Roads to Recovery Funding Conditions 2019

The Determination is organised around a handful of operational concepts that govern both use of money and recipient behaviour.

Eligible expenditure and works schedule conformity: Roads to Recovery payments are strictly to be used on construction and/or maintenance of roads (clause 2.1(a)), and only on projects identified in the recipient’s works schedule (clause 2.1(b)). Projects must be in progress on or after 1 July 2019 and require payment on or after that date (clause 2.1(c)). The works schedule must include project descriptions, start/completion dates, estimated Roads to Recovery contribution and, for non‑small projects, GIS location data (clauses 5.2(a)-(f), 5.2(c)).

Timing and spend‑down rules: Each payment must be spent within six months of receipt (clause 2.3). All Roads to Recovery payments must be exhausted by 31 December 2024 (clause 2.4). Interest earned on payments is treated as own source funds and, for larger recipients, must be spent on roads in the following financial year (clause 2.5 and note).

Own source roads expenditure obligation: Recipients must spend own source funds on road construction and maintenance equal to or above a “reference amount” established under the prior (2014-2019) conditions (clause 3.1). Clause 3.2 provides a smoothing rule; failing the obligation in a year can be cured if average own source expenditure across the year and one or two prior years exceeds the reference amount.

Public information and signage: Projects must acknowledge the Australian Government in formal public materials (clause 4.1). The Department must approve media releases (clause 4.2), and recipients must offer the local Federal MP an opportunity to participate in media events (clause 4.2a). When seeking a payment for a quarter, recipients must email a summary of projects starting, progressing or completing in the following quarter and funds claimed to the local Federal MP and copy the Department within seven days of payment (clause 4.2b). Signage rules require erection of signs at project start and end (subject to small‑project exceptions), signs must comply with the Signage Guidelines and remain for at least one year after project completion (clauses 4.3-4.5).

Accountability, audit and record‑keeping: CEOs must provide an annual financial statement and auditor’s report by 31 October after each financial year in which they receive, spend or retain any Roads to Recovery payment (clause 6.2). Annual reporting must address compliance with conditions including the own source obligation, public information requirements and whether expected outcomes were achieved (clause 6.3). Records must be retained for at least seven years (clause 7.1). The Department may inspect works and records and request copies and photographs (clauses 7.2-7.3).

Enforcement: The Secretary or delegate may issue written notices requiring repayment of the amount the Secretary specifies where the Secretary is satisfied a recipient has failed to comply with the Act or the Determination (clause 8.1). The power extends to failures to meet replacement conditions imposed in lieu of an exemption (clause 8.3). Exemptions under section 91 of the Act are acknowledged as available (notes to clauses 2.3, 6.4, 8.2).

Interaction with building and construction regimes: If Roads to Recovery payments fund building work described in Schedule 1 to the Building Code, recipients must comply with the Code or ensure contractors do so (clause 9.1). Where applicable under the Building and Construction Industry (Improving Productivity) Act 2016, contracts for certain building work must be awarded to accredited builders (clause 9.3). The instrument includes notes about the value/percentage thresholds that bring construction projects within the Building Code or the Accreditation Scheme (Part 9 notes).

Transitional eligibility: A recipient that received funding under the prior funding period (2014-19) is ineligible to receive further Roads to Recovery payments after 31 October 2019 unless it has delivered all annual reports required under the old conditions (clause 10.1).

These concepts combine legal constraints (what projects and spending are permitted), temporal constraints (timing of spending and reporting), administrative obligations (works schedule, signage and public information), accountability machinery (audits, inspections, CEO statements and repayment notices) and cross‑compliance with other Commonwealth regimes (Building Code and Accreditation Scheme). The Determination therefore operates as an operational contract: money is provided subject to specified deliverables, reporting and behaviour, with established consequences for non‑performance.

Primary recipients: The Determination applies to any person or body that is to receive or has received a Roads to Recovery payment for the funding period 1 July 2019 to 30 June 2024 (definition “funding recipient”, clause 1.4; application clause 1.3). That typically includes local government authorities, state bodies and other entities listed on the Roads to Recovery List 2019 (definition and note in clause 1.4).

Chief Executive Officer obligations: The Determination places direct obligations on the Chief Executive Officer or equivalent office holder of the funding recipient to submit the annual financial statement and signed auditor’s report by 31 October after each relevant financial year (clause 6.2). The CEO also must provide the annual report content specified in clause 6.3.

