Royalties for Regions Act 2009

The statute sets out a small number of persistent legal and fiscal concepts which determine how the policy operates in practice: earmarking by percentage of forecast revenue, a statutory cap on balances, subsidiary accounts, executive authorisation of expenditure with cabinet‑style concurrence, an advisory trust with specified composition and functions, reporting and transparency obligations, and legal protections and sanctions for participants.

Earmarking by percentage of forecast revenue. Section 6(2) requires the Treasurer to credit to the Fund an amount equal to 25 per cent of the forecast royalty income for the financial year. The Act does not tie credits to actual realised royalty receipts. The credit is based on the forecast figure appearing in specified budget papers, unless regulations designate another part (s 6(1)). The Act also specifies that amounts credited under s 6(2) are charged to the Consolidated Account (s 6(4)). This is a fiscal mechanism that converts an ex ante forecast parameter into a budgetary transaction rather than creating a claim on actual royalty receipts in a separate sovereign account.

Subsidiary accounts. The Fund is structured into named subsidiary accounts: Country Local Government Fund, Regional Community Services Fund, Regional Infrastructure and Headworks Fund, and any other account the Treasurer determines on the Minister’s recommendation (s 5(1)). Allocation between these subsidiary accounts is to be determined by the Treasurer on the Minister’s recommendation (s 5(2)). That establishes a two‑step allocation mechanism: the Minister recommends; the Treasurer determines allocation and credits.

Cap on Fund balance. Section 8 caps the amount standing to the credit of the Fund at $1 billion. Sections 6(3) and 7(2) require the Treasurer not to credit money if doing so would be contrary to s 8. Thus the Fund cannot accumulate an unconstrained balance regardless of the statutory 25 per cent credit rule.

Authorisation of expenditure. The Minister, with the Treasurer’s concurrence, may authorise expenditure from the Fund only for the three purposes listed in s 9(1). Those purposes are programmatic rather than project‑specific, but they define the permitted policy objects: infrastructure and services, economic base development, and job creation/career opportunities in regional Western Australia. The Minister’s authorisation, with Treasurer concurrence, is the trigger that makes money available for spending and charges it to the Fund (s 9(2)).

Advisory Trust. The Trust’s statutory role is advisory: to provide advice and recommendations to the Minister for the purposes of allocating the Fund between subsidiary accounts (s 12; s 5(2)) and on other matters referred by the Minister (s 12(b)). Composition rules (s 13) ensure regional representation through regional development commission chairs, with flexibility for additional appointments and for appointment of the Department CEO. The Trust has procedural rules for meetings, disclosure, confidentiality and reporting, and it is resourced through the Department (s 27).

Reporting, transparency and limits. The Department’s annual report must include information about the Fund (s 10) in addition to disclosure required by the Financial Management Act 2006. The Trust must itself produce an annual report for the Minister, which must be laid before Parliament within 90 days of year end (s 28). These reporting provisions create statutory transparency obligations that intersect with general financial reporting under the Financial Management Act.

Protections and sanctions. The Act confers protection from tort liability on persons acting in good faith in performance or purported performance of functions under the Act (s 29). It also criminalises or penalises certain non‑compliances by members: failure to disclose a pecuniary interest attracts a fine of $12 000 (s 24(1)); unlawful disclosure or use of information obtained in the course of duty attracts a $12 000 fine (s 30). Those provisions shape risk allocation for participants.

Interlocking statutory references. The Act explicitly links itself to other statutes: the Fund is a Treasurer’s special purpose account under the Financial Management Act 2006 s 10(a) (definition of Fund); the regional areas and regional development commissions are defined by reference to the Regional Development Commissions Act 1993 (s 3 definitions); and the ground for removal related to insolvency uses the Corporations Act 2001 definition of "insolvent under administration" (s 16(2)(b)). The Act therefore operates within an existing statutory tapestry of public finance, regional governance and corporate insolvency definitions.

Together, these concepts create a fiscal instrument that channels a defined proportion of forecast royalty revenue into region‑targeted spending, with administrative control retained by the Minister and Treasurer, and with an advisory Trust providing structured regional input.

The Act directly stipulates who pays, who decides, who advises, and who may be subject to sanctions. It also creates indirect effects for a range of public and private actors that will interact with the Fund and the Trust.

