What it does
This instrument, the Safety, Rehabilitation and Compensation (Definition of Employee - War Artists and Entertainers) Notice 2015, is a ministerial declaration made under subsection 5(6) of the Safety, Rehabilitation and Compensation Act 1988 (the SRC Act) (see the Notice preamble and s 3.1). Mechanically, it does a narrow, statutory characterisation: it declares that certain persons who perform specified acts or activities at the request or direction of either the Australian War Memorial or the Commonwealth (as represented by the Department of Defence) shall, for the purposes of the SRC Act, be taken to be employed by that Commonwealth authority (s 3.1(a)), and that the employment is constituted by the performance of those acts or activities (s 3.1(b)). The declaration expressly applies only “for the purposes of the SRC Act” (s 3.1).
The Notice identifies two distinct classes in its Schedule. Item 1 covers persons commissioned by the Australian War Memorial to provide original works in a range of media concerning operations of the Australian Defence Force, where the acts are performed in an Australian Defence Force area of operations; Column 3 identifies the Australian War Memorial as the employing body for SRC Act purposes. Item 2 covers persons contracted by the Department of Defence to provide entertainment, and related support and management or technical services; Column 3 identifies the Commonwealth (represented by the Department of Defence) as the employing body for SRC Act purposes. The Schedule contains notes that treat particular thresholds as satisfied for the purpose of the declaration (for example, a commissioned person is “taken to have acted at the direction or request” of the Australian War Memorial when performing acts in an ADF area of operations).
The instrument is limited in scope. It creates a deemed employment relationship only insofar as the SRC Act applies; it does not itself purport to alter other legal regimes. It contains two express exclusions (s 3.2): the declaration does not apply to a person who is a “member” as defined under s 5 of the Military Rehabilitation and Compensation Act 2004 (MRCA), and it does not apply where a State, Territory or foreign workers’ compensation law applies in respect of the person’s employment as described in s 3.1(b). The Notice commences the day after it is registered on the Federal Register of Legislative Instruments (s 2) and is dated 8 December 2015.