Department and Secretary: The Department (the Commonwealth administration) is the compliance manager and decision maker. It prescribes forms, websites and Signage Guidelines, can approve media releases and re‑allocation of funds in specified circumstances, requires reports and may inspect projects and records (see clauses 5.1-5.6, 4.2, 2.2, 7.2-7.3). The Secretary or delegate is the enforcement actor who may notify recipients of non‑compliance and require repayment (clause 8.1).

Minister and local Federal Members: The Determination involves political actors. The Minister has power under section 91 of the Act to exempt recipients from conditions and impose replacement conditions; the Determination references this power repeatedly (notes to clauses 2.3, 6.4 and 8.2). Local Federal Members of Parliament are given formal roles: recipients must offer MPs an opportunity to participate in media events (clause 4.2a), must notify MPs of proposed ceremonies at least two weeks out (clause 4.6) and must email MPs quarterly summaries when seeking a payment with the Department copied in (clause 4.2b). This embeds a routine informational flow to MPs.

Contractors and builders: Where Roads to Recovery funds are spent on building work captured by the Building Code or the Accreditation Scheme, building contractors and head contractors are affected: recipients must ensure contractors comply with the Building Code and must not contract with builders who are not accredited where the Accreditation Scheme applies (clauses 9.1-9.4).

Auditors and inspectors: Recipients must obtain an audit report from an “appropriate auditor” certifying the CEO’s financial statement, as required by clause 6.2(b). Australian Public Service employees and persons nominated by the Commonwealth may inspect works and records (clause 7.2).

Indirectly affected parties: Suppliers of materials, signage manufacturers, communications advisers and event organisers will be affected in practice because of signage, media approval, event notice and record‑keeping obligations (Part 4 and Part 7). Local communities may be affected by the timing of works and signage requirements; environmental and heritage clearance obligations referenced in Part 9 notes may also bring in environmental consultants and heritage specialists.

Excluded or differently treated recipients: The Determination incorporates thresholds and exceptions. For example, recipients who are to receive total funding of less than $1.25 million under the Roads to Recovery List are exempt from the interest‑spend obligation in clause 2.5. Small funded projects (total cost under $10,000) may be grouped as “group projects” in the works schedule and are excluded from the signage requirement for individual projects (definitions and clauses 1.4, 5.3, 4.3).

Timing consequences: Recipients who received funding in the prior 2014-19 funding period and have not provided the annual reports required under the “old conditions” are not eligible for new payments after 31 October 2019 (clause 10.1). This makes past reporting performance a gate to continued eligibility.

In short, the Determination places obligations on funding recipients and their CEOs, connects contractors to Commonwealth compliance regimes when thresholds are met, involves the Department and Secretary in approvals and enforcement, and requires routine engagement with local Federal Members. The practical costs of compliance will fall primarily on funding recipients, their executives and their administrative and communications teams, and indirectly on contractors and suppliers engaged in projects and signage production.

Overview of duties: The Determination establishes specific duties on funding recipients, the Chief Executive Officer of recipients, and procedural duties relating to contractors and communications.

Spending duties: Funding recipients must ensure Roads to Recovery payments are spent only on construction and/or maintenance of roads, only on projects listed in the works schedule, and only on projects in progress on or after 1 July 2019 and for which payment is required on or after 1 July 2019 (clauses 2.1(a)-(c)). Recipients must not use Roads to Recovery funds to meet the GST component of supplies (clause 2.1(d)). Each payment must be spent within six months of receipt (clause 2.3), and all payments must be exhausted by 31 December 2024 (clause 2.4).

Own source expenditure duty: Recipients must spend own source funds on road works equal to or greater than their reference amount for each financial year in which they deal with Roads to Recovery payments (clause 3.1). Clause 3.2 provides a multi‑year averaging rule that may cure a single year’s shortfall by reference to expenditure in the previous one or two years.

Planning and reporting duties: Recipients must prepare and submit a works schedule promptly after 1 July 2019 and before the first quarterly report, keep it current and update it before each quarterly report (clauses 5.1, 5.6). Quarterly reports are required to receive payments in a quarter (clauses 5.7-5.9) and must state amounts spent and intended to be spent. The CEO must submit an annual financial statement in the Department’s form and an auditor’s report by 31 October each year (clause 6.2) and an annual report addressing compliance and outcomes (clause 6.3).

