Same-Sex Relationships (Equal Treatment in Commonwealth Laws—General Law Reform) (Veterans’ Affairs) Regulations 2019

The instrument deploys a small set of legal techniques across a range of MRCA and VEA provisions. The main concepts are:

• Deeming of relationship status for statutory purposes. Several regulations take a person to have been a "wholly dependent partner" or "dependant" for specified sections when three conditions are met: the member or veteran died before 1 July 2009; at that time the person was not the relevant dependant or partner; and the person would have been so if the 2008 Act had been in force at the time, see regs 6(1)-(2), 9(1)-(2), 16(1)-(2), 19(1)-(2), 22(1)-(2), 26(1)-(2). Functionally, the instrument retrofits eligibility where the only reason for exclusion was the earlier non‑recognition of same‑sex relationships under Commonwealth law.
• Deeming of the date of death for entitlement timing. Several provisions fix the operative date of death for the purpose of calculating entitlement start dates or qualifying periods, most commonly treating the date of death as 1 July 2009, see regs 6(3), 16(2)(b), and others treat the veteran as having died on 30 June 2009 for specified provisions, see regs 23(2), 24(2). Those date fixes affect when pensions, treatments and schemes become payable or effective.
• Selective non‑liability or restriction of Commonwealth payment obligations. Multiple provisions specify that the Commonwealth is not liable to pay compensation under particular MRCA or VEA sections where the person would not, under the temporal constraints, have been a dependant before 1 July 2009, see regs 8(2), 10(2), 12(2), 14(2), 15(2), 21(2), 25(2). Where the Regulations deem a person to be a dependant, that deeming does not universally create liability for payments prior to 1 July 2009; it often limits payment exposure to dates on or after 1 July 2009.
• Treatment and pharmaceutical allowance entitlements. The instrument takes people within the scope of Part 3 of Chapter 6 of the MRCA (treatment entitlements) where the predicates are met, see regs 16(2)(a), 17(2)(a), and reg 18 directs that persons to whom regs 16 or 17 apply are taken to be entitled to treatment from 30 June 2009 for the purposes of s 300 MRCA (pharmaceutical allowance), see reg 18 and the note to it.
• Application to specific classes: "wholly dependent partner", "eligible young person", "dependant", "child", "partner", "widow or widower", "war widow or war widower" and eligibility under Parts III, VII and VIIC of the VEA. The instrument maps these relationship categories to specific statutory subparts of the MRCA and VEA and gives effect to them on the retroactive timeline described above.

The conceptual effect is limited: the Regulations do not alter substantive definitions in MRCA or VEA. Instead, they create conditional retroactive application for people who were excluded solely because the 2008 Act was not yet operative at the time of death. The operative test used repeatedly is hypothetical: "the person would have been the [category] if the Act had been in force at the time of the member's/veteran's death." Practically, that requires agencies to apply the legal tests in MRCA and VEA to contemporaneous facts from before 1 July 2009 and then to give those persons the statutory treatment or to exclude liability in the way the relevant regulation prescribes.

Primary affected groups identified in the Regulations are:

• Individuals who were not, at the time of a member’s or veteran’s death occurring before 1 July 2009, recognised under the MRCA or VEA as a partner, wholly dependent partner, dependant or child, but who would have been so recognised if the Same‑Sex Relationships (Equal Treatment in Commonwealth Laws,General Law Reform) Act 2008 had been in force at that time. The instrument repeatedly phrases the trigger as the person "would have been" a specified class under the MRCA or VEA had the 2008 Act been in force, see regs 6(1)(c) and similar throughout regs 6-26. Examples in the instrument include partners, wholly dependent partners, eligible young persons, dependants, children, widows and war widows for the defined statutory purposes.
• The Commonwealth as payer. The regulations modify when the Commonwealth becomes liable or is expressly not liable for specific payments under MRCA or VEA provisions. Multiple regulations specify that "the Commonwealth is not liable to pay compensation" to a person under particular sections for periods before 1 July 2009, see regs 8(2), 10(2), 12(2), 14(2), 15(2), 21(2), 25(2). Where persons are "taken to be" dependants, the Commonwealth retains payment obligations from the dates indicated by the regulations.
• Administrators and agencies who operate the MRCA and VEA schemes. The Department of Veterans’ Affairs and decision‑making bodies responsible for MRCA payments will need to process claims under the adjusted rules, apply the deeming rules, determine effective dates and reconcile payments. The Regulations direct how to treat people for the purposes of named statutory provisions, for example by taking the person to be entitled to treatment under Part 3 of Chapter 6 of the MRCA, see regs 16(2)(a), 17(2)(a).
• People who previously received payments or assistance where retrospective "deeming" or adjusted effective dates might affect overpayment calculations or eligibility determinations. The instrument contains specific non‑liability rules which imply that benefits are not payable before 1 July 2009 in some circumstances, see regs 7(3), 13(2)(b), 25(2).

