105 Return of existing scheme authority if applying for new authority
> > (1) This section applies to an applicant for a scheme authority (the new scheme authority) if the application is made before the expiry date of another scheme authority held by the applicant (the existing scheme authority).

> > (2) If Transport for NSW issues the new scheme authority to the applicant, the applicant must return the existing scheme authority to Transport for NSW by the end of the later of the following days—
> >
> > > (a) the day that is 7 days after the day on which the applicant receives the new scheme authority,
> >
> > > (b) the day after the expiry date of the existing scheme authority.

> > Maximum penalty—20 penalty units.

> > (3) Despite subsection (1), Transport for NSW may exempt a person from returning the existing scheme authority if Transport for NSW is satisfied it would be unreasonable in the circumstances to require the authority to be returned.
