Royal Children's Hospital (Land) Act 2007

The Act introduces and relies upon a limited set of defined concepts to govern which parcels are affected and how they move through reservation and management processes. Key definitions in s 3 are operational for the Act’s sequencing:

• excised land: the geographic area depicted hatched and cross‑hatched on the plan in Schedule 2 (s 3). The revocation in s 4 targets these hatched cross‑hatched areas by reference to the historic Orders in Council listed in Schedule 1.
• old Hospital site: land temporarily reserved as a Site for the Children’s Hospital by the 1950 Order in Council (s 3).
• new Hospital site: the land that becomes defined by a plan of survey prepared by the Surveyor‑General under s 8 and approved under s 8(2)-(3).
• project land: the excised land together with the old Hospital site (s 3).
• surplus project land: project land that is not part of the new Hospital site, to be shown on a plan prepared under s 9.

Statutory mapping and survey play a central role. The plan of survey prepared under s 8 by the Surveyor‑General is the instrument that fixes the new Hospital site boundaries and carries two statutory limits: (1) the new site’s total area must be less than 4.1 hectares and (2) the new site must be wholly within the project land (s 8(1)(b)(i)-(ii); s 8(3)). Only after the new site plan is approved must the Minister cause a plan of the surplus project land to be prepared (s 9). The Governor in Council’s power to reserve land under s 10 is expressly tied to those plans and to the Minister’s recommendation (s 10(1)-(2)) and effectuated by publication in the Government Gazette (s 7(2); s 10(3)-(4)).

Reservation status and committee of management appointments are treated as statutory statuses that the Act can both remove and create. Revocation of reservation under Part 2 carries a statutory deeming that the land becomes unalienated Crown land freed from prior trusts and encumbrances (s 5(a)). When an Order under s 10 is published, the Act again uses deeming: new Hospital site is temporarily reserved for hospital purposes and the RCH is deemed to be the committee of management; surplus project land is permanently reserved as a public park and Melbourne City Council is its committee of management (s 10(3)(d)-(e); s 10(4)(d)-(e)).

The Act also creates specific, delimited commercial powers for the committee of management of the new Hospital site to grant leases (s 14) and licences (s 15). Each grant requires written ministerial approval and must be for a purpose consistent with the land’s reserved purpose (ss 14(1)-(2); 15(1)-(2)). Leases may be for up to 30 years, including any renewal options whose aggregate term cannot exceed 30 years; provision is made for a discretionary post‑expiry occupation for not more than three months (s 14(3)-(4)). Licences may be granted for periods not exceeding 30 years (s 15(3)(a)). Both instruments are subject to covenants, exceptions, reservations and conditions determined by the committee and approved in writing by the Minister (s 14(4)(c); s 15(3)(b)).

Finally, the Act creates administrative sequencing and record‑keeping obligations. The Registrar of Titles is required to make any entries necessary under the Transfer of Land Act 1958 because of the revocations or re‑reservations (ss 6, 12). The Act also contains an express preservation clause for existing leases to secure continuity of certain interests (s 11).

These concepts collectively convert historical, mapped Crown reservations into a carefully sequenced set of revocations, surveys, re‑reservations and management powers, with tight ministerial and Governor in Council controls and specific term and purpose constraints on private occupation and use of the new Hospital site.

Identify the parties and public bodies that acquire new rights or obligations under the Act, and those whose existing rights may be extinguished or altered.

