Road Vehicle Standards (Additional Matters Relating to Eligibility for a Road Vehicle to be Entered on the Specialist and Enthusiast Vehicles Register) Determination 2021

The Determination is built around a small set of operational concepts that determine how vehicle variants and eligibility pathways are to be assessed. Those concepts are set out in Parts 2 and 3 and are best understood in relation to the Rules, which the Determination supplements (see s 4).

Variant and significant differences. The Rules provide that road vehicles of a particular kind constitute a variant of a model if “their design characteristics are significantly different” from other vehicles of that model (subsection 128(1) of the Rules, discussed in s 5 of this Determination). This Determination does not replace subsection 128(1), but it prescribes additional examples of differences that are to be treated as significant for particular vehicle categories (ss 7-9). It also explains how combinations of individually non‑significant differences can be significant when considered together (s 10), and it states that certain differences arising only from reference standards, marketing specifications or measurement/testing methods are not significant (s 11(2)).

Vehicle categories. The Determination treats different vehicle categories differently. It separately addresses L-group and M-category passenger vehicles MA, MB and MC (s 7), MD, ME (with gross vehicle mass up to 12 tonnes) and NA, NB goods vehicles (s 8), and ME (gross vehicle mass over 12 tonnes) and NC heavy goods vehicles (s 9). Different numeric thresholds and types of differences are used depending on the category. Vehicle categories themselves are defined in the Vehicle Standard (Australian Design Rule,Definitions and Vehicle Categories) 2005 (see s 7(1) note and s 4).

Quantitative thresholds. The Determination gives concrete percentage thresholds that create discontinuities in the variant analysis. Examples include: engine capacity differences of 30% for L‑group and 20% for M‑group vehicles (s 7(2)(b)); 50% engine capacity thresholds for MD, ME ≤12 t, NA and NB (s 8(2)(b)) and for heavy ME/NC vehicles (s 9(2)(c)); increases in maximum power of 30% for L/M passenger categories (s 7(4)) and 50% for other categories (ss 8(4), 9(4)); an electric-only driving range difference of 10% (ss 7(3), 8(3), 9(3)); a seating-position difference of 50% (ss 7(5), 8(5)); and a 50% threshold in the example seating comparisons (ss 7(5), 8(5)).

Performance metric and data inputs. For the performance criterion in section 130 of the Rules, the Determination prescribes a power to weight ratio formula (s 14(1)) and specifies that manufacturer’s nominal net engine power is the value measured by the original manufacturer (s 14(2)), and that tare mass has the ADR 2005 meaning and includes all trim and options fitted (s 14(3)). The Determination therefore fixes the numerator and denominator data points to be used in that eligibility pathway.

Environmental equivalence and timing. The Determination prescribes how to assess whether an alternative standard is “comparable” to the applicable national road vehicle standard: it must require similar or better emissions performance than the latest applicable national standard (s 16(1)-(2)). Crucially, the “date of manufacture” test in national standards is to be read as the date of the application for entry on the SEVs Register (s 16(4)), which can shift which version of a national standard is the “latest applicable” one (s 16(3)-(5)).

Campervans and motorhomes. The Determination defines physical constraints for the campervans/motorhomes pathway: a vehicle cannot be a campervan where gross vehicle mass exceeds 3.5 tonnes (s 17(2)); only vehicles with one of the listed body shapes may be a campervan or motorhome (s 17(3)): bus, cab‑chassis, truck, utility vehicle, van or people‑mover.

Combinations and operational performance. Where several non‑significant differences exist, the Determination requires an assessment of their combined impact on the vehicle and its operational performance, referencing specific performance aspects such as acceleration, braking, energy efficiency, lateral adhesion, crashworthiness and mobility assistance (s 10(2)-(3)). It also establishes a hierarchy of significance: hardware/mechanical differences are more likely to be significant than software/tuning differences, those are more likely to be significant than cosmetic differences, and differences that materially relate to the SEV eligibility criterion sought are more likely to be significant (s 10(2)(b)(i)-(iii)).