Public information duties: Recipients must acknowledge the Australian Government in formal public materials about funded projects (clause 4.1). Proposed media releases require Department approval (clause 4.2). Recipients must provide the local Federal Member an opportunity to participate in media events (clause 4.2a), and must email MPs a summary of projects and funds claimed within seven calendar days of receiving a payment (clause 4.2b). Signage obligations require erecting signs for non‑small projects at project commencement, in specified locations, in a form specified by the Signage Guidelines and retained for at least one year after completion (clauses 4.3-4.5).

Record‑keeping and inspection duties: Records relating to Roads to Recovery payments must be created and retained for at least seven years (clause 7.1). Recipients must allow APS staff or Commonwealth nominees to inspect works and records on request and must provide copies and photographs in the form requested (clauses 7.2-7.3).

Contracting duties: Where building work falls within Schedule 1 of the Building Code, recipients must comply with the Code or ensure contractors do so (clause 9.1). Where the Accreditation Scheme applies, recipients must not contract with non‑accredited builders for applicable building work (clause 9.3).

Rights and administrative options: The Determination grants recipients procedural rights and some administrative pathways. Recipients may seek Department approval to re‑assign unspent funds originally specified for particular Western Australian projects involving bridges or Aboriginal access roads, provided the replacement project is included in the works schedule (clause 2.2). Recipients may seek exemptions from specific conditions pursuant to the Minister’s statutory power under section 91 of the Act; where an exemption is granted, the Minister may impose replacement conditions (notes to clauses 2.3, 6.4, 8.2). Clause 3.2 offers recipients a remedial averaging mechanism to meet the own source obligation over multiple years.

Enforcement powers that affect duties: The Secretary or delegate may issue repayment notices where the Secretary is satisfied a recipient failed to comply with the Act or the Determination (clause 8.1). The amount to be repaid is at the Secretary’s discretion within the scope of the repayment notice (clause 8.1). Clause 8.3 extends that power to failures to comply with replacement conditions.

Procedural and evidentiary duties: The CEO’s financial statement must set out specific line items (amount brought forward, amount received in the year, amounts available and spent, amount carried forward, and amount of own source expenditure) and the auditor must certify the statement and that the expenditure was on roads and that own source expenditure figures are based on proper records (clause 6.2(a)-(b)).

In sum, duties are prescriptive and administratively demanding: the Determination prescribes permissible uses of funds, temporal constraints, reporting formats and deadlines, public engagement obligations and record‑keeping and audit requirements. Rights are limited to specific administrative avenues for approval and the statutory exemption power. Enforcement rests with the Department and the Secretary or delegate, with repayment the primary sanction stated in the instrument.

Primary enforcement mechanism: The Determination provides a remedial financial enforcement tool rather than criminal penalties. If the Secretary or a delegate is satisfied that a funding recipient has failed to comply with the Act or any condition in the Determination, the Secretary may issue a written notice requiring the funding recipient to repay to the Commonwealth an amount equal to so much of the payment as the Secretary specifies (clause 8.1). The instrument does not prescribe a formula for that specification; the Secretary determines the amount to be repaid in the notice.

Replacement conditions and repayment: The instrument contemplates the Minister’s ability under section 91 of the Act to exempt a recipient from a condition and to impose a replacement condition if considered appropriate (see notes to clauses 2.3, 6.4 and 8.2). Clause 8.3 explicitly allows the Secretary to require repayment where the recipient fails to fulfil any replacement condition imposed in place of an exemption, and the repayment amount is again at the Secretary’s specification.

Scope of review and Inspector access: The Determination gives the Department and its authorised representatives rights of inspection and information gathering. Clause 7.2 requires recipients to allow Australian Public Service employees or persons nominated by the Commonwealth to inspect work on Roads to Recovery projects and to inspect any or all records required to be kept under clause 7.1. Clause 7.3 empowers the Department to request copies of records and photographs and requires recipients to provide them in the manner and form requested. These access rights are administrative levers that allow the Department to gather evidence to support a compliance finding under clause 8.1.

Audit requirements as detection mechanism: The annual CEO financial statement must be accompanied by a report from an “appropriate auditor” addressing whether the financial statement is based on proper accounts and records, is in agreement with the accounts and records, that the expenditure identified was on construction and/or maintenance of roads, and that own source expenditure is properly based on accounts and records (clause 6.2(b)(i)-(iv)). That auditor’s report is an evidentiary component that the Department can use in assessing compliance and making a repayment decision.

