Safety on Public Land Act 2004

The Act rests on a handful of core legal building blocks: declaration, publication and inspection, authorisation, exclusion and enforcement. Each of these is defined and constrained by particular provisions, and they interact to produce a regime for managing public safety in State forests.

• Declaration (s 4). The Secretary may declare areas of State forest to be public safety zones for enumerated purposes, including public safety and conservation (s 4(2)(a)-(i)). Declarations can adopt external documents wholly or partially and can apply to matters as they exist when the declaration is made or as updated over time (s 4(3)). This is functionally a power to create a managed-access regime over State forest land.

• Content requirements (s 5). Declarations must state the physical extent, purpose, duration (fixed period or by season), times of restricted access, permitted/prohibited activities and any conditions or restrictions. The Secretary may also exempt specified persons or classes of persons from operation of the declaration (s 5(1)-(2)).

• Publication and inspection (s 7). Declarations take effect on Gazette publication or on a later date specified. The Secretary must publish notice in a State-wide newspaper and, where appropriate, a local newspaper, and must make the declaration available for inspection at departmental offices and online (s 7(1), (1A)-(1C), (2)).

• Consultation for long-term declarations (s 8). Proposed declarations longer than 12 continuous months require notice in State-wide and local newspapers, must specify the proposed particulars, and must invite submissions with a minimum 21-day period; the Secretary is obliged to consider submissions prior to making the declaration (s 8(1)-(4)).

• Exemptions and authorisations (ss 5(2), 9, 10). The Act provides for express exemptions in declarations and preserves operational space for the Secretary, authorised officers and essential service providers. Utilities and transport authorities are explicitly not covered by declarations when they are carrying out their functions in State forest (s 9(d)-(e)). Additionally, the Secretary may issue written authorisations to persons or classes of persons to be in a public safety zone, subject to terms and conditions (s 10(1)-(2)).

• Notices on site (s 11). The Secretary must ensure conspicuous display of notices indicating an area is a public safety zone and identifying restrictions. The Act expressly displaces any defence based on the absence of a notice: the failure to display does not affect liability for contravention (s 11(1)-(2)).

• Authorised officers and enforcement powers (ss 12-20). The Act imports the term authorised officer from the Conservation, Forests and Lands Act 1987 (s 3). Authorised officers have directed powers under s 14 to compel persons to leave public safety zones and may require production of name and address where there are reasonable grounds to believe an offence is being or has been committed (s 17). Officers must identify themselves when exercising s 17 powers (s 18). Section 19 allows officers to require production of authorisations issued under s 10. Criminal penalties are set out for specific contraventions, denominated in penalty units (ss 12-13, 15, 17, 19-20).

• Regulation-making and incorporation by reference (s 24). The Governor in Council may regulate additional purposes and matters for carrying the Act into effect. Regulations can adopt materials issued by third parties and may make different rules according to time, place or circumstance (s 24(1)-(2)(b), (c)).

These concepts produce an administrative template: the Secretary identifies risk areas and formally declares them, public notice and inspection routes are required for transparency, authorised officers operationalise compliance on the ground, and criminal penalties deter breaches. The incorporation powers at s 4(3) and s 24(2)(c) are particularly important conceptually because they allow the content of a declaration or regulations to import technical standards or operational rules prepared outside the Act, and to allow those materials to be updated without amending the Act itself.

The Act allocates rights and obligations across several identifiable groups. Who pays, who decides and who changes behaviour are the central practical effects.

• The Secretary and Departmental apparatus. The Secretary decides whether and when to make a public safety zone declaration (s 4(1)), to what extent to adopt external documents (s 4(3)), to publish notices and to make declarations available for inspection (s 7). The Secretary also authorises persons under s 10 and must consider submissions for long-duration declarations (s 8). Administration, notice publication and maintenance of signage are operational obligations the Secretary (and the Department of Energy, Environment and Climate Action as the head office and regional offices) must discharge (s 7(1C), s 11).

• Members of the public, including recreational users. Individuals accessing State forest must observe declared restrictions. A person who is not authorised to be in a public safety zone must not carry out activities contrary to the declaration or contravene specified restrictions (s 13) and must comply with directions by authorised officers to leave (s 14(3)). Recreational users bear compliance costs in checking Gazette notices, local signage and the online/office inspection points (s 7(1C)), and risk criminal penalties if they breach prohibitions or obstruct officers.