Terminology and exclusions. The Determination clarifies that “electric-only vehicle” excludes petrol‑electric or hybrid vehicles (s 4). It also states that its list of significant differences is not exhaustive (s 5), and that it does not limit which differences could be considered significant (s 11(1)), but it does exclude differences that only arise from different reference standards, marketing specifications, or measurement/testing methods (s 11(2)).

These concepts convert some previously qualitative assessment questions into definitional rules and thresholds. They also create discrete evidential points that applicants and assessors must address when arguing that a model or variant either is or is not significantly different for SEVs Register purposes.

Primary actors. The Determination directly affects persons who apply to have a make and model, or a variant of a model, entered on the SEVs Register under Division 6 of Part 4 of the Rules, as described in s 5. Those applicants will include vehicle manufacturers, importers, agents representing overseas manufacturers, specialist modifiers, and businesses seeking to bring particular models into SEV pathways. The instrument also affects the regulator or administrative body that assesses SEV applications because it prescribes assessment rules and thresholds (ss 5-6, generally).

Manufacturers and OEMs. Original equipment manufacturers are affected in two ways. First, their reported nominal net engine power, as measured by them, is the prescribed source figure for the power to weight calculation under the performance criterion (s 14(2)). Second, the Determination’s provisions on engine capacity, configuration, and fuel type differences (ss 7-9) will determine when variations within or across model ranges are treated as distinct variants for SEV entry; that matters for manufacturers who seek to segment market supply or to certify particular variants for SEV status.

Aftermarket modifiers and converters. Companies modifying vehicles (for example, converting vans to campervans or changing drivetrain or seating configurations) are affected because the Determination treats certain changes as significant or not (ss 7-11). Modifiers who change engine configuration, number of powered axles, seating positions, or increase maximum power beyond the thresholds will likely create variants that require separate entry on the SEVs Register (see ss 7(4), 7(5), 9(2)(a), 9(5)(a)-(c)). The combination rule (s 10) means multiple smaller changes can together generate a significant variant outcome.

Importers and small volume vehicles. Persons importing specialist or enthusiast vehicles will need to map applicants’ vehicles against the Determination’s thresholds and the Rules’ eligibility criteria. For example, relying on the environmental criterion under subparagraph 131(b)(ii) of the Rules is limited to particular vehicle categories (s 15), so importers of vehicles outside those categories cannot rely on that environmental pathway.

Regulators and assessors. The regulator applying the Rules is affected because the Determination supplies discrete legal tests and interpretative rules that the regulator must apply when deciding whether a make/model or variant is eligible for the SEVs Register. The Determination instructs how to treat combined differences (s 10), which emissions standard applies (s 16), and how to calculate power to weight (s 14). These rules change the assessment workload and the nature of required evidence.

Consumers and fleet owners. While the Determination does not directly regulate end-consumers, it indirectly affects vehicle availability and the supply chain. If certain modifications or variant configurations are treated as new variants requiring separate SEV entries, applicants may face additional compliance costs, which could influence whether certain configurations are sold or imported into Australia.

Which vehicles are ruled in or out of certain pathways. The Determination narrows eligibility for the environmental pathway in subparagraph 131(b)(ii) to MA, MB, MC, MD, ME and NA, NB, NC categories (s 15). It excludes vehicles over 3.5 tonnes from being campervans (s 17(2)). It clarifies that electric-only vehicle assessments are different from hybrid/petrol-electric vehicles (s 4). Manufacturers and importers must therefore map their vehicles to these categories in the ADR definitions referenced in s 4.

Who pays and who decides. Practically, applicants pay the compliance, testing and evidence costs required to meet the tests mandated by the Determination. The regulator decides whether the tests are satisfied when processing an application under the Rules, applying the prescribed thresholds and interpretive rules in this Determination (see s 3 noting the instrument’s authority under s 136 of the Rules).