Secondary impacts, implied by the Regulations’ operation:

• Lawyers, accountants, advocates and advisors who represent surviving partners, children or young persons will need to apply the MRCA and VEA definitions to facts existing before 1 July 2009 and submit claims or requests for determination under the relevant statutory provisions, using the Regulations as the legal basis for retroactive application.
• Records custodians and case managers will need to assemble historical evidence of dependence or partnerships that existed prior to 1 July 2009, because the Regulations hinge on whether the person "would have been" a specified class if the 2008 Act had been in force.
• The 2009 Regulations that previously governed this area are repealed by Schedule 1, item 1, so parties and administrators must work from the current 2019 instrument as the operative subordinate legislation, see Schedule 1.

The Regulations therefore primarily reallocate (or confirm) legal recognition and payment timing for a discrete group of potential claimants whose exclusion was due to the pre‑2009 legal status of same‑sex relationships. They also impose administrative tasks on decision makers within the existing MRCA and VEA frameworks.

The Regulations do not create new standalone duties in the sense of criminal or regulatory obligations. They modify how existing statutory rights and obligations under the MRCA and VEA are to be applied in the specified factual circumstances. The principal rights and administrative duties created or altered by the Regulations are as follows.

Rights conferred, by deeming, upon qualifying persons

• Right to be treated as a wholly dependent partner or dependant for certain MRCA sections. Where the instrument’s factual prerequisites are satisfied, the person is taken to have been the wholly dependent partner for the purposes of particular MRCA provisions, see reg 6(2) (sections 233 and 234 MRCA) and reg 9(2) (section 245 MRCA). Similarly, reg 7(2) takes the person to have been the wholly dependent partner for the purposes of s 239 MRCA.
• Right to certain MRCA payments for periods after specified dates. For eligible young persons who were wholly or mainly dependent immediately before the member’s death and who would have been a dependant, reg 11(2) provides compensation is payable for a week or part of a week occurring after 30 June 2009 as if the member had died on 1 July 2009, thereby establishing the timing of payment entitlement under s 253 MRCA.
• Right to treatment under Part 3 of Chapter 6 MRCA for injuries or disease where predicates are met, see regs 16(2)(a) and 17(2)(a). Reg 18 ties that treatment entitlement into pharmaceutical allowance eligibility under s 300 MRCA by directing that a person to whom regs 16 or 17 apply is taken to be entitled to treatment from 30 June 2009 for the purpose of s 300.
• Rights under the VEA. The instrument takes certain persons to be dependants or partners for the purposes of VEA provisions. For example, reg 19(2) applies s 13A VEA to a person as if the person is a dependant of the veteran from on or after 1 July 2009; reg 22(2) applies Part III of the VEA as if the veteran had died on 1 July 2009 and as if the person had been receiving a partner service pension immediately before the veteran’s death.

Duties, administrative obligations and limitations on Commonwealth liability

• Administrative duty to apply the deeming and date provisions. Decision makers administering MRCA and VEA provisions must apply the Regulations’ deeming where the factual predicates are satisfied. That is an operational duty arising from the Regulations’ direction to treat persons as having particular statuses or to take the date of death to be a specified date for the purpose of named sections, see regs 6-26.
• Limited Commonwealth liability for some payments. Several regulations expressly specify that the Commonwealth is not liable to pay compensation under certain MRCA sections to qualifying persons, see regs 8(2), 10(2), 12(2), 14(2), 15(2), 21(2), 25(2), or that benefits under schemes are not payable before 1 July 2009, see reg 13(2)(b) and reg 25(2). Those provisions construe the scope of the Commonwealth’s financial duty.
• Temporal qualifications on entitlement. Several rights are qualified by date: reg 7(3) bars compensation for the cost of obtaining financial advice under s 239 MRCA for advice received before 1 July 2009; reg 13(2)(b) bars payment of benefits under an education or training scheme before 1 July 2009 even though the power to determine such a scheme is taken to include power to provide it to the person. The instrument therefore creates duties to calculate entitlement start dates and to apply non‑liability rules where specified.
• Repeal effect , administrative duty to rely on the 2019 instrument. Schedule 1 repeals the 2009 Regulations in full. Administrators must therefore apply the current 2019 Regulations rather than the earlier instrument for all relevant determinations, see Schedule 1.