• The Crown and titles administration: the State as owner is the legal recipient and manager of the land changes. The Registrars responsible for the Transfer of Land Act 1958 must record changes (ss 6, 12). Historic trust and encumbrance regimes over the excised land are statutorily discharged on revocation (s 5(a)).
• The Minister administering the Health Services Act 1988: bears the duty to declare project completion once satisfied building works and demolition criteria are met (s 7). That declaration is the statutory trigger for survey and re‑reservation steps (s 7(2); s 8).
• The Minister administering this Act: must approve the plan of survey of the new Hospital site referred by the Health Services Minister (s 8(2)-(3)); must cause a plan of surplus project land to be prepared (s 9); must recommend to the Governor in Council that Orders be made under s 10 to reserve the new site and the surplus park land (s 10(1)).
• The Governor in Council: has the executive power to make the reservation Orders on the Minister’s recommendation and thereby effect the re‑reservation statuses by Government Gazette publication (s 10(2)-(4)).
• The Surveyor‑General: prepares the statutory plans of survey that fix final boundaries for the new Hospital site and the surplus project land (ss 8(1)(a), 9).
• Royal Children’s Hospital (RCH): on publication of the Order under s 10 in respect of the new Hospital site, the RCH,being a public health service incorporated under s 65P of the Health Services Act 1988,is statutorily deemed to be the committee of management for that land (s 10(3)(e)). That status confers the power to apply the land management provisions in Part 4 (s 13(2), s 14).
• Melbourne City Council: on publication of the Order under s 10 in respect of the surplus project land, the Council is statutorily deemed to be the committee of management for that land and responsible for park management (s 10(4)(e)).
• Existing committees of management for the excised land: their appointments are revoked to the extent they related to the excised land upon revocation (s 5(b)); similarly appointments are revoked in relation to the new Hospital site and the surplus project land when those lands are reserved under s 10 (s 10(3)(b), (4)(b)).
• Leaseholders and licencees: the Act preserves certain lease continuity (s 11). Leases that were in existence immediately before reservation of the old Hospital site remain unaffected (s 11(2)). For the new site, leases entered into after the commencement of Part 2 but in existence immediately before re‑reservation are saved (s 11(1)). Where new leases or licences are sought after re‑reservation, the committee of management may grant instruments subject to ministerial approval, purpose compatibility and term limits (ss 14-15).
• Potential commercial users, service providers and third party occupiers: Any party seeking to occupy, develop or use the new Hospital site on a lease or licence will be directly affected by the Act’s constraints: written ministerial approval is required for grants (ss 14(1), 15(1)), purposes must be consistent with the reservation (ss 14(2), 15(2)), and maximum term limits apply (ss 14(3), 15(3)(a)).
• The public and park users: the Act returns surplus project land to public park status (s 10(4)(d)). Users of Royal Park are affected by the initial excision and later re‑inclusion of surplus lands as determined by the plans and Orders.
• Third parties with encumbrances or other interests registered on title: revocation under Part 2 deems the land freed from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests (s 5(a)). That statutory effect may extinguish interests in the excised land; the Act provides no statutory compensation mechanism for those extinguished interests within its text.

Public authorities and private parties cannot safely assume that prior restrictions will remain in place where the Act operates. The State apparatus,Ministerial offices, the Surveyor‑General and the Registrar of Titles, are the actors who decide when the key triggers occur and who are responsible for the administrative steps that change legal status and record the changes (ss 6, 7, 8, 9, 10, 12). Committees of management, once appointed by deeming under s 10, exercise leasing and licensing powers under the strict supervision of ministerial approvals (ss 13-15). Existing leaseholders enjoy selective statutory protection (s 11), but other third‑party property interests are explicitly removed by the revocation deeming (s 5(a)).

The Act allocates specific duties, discretions and rights among Ministers, the Governor in Council, the Surveyor‑General, committees of management, the Registrar of Titles and affected private parties. The primary legal duties and rights set out by the Act are:

Ministerial duties and discretions

• The Minister administering the Health Services Act 1988 must make a declaration of project completion when satisfied that the new hospital buildings are complete and that redundant former buildings have been demolished (s 7(1)). The declaration must be published in the Government Gazette and takes effect on the date of publication or a later date specified in the declaration (s 7(2)(a)-(b)).
• After declaration, the Health Services Minister must cause the Surveyor‑General to prepare the plan of the new Hospital site and ensure the plan complies with the area and project‑land constraints (s 8(1)(a)-(b)).
• The Minister administering this Act receives the plan from the Health Services Minister and must not approve it unless satisfied that it meets the statutory size and boundary constraints (s 8(2)-(3)). Upon approval, that Minister must cause a plan of surplus project land to be prepared (s 9) and recommend to the Governor in Council that an Order be made under s 10 (s 10(1)).
• The Minister exercising approval functions under ss 14 and 15 must give written approval before a committee of management can grant a lease or licence; the Minister must be satisfied that the purpose of grant is not inconsistent with the reservation purpose (ss 14(1)-(2); 15(1)-(2)). That is a statutory gatekeeping role with no further statutory criteria specified.