Duties imposed on applicants and decision-makers. The Determination imposes procedural and evidential duties on applicants and prescribes rules the decision-maker must apply. Key duties include:

• Establishing whether differences in design characteristics are “significant” by reference to the specific thresholds listed for each vehicle category (ss 7-9). For example, when a vehicle with an internal combustion engine has a different fuel type (unless only fuel grade differs), that change is significant (ss 7(2)(a), 8(2)(a), 9(2)(b)). Applicants must therefore disclose fuel type, engine capacity, configuration, and the other listed attributes when asserting that a variant is or is not significantly different.

• Calculating the power to weight ratio under the performance criterion using the formula in s 14(1). Applicants relying on the performance criterion must use manufacturer’s nominal net engine power as measured by the original manufacturer (s 14(2)) and the ADR definition of tare mass including all trim and options (s 14(3)).

• Applying the environmental criterion in line with the Determination: if relying on subparagraph 131(b)(ii) of the Rules, the applicant must ensure the vehicle is in the vehicle categories listed in s 15. If relying on an alternate emissions standard, applicants must demonstrate that the alternative standard is comparable to the “latest applicable” national road vehicle standard, interpreted under s 16 (ss 16(1)-(5)).

• For campervan/motorhome claims, applicants must ensure the vehicle’s gross vehicle mass is 3.5 tonnes or less to be a campervan (s 17(2)) and that the vehicle has one of the enumerated body shapes (s 17(3)).

Duties on the regulator/assessor. The regulator must apply the Determination’s thresholds and interpretive rules when deciding if a model or variant qualifies as a variant for SEV Register entry and when assessing eligibility under the Rules. In particular, where multiple non‑significant differences exist, the regulator must assess their combined impact on the vehicle and operational performance per s 10(1)-(3) and must apply the principles in s 10(2)(b), including the hardware/software/cosmetic hierarchy.

Rights available to applicants. The instrument preserves applicants’ underlying right to apply for entry on the SEVs Register under the Rules (s 5). It also permits applicants to rely on “equivalent” standards in place of national road vehicle standards, provided the alternative standard requires emissions performance similar to or better than the latest applicable national standard (s 16(1)-(2)). Applicants may therefore propose alternative test standards or foreign standards as long as they can demonstrate comparability as defined in s 16.

Evidential rules and specification. The Determination places evidential expectations on applicants. For example, the power figure must be the manufacturer’s nominal net engine power (s 14(2)), and tare mass must include trim and options as per ADR definitions (s 14(3)). The application date is treated as date of manufacture for selecting the relevant national emissions standard (s 16(4)), which may increase evidential burden because it requires applicants to map their model against the latest standard as at application date.

Limits and scope of legal effect. The Determination does not itself create new criminal offences or penalties within its text. It is an instrument made under the Rules and so operates to define how the Rules are to be applied (s 3). Any duties to comply with accreditation, certification or enforcement are implemented through the Rules; this Determination supplies interpretive and prescriptive criteria for that process.

Practical obligations. In practice, applicants must gather manufacturer data (engine power, engine capacity and configuration), produce range figures for electric-only vehicles, document seating counts, steered and powered axle counts, and supply evidence comparing emissions performance to national standards. For combined changes, applicants must prepare technical analysis of impacts on acceleration, braking, energy efficiency, roadholding, crashworthiness and mobility assistance where relevant (s 10(3)).

The Determination itself does not set out criminal penalties or express enforcement mechanisms. It is a rule‑making instrument made under section 136 of the Road Vehicle Standards Rules 2019 (s 3), and it prescribes how the Rules are to be applied in certain respects. Any penalties or enforcement pathways applicable to non‑compliance with the registration, importation or SEV rules will therefore be those provided in the Rules and in the primary statutes and instruments that the Rules implement. The Determination contains no standalone penalty clauses.

