#### 40 Notification requirements—voluntary recalls (1) A person contravenes this subsection if: (a) the person is required by the rules to give a notice, or a copy of a notice, to the Minister in relation to a voluntary recall of road vehicles or approved road vehicle components; and (b) the person refuses or fails to give the notice, or the copy of the notice, as required by the rules. Strict liability offence (2) A person commits an offence of strict liability if the person contravenes subsection (1). Penalty: (a) if the person is a body corporate—80 penalty units; or (b) if the person is not a body corporate—16 penalty units. Civil penalty provision (3) A person is liable to a civil penalty if the person contravenes subsection (1). Civil penalty: (a) if the person is a body corporate—80 penalty units; or (b) if the person is not a body corporate—16 penalty units.
