#### 120 Notice of departure from Australia etc. (1) This section applies to a person to whom payments of compensation under section 19 are being made, and have been made for a period of 3 months or longer, by a relevant authority. (2) Where the person proposes to leave Australia (whether or not the person proposes to return to Australia), the person may give the relevant authority a notice in writing: (a) stating that the person proposes to leave Australia; and (b) specifying the day on which the person proposes to leave. (3) Where the person has left Australia (whether or not the person proposes to return to Australia) without giving a notice of the kind referred to in subsection (2) to the relevant authority, the person shall, within 7 days after the day on which the person left Australia, send the relevant authority a notice in writing: (a) stating that the person has left Australia; and (b) specifying the day on which the person did so. (4) Where the person is absent from Australia for a period of more than 3 months, the person shall: (a) within 7 days after the expiration of the period of 3 months commencing on the day on which the person left Australia; and (b) within 7 days after the expiration of each successive period of 3 months (if any) ending while the person is still absent from Australia; give the relevant authority a notice in writing setting out particulars of the residential address of the person on the day on which the notice is given. Penalty: 5 penalty units. (5) Subsection (4) is an offence of strict liability. > Note: For strict liability, see section 6.1 of the Criminal Code.