Administrative enforcement. The more immediate enforcement consequence of the Determination is administrative: if an applicant fails to demonstrate compliance with the specified thresholds or fails to provide required data (for example manufacturer nominal net engine power, tare mass, or emissions comparability evidence), the regulator can decline entry on the SEVs Register, or require a separate entry for a variant where design differences are significant under ss 7-10. Those administrative decisions flow from the Rules’ processes; this Determination makes those outcomes more predictable by setting thresholds and interpretive criteria.

Discretion and assessment. The Determination confers interpretive guidance that will shape administrative discretion. For example, s 10 requires assessors to consider combined differences and to apply the principles that hardware differences are more likely to be significant than software differences, that software differences are more likely to be significant than cosmetic differences, and that differences more closely tied to the eligibility criterion are more likely to be significant (s 10(2)(b)). That guidance narrows, but does not eliminate, discretion in borderline cases. The Determination’s examples and defined metrics will be the basis on which administrators exercise judgment in deciding whether a combination of non‑significant differences becomes significant.

Evidential burden. The Determination effectively raises the evidential burden on applicants in some scenarios. For the environmental criterion, the applicant must show equivalence to the latest applicable national road vehicle standard, with the “date of manufacture” read as the date of application (s 16(4)). This interpretive rule can make it more onerous to show comparability because it pushes applicants to meet the most recent standard applicable as at application date, potentially after the vehicles were originally manufactured.

Potential for review and challenge. Although this Determination does not itself set out appeal mechanisms, administrative decisions made under the Rules informed by the Determination may be subject to internal merits review or judicial review under the Administrative Decisions (Judicial Review) Act 1977 or related provisions in the Rules or enabling statutes. The Determination’s specific thresholds and the date‑of‑application substitution for manufacture date (s 16(4)) are identifiable points where a challenger might focus a review application, because those are discrete, legally determinative rules set in the instrument.

Implementation risk and compliance costs. The Determination places on applicants the cost of producing manufacturer and testing data (for power to weight, electric range, seating counts, axle counts, and emissions comparisons), and of legal or technical analysis where multiple small differences must be considered together (s 10). Regulators will similarly bear administrative costs in applying the Determination’s technical tests. The Determination therefore shifts some costs of precise technical assessment to applicants and to the regulator, rather than creating direct fines or penalties in the instrument itself.

The Determination is an instrument made under the Road Vehicle Standards Rules 2019 and is explicitly structured to add specificity to the Rules (s 3; see s 12). It therefore interacts with the Rules, and it cross‑references the Vehicle Standard (Australian Design Rule,Definitions and Vehicle Categories) 2005 and national road vehicle standards relating to emissions. The Determination’s operation must be understood in that statutory and regulatory matrix.

Dependence on the Rules. The substantive effect of the Determination is to clarify and expand matters “for the purposes of” sections of the Rules. For example, Part 2 of the Determination “specifies when differences in the design characteristics of road vehicles will, or will not, be significant for the purposes of subsection 128(1) of the Rules” (s 6). Parts 2 and 3 therefore operate only as interpretive and prescriptive instruments feeding into the Rules’ application; enforcement and penalty regimes remain those in the Rules and in the primary legislation that authorised the Rules. Any change to the Rules could therefore alter how the Determination functions in practice.

Interaction with Australian Design Rules (ADRs). The Determination repeatedly references or relies on definitions in the Vehicle Standard (Australian Design Rule,Definitions and Vehicle Categories) 2005. Section 4 notes that several expressions used in the Determination are defined in the Rules and ADR instrument, including gross vehicle mass and vehicle category. The power to weight calculation requires tare mass as defined by the ADRs (s 14(3)). Thus the Determination presumes ADR definitions as inputs, and any divergence or change in ADR definitions could change the practical application of the Determination’s thresholds.