• Utilities, transport authorities and service operators. The Act expressly excludes utilities and transport authorities from being subject to declarations when they are engaged in carrying out their functions in State forest (s 9(d)-(e)). The definitions of transport authority and utility in s 3 are expansive: transport authority sweeps in road authorities (Road Management Act 2004), various rail and tram operators (Rail Management Act 1996), bus service operators under Bus Services Act 1995, the Director under the Transport Integration Act 2010, and persons subject to specified sections of the Rail Management Act 1996, plus employees, agents and contractors carrying out duties (s 3 transport authority definition). Utility is similarly defined to include public or private entities providing core services under State or Commonwealth Acts, pipeline licence-holders under the Pipelines Act 2005, and their staff, agents and contractors (s 3 utility definition). The practical effect is that operational activities undertaken in carrying out statutory or contractual functions may not be criminalised under a public safety zone declaration, though those activities remain subject to other legal regimes.

• Holders of miner's rights and tourist fossicking authorities. The Act removes any contrary entitlements under the Mineral Resources (Sustainable Development) Act 1990 by declaring that holders are not entitled to re-enter a public safety zone contrary to a direction of an authorised officer under s 14 (s 16). This imposes a constraint on mineral rights holders and tourist fossickers operating in State forest.

• Authorised officers. Those officers (as defined in the Conservation, Forests and Lands Act 1987; s 3) are empowered to identify themselves (s 18), request name and address (s 17), direct people to leave (s 14), and require production of authorisations under s 10 (s 19). They bear procedural obligations when exercising powers, such as providing reasons and proving their identity (ss 14(2), 17(2), 18). Obstruction of an authorised officer is a distinct and heavily penalised offence (s 20).

• Persons or classes who may be exempted or authorised. The Secretary may exempt specified persons or classes from the operation of a declaration (s 5(2)) and may issue written authorisations under s 10. Those who obtain written authorisations must comply with any conditions and must produce authorisation when directed by an authorised officer (s 19). There is a compliance cost for organisations whose staff or contractors enter declared zones: they must maintain and produce written authorisations and ensure staff are trained to carry and produce such documents.

• Land managers under related legislation. The Act specifically amends and interacts with the Forests Act 1958 and the Conservation, Forests and Lands Act 1987 (s 1(b)-(c) and s 3 definitions). Committees of management in reserved forests and other land managers need to be aware of how declarations interact with their duties and powers under those Acts.

Who pays: administrative costs sit with the Secretary for publication, signage and inspection; compliance costs fall on members of the public and on organisations whose operations may be constrained by declarations (or who must secure exemptions or authorisations). Who decides: the Secretary decides to make declarations, to authorise persons, and to consider submissions for long-term declarations. Who changes behaviour: recreational users alter access, utilities and transport authorities may adjust operational practices when not carrying out functions in State forest, and authorised officers enforce compliance on the ground.

The Act assigns discrete duties and confers certain rights relevant for operational decision‑making and compliance planning. These duties fall principally on the Secretary and on persons within declared public safety zones, with specific procedural rights and obligations for authorised officers and affected parties.

Duties of the Secretary

• Decision-making duty. The Secretary may declare an area a public safety zone (s 4(1)). This is a discretionary statutory power; the Act sets the scope of permitted purposes (s 4(2)) and the procedural content requirements of any declaration (s 5).

• Content and publication duties. A declaration must specify the area, purpose, period, restricted access times, permitted/prohibited activities and any conditions (s 5(1)). The Secretary must publish declarations in the Government Gazette (s 7(1)) and must publish notice of the making of a declaration in a State-wide and, where relevant, a local newspaper, including details of where the declaration may be inspected (s 7(1A)-(1B)). The Secretary must make declarations available for public inspection at departmental head office and relevant regional offices and online (s 7(1C)).

• Consultation duty for long-term declarations. For proposed declarations that would continue for more than 12 months, the Secretary must publish notice in State-wide and local newspapers, invite submissions with a minimum 21-day period, and consider any submissions before making the declaration (s 8(1)-(4)). This is an explicit administrative obligation.

• Signage duty. The Secretary must ensure conspicuous display of a notice specifying that an area is a public safety zone and detailing restrictions on or near the area to which the declaration applies (s 11(1)). However, the Act removes a defence based on absence of notice by providing that failure to display does not affect liability for contraventions (s 11(2)).

Duties of authorised officers

• Identification duties. Authorised officers must produce proof of identity and official status before exercising powers under s 17 (requesting name and address) and also when exercising a power under s 14 (direction to leave), see s 14(2) and s 18.

• Procedural duties when directing. Before directing a person to leave, an authorised officer must inform the person that the officer has the power to direct them to leave and that failure to comply is an offence (s 14(2)(b)(i)-(ii)).

• Powers to require compliance. Authorised officers may request name and address if they have reasonable grounds to believe an offence has been or is being committed (s 17(1)-(2)), may require production of authorisations issued under s 10 (s 19(1)), and may direct persons to leave (s 14).

Rights and duties of persons in public safety zones

• Duty to comply with directions and prohibitions. A person not authorised to be in a public safety zone must comply with directions to leave given by an authorised officer (s 14(3)). A person must not carry out activities in a public safety zone that contravene the declaration, and must not contravene any restriction or condition specified in the declaration (ss 13(1)-(2)). A person must not re-enter a public safety zone contrary to a direction (s 15).