No new private civil enforcement mechanism is created by the Regulations. Persons seeking to enforce entitlements granted or recognised by the Regulations must proceed through the MRCA and VEA statutory processes, which determine eligibility, payment and review rights. The Regulations themselves alter how those statutory provisions operate in specified circumstances but leave the MRCA and VEA compliance, review and appeals architecture intact.

The Regulations do not create any new penalty provisions or criminal offences. There are no provisions within the instrument that prescribe fines, imprisonment, or administrative penalties. Enforcement therefore occurs only by incorporation into existing MRCA and VEA administrative and dispute resolution procedures. Practical enforcement features and consequences, as allowed by the source text, are:

• Administrative enforcement through the MRCA and VEA decision‑making frameworks. The Regulations direct how decision makers are to treat particular persons for the purposes of named MRCA and VEA sections, therefore any dispute about entitlement, liability or effective dates will be resolved using the statutory decision and review mechanisms in those Acts. The Regulations themselves do not specify appeal routes but their effect is to change the legal basis upon which MRCA and VEA determinations are made.
• Financial exposure and non‑liability mechanisms. The Regulations frequently specify that the Commonwealth is "not liable to pay compensation" under particular sections in a specified context, see regs 8(2), 10(2), 12(2), 14(2), 15(2), 21(2), 25(2). That is an express legal allocation of financial responsibility and functions as a binding rule on administrators about when not to make payments. Failure by an administrator to apply those non‑liability rules would be an error of law subject to the usual administrative review grounds in the MRCA or VEA regime.
• No express enforcement clauses for false statements or fraud. The instrument does not add offences for false representations or documentary falsification in claim processes. Existing reforms and offences in MRCA, VEA or general Commonwealth law (not reproduced in the Regulations) would govern fraudulent claims; those are not modified by the Regulations as presented.
• No specified regulatory penalty for administrative non‑compliance. There is no separate regulatory penalty for an administrator failing to apply the Regulations. Remedies for incorrect application are those supplied by the MRCA and VEA administrative law and merits/review processes.

For practitioners and administrators, the practical enforcement implication is that correctness in applying the Regulations will be tested within the MRCA/VEA frameworks and judicial or administrative review channels are the relevant enforcement pathways. The Regulations’ clear textual commands about non‑liability and date deemings will be focal points in any dispute over payments, entitlements and retrospective application.

The Regulations operate by changing how particular provisions of the MRCA and VEA apply in specified circumstances. The statutory interplay is explicit in the text: the instrument makes application provisions and transitional provisions tied to named sections of those Acts. Principal points of interaction are:

• Subordinate law under the 2008 Act. The instrument is made under item 86 of Schedule 2 to the Same‑Sex Relationships (Equal Treatment in Commonwealth Laws,General Law Reform) Act 2008, see reg 3. That confers the delegated power to make these adjustment regulations to implement the general law reform decisions made in the 2008 Act. The 2008 Act itself is the upstream enabling statute, but the Regulations effect the precise transitional rules for MRCA and VEA.
• MRCA and VEA substantive provisions. Each regulation names the MRCA or VEA provision to which it applies. For example, reg 6 affects ss 233 and 234 of the MRCA; reg 7 affects s 239; reg 16 affects s 284; reg 19 affects s 13A of the VEA; reg 22 affects Part III of the VEA; reg 26 affects Part VIIC of the VEA. The Regulations do not alter the text of those Acts but direct courts and administrators to treat persons in a specified way for the purposes of interpreting and applying those provisions.
• Temporal interplay with payment and allowance provisions. The Regulations also interact with MRCA s 300 (pharmaceutical allowance) by directing treatment entitlement dates for persons taken to be eligible, see reg 18 and the note. That interaction means pharmaceutical allowance eligibility under MRCA s 300 is affected by the deeming carried out in regs 16-18.
• Repeal of earlier subordinate law. Schedule 1 repeals the 2009 Regulations. That removes the earlier instrument from the subordinate law landscape and replaces its regulatory architecture with the 2019 instrument. Entities relying on historic subordinate law must now use the 2019 instrument for transitional determinations.
• No amendment to definitions within MRCA or VEA in this instrument. The Regulations do not change statutory definitions in the MRCA or VEA. Instead they require applying those existing definitions retrospectively. Therefore, the Tests and meanings for "wholly dependent partner", "dependant", "eligible young person", "child", "partner" and other terms remain those in MRCA and VEA; the Regulations only deem status or fix dates where the hypotheticals apply. Practitioners must read the MRCA/VEA definitions alongside the Regulations.
• Administrative law and review. Because the Regulations operate by directing how to treat persons under MRCA and VEA provisions, questions of legal error, reasonableness, procedural fairness and merits review remain governed by MRCA/VEA administrative and judicial review processes. The Regulations do not displace or modify the ordinary remedies available under those Acts.