Primary payor: Consolidated Account. The immediate financial impact is on the Consolidated Account. Section 6(4) states that amounts credited under s 6(2) are to be charged to the Consolidated Account. That means the state’s general revenue bears the initial cost of the credited amounts. The Fund is not an autonomous royalty receipt silo separate from the Consolidated Account: the Act prescribes credits charged to the Consolidated Account, derived from 25 per cent of the forecast royalty income.

State executive decision‑makers: Minister and Treasurer. The Minister and the Treasurer occupy central decision roles. The Minister recommends subsidiary accounts to the Treasurer and may authorise expenditure from the Fund but only with the Treasurer’s concurrence (ss 5(2), 9(1)). The Treasurer determines allocation between subsidiary accounts on the Minister’s recommendation (s 5(2)), ensures the $1 billion cap is not breached (s 8), and effects the credits to the Fund (s 6). Consequently, these two officers control the timing, allocation and amounts that are actually available for spending.

Advisory body: Western Australian Regional Development Trust. The Trust’s members, appointed by the Minister, provide advice and recommendations to the Minister on allocation between subsidiary accounts (s 12; s 5(2)) and on other matters referred by the Minister (s 12(b)). Membership rules ensure that at least one regional development commission chair is a member, with the possibility of another chair and the CEO to be appointed (s 13). Members are public actors with statutory duties and are subject to disclosure, confidentiality and potential fines (ss 24, 30). The Trust is resourced by the Department via the CEO (s 27).

Regional public bodies. Regional development commissions (as defined in s 3 reference to the Regional Development Commissions Act 1993) are implicated by composition rules and by the Fund’s regional focus. Country local government bodies, community services providers and infrastructure proponents in regional Western Australia are the presumptive recipients of allocations, because the permitted purposes in s 9 focus on regional infrastructure, community services, economic diversification, and job creation.

The Department and its staff. The Department (the public service department principally assisting in administration of Part 3, s 3) must include information about Fund operations in its annual report (s 10), provide services and facilities to the Trust (s 27(1)), and may make officers available to the Trust on agreed terms (s 27(2)). The Department therefore faces administrative responsibilities and potential increased workload in handling funds, compliance, reporting and support for the Trust.

Private sector applicants and project proponents. Although the Act does not create a detailed grant scheme, it authorises expenditure for infrastructure, services and economic development in regional WA (s 9). Those objectives create potential demand for project funding from local governments, not‑for‑profits, private contractors and businesses seeking to deliver infrastructure and services or to participate in economic diversification projects. Such actors will likely engage with regional commissions, local government, and the Minister’s processes to seek authorisation for particular spending.

Judicial parties and claimants. The statutory protection from tort liability in s 29 removes one category of civil exposure for persons acting in good faith under the Act. Nevertheless, parties affected by decisions to allocate or not allocate Fund money, local governments, communities, contractors, may bring administrative law challenges or other legal proceedings; the Act itself does not preclude judicial review remedies. The Act also imposes fines on Trust members for non‑disclosure or breaches of confidentiality, implicating those members in potential sanctions.

Taxpayers and budgetary stakeholders. Broadly, the Act reallocates a proportion of forecast royalty income away from unspecified general government uses toward region‑targeted spending. Although the statutory credit is charged to the Consolidated Account, the diversion of 25 per cent of forecast royalties creates opportunity costs in public budgeting. The Act thus affects the general taxpayer pool by prescribing a recurring allocation from forecast revenue.

In short, the Act directly binds the Treasurer and the Minister in the operation of the Fund, establishes the Trust and involves the Department in administration, creates a statutory funding stream that regional public bodies and private sector proponents will seek to access, and has downstream fiscal implications for the Consolidated Account and the broader state budget.

The Act imposes specific duties on executive officers, members of the Trust and the Department, and it creates statutory rights or entitlements in the form of authorised purposes and administrative resourcing.

Treasurer’s duties. The Treasurer must cause the annual credit of 25 per cent of forecast royalty income to be made to the Fund (s 6(2)), except to the extent that doing so would breach the $1 billion cap (s 6(3)). The Treasurer is empowered to determine allocation between the subsidiary accounts of the Fund on the Minister’s recommendation (s 5(2)). The Treasurer must ensure the amount standing to the credit of the Fund never exceeds $1 billion (s 8). The Treasurer also receives the Minister’s recommendation for subsidiary accounts (s 5(1)(d) and s 5(2)).

