#### 44 The Act, s 100A, definition of “excluded land” 44 The Act, s 100A, definition of “excluded land” > The following is prescribed as excluded land for the purposes of the Act, section 100A(1), definition of excluded land, paragraph (b)— > > > (a) land that was, immediately before the commencement of the [Biodiversity Conservation Act 2016](/view/html/inforce/current/act-2016-063), land declared under the [Threatened Species Conservation Act 1995](/view/html/repealed/current/act-1995-101), section 47 to be the critical habitat of an endangered species, population or ecological community, > > > (b) land within Lord Howe Island.