In short, the Regulations are a subordinate instrument that modifies application rather than substantive content of MRCA and VEA. They should be read as an overlay that tells administrators to treat certain pre‑1 July 2009 deaths as having particular legal consequences under those Acts, subject to the Acts’ own definitions, decision processes and appeal mechanisms.

The instrument provides limited amendment history material within its text:

• Made date and signatories. The instrument is dated 8 August 2019 and signed by the Governor‑General (General the Honourable David Hurley AC DSC (Retd)) and by the Attorney‑General (Christian Porter), see opening formalities and the date line.
• Commencement. The commencement table in reg 2(1) states that the whole instrument commences "the day after this instrument is registered" and the table indicates that date as 22 August 2019 for the original instrument. The instrument includes the usual note that the commencement table relates only to provisions as originally made and will not be amended to deal with later amendments, see reg 2(2).
• Authority for making the instrument. The instrument is made under item 86 of Schedule 2 to the Same‑Sex Relationships (Equal Treatment in Commonwealth Laws,General Law Reform) Act 2008, see reg 3. That links the Regulations to the earlier primary legislation undertaking general law reform.
• Repeal of the 2009 Regulations. Schedule 1, item 1 repeals in full the Same‑Sex Relationships (Equal Treatment in Commonwealth Laws , General Law Reform) (Veterans’ Affairs) Regulations 2009. The effect is to remove the 2009 subordinate instrument and replace it with the 2019 instrument. The 2019 instrument does not include a schedule of further amendments to itself within the provided text.
• No amendments or subsequent legislative history contained in the provided source. The instrument’s text, as supplied, contains no entries or notes of subsequent amendments, revocations, or history beyond the original commencement detail and the repeal of the 2009 Regulations. If there have been later amendments, they are not present in the supplied text and must be checked in updated legislative databases.

For users needing to trace changes over time, confirm the repeal of the 2009 regulations via Schedule 1, and note that any subsequent changes to either the MRCA, VEA, or the subordinate regulations will not appear here. To determine whether there have been later amendments, consult authoritative legislative repositories such as the Federal Register of Legislation.

The instrument itself does not identify or record any litigation. The text contains no references to court decisions, appeals or case law arising under these Regulations. Because subordinate legislation is an administrative instrument that adjusts application of MRCA and VEA provisions, disputes arising from its operation would be litigated under the MRCA and VEA administrative review and judicial review frameworks. The provided source contains no entries of judgments or proceedings that tested the Regulations’ provisions.

Practical implications for litigators and advisers

• No reported cases in the instrument. Since the Regulations do not list judicial treatment, practitioners must search external court and tribunal databases if they need to find litigation concerning the retroactive deeming provisions, date fixes or non‑liability rules. The absence of litigation in the instrument does not mean no disputes have occurred, only that none are recorded in this text.
• Likely grounds for litigation. Although not present in the source, predictable issues that could have given rise to disputes include (1) whether the factual predicate "would have been a dependant/partner if the Act had been in force" is satisfied, (2) construction of timing deemings (1 July 2009 v 30 June 2009), and (3) application of non‑liability rules where payments were made or not made. Any legal challenge would focus on statutory interpretation of the MRCA/VEA provisions as modified by the Regulations and on administrative law grounds where a decision maker failed to follow the Regulations’ directions.
• Procedural avenues remain those provided by MRCA and VEA. Appeals and merits review would proceed under the MRCA and VEA frameworks; the Regulations do not create a separate litigation route.

If litigation status is material to a matter, practitioners should perform an up‑to‑date case law search in Commonwealth and Federal Circuit and Family Court registries, the Administrative Appeals Tribunal decisions database and relevant higher court databases, because the instrument does not supply a litigation record.

The Regulations are compact and technical, but they contain several traps and practical subtleties for advisers and administrators. These are the principal "gotchas" drawn from the text.