Minister’s duties and entitlements. The Minister is the statutory authority that may authorise expenditure from the Fund, but only with the Treasurer’s concurrence (s 9(1)). The Minister may recommend subsidiary accounts to the Treasurer and refers matters to the Trust for advice (s 12). The Minister designates the Trust’s chairperson and deputy (s 14), appoints members within the statutory limits (s 13), and may remove members on specified grounds (s 16(2)). The Minister also receives the Trust’s annual report and is required to cause it to be laid before Parliament (s 28).

Statutory entitlements for the Fund’s purposes. Section 9(1) lists the authorised purposes for expenditure from the Fund: providing infrastructure and services in regional Western Australia, developing and broadening the economic base of regional Western Australia, and maximising job creation and career opportunities in regional Western Australia. Expenditure that is authorised under these headings is to be charged to the Fund (s 9(2)(a)). The Fund is also liable for administrative costs including Trust members’ remuneration (s 9(2)(b)-(c)).

Trust members’ duties and limits. Trust members have a duty to disclose direct or indirect pecuniary interests in matters before the Trust as soon as practicable after the facts come to their knowledge (s 24(1)). Failure to disclose attracts a fine of $12 000. Where a presiding person deems a member to have an interest, the presiding person may call for disclosure and may determine that the interest exists if the member defaults (s 24(2)). A member who discloses or is determined to have an interest may participate in consideration and discussion but may not advise or make a recommendation to the Minister on that matter (s 24(4)). Members are subject to confidentiality obligations with a $12 000 fine for recording, disclosing or making use of information obtained in the course of duty other than in defined exceptions (s 30).

Department and CEO duties. The Department’s accountable authority must include information about the operation of the Fund in its annual report (s 10). The CEO must ensure that the Trust is provided with necessary services and facilities and may, by arrangement with the Trust, provide staff and facilities on agreed terms (s 27). Those are operational duties to resource the advisory body.

Remuneration and allowances. Members are entitled to remuneration and allowances as the Minister determines on the recommendation of the Public Sector Commissioner (s 20). The Fund bears those costs (s 9(2)(c)).

Record‑keeping and procedural duties. The Trust must keep accurate minutes of its proceedings (s 25); determine its own meeting procedures except where specified (s 26); and may meet remotely (s 23). The chairperson must convene the first meeting and members must follow meeting and disclosure rules (ss 21-24).

Rights and protections: good faith tort protection. Section 29(1) provides that an action in tort does not lie against a person for things done, in good faith, in the performance or purported performance of a function under the Act. The State is also relieved of any liability it might otherwise have had for such actions (s 29(2)). That right functions as a statutory shield for exercise of functions within the Act, subject to the good faith requirement. Section 29(4) clarifies that references to doing anything include omissions.

Regulatory and reporting rights. The Governor may make regulations necessary to give effect to the Act (s 31). The Minister must lay the Trust’s annual report before Parliament within statutory timeframes or transmit it to the Clerk where Parliament is not sitting (s 28).

Collectively, the Act creates tightly defined administrative duties for the Treasurer and Minister, procedural and ethical duties for Trust members, operational duties for the Department and CEO, and statutory protections for persons acting in good faith. The statutory design privileges executive discretion over mandatory entitlement to funding for particular projects, with the Trust playing an advisory rather than decision‑making role.

The Act contains a compact enforcement architecture: monetary penalties for specified member misconduct, administrative removal mechanisms for members, statutory confidentiality and disclosure regimes, procedural reporting requirements enforced through parliamentary laying obligations, and a statutory protection against tort actions for persons acting in good faith. It provides no criminal penalties for misuse of Fund money beyond the specified fines for disclosure and confidentiality breaches. Enforcement is therefore primarily administrative, with limited penal backstops.

Monetary penalties for members. Two specific penalties are set in the Act. First, a member who has a direct or indirect pecuniary interest in a matter before a meeting and fails to disclose it as soon as possible after the relevant facts have come to their knowledge faces a fine of $12 000 (s 24(1)). Second, a person who is or has been a member must not record, disclose or make use of information obtained in the course of duty except in limited circumstances; breach attracts a fine of $12 000 (s 30).

Administrative removal. The Minister may remove a member from office for specified grounds: mental or physical incapacity to carry out duties satisfactorily; being an insolvent under administration as that expression is defined in the Corporations Act 2001; absence without leave from three consecutive meetings; neglect of duty; or misconduct (s 16(2)(a)-(e)). Removal is an administrative sanction exercisable by the Minister, not a penal sanction. The Act also provides that the office of a member becomes vacant in the event of death, resignation, or removal before the expiry of term (s 16(3)).

