What it does
This declaration, made under subsection 5(15) of the Safety, Rehabilitation and Compensation Act 1988 (the Act), treats specified COVID-19 emergency response volunteers as employees of the Australian Capital Territory for the limited purpose of the Act. The instrument names the document, sets a commencement date and defines the conditions that bring an identified volunteer within the Act. The operative rule is in section 5: persons whom the ACT Chief Health Officer has identified in writing as COVID-19 Response Volunteers, who are unpaid except for payment of expenses, and who meet one of three specified connection tests, and who assist in delivery of ACT COVID emergency response services under the control or direction of an ACT Government officer, are "taken to be an employee of the ACT for the purposes of the Act, when rendering such assistance" (s 5).
Mechanically, the declaration does three things. First, it creates a class of persons who are to be treated as ACT employees for the singular legal purpose of the Safety, Rehabilitation and Compensation Act 1988: the class is limited to those identified in writing by the ACT Chief Health Officer (s 5). Second, it sets eligibility conditions: volunteers must not receive remuneration other than reimbursement of expenses; they must act at the request/direction of, or for the benefit of, the ACT, or in accordance with an ACT enactment, or for the benefit of an authority or body established by an ACT enactment (s 5). Third, it confines the employee status to the time when the volunteer is actually assisting in delivery of ACT COVID emergency response services and doing so under the control or direction of an ACT Government officer (s 5).
The formal commencement clause states the declaration "commences on 12 August 2021" (s 2), while the instrument is executed on 11 October 2021 and signed by the Minister for Industrial Relations. The declaration relies on the ACT Chief Health Officer as the identifying official, the latter being a person appointed under s 7(1) of the Public Health Act 1997 (ACT), as defined in s 4. The instrument does not itself specify the rights, entitlements or administrative procedures under the Act, it simply alters the scope of who is to be treated as an employee for the Act's purposes (s 3 authority; s 5 declaration).