1. The central hypothetical test , "would have been". Each application provision turns on a counterfactual: the person must be someone who, at the time of the member’s or veteran’s death, was not the relevant dependant or partner but would have been if the 2008 Act had been in force, see reg 6(1)(c) and corresponding clauses throughout regs 6-26. That is not a simple factual finding; it requires applying the MRCA/VEA tests as they exist to historical facts. Expect evidentiary burdens and potential disputes about whether contemporaneous facts satisfy the statutory tests. The Regulations do not set out evidentiary standards or presumptions.

2. Deeming does not always equal payment before 1 July 2009. Even when the Regulations take a person to have been a dependant or partner for certain statutory purposes, several provisions expressly limit Commonwealth liability for payments before 1 July 2009, see regs 8(2), 10(2), 12(2), 14(2), 15(2), 21(2), 25(2). Advisers must read both the deeming and the non‑liability statements carefully. For example, reg 11(2) allows compensation under s 253 MRCA for weeks after 30 June 2009 as if death had occurred on 1 July 2009, but reg 12(2) expressly denies liability under s 255 MRCA in similar fact patterns.

3. Different date fixes across provisions. The instrument alternates between treating a person’s date of the member’s or veteran’s death as 1 July 2009 and as 30 June 2009 depending on which statutory provision is being applied, see regs 6(3), 16(2)(b), 18, 23(2), 24(2). That creates complexity when calculating entitlement start dates and overlap between benefits. For instance, treatment entitlements under Part 3 of Chapter 6 may be taken as effective from 30 June 2009 for pharmaceutical allowance purposes (reg 18), while other pension or dependant determinations are taken from 1 July 2009. Advisers must map each statutory benefit to the date fix in the relevant regulation.

4. Some benefits remain expressly not payable before 1 July 2009. Reg 13(2)(b) states benefits under an education and training scheme determined under s 258 MRCA are not payable to the person before 1 July 2009 even though the power to determine the scheme is taken to include power to determine one to provide education and training to the person. Reg 7(3) disallows compensation for the cost of financial advice received before 1 July 2009 under s 239 MRCA. Practitioners must therefore not assume universal retrospective payments.

5. Repeal of the 2009 Regulations means practice must rely on the 2019 text. Schedule 1 repeals the 2009 Regulations in whole. If advisers are following older precedent or forms grounded in the 2009 instrument, they must reconcile those with the 2019 Regulations. Differences between the two instruments are not explained here; verify that older administrative practice remains appropriate under the new text.

6. Agency record and evidence burdens. Because the Regulations operate retroactively, agencies will need to examine records that are a decade or more old to determine whether the "would have been" test is satisfied. That generates evidentiary and practical challenges: locating documents, verifying contemporaneous dependency, and assessing relationship facts under statutory tests as they applied at the time.

7. No penalties or fraud provisions added. The instrument does not change the underlying fraud, false declaration or overpayment remediation regimes. If an applicant falsely claims to have been dependant, existing MRCA/VEA mechanisms apply. Practitioners must ensure proper documentation is filed to avoid potential repayment and administrative consequences.

8. Narrow scope , only deaths before 1 July 2009 addressed. The Regulations apply only to persons connected to members or veterans who died before 1 July 2009, see the recurring starting condition in regs 6-26. Cases involving deaths on or after 1 July 2009 are not affected by this instrument and continue to be governed by MRCA/VEA and the 2008 Act as in force.

9. Administrative discretion versus statutory direction. The Regulations direct that persons are "taken to be" dependants or partners for specified statutory purposes. Decision makers may have to reconcile this statutory direction with other eligibility rules in MRCA/VEA. Administrative errors in interpretation could be susceptible to merits review.

10. Cross‑benefit interactions. Where multiple MRCA or VEA provisions might apply to the same person (pensions, treatment, education schemes, child entitlements), the differing date deemings and non‑liability statements can generate gaps or overlaps in entitlement timing that require careful calculation.

Practitioners and administrators should therefore not treat the Regulations as automatically producing monetary awards. Each eligible person will still need a determination under the MRCA or VEA framework, supported by historic evidence, and outcomes for different heads of entitlement may vary in start date and payment exposure.