Governor in Council

• On the Minister’s recommendation, the Governor in Council may make an Order reserving the new Hospital site for hospital purposes and the surplus project land as a public park; the Order is to be published in the Government Gazette and to include either copies of the approved plans or references to plans lodged in the Central Plan Office where practical difficulties prevent publishing the plans (s 10(2); s 10(5)(a)-(b)).

Surveyor‑General

• The Surveyor‑General must prepare the plan(s) of survey: the final boundaries of the new Hospital site (s 8(1)(a)) and the plan showing the surplus project land (s 9). The plans are the statutory instruments that the Minister and Governor in Council use to effect reservation changes.

Registrar of Titles

• Must make any recordings in or amendments to the Register under the Transfer of Land Act 1958 necessary because of the operation of any provision in Parts 2 and 3 (ss 6, 12). These are record‑keeping duties to maintain title consistency with the statutory changes.

Committees of management and RCH / Melbourne City Council

• Once the Orders under s 10 are published, the RCH is deemed to be the committee of management for the new Hospital site and Melbourne City Council is deemed to be the committee of management for the surplus project land (s 10(3)(e), s 10(4)(e)).
• The committee of management of the new Hospital site has express powers under Part 4, subject to the written approval of the Minister, to grant leases (s 14(1)) and licences (s 15(1)). The committee has discretion to determine covenants, exceptions, reservations and conditions in leases, but those are subject to the Minister’s written approval (s 14(4)(c)). Leases and licences have defined maximum terms and procedural constraints (ss 14(3)-(4); 15(3)).

Rights preserved and constrained

• Continuity of certain existing leases is protected: leases in existence immediately before new reservation of the old Hospital site are unaffected (s 11(2)); leases entered into after commencement of Part 2 that are in existence immediately before reservation of the new Hospital site continue (s 11(1)). The Act defines "lease" broadly to include licences, options to renew and similar interests (s 11(3)).
• Where the Crown revokes prior reservations under Part 2, the land is statutorily freed from "all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (s 5(a)). That is not a duty to pay compensation; it is a deeming that removes previously recorded or operative interests.
• Leases and licences beyond the permitted maximum terms or without the Minister’s written approval will lack the required statutory authority under ss 14 and 15. The Act imposes no specific criminal penalties for non‑compliance, but legal effectiveness of such instruments would be susceptible to challenge or invalidity for failing to comply with the statutory grant mechanism.

Override and primacy

• Part 4 operates "despite anything to the contrary in the Land Act 1958 and the Crown Land (Reserves) Act 1978" (s 13(1)), which gives these duties and discretions statutory primacy over inconsistent provisions in those Acts as they affect the new Hospital site management powers. The Act also clarifies that the Part 4 powers are in addition to the committee’s powers under the Crown Land (Reserves) Act 1978 (s 13(2)), creating an additive rather than exclusive statutory power set for the committee.

Procedural publication duties

• Several steps are tied to publication requirements: the declaration of project completion must be published in the Government Gazette (s 7(2)), and the Governor in Council can effect reservation by publishing the Order including the approved plans or references to them (s 10(2), s 10(5)). Publication is the mechanism that gives effect to the re‑reservation deemings provided under s 10(3)-(4).

Taken together, the Act concentrates decision rights with particular Ministers and the Governor in Council, gives the Surveyor‑General a technical mapping duty, imposes recording obligations on the Registrar of Titles, and establishes constrained commercial powers for the committee of management for the new Hospital site. Existing leases are partially protected by express saving clauses, while many other prior interests are statutorily extinguished upon revocation (s 5).

The Act does not create criminal offences or monetary penalties within its text. Enforcement and compliance are achieved by administrative control, statutory deeming and record alteration rather than by new penal provisions. The principal enforcement and compliance mechanisms are:

• Ministerial gatekeeping: the committee of management cannot lawfully grant a lease or licence over the new Hospital site without the written approval of the Minister, who must be satisfied that the proposed purpose is not inconsistent with the reservation (ss 14(1)-(2); 15(1)-(2)). This requirement functions as a statutory control on the creation of proprietary interests.
• Statutory deemings that extinguish prior rights: on revocation of reservations under Part 2, the land is "deemed to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (s 5(a)). The power of revocation and deeming operates as a legal effect rather than a sanction; it extinguishes pre‑existing rights without creating a penalty regime for contravention.
• Recording and title amendment obligations: the Registrar of Titles is required to make all necessary recordings or amendments to the Register under the Transfer of Land Act 1958 consequent on Part 2 revocations and Part 3 re‑reservations (ss 6, 12). The transfer and titling system is the primary mechanism by which the legal position is publicly maintained and by which third parties learn of changes.
• Deemed committee of management appointments and statutory responsibilities: the RCH and Melbourne City Council, once deemed committees of management under s 10, undertake the statutory duties and are bound by the legal regime (s 10(3)(e); s 10(4)(e); Part 4). Ministerial approval and the requirement that uses be consistent with reservation purposes constrain their exercise of leasing/licensing powers (ss 14(2), 15(2)).
• Administrative remedies: the Act invests administrative discretion with Ministers to approve plans and to approve leases and licences. Although the Act does not itself provide appeal rights or review mechanisms, those discretionary decisions are subject to the general administrative law framework applicable in Victoria for judicial review of administrative decisions. The Act does not specify an internal merits review process.

Because the Act contains no express punishments for failure to comply with its requirements, non‑compliant actions (for example, a committee purporting to grant a lease without the required written ministerial approval) would be vulnerable to legal challenge and likely treated as ultra vires or ineffective for lack of statutory authority. The practical enforcement consequences are therefore legal invalidity and administrative correction rather than statutory penalties.

Other relevant enforcement observations that follow from the statutory scheme:

• The Act’s reliance on Government Gazette publication for certain effects means that failure to publish the required declaration or Order would leave the deemings inoperative until publication occurs (s 7(2); s 10(3)-(4)). Publication is the operative administrative act triggering reservation status changes and committee-of‑management deemings.
• The Registrar’s duty to reflect changes in the register provides a practical enforcement channel: once the Registrar amends title records under the Transfer of Land Act 1958 pursuant to ss 6 and 12, third parties are put on notice of the new legal status.
• The Act does contain express saving clauses for certain existing leases (s 11). Any attempt to disturb those saved lease interests would need to confront the statutory protection in s 11(1)-(3).

In short, compliance and enforcement are administrative and property law centred: ministerial approvals, statutory deemings and title record adjustments are the mechanisms that produce legal effects. The Act does not establish a separate criminal or penalty regime for contraventions.

The Act is expressly drafted to interact with, and in some respects override, several existing statutes governing Crown land, title registration and health service administration. The principal cross‑statutory interactions recorded by the Act are:

Crown Land (Reserves) Act 1978

• Multiple provisions of this Act reference and modify the effect of the Crown Land (Reserves) Act 1978. On revocation of reservations under Part 2, any regulations under s 13 of that Act are revoked to the extent they applied to the excised land (s 5(c)). When re‑reservation occurs under s 10, similar revocations of regulations under s 13 of the Crown Land (Reserves) Act 1978 apply to land being reserved under s 10(3)(c) and s 10(4)(c).
• The Act deems particular lands to be temporarily or permanently reserved under s 4(1) of the Crown Land (Reserves) Act 1978 (s 10(3)(d); s 10(4)(d)). That deeming places the lands within the legal architecture of the Crown Land (Reserves) Act 1978 and imports the statutory consequences of a reservation under that Act.
• The Act expressly states that Part 4 has effect "despite anything to the contrary in the Land Act 1958 and the Crown Land (Reserves) Act 1978" (s 13(1)). That phrase creates statutory primacy for this Act’s Part 4 provisions in the event of inconsistency, while s 13(2) confirms the Part 4 powers are additional to a committee’s powers under the Crown Land (Reserves) Act 1978.

Land Act 1958

• Part 4 is declared to have effect despite anything to the contrary in the Land Act 1958 (s 13(1)), which means the committee’s leasing/licensing powers under this Act prevail where there is a conflict between the two statutes.

Transfer of Land Act 1958

• The Registrar of Titles must make the entries and amendments necessary under the Transfer of Land Act 1958 as a consequence of both the revocations in Part 2 and the re‑reservations under Part 3 (ss 6, 12). The Act thus relies on the Transfer of Land Act’s register mechanisms to give public effect to title changes.