Temporal constraints and administrative non‑compliance: Failure to meet timing rules is a clear enforcement exposure. The Determination requires that each payment be spent within six months (clause 2.3) and that all payments be spent by 31 December 2024 (clause 2.4). Interest‑earnings obligations for larger recipients require the interest to be spent in the next financial year and capable of being demonstrated (clause 2.5). Failure to meet those timing and demonstration requirements could ground a Secretary’s satisfaction of non‑compliance.

Eligibility gate and retrospective enforcement: Clause 10.1 makes past reporting a gate to future payments: recipients that were funded in the prior funding period but have not provided all required annual reports under the old conditions are ineligible for new payments after 31 October 2019. This is a screening mechanism that may limit a recipient’s ability to receive funds if prior compliance was deficient.

No criminal sanctions in the Determination: The instrument does not itself create criminal offences or expressly state interest or penalties beyond a repayment requirement, nor does it prescribe administrative penalties such as withholding future funds beyond the eligibility provision in clause 10.1. The primary compliance lever is the repayment notice issued by the Secretary or delegate.

Delegation and discretion: Enforcement depends on administrative determinations by the Secretary or the Secretary’s delegate and on the Secretary’s satisfaction that a recipient has failed to comply (clause 8.1). That creates an administrative discretion whose exercise may be subject to merits review or procedural fairness principles under general administrative law if challenged, though the Determination itself does not set out a review pathway.

Consequences for contractors and third parties: The Determination’s repayment remedy is directed at the funding recipient. The instrument does not provide for direct sanctions against contractors or suppliers, but failures by recipients to ensure contractor compliance with the Building Code or to use accredited builders where required could trigger Departmental enforcement actions focused on the recipient (clauses 9.1-9.4).

In practice, therefore, enforcement is administrative, financial and reliant on documentary proof, inspections and auditor certifications. The Secretary has latitude to specify repayment amounts, and the Department has inspection and audit detection powers. The instrument relies on financial remedies rather than penal sanctions to achieve compliance.

References to the National Land Transport Act: The Determination is made under subsection 90(1) of the National Land Transport Act 2014 (instrument preamble) and applies to payments under Part 8 of that Act (clause 1.3). It adopts definitions used in the Act and explicitly notes that terms defined in the Act have the same meaning in the Determination (clause 1.5). The Minister’s power under section 91 of the Act, to exempt recipients from conditions and impose replacement conditions, is referred to in several notes (see notes to clauses 2.3, 6.4 and 8.2), indicating that the Determination operates within the Act’s exemption framework.

GST law and accounting interaction: Clause 2.1(d) excludes using Roads to Recovery payments to meet the GST component of a supply. It cross‑references the A New Tax System (Goods and Services Tax) Act 1999 by referring to supplies within the meaning of that statute (clause 2.1(d)(i)). Practically, recipients must not count GST payable on supplier invoices as Roads to Recovery expenditure, which interacts with recipients’ GST accounting and claiming of input tax credits under the GST Act.

Building Code and construction law: Part 9 of the Determination requires compliance with the Code for the Tendering and Performance of Building Work 2016 (the Building Code) where Roads to Recovery funds are spent on building work described in Schedule 1 to the Building Code (clause 9.1). The Determination also requires recipients, where subsection 43(4) of the Building and Construction Industry (Improving Productivity) Act 2016 applies, not to contract with non‑accredited builders (clause 9.3). Notes in Part 9 explain the thresholds under which the Building Code applies (Australian Government funding contribution at least $5 million and representing at least 50 per cent of total project value; or funding contribution of $10 million or more), and the relevance of the Accreditation Scheme. These references make Roads to Recovery expenditure subject to the existing Commonwealth building procurement and accreditation regimes where thresholds are met.

Environment, heritage and native title laws: The Determination’s notes in Part 9 remind recipients that projects must adhere to Australian Government environment and heritage legislation including the Environment Protection and Biodiversity Conservation Act 1999, and that construction cannot start until relevant obligations are met (Part 9 note). The instrument advises recipients to contact the Department of the Environment before starting environmental studies to ensure statutory requirements are addressed. Native title and state and local planning approvals are also noted as statutory prerequisites. These notes mean recipients must align project planning and timing with environmental approvals, Aboriginal heritage and native title considerations, and state and local permitting regimes.