Disclosure and procedural enforcement at meetings. The chair or presiding person at a meeting may call on a member to disclose an interest and may determine that the interest exists if the member defaults (s 24(2)). The disclosure or determination must be recorded in the minutes (s 24(3)). If a disclosure is made, the member may participate in discussion but not in advising or recommending to the Minister on the matter (s 24(4)). This procedural rule is enforced internally by the presiding person and by minute‑keeping; failure to observe disclosure provisions can attract the monetary fine noted above.

Confidentiality enforcement. Section 30 prohibits recording, disclosing or making use of information obtained in the course of duty except for limited purposes; breach attracts a $12 000 fine. The Act leaves open the Court or other statutory mechanisms to enforce those fines, but it does not itself create criminal offences beyond the penalty provisions.

Reporting obligations. The Department’s annual report must include information about the Fund (s 10). The Trust must prepare an annual report and the Minister must lay it before each House of Parliament within 90 days of the financial year end or transmit it to the Clerk if Parliament is not sitting (s 28). Non‑compliance with those reporting timelines could result in parliamentary scrutiny and political accountability rather than a specified statutory penalty.

Protection from tort liability. Section 29(1) provides that an action in tort does not lie against a person for things done in good faith under the Act. Section 29(2) extends relief to the State. That provision allocates legal risk away from individual officers in tort litigation and limits civil exposure. The good faith qualifier is central; the statutory shield does not remove other civil remedies where good faith may be absent. The section does not bar judicial review or remedies available under other written laws.

Regulatory enforcement. The Act authorises the Governor to make regulations (s 31). Regulations may prescribe additional enforcement mechanisms or procedural requirements, but the Act as enacted does not list further penalties beyond those noted.

In practice, enforcement of the Act’s rules will be effected by (a) internal administrative decisions (appointment and removal by the Minister, meeting governance and minutes), (b) imposition of monetary fines for disclosure/confidentiality infractions, (c) statutory reporting and parliamentary oversight, and (d) immunity in tort for good faith acts. The regime therefore combines administrative control and modest penal deterrents focused on the Trust’s integrity rather than tight criminalisation of funding decisions.

The Act deliberately references and sits alongside several existing statutory regimes. The cross‑references shape the Fund’s legal status, membership qualifications and reporting obligations and create a web of statutory interactions practitioners must note.

Financial Management Act 2006. The Fund is defined as a Treasurer’s special purpose account under the Financial Management Act 2006 s 10(a) (s 3, definition of Fund). The Act also cross‑refers to the Financial Management Act 2006 s 61 with respect to the Department’s annual report (s 10). As a Treasurer’s special purpose account, the Fund’s operations will be subject to the Financial Management Act’s broader provisions on appropriations, accounting and audit, including audit oversight by the Auditor General under that statute. The Act’s direction that amounts credited under s 6(2) are charged to the Consolidated Account (s 6(4)) matters for budget management under the Financial Management Act framework.

Regional Development Commissions Act 1993. Definitions of regional Western Australia and regional development commission are drawn from the Regional Development Commissions Act 1993 (s 3 definitions). The Act therefore integrates with the institutional architecture of regional commissions. The requirement that at least one Trust member be the chairperson of a regional development commission (s 13(1)(a)) ties the Trust’s composition to that statute’s offices.

Corporations Act 2001. The ground for removal of a Trust member includes the person being an "insolvent under administration", a term defined in the Corporations Act 2001 (s 16(2)(b)). That cross‑reference imports a federal corporate insolvency concept into the state statute as a disqualifying condition for public office on the Trust.

Constitution Acts Amendment Act 1899. The Act amends the Constitution Acts Amendment Act 1899 to insert the Western Australian Regional Development Trust in Schedule V Part 3 (s 32). That is a formal inclusion for the purposes of public body listings and potentially for any constitutional or statutory processes that refer to that schedule.

Other statutory interactions and constraints. The Act makes the Minister’s and Treasurer’s actions subject to their statutory duties in other laws. For example, the Treasurer’s management of the Fund must comply with the Financial Management Act 2006. The Minister’s recommendations and authorisations will interact with public sector employment and procurement law when the Fund is used to pay for services or infrastructure. The Act does not displace other written laws where they apply; it expressly allows disclosure of information "as required or allowed by this Act or another written law" (s 30(c)). The tort immunity in s 29 is narrow: it prevents actions in tort against persons acting in good faith under the Act, and it relieves the State of liability it might otherwise have had. That does not remove potential liabilities under other written laws or statutory remedies outside tort.