Health Services Act 1988

• The Minister administering the Health Services Act 1988 carries the initial trigger role of declaring project completion (s 7). The RCH is also identified by reference to its incorporation under s 65P of the Health Services Act 1988, which is the basis for deeming the RCH to be the committee of management for the new Hospital site (s 10(3)(e)). The Act therefore nests within the administrative architecture of health services.

Governor in Council and Government Gazette Publication

• The Act uses the Governor in Council’s power to create reservations on the Minister’s recommendation (s 10(1)-(2)) and ties legal effect to publication in the Government Gazette (s 7(2); s 10(3)-(4)). It also provides for the practical problem of plan publication by permitting reference to plans lodged in the Central Plan Office where publishing the full plans is impractical (s 10(5)(b)).

Other administrative law and statutory frameworks

• While the Act does not itself invoke the Planning and Environment Act 1987, the Municipal Act or other land use laws, its provisions materially alter land reservation status and committee of management appointments, which will interact operationally with other statutory regimes governing land use and municipal management. The Act, however, does not specify or change planning processes; it focuses on reservation, titling and committee of management powers.

Interpretation of legislation and endnotes

• The Endnotes explain that the Act was subject to style changes authorised by the Interpretation of Legislation Act 1984 and include the Act’s long title, second reading speech dates and commencement information (Endnotes). The Act has been amended by the Parks and Crown Land Legislation Amendment Act 2017 (No. 53/2017) with a specific amendment to s 10(5)(b) (Table of Amendments).

Net effect on statutory hierarchy

• The Act creates an operational priority over certain provisions of the Land Act 1958 and Crown Land (Reserves) Act 1978 for the purposes of the new Hospital site management (s 13(1)). It also depends on the Transfer of Land Act 1958 for recording purposes and on the Health Services Act 1988 for the initial satisfaction trigger and for identifying the RCH as a statutory entity eligible to be deemed committee of management (s 7; s 10(3)(e)).

Practitioners should therefore view this Act as a specialised overlay that uses existing statutory instruments (Governor in Council orders, Government Gazette publication, Surveyor‑General plans, Transfer of Land registrations) to effect reservation and management changes, while giving Part 4 specific primacy where it conflicts with more general Crown land statutes (s 13(1)). The Act’s limited cross‑references mean that the statutory interplay is largely administrative and title‑management focused rather than a general reform of Crown land law.

The Act’s formal amendment history is brief and recorded in its endnotes. Key dates and amendment particulars in the published version incorporate:

• Original enactment: Royal Children’s Hospital (Land) Act 2007, assented to 25 September 2007 and brought into operation on 5 November 2007 (Endnotes; Government Gazette 1 November 2007 p. 2519).
• Consolidated version date: this version incorporates amendments as at 15 December 2017 (cover page).
• Subsequent amendment: Parks and Crown Land Legislation Amendment Act 2017 (No. 53/2017) amended s 10(5)(b). The Table of Amendments records this amendment with assent date 24 October 2017 and a commencement notation that s 92 commenced on 15 December 2017: Special Gazette (No. 433) 12.12.17 p. 1. The Act text itself notes "S. 10(5)(b) amended by No. 53/2017 s. 92."
• No outstanding amendments not in operation: the endnotes state there are no amendments that were "Not in Operation" at the publication date.

Other publication details

• The Endnotes provide legislative housekeeping details such as the long title of the Bill, second reading speech dates (Legislative Assembly: 19 July 2007; Legislative Council: 23 August 2007), and interpretive notes about style changes made under the Interpretation of Legislation Act 1984.
• The Act’s schedules (Schedule 1 and Schedule 2) are part of the statutory instrument and map out the land affected by the revocations and the plan of excised land respectively. Schedule 1 identifies the historic Orders in Council from 1876 and 1882 that are revoked to the extent shown on Schedule 2.

Practical note on the 2017 amendment

• The only recorded substantive textual amendment in the consolidated materials (No. 53/2017 s 92) relates to s 10(5)(b), which governs the content of the Governor in Council Order and allows the Order to refer to plans lodged in the Central Plan Office where it is not practical to publish plans due to size, complexity or other technical matters (s 10(5)(b)). That amendment reflects a drafting or publication practicality rather than a substantive policy shift in reservation or land management rules.