Auditors and financial rules: Clause 6.2(b) requires an auditor’s report from an “appropriate auditor”, a term defined in the Act. That ties the Determination’s audit requirements into the Act’s definitions and into broader financial reporting and auditing rules applicable to public sector grants.

Administrative law and review: The Determination confers enforcement discretion on the Secretary or the Secretary’s delegate (clause 8.1). While the Determination does not itself state review rights, administrative decisions of the Secretary or delegate about repayment or exemption are subject to general administrative law constraints (procedural fairness, lawful exercise of power) and may be susceptible to external merits or judicial review avenues under the Administrative Decisions (Judicial Review) Act or judicial review principles, subject to jurisdictional limits not specified in the Determination.

Interplay with prior conditions: Clause 10.1 conditions eligibility for new payments on completion of annual reports required under the “old conditions” for the 2014-19 funding period. The Determination therefore interlocks with the prior instruments and their reporting regimes in practice.

In short, the Determination sits within a constellation of Commonwealth statutes and administrative regimes: the National Land Transport Act provides the enabling and exemption framework; GST law affects eligible expenditure accounting; the Building Code and accreditation statutes interact where construction thresholds are met; environmental, heritage and native title statutes and state/local planning laws remain applicable; and general administrative and audit rules apply to enforcement, review and certification. Recipients must therefore manage compliance across multiple legal domains to satisfy the Determination’s requirements.

The compilation includes the Determination as in force on 29 November 2019 and records that it was made under subsection 90(1) of the National Land Transport Act 2014 (instrument preamble and endnotes). Endnote 3 records the initial registration date and a variation: the Roads to Recovery Funding Conditions 2019 was registered as F2019L00373 and commenced 20 March 2019; a Variation Instrument No. 2019/2 (F2019L01514) commenced 29 November 2019 (Endnote 3 table). The compilation therefore reflects two registered instruments: the original instrument and a variation.

Endnote 4 provides a provision‑level amendment history. It records: insertion of clause 4.2a after clause 4.2 (added by F2019L01514), insertion of clause 4.2b after clause 4.2a (added by F2019L01514), and amendments to clauses 4.6 and 4.7 (amended by F2019L01514) (Endnote 4). The variation instrument thus added two new public information obligations relating to media engagement and MP notification and amended the clauses dealing with events and invitations (clauses 4.6 and 4.7).

The compilation notes that the variation instrument is Compilation Number One and that the compilation start date is 29 November 2019 and includes amendments up to Variation Instrument No. 2019/2 (top matter). The endnotes indicate there are no uncommenced amendments, modifications, misdescribed amendments or miscellaneous entries (Endnotes 5-8 show “[None]” or “[None]” categories), implying that, as of the compilation date, there were no other amendments or outstanding modifications recorded in this compilation.

Because the Determination is a legislative instrument made under the National Land Transport Act 2014, any future amendments would also appear in the Federal Register of Legislation and be reflected in subsequent compilation endnotes. The instrument’s own notes repeatedly reference the Minister’s power under section 91 of the Act to exempt recipients or impose replacement conditions; that statutory power remains central to potential future operational changes affecting recipients.

Practical effect of the November 2019 variation: The addition of clauses 4.2a and 4.2b and amendments to clauses 4.6-4.7 indicate a policy change to increase formal engagement with local Federal Members of Parliament and to impose additional notification and participation requirements for media events and quarterly payment notifications. Those concrete changes were effected by the Variation Instrument No. 2019/2 that commenced on 29 November 2019, as recorded in Endnotes 3 and 4.

There is no further amendment history recorded in the compilation beyond the Variation Instrument No. 2019/2, and no uncommenced provisions are listed (Endnote 5). The Determination’s endnotes therefore provide a concise legislative history limited to the original Determination and the single identified variation in 2019.

The text of the Determination and its endnotes do not identify any litigation history. The compilation’s endnotes (Endnotes 3 and 4) record the legislative history and amendment history; they do not list judicial decisions or disputes. There are no cases named or decisions referred to in the instrument or the endnotes that would indicate prior court challenges to the Determination’s provisions, nor are there internal references to any litigation involving the Roads to Recovery Funding Conditions 2019.

Absence of litigation in the instrument does not, by itself, indicate whether administrative decisions under the Determination have been subject to judicial or merits review; it simply reflects that the compilation does not record or attach any judicial decisions. Recipients’ disputes over Secretary or Departmental decisions, such as repayment notices issued under clause 8.1 or determinations concerning compliance, exemptions under section 91 of the Act or interpretations of the Determination’s provisions, would generate litigation only if a party sought judicial review or other legal remedies. The Determination itself does not set out internal merits review procedures, which means aggrieved parties would be reliant on general administrative law processes for contesting adverse decisions.