• Duty to provide identity information. If an authorised officer reasonably believes a person has committed or is committing an offence under the Act, the person must state their name and ordinary place of residence or business when requested, unless they have a reasonable excuse (s 17(1), (3)). They must not provide false name or address (s 17(3)(b)-(c)). If the officer suspects the name/address is false, they can request evidence of correctness; the person must produce it unless they have a reasonable excuse (s 17(4)-(5)).

• Right against defective identification by officer. It is not an offence to fail to comply with a s 17 request if the authorised officer did not inform the person that failure to comply is an offence, or did not identify themselves in accordance with s 18 (s 17(6)(a)-(b)).

• Duty to produce authorisation. A person subject to an authorisation under s 10 (or belonging to such a class) must produce the authorisation for inspection immediately or within 7 days at a place determined by the authorised officer (s 19(1)-(2)).

Penalties and enforcement duties

• Specific offences carry specified penalty units. The Act quantifies penalties in penalty units for particular offences: removal or destruction of notices or barriers (50 penalty units each, s 12(1)-(2)); carrying out prohibited activities or contravening conditions in a zone (20 penalty units each, s 13); failing to comply with directions to leave or re-entering contrary to such directions (20 penalty units each, ss 14(3), 15); failing to give name or produce evidence (5 penalty units, s 17); failing to produce an authorisation under s 10 when directed (5 penalty units, s 19); and hindering or obstructing an authorised officer (60 penalty units, s 20).

Regulatory and incorporation powers

• The Governor in Council may prescribe additional purposes for public safety zones and make regulations necessary to carry out the Act (s 24(1)). Regulations can be of general or limited application, differ by time/place/circumstance, and may adopt or incorporate third-party documents wholly or partially (s 24(2)(a)-(c)).

Rights preserved or curtailed

• The Act expressly curtails any entitlement of miner's rights and tourist fossicking authorities to re-enter a public safety zone contrary to an authorised officer’s direction (s 16). Conversely, utilities and transport authorities carrying out their functions are excluded from application of declarations (s 9(d)-(e)).

Overall, duties attach primarily to the Secretary for declaring, publishing and signage; to authorised officers for procedurally fair exercise of powers; and to members of the public, miners and other users to obey declared restrictions, carry necessary authorisations and provide correct identification. The Act balances decisional discretion in the Secretary with procedural publication and consultation duties, and backs operational enforcement with criminal penalties.

The Act sets out a detailed criminal enforcement scheme, denominated in penalty units, and allocates enforcement powers to authorised officers. The enforcement architecture is targeted on preventing access, preserving signage and preventing obstruction of officers.

Penalty regime

• Notices and barriers. Unlawfully altering, obliterating, defacing, removing or destroying a notice displayed under s 11 attracts a penalty of 50 penalty units (s 12(1)). Unlawfully breaking down, damaging or destroying a barrier or fence erected to prohibit or restrict access to a public safety zone also carries 50 penalty units (s 12(2)). These are comparatively high-specified penalties and apply regardless of whether the absence of notice affects liability for other contraventions (s 11(2)).

• Contravening declaration conditions. A person not authorised to be in a public safety zone who carries out an activity in contravention of a declaration faces 20 penalty units (s 13(1)). Contravening any restriction or condition specified in the declaration similarly attracts 20 penalty units (s 13(2)). These provisions create direct criminal exposure for persons who ignore the substantive prohibitions and conditions of a declaration.

• Directions to leave and re-entry. An authorised officer may direct a person to leave a public safety zone under specified circumstances (s 14(1)). A person not authorised under the Act who fails to comply with such a direction commits an offence with a penalty of 20 penalty units (s 14(3)). A person who re-enters or attempts to re-enter a public safety zone contrary to an authorised officer’s direction (s 15) also faces 20 penalty units.

• Identification and production obligations. A person who fails to state their name and ordinary place of residence or business when requested by an authorised officer who reasonably suspects an offence, or who gives a materially false name or address, is liable to 5 penalty units (s 17(3)). Failure to produce evidence when requested under s 17(4)-(5) also attracts 5 penalty units. A person who fails to comply with a direction under s 19 to produce a written authorisation under s 10 is liable to 5 penalty units (s 19(2)).

• Obstruction. Hindering or obstructing an authorised officer exercising duties or powers under the Act is a separate offence with a penalty of 60 penalty units (s 20). This is the largest explicit penalty in the Act and is targeted at protecting enforcement personnel and ensuring operational viability of officer functions.

