What it does
This statutory instrument, the Safety, Rehabilitation and Compensation (Definition of Employee - Defence Families of Australia) Notice 2015, is a ministerial declaration made under subsection 5(6) of the Safety, Rehabilitation and Compensation Act 1988. It formally declares that certain classes of persons associated with Defence Families of Australia are to be treated, for the purposes of that Act, as employees of the Commonwealth. The Notice is dated 20 April 2015, was made by the Minister for Employment, Eric Abetz, and commences on the day after it is registered on the Federal Register of Legislative Instruments, per clause 2.
Mechanically the instrument does two things. First, clause 3(a) declares that the classes of persons specified in Column 1 of the Schedule shall be taken to be employed by the Commonwealth. Second, clause 3(b) declares that the relevant employment is to be constituted, for the purposes of the Safety, Rehabilitation and Compensation Act 1988, by the performance of the acts or activities specified in Column 2 of the Schedule. The Schedule lists two items. Item 1 covers persons currently appointed to the Executive Committee of Defence Families of Australia, with a specific exclusion for any person who is a “member” as defined in section 5 of the Military Rehabilitation and Compensation Act 2004. Item 2 covers representatives of Defence Families of Australia who, at the direction or request of the Executive Committee, perform the listed acts for the benefit of the Commonwealth.
The Schedule describes the acts in Column 2 by reference to the Charter of Defence Families of Australia and then enumerates functions such as providing advice to responsible Ministers and ADF leadership, providing a forum for families to raise issues, assisting families to contact appropriate bodies, advocating on behalf of families, and assisting families to obtain information about benefits, assistance, rights, responsibilities and relevant Department of Defence policies. Item 2 adds that representatives may also provide assistance to the Executive Committee in carrying out those acts. The instrument is limited to its statutory effect under subsection 5(6) of the Safety, Rehabilitation and Compensation Act 1988 and does not itself reproduce or amend that Act, nor does it reproduce the Charter it references.