Given that enforcement is administratively centred (repayment notices, audit verification, inspection and eligibility gates), the likely loci for legal disputes would be administrative decisions by the Secretary or delegate, for example, a decision that a recipient failed to comply for the purposes of clause 8.1,or disputes about the proper calculation of own source expenditure and the reference amount under Part 3. Any litigation would therefore likely concern questions of statutory interpretation, factual findings about compliance, adequacy of accounting records, procedural fairness in the Department’s decision‑making, or the scope of the Minister’s exemption power under section 91 of the Act.

Absent specific cases listed in the source, a practitioner needing to assess litigation risk should assume that ordinary administrative law avenues apply to actions taken under the Determination and should examine contemporaneous Departmental practices on notices, reasons, internal review and settlement to gauge the likelihood of formal legal challenges. The Determination’s reliance on documentary certification (auditor’s statements) and on the Secretary’s satisfaction as the standard for repayment suggests that evidentiary disputes about accounting records or auditor conclusions would be the common basis for any contested enforcement action.

Because the source contains no litigation history, this section cannot summarise cases or judicial reasoning; it can only note the absence of recorded litigation in the compilation and identify likely dispute vectors given the Determination’s structure.

The Determination contains several operational traps and precise rules that create exposure or administrative burden for recipients. Practitioners should flag the following concrete points drawn from the text.

Spending windows are tight and cumulative: Each Roads to Recovery payment must be spent within six months of receipt (clause 2.3). Separately, all Roads to Recovery payments must be spent by 31 December 2024 (clause 2.4). These are independent timing obligations; missing the six‑month window for a specific payment may expose the recipient to a non‑compliance finding even if funds are ultimately spent before 2024. The Secretary’s repayment power in clause 8.1 could be engaged where timing rules are breached.

GST exclusion: Clause 2.1(d) excludes from Roads to Recovery expenditure any amount of a price that represents GST payable by a supplier. Recipients may inadvertently overstate Roads to Recovery‑eligible expenditure if they do not strip out the GST element or misclassify invoices, potentially exposing them to reconciliation disputes at audit.

Works schedule constraint: Roads to Recovery funds can be spent only on projects identified in the works schedule (clauses 2.1(b), 5.1-5.6). Only projects for which expenditure is proposed on or after 1 July 2019 may be included (clause 5.4). Including a project in a works schedule but then deviating materially without Department approval could trigger compliance scrutiny. Small projects may be grouped, but the works schedule must still list each small funded project’s location and cost within the group (clause 5.3(b)).

Quarterly reporting timing for payments: Clause 5.8 sets different reporting deadlines depending on the quarter; importantly, the October-December quarter requires a quarterly report by 15 February for payment, which is a later and non‑standard deadline (clause 5.8(d)). The example at clause 5.8 confirms that receiving payment in a quarter is conditional on timely prior submission. Failure to meet reporting deadlines may mean payment is withheld and may complicate the six‑month spend rule.

Interest rules and thresholds: Interest earned on Roads to Recovery payments is treated as own source funds (note to clause 2.5). For recipients to receive total funding of $1.25 million or more, interest must be spent in the following financial year and be demonstrable (clause 2.5). Recipients under the $1.25 million threshold are exempt from the interest‑spend obligation, but larger recipients must track and demonstrate interest spending; failing to do so could be a compliance issue.

Signage and publicity obligations: Signage must be erected for each funded project other than small funded projects, in specified locations with greater prominence than other project signs, and conform to the Signage Guidelines (clauses 4.3-4.4). Signs must remain for the duration of the project and for at least one year after completion (clause 4.5). Media releases require Department approval (clause 4.2), and the recipient must offer the local Federal MP the opportunity to participate in media events (clause 4.2a). A new obligation inserted by the November 2019 variation requires that when seeking a payment for a quarter, the recipient must email a summary of projects commencing, in progress, or completing in the following quarter and the funds claimed to the relevant local Federal MP and copy the Department within seven calendar days of payment (clause 4.2b). That creates tight timelines for communications and potentially political oversight of routine payments.

