What it does
This Notice, made by the Minister for Employment and Workplace Relations under subsection 5(6) of the Safety, Rehabilitation and Compensation Act 1988 (SRC Act) (see opening lines and clause 3), declares particular classes of persons to be employees of the Australian Federal Police (AFP) for the purposes of the acts specified in the Schedule. The Notice is titled Safety, Rehabilitation and Compensation (Definition of Employee) Notice 2006 (3) (clause 1) and commences on registration on the Federal Register of Legislative Instruments (clause 2). It was made by the Minister on 28 June 2006 (front page and signature block).
Mechanically, the instrument performs a single legal operation: it invokes the power in subsection 5(6) of the SRC Act to declare that specified classes of persons are “employees of the Australian Federal Police” for the purposes of the particular classes of acts listed opposite each class of persons in the Schedule (clause 3; Schedule columns 2 and 3). The Schedule sets out six discrete items (Items 1-6). For each item the Schedule pairs a class of persons (Column 2) with the class of acts for which those persons are declared employees of the AFP (Column 3). Examples include volunteers engaged under written agreement who receive no remuneration other than expenses (Item 1), persons assisting in training exercises without remuneration (Item 2), persons on secondment under section 69D(1) of the Australian Federal Police Act 1979 (Item 3), persons appointed as special members (Item 4) or special protective service officers (Item 5) under specified provisions of the AFP Act, and persons rendering assistance in emergencies or at request (Item 6).
The Notice is explicit about its limited scope. Clause 3 states that the declaration is made “for subsection 5(6) of the Safety, Rehabilitation and Compensation Act 1988,” and the Schedule confines the declaration to acts specified in Column 3. The short Note in the instrument further frames the target population as those “engaged in activities or perform acts at the request or direction, or for the benefit, of the Commonwealth” (Note under clause 3). The instrument therefore changes the legal status of the listed persons only insofar as the SRC Act’s relevant provision (s 5(6)) is engaged and only for the classes of acts specified.
