What it does
This instrument, the Safety, Rehabilitation and Compensation (Specified Persons and Acts) Declaration 2019, operates by declaring particular classes of persons and particular acts to be employment by the Commonwealth for the purposes of subsection 5(6) of the Safety, Rehabilitation and Compensation Act 1988 (the Act) (see s 1; s 3; s 5). Mechanically, it does not amend the Act; it exercises the power in s 5(6) to specify classes of persons and the acts that are to be treated as constituting their employment by the Commonwealth. Under the declaration, when a person falls within a class in Column 1 of an item in Schedule 1 and performs the acts described in Column 3, that person is "taken to be employed by the Commonwealth as represented by the Entity in column 2 of the item, or by the authority or corporation specified in column 2 of the item" (s 5(a)-(b); Schedule 1).
The instrument therefore creates a statutory deeming of employment status for a limited set of relationships and activities. It identifies the employer for Act purposes (the Commonwealth as represented by a named Entity or the named authority or corporation) and the acts that constitute the employment. The declaration covers unpaid assistance under control or direction of a Commonwealth officer for two named cultural/environmental authorities (Items 1 and 2), two specified appointed office-holders (Chief Scientist and CEO of the Australian Radioactive Waste Agency at Items 3 and 4), and members of certain emergency response teams (Item 5). For emergency response teams, the declaration expressly covers acts performed overseas and training activities connected to emergency response where Australian Government assistance has been requested (Schedule 1, Item 5, Column 3).
The instrument also links its definitions to the Act: the terms Act, Commonwealth authority, Entity and licensed corporation are to be read with the meanings they have in the Act (s 4). Consequently, the instrument’s scope and effect depend on those definitions in the parent Act. The immediate legal consequence is that, for the limited purposes of the Act, those persons and acts listed in Schedule 1 are treated as employment relationships with the Commonwealth (or the named authority/corporation), thereby bringing them within the coverage and obligations the Act imposes on employers and employees for safety, rehabilitation and compensation matters.