Regulatory gap‑filling. Section 31 confers regulation‑making power to prescribe matters necessary for giving effect to the Act. Regulations can therefore create additional compliance, procedural or enforcement mechanisms that further interact with other legislation. The Act also permits the regulations to change which part of the budget papers constitutes the forecast royalty income (s 6(1)), so the Financial Management Act’s budget classifications can be adjusted by regulation under this Act.

Administrative law and judicial review. The Act does not remove judicial review as a remedy for reviewable executive action. Where Ministerial authorisation or Treasurer decisions are made, affected persons could challenge those decisions under administrative law grounds. The tort immunity in s 29 does not prevent review of the lawfulness of administrative decisions. The Act therefore interlocks with general principles of administrative law even while providing some internal protections and procedures.

In summary, the Royalties for Regions Act is designed to operate inside the existing framework for public finance, regional development governance and public sector administration. The most direct statutory interactions are with the Financial Management Act 2006 (accounting, budget and audit), the Regional Development Commissions Act 1993 (definitions and membership links), the Corporations Act 2001 (insolvency definition), and the Constitution Acts Amendment Act 1899 (formal listing). Regulations under s 31 can further shape how these interactions operate in practice.

The compilation table in the statute text lists the original enactment and a single subsequent amendment recorded in the table. The drafting record in the source provides the following timeline.

Enactment and commencement. The Royalties for Regions Act 2009 received Royal Assent on 3 December 2009 (short title and s 1 and 2). Sections 3, 4 and Part 2 and Part 4 commenced on 27 March 2010. Parts 3 and 5 (which include the Trust establishment and the consequential amendment to the Constitution Acts Amendment Act 1899) commenced on 17 July 2010 (Compilation table and s 2).

Subsequent amendment. The compilation table records an amendment by the Public Sector Reform Act 2010 (No. 39 of 2010), s 89. The table notes that this amendment affected s 20, which concerns members’ remuneration and allowances, and came into effect on 1 December 2010 (Public Sector Reform Act 2010 s 89; compilation table). The text also indicates s 20 was amended by No. 39 of 2010 s 89. No other substantive amendments are listed in the provided compilation table.

Consequential amendment to other statutes. The Act itself effects a consequential amendment to the Constitution Acts Amendment Act 1899 by inserting the Western Australian Regional Development Trust in Schedule V Part 3 (s 32). That is an internal consequential change effected by the Act itself rather than a later amendment.

Absence of further recorded amendments in source. The provided compilation table lists only the enactment and the one amendment via the Public Sector Reform Act 2010 affecting s 20. The statute text supplied does not include further delegation, repeal or later amendments. Any subsequent legislative changes beyond those recorded in the provided compilation table are not present in the source and therefore not discussed here.

Practical reading for practitioners. For compliance and advisory purposes, the amendment history of immediate relevance is the Public Sector Reform Act 2010 change to the remuneration provision (s 20). The Act’s commencement was staged, with the Fund and its financial provisions starting earlier (March 2010) than the Trust’s structural provisions (July 2010). The enactment's insertion into the Constitution Acts Amendment Act 1899 is recorded as a consequential amendment effected by s 32 of the Royalties for Regions Act itself.

If advising clients or officials, verify whether any regulations have been made under s 31 and whether subsequent primary legislation has altered any operative provisions since the last recorded amendment in the compilation table. The compilation table supplied here is the authoritative summary contained in the source text; it records no additional amendments.

The Act text provided contains no judicial decisions or litigation history. The source names no cases, provides no extracts from judgments, and lists no disputes. Accordingly, there is no litigation recorded in the material supplied.

Notwithstanding the absence of recorded cases in the source, the Act’s structure identifies areas where legal disputes could plausibly arise, and practitioners should be alert to those potential dispute vectors when advising clients or planning projects that depend on Fund allocation.

Potential grounds for legal challenge indicated by the Act’s mechanics:

• Compliance with s 8 cap and crediting rules: The Treasurer is required to ensure the Fund’s balance does not exceed $1 billion and must not credit amounts that would contravene that limit (ss 6(3), 7(2), 8). Disputes could arise about whether the Treasurer properly applied the cap when crediting or withholding credits, especially where stakeholders claim an entitlement or reliance on a statutory credit based on the forecast calculation.