Emissions standards and national road vehicle standards. Section 16 prescribes how to treat comparable emissions standards relative to national road vehicle standards mentioned in subparagraph 131(a)(i) of the Rules. The Determination defines the “latest applicable national road vehicle standard” for a relevant model or variant, and instructs that the date of the SEV Register application is to be treated as the date of manufacture for determining which version of a standard applies (s 16(3)-(4)). That interpretive rule will interact with any statutory or regulatory scheme that fixes emissions requirements by reference to the date of manufacture. The Determination therefore has the practical effect of potentially moving the applicable national standard forward to the latest version where an applicant lodges a SEV Register application after the standard’s later effective date. Any other laws or standards that measure compliance by actual manufacture date will not automatically be altered, but for the purposes of SEV eligibility the Determination fixes application date as the measure.

Administrative law and review. Decisions applying the Rules and this Determination will fall within the broader framework of administrative law. Although the Determination does not specify review mechanisms, it supplies discrete legal standards (for example the 10% electric range threshold, 50% seating difference, or power increase thresholds) that will be used in administrative decisions and thus could be challenged on conventional public law grounds if an applicant alleges error in application of the Determination’s provisions.

Scope limits and exclusions. Section 11(2) identifies categories of differences that are not significant where they result only from the use of different reference standards, marketing specifications, or measurement/testing methods. That interacts with any other legal requirement that imposes certain measurement methods; for instance, if two manufacturers use different testing standards to measure the same parameter, the Determination says that those differences alone are not significant. That may restrict regulatory outcomes where other laws rely on particular test methods.

In short, the Determination is an interpretive, technical instrument that supplements the Rules and relies on ADR definitions. It should be read in conjunction with the Rules and the ADRs, because its tests and thresholds have legal effect only in the context of the SEVs Register procedures established by the Rules and defined terms from the ADRs.

The instrument includes a date and signature showing it was made on 25 March 2021 by Michael McCormack, Deputy Prime Minister and Minister for Infrastructure, Transport and Regional Development (heading and signature page). Section 1 records the name of the Determination; section 2 states that it commences at the same time as section 136 of the Road Vehicle Standards Rules 2019; and section 3 records that it is made under section 136 of the Rules.

There are no subsequent amendments or revision notes contained in the text provided. The Determination itself does not contain amendment history entries, transitional provisions, or sunset clauses. The instrument’s opening provisions and structure indicate it is intended as an implementing, interpretive instrument under s 136 of the Rules rather than a frequently amended policy statement.

Implications of the absence of recorded amendments. Because the instrument does not include amendment history in the provided text, users should assume the content as delivered is the original version made on 25 March 2021. Any later amendments, revocations or replacements would be recorded by the legislative database or the issuing agency and would not appear in this text. Practitioners relying on these provisions should check the consolidated register of instruments or the Federal Register of Legislation for any subsequent amending instruments or disallowance events.

Points likely to attract amendment in practice. The Determination contains precise numeric thresholds (for example the 10% electric range difference, the 50% seating threshold, and different power/engine capacity thresholds by category). Those thresholds are the types of provisions that might be subject to future amendment in response to evolving technology or policy, for example shifts in electric vehicle range norms, drivetrain architectures, or international harmonisation of emissions standards. The instrument also substitutes application date for date of manufacture for emissions standard applicability (s 16(4)), a rule that has immediate policy consequences and might be revisited should administrators or stakeholders identify unintended effects.

Where to check for updates. Because the Determination was made under the Rules, any changes to the Rules or to section 136 in particular could also lead to consequential amendments to this Determination. Users should consult the Federal Register of Legislation and the administering department (Infrastructure, Transport and Regional Development) for any amending instruments, as the Determination itself contains no version history.

The text of the Determination supplied contains no references to judicial decisions, tribunal determinations or challenges. It therefore does not record any litigation history. The Determination is an administrative instrument that supplies definitions, thresholds and interpretive rules; where disputes arise about its application, they would be addressed through administrative review processes or judicial review of decisions made under the Road Vehicle Standards Rules 2019. The Determination itself does not cite or incorporate case law.

