What it does
This Notice, made under subsection 5(6) of the Safety, Rehabilitation and Compensation Act 1988 (Cth) (SRC Act), declares certain classes of persons to be employees of the Commonwealth or a Commonwealth authority for the purposes of that Act. The practical effect is that persons falling within the described classes, while performing the specified acts, are deemed to be employees under the SRC Act and therefore entitled to workers’ compensation coverage under that regime.
The Notice achieves this through a single declaration in clause 3, which operates in two limbs. First, it declares that a person who is included in a class listed in Column 2 of the Schedule, being a class of persons who engage in activities at the request or direction, for the benefit, or under a requirement made by or under a Commonwealth law, or at the request or direction or for the benefit of a Commonwealth authority, is employed by the Commonwealth or by that authority. Second, it declares that the employment is constituted by the performance of an act included in the class of acts referred to in Column 3 of the Schedule opposite the relevant class of persons.
This is not a general declaration of employment for all purposes. It is a deeming provision that applies only for the SRC Act’s workers’ compensation scheme. The Notice does not create a contract of service, confer industrial relations rights under the Fair Work Act, or entitle the person to leave, superannuation, or other employment benefits. It simply treats the person as an employee for the limited purpose of enabling them to claim compensation for work-related injury or disease under the SRC Act.
The Notice only applies to persons who meet both the class description and the activity description. The declaration is conditional on the person’s acts being within the Column 3 class of acts. If a person in a Column 2 class performs acts outside the described scope, they are not covered. Similarly, if a person not in any Column 2 class performs an act described in Column 3, they are not covered.