• Lawfulness of Ministerial authorisation: The Act vests the authority to authorise expenditure in the Minister with the Treasurer’s concurrence (s 9(1)). Affected parties could seek judicial review of a Ministerial authorisation decision on administrative law grounds such as Wednesbury unreasonableness, procedural unfairness, failure to consider relevant matters, or acting for an improper purpose. The statutory requirement for concurrence may raise questions about proper delegation or joint decision‑making.

• Trust procedural fairness and disclosure: The Trust provides advice and recommendations to the Minister (s 12). Disputes might arise concerning whether the Trust complied with its own procedures, disclosure obligations (s 24), or confidentiality rules (s 30) in preparing recommendations, particularly where a recommendation has material consequences for funding decisions. The Act allows a member to participate in discussion but not in advising or making a recommendation where a pecuniary interest exists (s 24(4)); a breach could provide a basis for contesting a recommendation’s legitimacy.

• Interaction with Financial Management Act processes: Because the Fund is a Treasurer’s special purpose account and credits are charged to the Consolidated Account (s 6(4)), disputes could concern the proper accounting of Fund credits or whether the Treasurer complied with Financial Management Act requirements when effecting credits or allocations.

• Tort immunity scope: Section 29 confers immunity from actions in tort for persons acting in good faith. Questions could arise about the boundary of that immunity, what constitutes good faith, and whether alleged conduct falls within the “performance or purported performance” of a function under the Act. Although s 29 removes a category of tort exposure, it does not remove judicial review or other statutory claims.

• Confidentiality and information release: Section 30 restricts disclosure of information obtained in the course of duty except in specified circumstances and creates a penalty. Disputes could arise about the validity of refused information requests, whether prescribed circumstances for lawful disclosure apply, or whether a member’s disclosure was lawful.

Because the supplied source contains no case law, practitioners must search the state law reports and administrative decisions databases for any post‑enactment litigation addressing these or other issues. Any such litigation would be pertinent for instructing clients on the Act’s practical legal risks.

The Act’s concise drafting contains a number of practical traps and non‑obvious operational constraints that can be consequential for departments, applicants and counsel. The following are concrete items to watch for.

Forecast basis not actual receipts. Section 6(2) requires credits equal to 25 per cent of the forecast royalty income, as set out in the General Government Operating Statement in the budget papers (s 6(1)). This is a statutory credit based on forecast figures, not actual royalty collections. The forecast may differ materially from actual receipts. Stakeholders who assume the Fund will mirror realised royalties will be disappointed. The regulations may change which budget paper part constitutes the forecast figure, because s 6(1) allows regulations to prescribe another part.

$1 billion cap can bite. The Treasurer must ensure the Fund’s balance never exceeds $1 billion (s 8) and must not credit amounts that would contravene that limit (ss 6(3), 7(2)). That means the statutory 25 per cent credit is not absolute in effect; once the Fund balance approaches the cap, upcoming credits may be withheld even though the 25 per cent rule is in place. Practitioners and proponents must account for the operational risk that funds will not be credited if the cap is binding.

Credits charged to the Consolidated Account. Although the Fund is the visible repository, amounts credited under s 6(2) are charged to the Consolidated Account (s 6(4)). This has two consequences. First, budgetary management requires coordination with broader Consolidated Account cashflows. Second, the Fund does not operate as a ring‑fenced silo of actual royalty receipts; the mechanism transforms forecast royalties into Consolidated Account charges.

Minister/Treasurer concurrence required for spending. Expenditure from the Fund requires the Minister’s authorisation with the Treasurer’s concurrence (s 9(1)). That dual requirement centralises decision power in the executive and means project proponents need to secure political and fiscal buy‑in. The Trust only advises; it does not authorise expenditure. The decision pathway is therefore political/administrative rather than automatic.

Broadly drafted authorised purposes. The permitted spending categories in s 9(1) are programmatic and broad. That allows a wide variety of projects to be justified under the rubric of infrastructure and services, economic base development, or job creation. The breadth enables flexible use but also creates ambiguity on eligible projects and increases the importance of administrative guidance or regulations to refine eligibility.

Treasurer’s power to create subsidiary accounts. Section 5(1)(d) permits the Treasurer, on the Minister’s recommendation, to create “any other account” as a subsidiary account. That allows the creation of new sub‑pots without parliamentary amendment of the Act. Practitioners should watch for the Treasurer’s determinations and Ministerial recommendations that create new accounts with different allocation rules.