Potential litigation focal points identified in the text. While there is no recorded litigation history in the instrument, the Determination contains several provisions that, by their nature, are likely to generate disputes and therefore could be the subject of future litigation or merits review. These include:

• The combined differences rule in section 10. Section 10 provides that multiple individually non‑significant differences can be significant in combination, and sets out assessment principles and operational performance factors. Disputes may arise about how to apply the hierarchy in s 10(2)(b) and the operational performance factors in s 10(3), particularly where technical expert evidence differs about how individual changes interact.

• The substitution of application date for date of manufacture in section 16(4). This interpretive rule can materially change which version of a national emissions standard applies. Applicants and regulators may disagree about whether the proper standard is the one in force at actual manufacture or the one applicable at the date of application, and that question could form the basis of administrative review.

• The comparability test for emissions standards in section 16(1)-(2). Determining whether an alternative standard “requires emissions performance that is similar to or better than” the relevant national standard is a comparative exercise that will involve technical evidence; disputes over comparability could be litigated.

• Definitions and measurement inputs in section 14. The reliance on the manufacturer’s nominal net engine power as measured by the original manufacturer and on ADR definitions for tare mass could generate disputes where parties disagree about which figure is authoritative or whether modifications alter the baseline measurements.

Absence of immediate precedents in the instrument. Because the Determination is fairly technical and prescriptive, and because it is a rule‑making instrument rather than a statute creating private rights, initial disputes are more likely to arise in administrative decision contexts and merit reviews rather than in large, precedent‑setting court cases. The instrument does not contain any mention of prior administrative interpretations, so early decisions under the Rules applying this Determination may generate the first line of authority on ambiguous points.

Practical advice given the lack of recorded litigation. Applicants should document technical justifications for their positions under the Determination, including expert technical reports where multiple small differences are relied upon to argue non‑significance or significance, and prepare clear emissions comparability analyses where alternative standards are proposed. That evidence will support administrative appeal or judicial review if disputes arise over the regulator’s application of the Determination.

This Determination contains several specific technical traps and interpretive switches that can create unexpected outcomes unless directly addressed in an application. The following are concrete “gotchas” tied to numbered provisions in the instrument.

Date of application treated as date of manufacture (s 16(4)). For determining which national emissions standard applies, the Determination tells assessors to read any reference to “date of manufacture” in the applicable national standard as the date of the application for entry on the SEVs Register. This is concrete and non‑obvious. It means an applicant whose vehicle was manufactured earlier may nonetheless be required to meet a later national standard if they file their SEV application after that later standard’s effective date. The example in s 16(4) illustrates this. The practical effect is that the timing of application can increase emissions compliance requirements unexpectedly.

Differing thresholds by vehicle category (ss 7-9). Engine capacity percentage differences, power increase thresholds and other metrics are not uniform. For L-group vehicles and M-group passenger vehicles the engine capacity threshold is 30% or 20% respectively (s 7(2)(b)), whereas MD, ME ≤12 t, NA and NB categories use 50% (s 8(2)(b)), and heavy ME/NC uses 50% (s 9(2)(c)) and also treats engine configuration changes as significant (s 9(2)(a)). Power increase thresholds are 30% in s 7(4) and 50% in ss 8(4)-9(4). Applicants must map their vehicle to the correct category (which depends on ADR definitions) before applying the thresholds, or they may calculate against the wrong standard.

Electric-only range threshold and hybrids (s 4 and ss 7(3), 8(3), 9(3)). The electric-only vehicle classification excludes petrol‑electric or other hybrids (s 4). For electric-only vehicles the Determination sets a 10% maximum driving range difference threshold for significance (ss 7(3), 8(3), 9(3)). An applicant relying on electric range numbers must ensure that their vehicle is truly electric-only and not a hybrid, or the range criterion will not apply and different (likely higher) significance thresholds will be used.

Combinations of non-significant differences can be significant (s 10). Multiple differences that are individually non‑significant can together render a model a separate variant. Section 10 imposes an assessment centred on operational performance and sets a hierarchy favouring hardware differences over software and cosmetic differences. Applicants who assume that small changes can be aggregated without consequence face risk: the regulator must assess combined effects on acceleration, braking, energy efficiency, roadholding, crashworthiness, or mobility assistance (s 10(3)). Technical analysis is therefore often required to show non‑materiality.

