and record the unique reference number for each student (regulation 4(1)-(2)). Ensure URNs are recorded in the school management system and used on practical examination submissions (regulation 24(2)-(3)).

3. Submit year‑end results: Notify the Authority of students’ results for the educational programme/courses in which the student was enrolled at the end of the school year, in accordance with Authority requirements (regulation 5(2)). Schedule internal data validation well before 31 December to meet the deadline (regulation 7(2)).

4. Make corrections within specified windows: If corrections are necessary and discovered by 31 March, supply corrected information by 30 April (regulation 7(4)). For certification issues in the final year, if corrected information is discovered after 31 March and on or before 23 November, supply by 1 December (regulation 7(5)).

5. Support special arrangements: For students needing special arrangements (disability, illness), prepare and submit written applications and supporting evidence well before examination days; principals must submit applications for student applicants (regulation 25(2), (5)).

6. Witness practical exam declarations: Ensure supervising teachers and the principal sign and witness the authenticity declaration on any practical examination material (regulation 24(3)).

For non‑school providers, employers and trainers

1. Understand provider classification: Identify which item in the provider table in s19A(2) of the Act applies; regulation 6 references that table and imposes reporting obligations (regulation 6(1)-(3)).

2. Supply particulars on final assessment: When a final result is assessed, give particulars to the Authority (regulation 6(2)). Implement administrative procedures to transmit such particulars promptly.

3. Notify enrolments and cessations in strict timelines: For providers in section 19F(2)(b) or (3) notify the Authority within 14 days of enrolment (regulation 7(3)). For providers in section 19F(5) notify cessation within 7 days (regulation 7(6)). Put automated notifications into the enrolment/onboarding workflows to avoid lapses.

4. Apply for extensions if necessary: If an exceptional circumstance prevents meeting a deadline request the Authority for an extension under regulation 7(7) and document the request.

For candidates (students and private candidates)

1. Check eligibility for examinations: Students may sit exams only if enrolled in the course (regulation 14(1)). Final‑year students must take specified examinations unless they have a written exemption from the Authority (regulation 14(2)).

2. Private candidate eligibility and fees: If you are not enrolled at a school but seek to sit as a private candidate, ensure State residency, make a written application within the Authority’s approved period, and pay the prescribed fee in Schedule 1 (regulation 14(3) and Schedule 1 items 6-8).

3. Obtain and retain identification document: The Authority will issue an ID document containing your URN (regulation 16(1)); produce it if requested by a supervisor (regulation 16(2)).

4. Follow examination conduct rules: Do not bring unauthorised materials into the examination centre, comply with supervisor directions, answer in English unless authorised otherwise, observe food and drink rules, avoid communicating with others, and do not remove materials without approval (regulations 18-23, 19, 20, 21, 22).

5. Special arrangements and special consideration: Apply in writing with supporting medical evidence for special arrangements before the examination day (regulation 25(2)). For acute illness on the day, apply for special consideration by 28 November with evidence (regulation 25(3)-(4)).

6. Sign practical declaration or statutory declaration: For practical exams, include the required signed declaration witnessed by teacher and principal (regulation 24(3)). Private candidates must provide a statutory declaration (regulation 24(4)).

If accused of misconduct

1. Respond quickly to an allegation: A mark reduction decision can be appealed within 7 days of notification; prepare a written appeal with grounds and any evidence within the seven‑day window (regulation 26(3)-(5)).

2. Expect rapid procedural timelines: The Authority must appoint an appeals committee within five days after appeal receipt or after receipt of requested evidence (regulation 27(2)). Ensure availability for any expedited processes.

For researchers seeking disclosure of relevant information

1. Form applications carefully: Do not submit an incomplete request. The Board will not accept a request unless it is in writing, contains sufficient information to understand objectives and methodology and to identify the relevant information requested, and indicates whether the research has HREC approval (regulation 31(a)-(c)).

2. Secure HREC approval where relevant: Where human research ethics committee approval is appropriate, include evidence or an indication of approval status. The Board’s procedures explicitly reference the NHMRC National Statement (regulation 30 and 31(c)).

3. Prepare robust data security and compliance plans: Non‑government requests that might require personal information will be referred to a committee which must advise on the recipient’s capacity to secure personal information and comply with conditions (regulation 32(3)-(4)). Provide detailed security, governance and compliance documentation up front.

4. Expect public reporting of request outcomes: The Board maintains a register listing requests, whether accepted and types of personal information disclosed (regulation 33(2)-(3)), and the Authority must report the number, nature and outcome of accepted requests in its annual report (regulation 35). Prepare to have non‑identifying summary information disclosed in public reporting.

For the Authority and Board administrators

1. Maintain URN allocation arrangements: Implement and document the URN allocation scheme and ensure each student record opening follows the arrangements (regulation 4).

2. Secure exam materials and appoint supervisors: Ensure managers of examination centres maintain security and supervisors comply with storage and inspection directions (regulations 15(2), 17(2)).

3. Keep the register of disclosure requests: Meet the register content requirements and avoid storing personal information in the register itself while accurately recording the types of personal data disclosed if any (regulation 33(2)-(4)).

4. Ensure timely appointment of committees and decisions: Follow the tight timeframes for misconduct appeals, appointment of appeals committees and notification to candidates (regulations 26-27).

5. Publish fee determinations and charge appropriately: For fees and charges set by the Minister for non‑residents and publications, ensure publication in the Gazette (regulations 11(2), 12(3)) and implement collection procedures for fees in Schedule 1.

In short, compliance requires process controls mapped to the Regulations’ deadlines, document templates for declarations and applications, secure data governance plans for disclosure requests, and administrative capacity to act quickly on appeals and misconduct decisions.