Because the Act is narrowly focused and procedurally driven, its amendment history is correspondingly narrow and largely administrative. The consolidation up to 15 December 2017 captures the relevant changes to the publication mechanics for Orders under s 10.

The Act as published contains no references to litigation, and the Endnotes do not record any cases or judicial consideration of the Act. The text does not cite or incorporate any case law. The schedules and endnotes list legislative history and explanatory inputs such as second reading speeches, but there is no internal litigation history provided.

Given the Act’s procedural and administrative character, disputes that might arise in practice would likely concern:

• The validity of ministerial approvals and the Minister’s state of satisfaction when making the declaration of project completion under s 7(1); or the approval of plans under s 8(3). The Act vests fact‑dependent discretions in Ministers, which are the kinds of administrative actions that could be subject to judicial review in the usual course if procedural fairness, relevant considerations or legal limits were alleged to have been breached. The Act itself does not set out judicial review procedures or appeal rights.
• Challenges to the legal effect of revocations and the extinguishment of prior interests under s 5(a). Third parties whose registered or unregistered interests are affected by the deeming that land is "freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" could in principle litigate questions about the application and scope of that deeming and any compensation implications. The Act does not specify compensation within its terms.
• Disputes about the interpretation and application of the lease and licence powers in Part 4, including whether a proposed use is "not inconsistent with the purposes for which the land is reserved" as required by ss 14(2) and 15(2), or whether ministerial written approval was properly obtained.

The Act’s endnotes and schedules do not list any litigation to date. Practitioners should check up‑to‑date legal databases and court records for any proceedings that post‑date the consolidation cutoff (15 December 2017), as litigation post‑consolidation would not appear in the Act text.

The Act contains several discrete provisions and constraints that create practical risks or traps for practitioners, public authorities and private parties. These are concrete, statute‑based issues to flag when advising clients or planning transactions:

1. The strict area and boundary constraints on the new Hospital site

• The plan of survey for the new Hospital site must show a total area of less than 4.1 hectares and must not include any land that is not part of the project land (s 8(1)(b)(i)-(ii); s 8(3)(a)-(b)). Those are mandatory conditions for ministerial approval and offer a hard statutory cap on the new site’s footprint. Any proposed survey or design that inadvertently exceeds that area or includes land outside project land will fail approval.

2. The Ministerial satisfaction trigger for declaration of project completion

• The declaration of project completion under s 7(1) is a prerequisite to the survey, approval and re‑reservation steps. The statutory test requires the Health Services Minister to be satisfied that construction of the new Hospital is complete and that redundant buildings have been demolished (s 7(1)(a)-(b)). The Act places procedural importance on the Minister’s factual satisfaction and on Government Gazette publication (s 7(2)). Parties should treat Ministerial satisfaction as an administrative milestone that may be contested or delayed.

3. Revocation extinguishes prior interests without an express compensation mechanism

• On revocation of reservations under Part 2, the land is "deemed to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (s 5(a)). That statutory extinguishment has potentially wide consequences for registered and equitable interests. The Act contains no express compensation scheme for extinguished interests. Advisors should not assume replacement rights or indemnities are provided by the Act itself.

4. Limited and prescriptive protection for existing leases

• Protection for existing leases is limited and defined by timing: s 11(1) protects leases of the new site if entered into after commencement of Part 2 and in existence immediately before re‑reservation; s 11(2) protects leases of the old Hospital site in existence immediately before re‑reservation. The definition of "lease" is wide (s 11(3)), but reliance on the savings requires careful timing analysis. Parties holding or proposing lease interests should check the relevant timestamps to ensure the saving applies.

5. Ministerial control over lease and licence terms

• Any lease or licence grant by the committee of management of the new Hospital site requires the Minister’s written approval and must not be inconsistent with the reserved purpose (ss 14(1)-(2); 15(1)-(2)). Moreover, covenants, exceptions, reservations and conditions determined by the committee must be approved in writing by the Minister (s 14(4)(c)). This concentrates significant control over commercial terms with an executive actor who is not statutorily constrained by detailed criteria beyond "not inconsistent with the purposes" test.

6. Aggregate term cap for leases and subtle holdover rule

• Leases may contain options for renewal, but the aggregate of the original term and further term(s) must not exceed 30 years (s 14(4)(a)). Additionally, the lessor may permit a lessee to remain in occupation under the same terms for not more than three months from expiry (s 14(4)(b)). These time caps will constrain commercial models that expect long‑term security or rolling tenancies.