Enforcement powers and procedural safeguards

• Direction to leave. Under s 14, an authorised officer may direct a person to leave a public safety zone if the officer has informed the person they are in a public safety zone and has requested that the person leave, and the person has refused. Before exercising this power, the authorised officer must produce proof of identity and official status and inform the person that the officer is so empowered and that it is an offence to fail to comply (s 14(2)). Failure by the officer to comply with these procedural requirements removes criminal liability for the person who fails to comply with the direction (s 14(4)). This creates a procedural protection for individuals and a compliance duty on officers.

• Name and address inquiries. An authorised officer may ask for name and ordinary place of residence or business if they have reasonable grounds to believe an offence against the Act has been or is being committed (s 17(1)). The officer must inform the person of the grounds for their belief (s 17(2)). If the officer suspects the name/address may be false, they may request evidence of correctness and the person must comply unless they have a reasonable excuse (s 17(4)-(5)). A failure of the officer to properly warn the person that it is an offence to refuse the request or to identify themselves in accordance with s 18 will make it not an offence for the person to fail to comply (s 17(6)).

• Identification requirement for officers. Section 18 requires an authorised officer to produce proof of identity and official status before exercising powers under s 17, and to do so at any time during the exercise of the power if asked. The requirement is a safeguard aimed at ensuring that persons requested to provide identifying information can verify the officer’s status.

• Production of authorisation. Under s 19 an authorised officer may direct a person who is subject to a s 10 authorisation to produce that authorisation either immediately or within seven days at a place determined by the officer. Non-compliance is an offence (s 19(2)). The mechanism enforces the written-authorisation regime at s 10.

Operational enforcement considerations

• Authorised officers implement enforcement in the field. The Act imports the term authorised officer from the Conservation, Forests and Lands Act 1987 (s 3), so the scope and appointment of authorised officers are defined in that separate Act. This means enforcement capacity and officer powers can be understood only by consulting both Acts together.

• Practicalities of proving offences. Certain offences, like contravening a declaration (s 13) or failing to comply with the direction to leave (s 14(3)), require proof that a person was not authorised to be in the public safety zone. The Act provides the Secretary with a mechanism to authorise persons in writing (s 10), and authorisations must be produced on request (s 19), which streamlines the evidentiary chain for enforcement.

• Signage and notice do not defeat liability. A key enforcement point is that the absence of on-site signage does not affect liability for contraventions (s 11(2)). Enforcement can therefore proceed even where a notice is missing, though officers must still identify themselves and follow s 14(2).

• Heavier penalty for obstruction. The comparatively high penalty for hindering or obstructing an authorised officer (60 penalty units, s 20) signals the legislature’s intention to protect enforcement operations from interference.

Limitations and gaps in enforcement architecture

• No express civil remedy or compensation mechanism. The Act focuses on criminal sanctions and administrative directions. It does not set out a compensation scheme for persons excluded from an area by declaration, nor does it create an express civil right of action in respect of declarations. Any civil consequences would arise under separate legislation or common law.

• Reliance on delegated officers and external definitions. Because authorised officers are defined in another Act, the operational capacity to enforce depends on those appointment regimes and resourcing under the Conservation, Forests and Lands Act 1987.

In summary, enforcement under the Act is achieved through a mix of preventive signage, criminal offences denominated in penalty units, procedural safeguards for persons subject to enforcement, and operational tools for authorised officers to make on-the-spot directions and to require identity and authorisation production.

The Act is explicitly designed to operate alongside and to amend provisions of other Victorian statutes. The text and endnotes show multiple cross-references and consequential amendments. The primary points of legal interaction are as follows.

Definitions and imported concepts

• Authorised officer. The Act adopts the meaning of authorised officer from s 3 of the Conservation, Forests and Lands Act 1987 (s 3). Any analysis of enforcement powers necessarily depends on the definition, appointment, delegations and qualifications in that Act.

• State forest and Secretary. State forest is defined with the same meaning as in the Forests Act 1958 (s 3), and the Secretary is the body corporate established by Part 2 of the Conservation, Forests and Lands Act 1987 (s 3). Decisions about the spatial extent of declarations therefore hinge on the statutory meaning of State forest in the Forests Act 1958.

Operational exemptions and sectoral interaction

• Utilities and pipelines. Section 9(d) excludes utilities engaged in carrying out their functions in a State forest from the operation of a public safety zone declaration. Section 3 defines utility to include entities providing water, sewerage, drainage, gas, electricity, telephone, telecommunication or similar services under State or Commonwealth Acts, and licence-holders under the Pipelines Act 2005 (s 3 utility definition). The Act therefore interfaces with the Pipelines Act 2005 via the definition of utility and exempts pipeline operators and their staff when performing statutory functions in State forest.

• Transport authorities. Section 9(e) excludes transport authorities engaged in carrying out their functions in State forest. The transport authority definition in s 3 includes entities under the Road Management Act 2004, Rail Management Act 1996, Bus Services Act 1995, and the Director under the Transport Integration Act 2010, plus employees, agents and contractors when carrying out duties (s 3 transport authority definition). The Act therefore sits alongside road, rail and bus regulatory regimes and does not displace operational activities conducted under those Acts.