CEO and auditor certification specifics: The CEO’s financial statement must include specified line items and be accompanied by an auditor’s report that addresses both the CEO’s statement and whether Roads to Recovery expenditure was on road construction/maintenance and whether own source expenditure is properly supported (clause 6.2). Auditors must be “appropriate auditors” as defined in the Act. Poor record‑keeping (clause 7.1 requires retention for seven years) or non‑accrual accounting may result in adverse auditor opinions and Departmental non‑compliance findings.

Inspection rights: Clause 7.2 permits Australian Public Service employees or persons nominated by the Commonwealth to inspect work and records. Inspections can be operationally disruptive and require readiness to produce documents and photographs in the form requested (clause 7.3).

Re‑allocation approvals with geographic caveat: Clause 2.2 sets a narrow exception for re‑allocating unspent amounts that were specified by the Commonwealth for particular Western Australian projects involving bridges or Aboriginal access roads, but only with Department approval and only if the new project is included in the works schedule. Recipients cannot unilaterally redirect funds that were specifically tagged by the Commonwealth without prior approval.

Eligibility choke for prior non‑reporters: Clause 10.1 renders recipients who received payments under the 2014-19 period ineligible for payments after 31 October 2019 if they have not provided all annual reports required under the old conditions. That creates a hard administrative gate to current funding tied to historical compliance.

Building Code and accreditation thresholds: Part 9 ties obligations to the Building Code and Accreditation Scheme. The notes explain thresholds (for example, Commonwealth funding contribution of at least $5 million representing at least 50 per cent of total project value, or $10 million or more) that bring the Building Code or Accreditation Scheme into play. Misunderstanding whether a project meets those thresholds could lead to procurement non‑compliance and remedial costs.

Limited explicit sanctions beyond repayment: The Determination’s direct sanction is a repayment notice under clause 8.1. The absence of specified fines, interest on repayments, or criminal penalties means the principal remedy is recovery of funds, but the Secretary’s specification of the amount may be broad. The Determination does not specify appeals or internal review pathways for repayment decisions, so administrative law remedies would be the likely challenge route.

Taken together, these “gotchas” show that the Determination imposes precise accounting, timing and publicity obligations; errors in classification (GST), timetable lapses (six‑month spend rule), reporting omissions, or inadequate records and audit evidence present concrete compliance risks with financial consequences.

Map of immediate actions: The Determination prescribes specific, documentable actions recipients must take; the following practical checklist translates the text into actionable compliance tasks rooted in the instrument’s clauses.

1. Establish governance and designate responsibilities

• Assign executive responsibility to the Chief Executive Officer (clause 6.2) and delegate day‑to‑day administrative tasks to named officers for works schedule maintenance, quarterly reporting, signage, media approvals and financial record‑keeping.
• Document the delegation lines between the CEO, finance, project managers and communications staff.

2. Prepare and maintain the works schedule

• Prepare the works schedule as soon as practicable after 1 July 2019 and before the first quarterly report (clause 5.1).
• For each project include descriptions, reasons, estimated start and completion dates, estimated Roads to Recovery contribution, estimated total project cost excluding GST, main expected outcome and GIS location data for non‑small projects (clauses 5.2(a)-(i) and 5.2(c)).
• Where you have multiple small funded projects (each under $10,000), group them as “group projects” but list the cost and location of each small project within the group (clause 5.3(b)).
• Keep the works schedule current and submit an updated version immediately prior to each quarterly report (clause 5.6).

3. Manage Spend and Cashflow

• Ensure each Roads to Recovery payment is spent within six months of receipt (clause 2.3). Implement a payment ledger that tracks receipt dates and scheduled use by project.
• Plan to expend all Roads to Recovery payments by 31 December 2024 (clause 2.4).
• Exclude GST amounts when recording Roads to Recovery expenditure and ensure GST is correctly accounted for under GST law (clause 2.1(d)).

4. Own source expenditure tracking

• Determine the reference amount applicable to your entity as at 30 June 2019 under the old conditions (definition: “reference amount” clause 1.4).
• Maintain clear accounting lines to record own source funds and own source expenditure on roads (clause 3.1 and note to clause 2.5 that interest is own source).
• Use the averaging rule in clause 3.2 where annual volatility occurs; document calculations to show compliance across the relevant averaging period.