For advisers, administrators and claimants planning action under these Regulations, compliance is primarily administrative and evidential. The Regulations do not create new claim forms but change how existing MRCA and VEA provisions are to be applied. Practical compliance steps, grounded in the instrument’s text, are:

1. Identify eligible matters and confirm the triggering conditions. Before lodging or accepting a claim that relies on these Regulations, confirm the two recurring factual conditions in the relevant regulation are met: (a) the member or veteran died before 1 July 2009; and (b) at the time of death the person was not the relevant dependant or partner but would have been if the 2008 Act had been in force, see reg 6(1) and equivalents in regs 6-26. Where the regulation requires additional predicates (for example, reg 11(1)(d) that the person was wholly or mainly dependent immediately before death), ensure those are also satisfied.

2. Assemble contemporaneous evidence. Because the Regulations require hypothetical application of the 2008 Act to facts existing pre‑1 July 2009, gather documentary evidence from the time around the death to demonstrate the relationship or dependence. Such evidence may include financial records, shared household evidence, wills, contemporaneous affidavits, medical records indicating dependency, school or training records for young persons, and any correspondence showing the nature of the relationship at the relevant time.

3. Map the relevant statutory provision and the regulation’s effect. Each regulation names the MRCA or VEA section to which it applies. For the claim being pursued, identify the precise statutory head of entitlement in MRCA or VEA, then apply the corresponding regulation to determine the legal effect. Example mappings include reg 6 to ss 233 and 234 MRCA, reg 11 to s 253 MRCA, reg 19 to s 13A VEA, reg 22 to Part III VEA. That mapping determines whether you are seeking treatment, pension, education/training benefits, pharmaceutical allowance, funeral expenses, or other entitlements.

4. Calculate entitlement timing carefully. Check whether the regulation takes the date of death to be 1 July 2009, 30 June 2009, or otherwise adjusts timing. For example, reg 6(3) takes the date of death to be 1 July 2009 for ss 233 and 234 MRCA; reg 18 takes persons to be entitled to treatment under Part 3 of Chapter 6 from 30 June 2009 for s 300 MRCA. These date differences affect when pension or treatment payments begin and whether benefits are payable for particular periods.

5. Note express non‑liability provisions and exemptions. Do not assume universal retrospective payment. Check whether the regulation expressly states the Commonwealth is not liable to pay under a section for the person in question, see regs 8(2), 10(2), 12(2), 14(2), 15(2), 21(2), 25(2), or whether particular benefits are not payable before 1 July 2009, see reg 13(2)(b), reg 7(3). Those directives must be applied by the administrator.

6. Present claims through the MRCA/VEA channels. Use the MRCA or VEA claims processes to lodge requests for determination. The Regulations alter the legal basis for entitlement but do not create a separate claims regime. Where appropriate, cite the relevant regulation in the claim submission and explain how the fact pattern meets the regulation’s prerequisites.

7. Prepare for review and dispute. Given potential evidentiary and interpretative disputes about the "would have been" test and date deemings, ensure documentation supports both the factual predicate and statutory interpretation. If an administrative decision under MRCA or VEA is unfavourable, use the MRCA/VEA review and appeal mechanisms.

8. For administrators: update processing systems and training. Agencies administering MRCA and VEA should update guidance, training and decision templates to incorporate the 2019 Regulations’ deeming rules, date fixes and non‑liability clauses. Because the Regulations replace the 2009 instrument (Schedule 1), ensure legacy references and forms are changed to reflect the 2019 text.

9. Record and reconcile payments. Where payments or allowances are payable from dates set by the Regulations, agencies should reconcile accounts to reflect retrospective payment obligations and to ensure the non‑liability provisions are respected. Where payments were previously made that are inconsistent with the Regulations, follow the MRCA/VEA debt and overpayment handling processes.

10. Check for other legal limits. Verify whether other statutory limitations, qualification periods or eligibility tests in MRCA or VEA apply. The Regulations do not modify those tests; they only direct how particular provisions operate if the section’s prerequisites are satisfied.

11. Consult the enabling Act and MRCA/VEA definitions. Because the Regulations require applying MRCA and VEA terms to pre‑2009 facts, check the definitions and interpretive provisions in those Acts to ensure accuracy in applying the "wholly dependent partner", "dependant", "eligible young person" and similar statuses.

12. Note commencement and repeal. The instrument commenced on the day after registration, noted as 22 August 2019 in the commencement table, see reg 2(1). The 2009 Regulations were repealed by Schedule 1, item 1, so do not rely on that revoked instrument.

Following these practical steps will align claim preparation and administrative processing with the Regulations’ requirements. The focal points for evidence and calculation are the "would have been" counterfactual test, the specific MRCA/VEA provision being engaged, and the dates for payment or non‑liability specified in the relevant regulation.