• Mining and fossicking. Section 16 modifies the relationship between the Act and the Mineral Resources (Sustainable Development) Act 1990 by providing that holders of miner's rights and tourist fossicking authorities are not entitled to re-enter a public safety zone contrary to a direction of an authorised officer under s 14. This expressly limits mineral entitlements where public safety zones are in force and places the direction of an authorised officer above any entitlement to re-entry under that mining statute.

Regulatory and incorporation-by-reference interaction

• Incorporation of external documents. Section 4(3) permits a declaration to apply, adopt or incorporate any matter contained in any document formulated, issued, prescribed or published by any person, either wholly or partially, as amended by the declaration, and either as at declaration time or from time to time. Likewise, s 24(2)(c) allows regulations to apply or incorporate material from other persons, including as updated. These cross-reference mechanisms mean that technical standards, guidelines or operational plans produced under other statutes or by statutory agencies can be imported into a public safety zone declaration or regulations without amending the Act. That creates an interaction whereby non‑legislative instruments can have legal force within the declaration/regulation framework.

Consequential amendments and historical amendments

• The Act was intended to amend the Forests Act 1958 and consequentially amend the Conservation, Forests and Lands Act 1987 (s 1(b)-(c)). The Table of Amendments in the endnotes records a series of legislative instruments that have amended definitions and other provisions over time, including:

  • Environment and Water Legislation (Miscellaneous Amendments) Act 2005 (No. 48/2005), which inserted s 4(3) and amended s 7 provisions concerning publication (see endnotes Table of Amendments).

  • Pipelines Act 2005 (No. 61/2005), which affected the utility definition (s 3).

  • Mineral Resources Development (Sustainable Development) Act 2006 (No. 63/2006), which affected s 16.

  • Bus Safety Act 2009, Transport Integration Act 2010, various Statute Law Revision Acts, and later Statute Law Revision Act 2024 and 2025, which amended definitions and publication duties (see endnotes Table of Amendments).

Administrative law and procedural safeguards

• Consultation and review. Section 8 requires public notice and the opportunity to make submissions for proposed declarations longer than 12 months, and obliges the Secretary to consider submissions. This creates an administrative procedural obligation that interacts with principles of administrative law and potential review mechanisms under general review provisions in other statutes. The Act itself does not provide an internal merits review mechanism or appeals process in relation to declarations; any recourse would need to be sought under general administrative law remedies or judicial review in the courts, which is a separate statutory and common-law domain.

Divisions of power and operational overlaps

• Overlap with other regulatory obligations. Entities operating in State forest, such as utilities, transport authorities, pipeline operators and miners, will continue to be regulated under their sectoral statutes (for example, Road Management Act 2004, Rail Management Act 1996, Pipelines Act 2005 and Mineral Resources (Sustainable Development) Act 1990). The Act does not appear to displace obligations under those Acts but rather coexists with them, sometimes excluding certain activities from liability under a declaration (s 9), and sometimes limiting mining entitlements (s 16).

In summary, the Act is designed to work in conjunction with a network of other Victorian statutes. Its cross-references to definitions and explicit exemptions create a layered regulatory environment. Users and lawyers must read the Act together with the Conservation, Forests and Lands Act 1987 and the Forests Act 1958 to determine who is an authorised officer, what constitutes State forest and how other statutory functions interact with a public safety zone declaration. The power to adopt external documents into declarations or regulations (ss 4(3), 24(2)(c)) also creates an intersection with non-legislative instruments and standards produced elsewhere.

The Act as provided includes a Table of Amendments in the endnotes that records a series of legislative changes and subordinate instruments which have modified definitions, publication requirements and other provisions. The key amendments and their mechanical effects, as recorded in the source, are:

• Environment and Water Legislation (Miscellaneous Amendments) Act 2005 (No. 48/2005), assent 24 August 2005. Commenced ss 5-7 on 25 August 2005. This Act substantially amended s 7 concerning publication (substitution of s 7(1), insertion of s 7(1A)-(1C)) and inserted s 4(3), which permits declarations to adopt or incorporate external documents (see Table of Amendments and s 4(3), s 7).

• Pipelines Act 2005 (No. 61/2005), assent 20 September 2005. Commenced s 222 on 1 April 2007. This Act amended the definition of utility in s 3 to include licence-holders under the Pipelines Act 2005 (see Table of Amendments and s 3 utility definition).

• Mineral Resources Development (Sustainable Development) Act 2006 (No. 63/2006), assent 29 August 2006. Commenced s 61(Sch. item 28) on 30 August 2006. This Act amended s 16 to clarify the effect of miner's rights and tourist fossicking authorities in relation to directions under s 14 (see s 16 and Table of Amendments).