Trust is advisory, not decision‑making. The Trust’s functions are confined to advice and recommendations (s 12). It has no statutory power to authorise spending or to bind the Minister or Treasurer. It can, however, influence allocations since s 5(2) requires the Treasurer to act on the Minister’s recommendation and s 12 makes the Trust the vehicle for developing recommendations. But appellants or proponents should not assume Trust approval equates to funding certainty.

Disclosure rules permit participation in discussion. A member who discloses a pecuniary interest may still participate in consideration or discussion of the matter but may not advise or make a recommendation to the Minister on the matter (s 24(4)). That nuance means a conflicted member can contribute to factual discussion but must be excluded from the advisory output. The presiding person can compel disclosure and determine an interest exists if the member defaults (s 24(2)). Non‑disclosure attracts a $12 000 fine (s 24(1)).

Confidentiality exceptions and penalties. Section 30 permits disclosure in specified circumstances, including under another written law and with written consent of the person to whom the information relates (s 30(b)-(c)). However, the penalty for unauthorised disclosure or use is $12 000. Practitioners must carefully manage information flows, FOI requests and briefings to ensure compliance.

Tort immunity does not eliminate other liability. Section 29 provides that an action in tort does not lie against a person for acts done in good faith under the Act and relieves the State of corresponding liability (ss 29(1)-(2)). That immunity is limited to tort and to acts done in good faith; it does not displace judicial review or statutory causes of action under other written laws. Reliance on s 29 as complete legal protection is therefore a potential misreading.

Short statutory terms for certain members. A regional development commission chair appointed as a member has a term of 12 months (s 15(2)), whereas other members may have terms up to three years (s 15(1)). That annual churn can affect institutional continuity if commission chairs are rotated frequently.

Remuneration subject to Public Sector Commissioner recommendation. Member remuneration and allowances are determined by the Minister on the recommendation of the Public Sector Commissioner (s 20). Budgeting for remuneration must therefore fit public sector pay frameworks and may be altered by public sector reform.

Regulation‑making power may shift practical operation. Section 31 allows the Governor to make regulations necessary to give effect to the Act. The regulations can change operational details, including what part of the budget papers counts as the forecast royalty income (s 6(1)). Regulatory changes can therefore materially affect how credits are calculated and administered.

No automatic entitlement for projects. The Act creates a statutory funding stream for regional purposes but does not create a statutory entitlement for any particular project or class of project. Expenditure remains subject to Ministerial authorisation with Treasurer concurrence (s 9). Applicants should not assume receiving funding simply because a project aligns with the Fund’s broad purposes.

These operational “gotchas” are points of friction where statutory text and administrative practice meet. Advisers and officials should build them into budgeting, project planning and compliance workflows.

Compliance with the Act requires coordinated action by executive officers, departmental staff, Trust members and prospective applicants. The following checklist sets out concrete steps and control points grounded in the statute.

Budgetary controls and forecasting

• Use the correct forecast royalty income. Ensure that the forecast royalty income used for the s 6(2) 25 per cent calculation is the figure appearing in the part of the budget papers titled “General Government Operating Statement” unless regulations prescribe another part (s 6(1)). If regulations have changed this reference, follow the regulations.

• Monitor the $1 billion cap. The Treasurer must ensure the Fund balance never exceeds $1 billion (s 8). Implement daily or monthly cash and ledger controls that flag the Fund’s balance relative to the cap so that s 6(3) and s 7(2) constraints are respected when making credits.

• Coordinate with Consolidated Account managers. Amounts credited under s 6(2) are charged to the Consolidated Account (s 6(4)). The Treasury’s cash management team should integrate the Fund credit schedule into Consolidated Account cashflows and appropriation planning.

Governance and decision procedures

• Formalise Minister/Treasurer concurrence process. Create a documented workflow for Ministerial authorisation and Treasurer concurrence for expenditures under s 9. Capture evidence of recommendation, advice from the Trust, financial implications and Minister/Treasurer sign‑off to create an audit trail.

• Ensure Trust advice is recorded. The Trust’s output is advisory (s 12). Draft practice notes that define the form and content of Trust recommendations to the Minister on subsidiary allocation (s 5(2)) and on referrals (s 12(b)), and ensure minutes capture the reasoning supporting recommendations (s 25).

Trust member obligations and records

• Disclosure register and process. Implement a written disclosure process that captures members’ direct or indirect pecuniary interests and records them in Trust minutes as required (ss 24(1), 24(3)). Train members on the $12 000 fine for failure to disclose and on the rule that disclosed members may take part in discussion but not advise or recommend to the Minister on the matter (s 24(4)).