Seating positions threshold (ss 7(5), 8(5)). A 50% difference in the maximum number of seating positions compared with other vehicles of the model available in Australia is significant. The Determination uses a maximum seating count comparison to the other vehicles of the relevant model available in Australia; that requires applicants to show what seating configurations are “available in Australia” for the model.

Powered and steered axles (ss 7(6), 8(6), 9(5)(a)-(b)). A change in the number of steered axles is significant across categories (s 7(6) and s 8(6)), and for heavier vehicles, differences in number or position of powered axles and number of steered axles are also significant (s 9(5)(a)-(b)). Small axle configuration changes result in significant variant status, which can have knock‑on certification and compliance effects.

Manufacturer’s nominal net engine power as authoritative (s 14(2)). The power to weight ratio must use the manufacturer’s nominal net engine power measured by the original manufacturer. Where there is aftermarket tuning, engine swaps or variable reported power figures, applicants must reconcile which figure is the “manufacturer’s nominal net engine power” and provide documentary proof. Tare mass is similarly required to use the ADR definition and must include trim and options (s 14(3)).

Exclusions for differences arising only from measurement methods (s 11(2)). Differences that only result from use of different reference standards, marketing specifications, or measurement/testing methods are not significant. This protects some differences, but it also requires careful evidence to show that the difference is purely methodological rather than substantive. Relying on that exclusion without precise proof risks a finding of significance.

Campervan body shape and GVW cap (s 17). The Determination limits campervan status to vehicles under 3.5 tonnes GVW (s 17(2)) and to specific body shapes (s 17(3)). Applicants converting larger chassis or unusual body shapes cannot rely on the campervan pathway. The list of body shapes is finite; anything outside that list will require an alternate eligibility basis.

Ambiguity in “comparable” emissions standards (s 16(2)). An alternative standard must require emissions performance “similar to or better than” the latest applicable national standard. That comparative language requires technical evidence and leaves some room for dispute about the equivalence margin. Applicants proposing foreign certifications will need comparative test data and legal/legal-technical argument.

No exhaustive list of significant differences (s 5, s 11(1)). The Determination states it is not exhaustive and does not limit what differences could be significant. That leaves open residual uncertainty beyond the enumerated thresholds. Applicants should assume that novel or unusual changes may still be treated as significant under subsection 128(1) of the Rules even if not listed.

These concrete points create specific evidential and timing risks. Practitioners should assess them early in any SEVs application strategy.

Compliance requires both a procedural checklist and substantive technical work. The Determination prescribes discrete, documentable thresholds and analytic steps; applicants should follow them closely. The following compliance roadmap aligns with the Determination’s provisions.

1. Map vehicle to the correct category and definitions. Identify the vehicle category under the Vehicle Standard (Australian Design Rule,Definitions and Vehicle Categories) 2005 as referenced in s 4 and the notes to ss 7 and 15. The applicable thresholds for engine capacity, power increases, seating positions and other characteristics differ by category (see ss 7-9). If category classification is uncertain, obtain ADR advisory material or engage technical/legal counsel before submitting the SEV application.

2. Audit all design differences against listed significant thresholds. Prepare a catalogue of differences between the make and model variants you intend to include or exclude. For each difference, apply the category‑specific thresholds:

• Internal combustion engine fuel type: any different fuel type other than mere fuel grade change is significant (ss 7(2)(a), 8(2)(a), 9(2)(b)).
• Engine capacity: compare percentage differences to the category thresholds (s 7(2)(b), s 8(2)(b), s 9(2)(c)).
• Maximum power: calculate percentage increases; compare to 30% threshold for L/M passenger vehicles (s 7(4)) and 50% for the other categories (ss 8(4), 9(4)).
• Electric-only maximum range: where the vehicle is electric-only (not a hybrid), a 10% or more difference is significant (ss 7(3), 8(3), 9(3)); confirm the vehicle is electric-only per s 4.
• Seating positions: a 50% or more difference is significant (ss 7(5), 8(5)).
• Steered and powered axles: any change in number of steered axles is significant (ss 7(6), 8(6)); heavy vehicles have broader axle and category triggers (s 9(5)).