• Bus Safety Act 2009 (No. 13/2009), assent 7 April 2009. Commenced s 90 on 31 December 2010. This Act amended the definition of transport authority in s 3 to include persons operating regular passenger services under the Bus Services Act 1995 and other transport definitions (see s 3 transport authority).

• Transport Integration Act 2010 (No. 6/2010), assent 2 March 2010. Commenced s 203(1)(Sch. 6 item 43) on 1 July 2010. This Act further amended the transport authority definition to include the Director under the Transport Integration Act 2010 (s 3).

• Statute Law Revision Act 2011 (No. 29/2011), assent 21 June 2011. Commenced relevant schedule items on 22 June 2011; this Act repealed ss 21-23 of the Safety on Public Land Act 2004 (see Part 4 notes in the text and Table of Amendments).

• Statute Law Revision Act 2013 (No. 70/2013), assent 19 November 2013. Commenced s 4(Sch. 2 item 45) on 1 December 2013. This amendment modified the location requirement for public inspection in s 7(1C) to include regional offices (see s 7(1C) amendments noted in the text).

• Sustainable Forests (Timber) and Wildlife Amendment Act 2014 (No. 11/2014), assent 25 February 2014. Commenced ss 27, 28 on 28 May 2014. This Act repealed s 4(2)(g) and repealed s 6; the schedule indicates those repeals were enacted on 28 May 2014 (see text annotation and Table of Amendments).

• Statute Law Revision Act 2024 (No. 13/2024), assent 23 April 2024. Commenced s 3(Sch. 1 item 12) on 24 April 2024. This amendment affected s 3, notably the def. of transport authority and possibly other style or definition adjustments (as recorded in the endnotes).

• Statute Law Revision Act 2025 (No. 41/2025), assent 21 October 2025. Commenced s 4(Sch. 2 item 25) on 22 October 2025. This amendment corresponded with the version date at the head of the Act and modified the s 7(1C)(a) reference to the Department of Energy, Environment and Climate Action regional office as the inspection location (see endnotes Table of Amendments).

Other recorded technical amendments include:

• S. 3 definition adjustments as a result of sectoral legislative changes (Bus Safety Act 2009, Transport Integration Act 2010, Pipelines Act 2005).

• S. 4(3) insertion by No. 48/2005 s. 5; S. 5(1)(c) amended by No. 13/2024 s. 3(Sch. 1 item 12).

• S. 7 substitution and insertions by No. 48/2005 s. 6 and later amendments expanding inspection locations and online availability (s 7(1C) amendments by Nos 70/2013 and 41/2025).

• Repeals of certain sections via Statute Law Revision Acts (ss 21-23 repealed by No. 29/2011 s. 3(Sch. 1 item 83); s 6 repealed by No. 11/2014 s. 28).

The endnotes caution that the publication of the Act incorporates amendments made by Acts and subordinate instruments and cross-refer to the Victorian Legislation website for Bills, Acts and current versions. The Table of Amendments in the endnotes should be consulted for precise commencement dates and the particular schedule items amending specific provisions.

Practically, these amendments show the Act evolving to: clarify publication and inspection requirements, adapt to new transport and pipeline legislation by expanding the definitions of transport authority and utility, and allow for incorporation of external documents into declarations. The amendment history highlights the shifting institutional names and departmental arrangements (for example the Department of Energy, Environment and Climate Action being specified as an inspection point in s 7(1C) as amended).

The source material supplied contains no reported litigation history, no case law citations and no records of judicial interpretation of the Safety on Public Land Act 2004. The Endnotes contain a "3 Explanatory details" heading with the entry "No entries at date of publication." The text of the Act itself names no judicial decisions. Therefore, based on the material provided, there is no litigation history recorded within this document.

Implication for practitioners

• Absence of reported cases in the source means there is no statutory judicial gloss provided in the supplied material on how courts have interpreted key provisions such as the scope of a public safety zone declaration under s 4, the permissible content of incorporated external documents under s 4(3), or the limits of authorised officer powers under ss 14-19. Any such interpretations must be sought in case law databases or subsequent commentary external to this Act text.

• Administrative review pathways. The Act contains procedural obligations (for example, s 8 requires the Secretary to consider submissions for proposed declarations exceeding 12 months), but it does not include express statutory avenues for merits review, appeal against a declaration, or internal reconsideration mechanisms. Practitioners should therefore consider judicial review or statutory review mechanisms in related statutes as potential avenues for challenge, noting that no authorities are supplied in this source.

• Evidence base for enforcement interpretations. In the absence of litigation referenced in this text, practitioners advising clients on enforcement risk must rely on the statutory text and on cross-referenced statutes (Conservation, Forests and Lands Act 1987; Forests Act 1958; related transport, pipeline and mineral resources legislation) to anticipate how enforcement may be applied.