• Meeting procedures and minutes. The Trust must keep accurate minutes (s 25). Use a standard minute template to record attendance, disclosures, determinations under s 24(2), decisions on who presides, remote attendance methods where used (s 23), and the text of recommendations.

• Confidentiality handling. Put in place statutory confidentiality protocols reflecting s 30. Ensure secure handling of confidential material, processes for seeking written consent for disclosure where appropriate (s 30(c)), and a mechanism for determining whether a disclosure is permitted by another written law or falls within prescribed circumstances.

Departmental support and resourcing

• CEO arrangements for services and facilities. The CEO must ensure the Trust is provided with necessary services and may make staff available on agreed terms (s 27). Prepare service‑level agreements or memoranda of understanding specifying staff secondment terms, facilities access and cost recovery or charge arrangements (s 27(2)(a)-(b)).

• Annual reporting compliance. The Department’s annual report must include information about the Fund’s operation (s 10). Establish data collection and reporting templates aligned with Financial Management Act reporting obligations so the accountable authority can meet s 61 and the s 10 requirement.

Financial administration and audit

• Charging authorised expenditure to the Fund. Ensure that any expenditure authorised under s 9(1) is charged to the Fund in accordance with s 9(2). Maintain project‑level budgets and reconciliation to subsidiary account allocations.

• Track administrative expenses and remuneration. The Fund bears administration of the Fund and the Trust, including members’ remuneration (s 9(2)(b)-(c)). Maintain clear cost allocations and approvals for payments to members in line with the Minister’s determinations on the Public Sector Commissioner’s recommendation (s 20).

Regulatory monitoring and legal risk

• Monitor regulations. Section 31 permits regulations altering operational details, including potentially the budget paper reference in s 6(1). Maintain a review process to capture any regulations made under s 31 and integrate their requirements into procedures.

• Legal review and administrative law readiness. Given that significant discretion resides with the Minister and Treasurer, document decision‑making processes, reasons and evidence to reduce risk of judicial review. Ensure legal counsel reviews major authorisations to confirm procedural fairness and legality.

Project and applicant engagement

• Clarify project eligibility and authorisation route. Publicise the process by which projects may be considered for Fund expenditure, make clear that the Trust’s recommendations are advisory (s 12), and that Ministerial authorisation with Treasurer concurrence (s 9(1)) is required to access funds. Provide guidance on submission requirements, assessment criteria aligned to the statutory purposes in s 9(1), and expected timelines.

• Manage expectations about funding certainty. Communicate that the Fund’s credits are based on forecast royalty income and subject to the $1 billion cap (ss 6(2), 8), and that expenditure is subject to Minister/Treasurer authorisation.

Audit, records and FOI

• Maintain full audit‑ready records. Because the Fund sits within the Financial Management Act framework, keep contemporaneous records of credits, allocations, recommendations, authorisations and disbursements to provide evidence for internal audit and the Auditor General.

• FOI and information release policies. Establish FOI handling protocols that reconcile s 30 confidentiality constraints with FOI obligations and other written law. Ensure clear procedures for assessing whether an information disclosure is authorised, required or prohibited.

Training and induction

• Induct Trust members. Provide written induction material covering statutory duties, disclosure obligations, confidentiality rules, the $12 000 penalties, minute‑keeping expectations, meeting attendance rules and the scope of the Trust’s advisory role (s 12).

• Train departmental staff on financial and governance controls. Provide training on the statutory crediting mechanism, the $1 billion cap, Consolidated Account interactions, and the Minister/Treasurer authorisation workflow.

Implementation checklist for first‑order acts

• Before crediting the Fund for a financial year: confirm forecast royalty income figure in budget papers; verify that crediting will not breach the $1 billion cap; prepare Consolidated Account cash plans.

• Before authorising expenditure: ensure Minister’s proposed authorisation aligns with s 9(1) purposes; obtain Treasurer concurrence in writing; confirm funding source within Fund/subsidiary account; document Trust advice where relied upon.

• On Trust meetings: record disclosures in minutes; ensure conflicted members do not participate in final recommendations; maintain confidentiality controls; keep accurate minutes and publish annual report in timely fashion (s 28).

Adherence to these concrete steps will align day‑to‑day operation with statutory obligations and reduce legal, financial and reputational risk for the Department, the Trust and executive decision‑makers.