5. Quarterly reporting to obtain payments

• Submit quarterly reports in the Department’s form by the deadlines in clause 5.8 to obtain payments: 30 April for Jan-Mar; 31 July for Apr-Jun; 31 October for Jul-Sep; 15 February for Oct-Dec. For the first quarter recipients may use the option in clause 5.7 to report for Jul-Sep by 31 July 2019.
• In each quarterly report state amounts spent to date and intended expenditure next quarter on an accrual basis (clauses 5.7-5.9).
• If you do not seek payment for a quarter, consider submitting a report to assist Departmental monitoring (clause 5.8 note).

6. Annual CEO statement and auditor certification

• Prepare the CEO’s annual financial statement in the Department’s form by 31 October following the end of the financial year, including required line items (clause 6.2(a)).
• Engage an “appropriate auditor” as defined in the Act to provide the audit report required by clause 6.2(b)(i)-(iv), ensuring the auditor can attest to the CEO statement and Roads to Recovery expenditure being on roads and own source expenditure being properly recorded.

7. Records and inspection readiness

• Create and keep accurate and comprehensive records relating to Roads to Recovery payments and retain them for at least seven years (clause 7.1).
• Maintain project files, invoices, contracts, bank statements and evidence of signage and media approvals.
• Be ready to allow APS employees or Commonwealth nominees to inspect works and records and to provide copies and photographs in the manner requested (clauses 7.2-7.3).

8. Public information and signage compliance

• Ensure all formal public statements and project materials acknowledge the Australian Government’s contribution (clause 4.1).
• Seek Department approval for proposed media releases relating to funded projects before issuing them (clause 4.2).
• Provide the local Federal Member of Parliament with the opportunity to participate in media events and invite MPs to works commencement/opening ceremonies at least two weeks before the event, supplying proposed invitees and order of proceedings (clauses 4.2a, 4.6).
• When seeking a payment for a quarter, email the local Federal Member a summary of projects commencing, in progress or completing in the following quarter and funds claimed, copying the Department, within seven calendar days of the payment being made (clause 4.2b).
• Erect signs for each funded project other than small funded projects at commencement and at the end points (or entrance for cul‑de‑sacs), in locations visible to oncoming traffic, and in the form specified in the Signage Guidelines; keep signs in place for the project duration and for a minimum of one year after completion (clauses 4.3-4.5).

9. Building and contractor compliance

• For any building work that may be captured by the Building Code or Accreditation Scheme, review thresholds (notes in Part 9) and ensure compliance: where the Building Code applies, ensure either the recipient or its contractors comply with the Code (clause 9.1); where the Accreditation Scheme applies, do not contract with non‑accredited builders (clause 9.3).
• Document procurement decisions, contract clauses and certifications required under the Building Code and the Accreditation Scheme.

10. Interest and small recipient rules

• Track interest earned on Roads to Recovery funds; for recipients whose total funding is $1.25 million or more, plan to expend interest on road works in the next financial year and document the expenditure (clause 2.5). Smaller recipients are exempt from the interest‑spend obligation.

11. Process for re‑allocating specific Commonwealth‑specified funds

• If the Commonwealth specified a payment for particular Western Australian bridge projects or Aboriginal access roads and the project does not proceed or costs less, obtain Department approval before reallocating the unspent amount to another project and ensure the new project is included in the works schedule (clause 2.2).

12. Monitoring, internal audit and audit trail

• Implement internal controls and periodic checks to ensure spend timing, report accuracy, GST treatment, signage presence and retention, and records retention meet Determination requirements.
• Prepare reconciliations that connect the quarterly reports, CEO financial statements and auditor reports to demonstrate consistency.

13. Use Departmental systems and forms

• Where the Department provides secure website access for submission, use it; if not possible, agree an alternative submission method with the Department (clause 5.5).

14. Exemption and remedial engagement

• If compliance presents genuine hardship or exceptional circumstances, prepare a clear case and apply for exemption under section 91 of the Act; if a replacement condition is imposed, ensure compliance with that replacement condition (notes to clauses 2.3, 6.4 and 8.2, clause 8.3).

15. Calendarise deadlines

• Enter critical deadlines into a compliance calendar: quarterly report deadlines, six‑month spend windows per payment, CEO/auditor submissions by 31 October, signage minimum one year retention after project completion, seven‑year records retention.

Taken together, these steps translate the Determination’s prescriptions into a compliance programme geared to documentation, timing control, audit preparedness and structured communications. Each step is traceable to specific clauses and mitigates the principal enforcement exposure, repayment notices under clause 8.1,by producing clear documentary evidence aligning actions to the Determination’s requirements.
