40Duty to provide suitable employment

#### 40 Duty to provide suitable employment (1) Where an employee is undertaking, or has completed, a rehabilitation program, the relevant employer shall take all reasonable steps to provide the employee with suitable employment or to assist the employee to find such employment. (2) In this section: > relevant employer means: (a) in relation to an employee employed by a Commonwealth authority—that authority; and (aa) in relation to an employee employed by a licensed corporation—that corporation; and (b) in relation to any other employee—the Commonwealth.
