42Self‑incrimination

#### 42 Self‑incrimination (1) A person is not excused from: (a) giving information or evidence; or (b) producing a document; as required by a disclosure notice given to the person on the ground that the information or evidence, or production of the document, might tend to incriminate the person or expose the person to a penalty. (2) However, in the case of an individual: (a) the information or evidence given, or the document produced; and (b) giving the information or evidence, or producing the document; are not admissible in evidence against the individual: (c) in civil proceedings; or (d) in criminal proceedings, other than proceedings against the individual for: (i) an offence against section 43 or 44; or (ii) an offence against section 137.1 or 137.2 of the Criminal Code that relates to this Division.
