In this instrument:

Act means the Safety, Rehabilitation and Compensation (Defence‑related Claims) Act 1988.

quarter means a period of 3 months beginning on 1 January, 1 April, 1 July or 1 October.

Forms of medical treatment

5 Forms of medical treatment

(1) For the purposes of paragraph (i) of the definition of medical treatment in subsection 4(1) of the Act, therapeutic treatment by, or under the supervision of, any of the following persons who meet the requirements of subsection (2) of this section is prescribed: (a) an occupational therapist; (b) an optometrist; (c) a podiatrist; (d) a psychologist; (e) a speech therapist or speech pathologist. (2) A person mentioned in any of paragraphs (1)(a) to (e) meets the requirements of this subsection if the person is: (a) registered by a national registration authority (within the meaning of section 8 of the Healthcare Identifiers Act 2010); or (b) if there is no such authority—a member of a relevant professional association.

For the purposes of item 13 of the table in subsection 7(8) of the Act, a kind of cancer specified in an item of the following table, and the qualifying period specified in the item for that kind of cancer, are prescribed.

For the purposes of subsection 8(9D) of the Act, the further increase in normal weekly earnings referred to in subsection 8(9B) of the Act is to be calculated, to 3 decimal places and rounded up to 2 decimal places, in accordance with the following formula: Start formula open bracket F times WE close bracket minus WE end formula where:

(a) the number (worked out to 4 decimal places and rounded up to 3 decimal places) obtained by dividing the index number by the previous index number;

11 Repeal of instrument taken to be made under the Act

The Safety, Rehabilitation and Compensation Regulations 2002 as in force for the purposes of the Act under item 63 of Schedule 1 to the Safety, Rehabilitation and Compensation Legislation Amendment (Defence Force) Act 2017 is taken to be repealed.

12 Application

Section 5A, as inserted by the Safety, Rehabilitation and Compensation (Defence‑related Claims) Amendment (Prescribed Cancers) Regulations 2023, applies in relation to a decision made under the Act (including a decision on reconsideration or review under Part VI of the Act), after the commencement of that instrument, in relation to a cancer mentioned in that section sustained by an employee on or after 4 July 2011.

This section sets out practical, source‑grounded steps for administrators, employers, practitioners and claimants to comply with the Regulations’ requirements. Each step maps to a Regulation citation in the instrument text.

For claims involving therapeutic treatment by the specified allied health professions, obtain and record proof of professional status. Under regulation 5(1)-(2), treatment by an occupational therapist, optometrist, podiatrist, psychologist or speech therapist/speech pathologist is to be treated as medical treatment only if the practitioner is either:
- registered by a national registration authority within the meaning of section 8 of the Healthcare Identifiers Act 2010 (produce a registration number or certificate); or
- if no such national registration authority exists for the profession in question, a member of a relevant professional association (produce evidence of active membership). Administrative practice should require claimants to supply verifiable registration or association documentation at the time treatment is claimed.
When applying item 13 of subsection 7(8) of the Act, use the prescribed cancers and qualifying periods set out in regulation 5A. Decision‑makers should consult the regulation 5A table and apply the listed qualifying periods exactly: 10 years for cervical, ovarian, pancreatic and thyroid cancer; 15 years for lung, skin, penile and malignant mesothelioma. Record how the sustaining date of the cancer aligns with the qualifying period test required by the Act.
Use the prescribed ABS Wage Price Index series where subsections 8(9B) and 8(9F) of the Act apply (regulations 6 and 8). When performing indexation computations, use the specific WPI series described in the Regulations: "total hourly rates of pay excluding bonuses/all sectors/all Australia/original" published by the Australian Statistician. Keep a record of the exact index numbers used and of the ABS publication citations (series code, release date, and the index number for the December quarter in the relevant years).
Apply the calculation formulas and rounding conventions exactly as set out in regulations 7 and 9. For each indexation event:
- Identify the "index number" (WPI for the quarter ended 31 December in the year immediately before the indexation date) and the "previous index number" (WPI for the quarter ended 31 December in the previous year).
- Compute the ratio index number / previous index number worked out to 4 decimal places.
- For the computation under regulation 7: round that 4‑decimal number up to 3 decimal places (explicit upward rounding).
- For regulation 9: round that 4‑decimal number to 3 decimal places using ordinary rounding.
- In each case, set F equal to the greater of the rounded ratio and 1.000.
- Let WE be the normal weekly earnings that applied immediately before the indexation date.
- Compute (F × WE) − WE to 3 decimal places, then round that result up to 2 decimal places.
- Note and implement the express rule that a further increase arises only if F is greater than 1.000.
Because the regulations prescribe both arithmetic precision and a "rounded up" final step, accounting systems must preserve intermediate decimal places (4 and 3 places as required) before performing the final rounding to 2 decimal places.
Ensure that the "indexation date" and the defined "quarter" are correctly identified in each case. The Regulations define "quarter" as the standard calendar quarters (regulation 4). The indexation calculations reference the quarter ended 31 December in successive years. Administrative staff should thus obtain the ABS WPI December quarter index numbers for the two relevant years aligned to the indexation date.
For retirement notices under paragraph 114A(2)(b) of the Act relating to Defence Force members, route notices through the Chief of the Defence Force. Regulation 10 identifies the Chief of the Defence Force as the "appropriate officer" for giving notice of retirement in relation to a member of the Defence Force. Defence administration should adhere to this routing to satisfy the Act’s procedural requirement.
For decisions potentially affected by the 2023 insertion of section 5A, check the timing conditions in regulation 12. Section 5A applies to decisions made under the Act after the commencement of the 2023 instrument, in relation to cancers sustained on or after 4 July 2011. If a client’s matter involves a claim sustained on or after that date and the decision is made after the 2023 amendment’s commencement, apply section 5A. Consider whether reconsideration under Part VI of the Act is applicable where a prior decision predates the 2023 commencement and the claimant seeks reapplication of the new prescribed cancers.
Maintain audit trails for calculations and registration evidence. Given the Regulations’ precise numeric rules and evidentiary thresholds, maintain clear audit records: the specific WPI numbers used, the decimal arithmetic steps showing the 4‑ and 3‑decimal intermediate values, the final rounded figure, and documentary evidence of practitioner registration or association membership. These records will be necessary if a claimant seeks reconsideration or review.
Train staff on the rounding asymmetry and context‑dependent rule application. Because regulations 7 and 9 differ in their intermediate rounding requirement, staff must be trained to apply the correct rule depending on which Act subsection is being implemented. Errors here are easy and could be material.
Where uncertainty exists about whether an entity qualifies as a "relevant professional association" under regulation 5(2)(b), seek administrative guidance or legal advice. The Regulations do not define "relevant professional association", so documenting the association’s scope, membership standards and recognition in practice will assist in defending a decision.
When making decisions, attach references to the Regulations in decisions and recollection letters. Where a decision accepts or rejects a treatment item or applies indexation, the decision should state which regulation was applied and how the calculation or qualification was worked out. This reduces later procedural disputes about what methodology was used.
Use Part VI reconsideration and review mechanisms for disputes. If a claimant disputes the application of these Regulations (for example contesting a registration test or an indexation calculation), advise them on the Act’s internal reconsideration/review procedures referenced by regulation 12 and the Act itself.

Following these steps aligns administration with the Regulations’ express language (regulations 4-12) and reduces the risk of errors that could lead to reconsideration, review or judicial challenge.