7. Part 4 primacy over the Land Act and Crown Land (Reserves) Act

• Part 4 operates "despite anything to the contrary" in those Acts (s 13(1)). This means customary powers, constraints or processes in the Land Act or Crown Land (Reserves) Act may not apply to the committee of management’s specified leasing/licensing powers. Practitioners must therefore not assume general Crown land grant procedures apply; rather, they should follow the special route set out in this Act.

8. Publication formalities are material

• Deeming effects and committee appointments are tied to Government Gazette publication requirements under ss 7(2) and 10(3)-(4). Failure to publish (or to comply with plan publication requirements under s 10(5)) may delay or prevent legal effect. Where plans are impractical to publish, the Order may refer to the Central Plan Office (s 10(5)(b)), but the Order must still satisfy the publication requirement.

9. Title registrations must be monitored and corrected

• The Registrar of Titles is required to amend the Register (ss 6, 12), but parties should confirm that amendments have been made and reflect the new reservation status, as the Act’s extinguishment of interests and creation of new reservation statuses have major title consequences.

10. Absence of explicit enforcement penalties

• Because the Act does not create criminal penalties or a specific enforcement regime, the primary remedies for non‑compliance are administrative invalidity and title correction. Parties should not assume statutory penalty provisions will deter wrongful grants; instead, ensure documentary compliance with ministerial approvals and publication requirements to secure enforceable rights.

Each of these items is rooted in specific sections of the Act and creates practical compliance and transactional issues that require attention by Ministers, committees, title professionals, prospective lessees and councils.

This section gives a practical checklist‑style approach to compliance for the main actors: Ministers and their departments, the Surveyor‑General, the Registrar of Titles, the Royal Children’s Hospital and Melbourne City Council (as committees of management), and prospective lessees or licencees. Each step is grounded in the statutory sections.

For Ministers and Departments

1. Declaration of project completion (s 7)

• Ensure the Health Services Minister documents the factual basis for satisfaction that the new Hospital buildings are complete and that redundant old Hospital buildings have been demolished (s 7(1)(a)-(b)). Prepare the Government Gazette notice and specify the effective date if a later date is intended (s 7(2)(a)-(b)). Retain contemporaneous evidence of completion and demolition for administrative record and potential review.

2. Plan preparation and approval (s 8)

• After publication of the declaration, instruct the Surveyor‑General to prepare a plan of survey showing final boundaries for the new Hospital site (s 8(1)(a)). Verify that the plan shows a total area of less than 4.1 hectares and that the plan does not incorporate land outside the project land (s 8(1)(b)). On receipt of a signed plan, the Health Services Minister must refer it to the Minister administering this Act for approval (s 8(2)). The receiving Minister must record satisfaction that the plan complies with the statutory constraints before approving (s 8(3)).

3. Plan of surplus project land (s 9)

• After approving the new Hospital site plan, cause the Surveyor‑General to prepare the plan of surplus project land (s 9). Confirm that the plan accurately excludes the approved new site and otherwise maps only project land.

4. Recommend Orders and publication (s 10)

• Prepare and lodge the recommendation for a Governor in Council Order under s 10(1). When preparing the Order, include the approved plans where practicable and, if not practicable, prepare references to the plans lodged in the Central Plan Office as authorised by s 10(5)(b). Ensure the Orders are published in the Government Gazette in the required form so that the s 10 deemings take effect (s 10(3)-(4)).

For the Surveyor‑General

• Provide plans that unambiguously comply with the statutory constraints in s 8(1)(b) and s 8(3). Ensure plans are signed and lodged in formats acceptable for Government Gazette inclusion or for the Central Plan Office reference (s 10(5)). Coordinate with the Health Services Minister and the Minister administering this Act to meet statutory referral and approval steps.

For the Registrar of Titles

• On receipt of notification of revocations (Part 2) or publication of Orders under s 10 (Part 3), make any necessary recordings or amendments to the Register pursuant to the Transfer of Land Act 1958 as required by ss 6 and 12. Ensure public registers reflect the new reservation statuses and any extinguishments of prior interests effected by s 5(a).