If litigation history or judicial interpretation is required for a particular matter, a search of case databases and subsequent legislative instruments will be necessary, because the supplied Act text does not supply that material.

This Act contains a number of specific drafting and practical features that can create traps for the unwary. These are concrete operational or legal risks to watch for, drawn strictly from the statutory text.

1. Absence of signage does not excuse liability (s 11(2)). The Act requires the Secretary to ensure conspicuous notices are displayed (s 11(1)) but expressly states that the fact a notice is not displayed does not affect criminal liability for contravening the Act (s 11(2)). Practically, individuals cannot rely on missing signage as a defence if they enter a declared zone or breach a restriction.

2. Declarations can incorporate external material, including as updated (s 4(3); s 24(2)(c)). A declaration may adopt matters contained in any document formulated or published by any person, either as at the time of making, or "from time to time". Regulations may do the same. This creates a moving target risk: the legal content of a declaration may change without amendment to the Act, depending on the adopted external instrument and whether the declaration/regulation adopts future changes. Practitioners should inspect not only the Gazette declaration but also any referenced external documents and monitor updates to those documents.

3. Written authorisation is a precondition to avoid offences for presence in a public safety zone (s 10(1)-(2)). The Secretary’s authorisation must be in writing and is subject to terms and conditions. Persons relying on authorisations should carry and be able to produce the written instrument on demand because failure to produce it when directed is itself an offence carrying 5 penalty units (s 19(1)-(2)).

4. Long-duration declarations require formal consultation and the Secretary must "consider" submissions (s 8(1)-(4)). The Act requires notice and at least 21 days for submissions where the proposed declaration would run for more than 12 months. The obligation to "consider" submissions implies an administrative burden and potential procedural challenge if consultation is not properly conducted.

5. Utilities and transport authorities are exempt only when "engaged in the carrying out of their functions in a State forest" (s 9(d)-(e)). The exemption is functional and limited; if a utility or transport authority is not performing its statutory or contractual functions at the time, the exemption may not apply. Parties should verify whether their activity falls within the scope of "carrying out of its functions."

6. Miner rights and tourist fossicking authorities are expressly subordinated to authorised officers’ directions (s 16). Despite other entitlements under the Mineral Resources (Sustainable Development) Act 1990, holders cannot re-enter a public safety zone contrary to an authorised officer’s direction. Operators should therefore expect directions to be decisive in the field.

7. Authorised officer identification and procedural strictures (ss 14(2), 17(2), 18). Authorised officers must identify themselves and must inform a person of the grounds for suspicion when requesting name and address. Failure to comply with these procedural obligations removes criminal liability for non‑compliance by the private party under certain sections (s 14(4), s 17(6)). This places a compliance burden on officers and creates potential evidentiary issues in prosecutions.

8. High penalties for damaging notices, barriers, or obstructing officers (ss 12, 20). Destroying signage or barriers carries 50 penalty units (s 12) and obstructing an authorised officer carries 60 penalty units (s 20). For persons considering protest tactics or physical obstruction, these are material criminal risks.

9. Declarations take effect on Gazette publication, not necessarily when notices are put up on site (s 7(2)). Declarations may specify a later date, but their legal effect is measured by Gazette publication or the declared later date. Practitioners advising clients on the timing of a prohibition should check Gazette dates and any later effective date stated in the declaration.

10. The Act leaves out certain remedial or compensation mechanisms. The Act does not provide a statutory compensation scheme for persons excluded from land by a declaration, nor an express internal appeal against the making of declarations. Any remedy for loss would need to be pursued elsewhere; the Act is silent on compensation and appeals.

11. Reliance on external definitions and appointment regimes (s 3). The term authorised officer and the meaning of State forest are imported from other Acts. If those definitions or appointment mechanisms change, enforcement capacity and the scope of the regime will shift. Practitioners must consult the Conservation, Forests and Lands Act 1987 and the Forests Act 1958 alongside this Act.

12. Regulations may differ by time, place or circumstance (s 24(2)(b)). This grants flexibility to create tailored rules but also creates legal complexity where different rules may apply in different areas or seasons. Compliance requires checking applicable regulations in addition to declarations.

These "gotchas" point to practical risks for field operators, recreational users, utilities, transport authorities and legal advisers. The common practical mitigation steps are: (a) check the Government Gazette and the Department’s online publication for declarations, (b) retain and carry any written authorisation, (c) ensure staff and contractors understand officer identification and direction procedures, and (d) monitor incorporated external documents and relevant regulations.

This section gives a practical, statute-grounded checklist for different stakeholders. All recommendations refer directly to the Act’s provisions.

