What it does
This instrument, the Road Vehicle Standards (Limit of Acceptable Damage or Corrosion) Determination 2021, prescribes specific, measurable thresholds and categories of damage, corrosion and repair that will not, by themselves, prevent the holder of an Australian Vehicle Verification (AVV) approval from verifying a road vehicle or modifications of a road vehicle under that approval (s 1, s 3, s 4, s 6). It commenced on 1 July 2021 (s 2).
Mechanically, the Determination does two things. First, it defines terms used to assess damage and corrosion for the purposes of verification, including "body alignment test", "dent" (and what a dent excludes), "flaking", "pitting", "structural component of a vehicle" and "vehicle structure" (s 5). Second, it lists discrete examples of damage/corrosion/repairs that, if limited to the stated extent, will not prevent an AVV approval holder from verifying a vehicle or its modifications (s 6(1)(a)-(f)). Those examples include numerical thresholds (for example, dents up to 25 millimetres depth at s 6(1)(a); diagonal length differences of 10 millimetres at s 6(1)(b); panel gap variations greater than 5 millimetres in specified circumstances at s 6(1)(d); and a 5 millimetre diagonal threshold where a body alignment test has been conducted, at s 6(1)(d)(iii)). The Determination also makes express exclusions: it does not apply where damage or corrosion, or repair of it, has resulted in splitting of a seam or joint between panels or the failure of a spot weld (s 6(2)).
The Determination is an instrument made under s 107 of the Road Vehicle Standards Rules 2019 (the Rules) and is intended to be read and applied within the verification regime established by the Rules and the Road Vehicle Standards Act 2018 (s 3, s 4, s 5 Notes). It does not itself set out verification procedures in full; rather it defines the acceptable limits that will not, by themselves, prevent verification. Where the Determination refers to the Road Vehicle Standards (Verification of Road Vehicles) Determination 2021 (for example, whether a body alignment test would be required), it creates conditional rules that depend on how those other instruments operate (s 6(1)(d)(ii)).