For the committee of management of the new Hospital site (Royal Children’s Hospital)

1. Preparation for committee role (s 10(3)(e); s 13(2))

• When the Order under s 10 is published, the RCH will be deemed to be committee of management. RCH should prepare governance arrangements consistent with its new statutory status and the additional powers conferred by Part 4 (s 13(2)).

2. Lease and licence approvals (ss 14-15)

• Before granting any lease or licence, obtain written approval from the Minister. Prepare applications that demonstrate the proposed purpose is "not inconsistent with the purposes for which the land is reserved" (ss 14(1)-(2); 15(1)-(2)). Draft covenants, exceptions, reservations and conditions for the Minister’s written approval as required by s 14(4)(c) and s 15(3)(b).
• Ensure the term of any lease and any renewal options comply with the 30‑year aggregate cap (s 14(3)-(4)(a)) and that any holdover occupation does not exceed three months (s 14(4)(b)). For licences, do not exceed 30 years (s 15(3)(a)).

3. Record keeping and coordination

• Maintain records of ministerial approvals and ensure that any leases or licences are properly documented and lodged in the appropriate registries if required by title or tenurial practice. Coordinate with the Registrar for any title recording consequences.

For Melbourne City Council (as committee of management for surplus park)

• Prepare to assume public park management responsibilities once the s 10 Order is published (s 10(4)(e)). Ensure park management plans align with the reservation and any expectations or constraints set by the Minister or by Crown Land (Reserves) Act arrangements that continue to apply.

For prospective lessees and licencees

1. Due diligence

• Confirm that the land proposed for lease or licence is within the new Hospital site as defined by the approved plan and is not surplus project land or other Crown land (s 8, s 9, s 10). Check title records and Registrar entries post‑publication (ss 6, 12).
• Ensure timing: leases that claim statutory protection under s 11 must meet the timing conditions precisely. Seek written confirmation of the reservation status and the RCH’s committee of management powers.

2. Application and documentation

• Prepare applications to the committee of management that clearly set out the proposed purpose and how that purpose is compatible with the reserved purpose. Anticipate that the Minister will require evidence and justification before giving written approval (ss 14(2), 15(2)).
• Ensure lease terms comply with the statutory maximums, and draft renewal options so that the aggregate term does not exceed 30 years (s 14(4)(a)). Factor in the discretionary three‑month holdover clause if near term expiration (s 14(4)(b)).

3. Commercial modelling and title risk

• Account for the Act’s extinguishment framework: revocations under Part 2 removed prior trusts and encumbrances (s 5(a)). If relying on pre‑existing interests, verify whether those interests were saved by s 11 or otherwise preserved in registers. Consider securing contractual protections with the Crown or committee of management outside the statutory schema where appropriate.

Cross‑actor practical steps

• Confirm publication status in the Government Gazette for the declaration of project completion and for any Governor in Council Orders (ss 7(2), 10(2)). Do not rely on private assurances; the statutory effect is tied to publication.
• Coordinate with the Central Plan Office where plans are lodged instead of published in full, and confirm the exact plan references to be included in Orders under s 10(5)(b).
• Maintain clear administrative records of ministerial satisfactions, approvals and approvals in writing for any lease or licence. Written approvals are the legal precondition for valid grants (ss 14(1), 15(1)).

Summary checklist (minimum compliance items)

• Health Services Minister: obtain and record factual satisfaction of completion and demolition; publish declaration (s 7).
• Surveyor‑General: prepare signed plan(s) that comply with area and boundary constraints (s 8).
• Minister administering this Act: approve new Hospital site plan only if statutory criteria are met; cause surplus plan (s 9); recommend Governor in Council Order (s 10).
• Governor in Council: publish required Orders and ensure plan inclusion or Central Plan Office references (s 10(5)).
• Registrar of Titles: amend Register entries per ss 6 and 12.
• Committees of management: secure Minister’s written approval for any leases or licences; ensure terms and covenants comply with ss 14-15 and the reservation purpose.
• Prospective lessees/licencees: confirm title and reservation status, submit purpose compatibility evidence, and ensure contract terms respect the statutory term caps.

Following these steps will align administrative action and commercial transactions with the Act’s sequential requirements and minimise the risk of grants being treated as ultra vires or otherwise ineffective.