For the Secretary (and Departmental managers)

• Publication and inspection duties. Ensure every declaration is published in the Government Gazette (s 7(1)), a State-wide newspaper and, where applicable, a local newspaper (s 7(1A)), and that the notice identifies where the declaration may be inspected (s 7(1B)). Keep a copy available for inspection at the head office and relevant regional offices and maintain an up-to-date copy on the Internet (s 7(1C)).

• Signage. Install conspicuous notices on or near the public safety zone specifying that the area is a public safety zone and the restrictions applying to it (s 11(1)). Since absence of signage does not excuse liability (s 11(2)), signs are a duty and a best practice for risk management but do not determine liability.

• Consultation for long-term declarations. For proposed declarations exceeding 12 months continuously, publish formal notice in State-wide and local newspapers, specify the proposed particulars (area, purpose, period), allow at least 21 days for submissions and document consideration of submissions (s 8(1)-(4)).

• Authorisations in writing. When issuing authorisations under s 10, ensure they are in writing, specify terms and conditions, and include a clear statement of the period and activities permitted. Maintain a register of authorisations for inspection by authorised officers.

• Incorporation of external documents. If adopting external technical standards or operational documents under s 4(3) or s 24(2)(c), ensure referenced materials are accessible to the public and that their incorporation is stated explicitly in the declaration or regulation. Anticipate and manage the implications of "from time to time" language to ensure stakeholders are aware of when incorporated materials might change.

For authorised officers and field enforcement teams

• Identification and procedural compliance. Always produce proof of identity and official status before exercising s 17 powers and when directing a person to leave under s 14 (ss 14(2), 18). When requesting name and address, inform the person of the grounds for the belief that an offence has been or is being committed (s 17(2)). Failure to comply with these procedural steps can remove criminal liability for the person.

• Documentation. Keep appropriate forms and written templates for issuing directions to leave, requesting name and address, and requesting production of authorisations under s 19. Record the facts that constitute the reasonable grounds for believing an offence has been or is being committed.

• Enforcement training. Train officers to handle production requests for s 10 authorisations, to set reasonable settings for immediate or seven-day production (s 19(1)(a)-(b)), and to avoid unwarranted obstruction charges. Emphasise the high penalty unit for obstruction (s 20).

For utilities, transport authorities and contractors

• Confirm scope of exemption. Where planning to operate in State forest, confirm that the activity is "engaged in the carrying out of its functions in a State forest" to rely on the s 9(d)-(e) exclusion. Document the statutory or contractual basis for the activity to show it falls within the exemption.

• Authorisations and documentation. Even where an exemption is likely, consider securing a written authorisation under s 10 if there is any doubt. Ensure employees, agents and contractors carry identifying documents and any authorisation documentation and are trained to produce them when asked (s 19).

For holders of miner's rights and tourist fossicking authorities

• Respect directions. If an authorised officer directs you not to re-enter a public safety zone, comply. Section 16 removes any entitlement to re-enter contrary to an authorised officer’s direction. Keep records of permissions and directions to avoid disputes.

For members of the public and recreational users

• Check all sources. Before visiting State forest areas, check the Government Gazette, the Department’s online publication and local notices for any public safety zone declarations and their conditions (s 7(1)-(1C)). The Act requires publication and inspection, and failure to check these sources exposes a visitor to criminal liability.

• Obey directions. If an authorised officer informs you you are in a public safety zone and directs you to leave, comply promptly. Non-compliance is an offence (s 14(3)) unless the officer failed to follow identification/procedural requirements (s 14(4)).

• Provide correct identity information. If an authorised officer with reasonable grounds asks for your name and address, provide accurate details. False or incomplete information is a 5-penalty-unit offence (s 17(3)).

Practical checklist (concise)

• For sites likely to be declared: liaise early with the Secretary to understand planned declarations and whether authorisations or exemptions will be needed (s 4-5, s 10).

• Obtain and carry written authorisation where applicable (s 10(1)-(2); s 19).

• Monitor the Government Gazette and Department website for declaration publications and any regulations that may apply (s 7(1), (1C); s 24).

• Train staff and contractors in interaction protocols with authorised officers: produce ID, produce authorisations promptly, comply with directions to leave, and avoid obstructive conduct (ss 14, 17-19, 20).

• Keep a record of submissions made under s 8 in the case of long-term proposed declarations, and follow up with the Secretary as to how submissions were considered.

• For incorporated external documents: obtain copies and track updates if a declaration or regulation adopts "from time to time" changes (s 4(3), s 24(2)(c)).

Limitations of this checklist

• The Act prescribes criminal offences and certain administrative steps, but does not provide template forms, statutory merits review pathways or compensation mechanisms. Compliance work should therefore be integrated with wider administrative law advice and with any sectoral regulatory obligations applicable to utilities, transport operators or mining activities.

Following these steps aligns operational practice with the explicit statutory duties in the Safety on Public Land Act 2004 and reduces the risk of criminal exposure under the Act.