3. For combined changes, prepare an integrated operational performance assessment. Where multiple minor differences exist, they may be significant in combination under s 10. Provide technical evidence that addresses the operational performance factors listed in s 10(3): acceleration and braking, energy efficiency, lateral adhesion/roadholding, vehicle safety rating/crashworthiness, and mobility assistance where applicable. Explicitly address s 10(2)(b) principles: show whether changes are hardware/mechanical, software/tuning or cosmetic and quantify the extent to which they relate to the eligibility criterion relied upon.

4. Calculate power to weight precisely. If relying on the performance criterion, use the formula in s 14(1). Source the numerator from the manufacturer’s nominal net engine power measured by the original manufacturer (s 14(2)). Use ADR 2005 values for tare mass and include the mass of all trim and options (s 14(3)). Retain manufacturer documentation and test reports to substantiate figures.

5. Build the emissions comparability case early. If relying on the environmental criterion and an alternative emissions standard, prepare a comparative technical analysis showing that the alternative standard requires emissions performance similar to or better than the latest applicable national standard (s 16(1)-(2)). Critically, treat the date of application as the date of manufacture when determining which version of the national standard is “latest applicable” (s 16(4)). If your vehicle was manufactured before the latest standard, be prepared to meet the later standard if you submit your application after the later standard’s effective date.

6. Campervan/motorhome pathway checks. If relying on the campervan or motorhome criterion, confirm the vehicle’s gross vehicle mass is 3.5 tonnes or less for campervan status (s 17(2)) and that the body shape is one of the enumerated forms (bus, cab chassis, truck, utility vehicle, van or people‑mover) (s 17(3)). If conversion is planned, ensure the final configuration fits those body shape categories and weight limits.

7. Evidence management and documentation. Collate original manufacturer documentation (engine power, capacity, engine configuration), mass certification data (tare mass including trim and options), seating charts, axle configuration records, electric vehicle range test certificates, emissions test reports, and any technical analyses that explain combined effects. Where manufacturer figures are relied upon, ensure you retain the manufacturer’s written statements or test certificates, because s 14(2) requires manufacturer’s nominal net engine power as measured by the original manufacturer.

8. Engage early with the regulator. Because the Determination creates precise interpretive rules that the regulator will apply, early engagement can reduce the risk of an adverse interpretation. Discuss the technical evidence you intend to provide and confirm the regulator’s expectations regarding comparability analyses and combined differences assessments.

9. Prepare for potential administrative review. Where the Determination’s provisions create contentious or borderline issues (for example s 10 combinations, s 16 date substitution, or defining the “latest applicable” standard), prepare contingency plans for internal review or judicial review. Keep a full evidentiary trail supporting the technical positions taken in the application.

10. Keep abreast of ADRs and national standards. The Determination relies on ADR definitions and national emissions standards. Monitor updates to those instruments because changes will affect how the Determination’s thresholds operate (for example, tare mass definitions or vehicle category rules).

Who pays. Practical compliance costs fall to the applicant: obtaining manufacturer confirmations, third‑party testing, technical consultancy for combined differences assessments, and potentially reengineering or limiting sales/configurations to avoid creating new variants.

Who decides. The regulator applying the Road Vehicle Standards Rules will decide eligibility, applying the Determination’s thresholds and interpretive guidance. Where decisions are contested, the usual public law avenues for review apply.

In sum, compliance is a technical exercise requiring careful category mapping, precise measurement and documentation, tailored technical analysis for combined changes, and thoughtful timing of SEV applications where emissions standards are at issue.
