Road Transport (Alcohol and Drugs) Regulation 2000

The Regulation operationalises three core concepts the Act uses: prescribed devices/instruments, prescribed drugs, and sampling facilities. Each is a discrete statutory category used elsewhere in the Act as a definitional hook.

Prescribed devices and instruments. The Regulation lists the precise device models that are “prescribed” for the Act’s definitions. For alcohol screening devices (Act, s 7) the Regulation prescribes Alcolizer LE; lion alcolmeter SD-400; Alcolizer 5 Series; and Alcolizer LE 5 Series (s 2). For breath-analysis instruments (Act, s 7A) it prescribes Dräger Alcotest 7110 MKV and Dräger Alcotest 9510 AUS (s 3). For drug screening devices (Act, s 7B) it prescribes Securetec DrugWipe 3 S and Securetec DrugWipe TWIN, also known as the Securetec DrugWipe II TWIN (s 3A). For oral fluid analysis instruments (Act, s 7C) it prescribes Cozart DDS and Dräger DrugTest 5000, also known as the Draeger DrugTest 5000 (s 3B). The Regulation provides alternate names where relevant. The instruments and devices named are the only models that the Regulation authorises as satisfying those Act definitions.

Documentary particulars for statements. The Regulation prescribes the precise particulars that must be recorded in statements following breath and oral-fluid analysis. Schedule 1 requires nine items for breath: instrument type and serial number and test number; date, start time and location; name and date of birth of the person tested; name of the police officer who has custody (who may be called the informant); the authorised operator’s service number and signature; whether self-tests were conducted before and after, with time and results; whether the instrument was on “override” mode; date and time of analysis; and the result shown by the instrument (Schedule 1). Schedule 2 requires six items for oral fluid: instrument type and serial number and test number; name and date of birth of the person tested; the unique identifying number for the sample; the authorised operator’s service number and signature; date and time of analysis; and the result shown by the instrument (Schedule 2). These are mandatory particulars to be included in statements referenced by Act ss 12(5) and 13E(6) respectively (s 4; s 5).

Prescribed drugs. The Regulation lists the chemical/drug items that count as “prescribed drugs” in the Act’s dictionary (s 5A). The list comprises four items: delta-9-tetrahydrocannabinol; methylamphetamine; N, α-Dimethyl-3,4-(Methylenedioxy)phenylethylamine; and cocaine (s 5A).

Sampling facility. The Regulation narrows the Act’s dictionary of “sampling facility” to two physical classes: a police station, and a police vehicle that is a truck, bus or trailer and is equipped for conducting alcohol or drug tests under the Act (s 6(1)). The section cross-references other instruments for the defined terms “police station”, “police vehicle”, “truck”, “bus” and “trailer” (s 6(2)). The structure is binary: either testing is done at a police station, or at a police vehicle of the specified classes that has appropriate equipment.

Cross-reference architecture. The Regulation is written to sit inside a network of cross-references. Each prescribing provision is headed with the Act provision it supports (for example, “Alcohol screening device,Act, s 7, def alcohol screening device” for s 2). The sampling-facility definition explicitly draws on other vehicle and criminal law instruments (s 6(2)). The schedules refer to sections of the Act that create a duty to give a statement (s 4, s 5). The endnotes and legislation history show the Regulation has been amended repeatedly and that the device lists and prescribed-drug list have been changed by subsequent Acts and subordinate instruments.

Formal characteristics. The Regulation is a subordinate instrument made under the Road Transport (Alcohol and Drugs) Act 1977. The republication notes that editorial changes under the Legislation Act 2001, part 11.3 have been applied (About this republication). The republication date is 1 January 2025 and the instrument includes amendments up to that date (republication cover notes and legislation history).

In sum, the Regulation turns definitional and evidentiary hooks in the Act into specific models, lists and documentary fields. The principal legal mechanism is prescription by model name and by list; the principal evidentiary mechanism is mandatory particulars in post-test statements.

Identify the parties that bear direct compliance obligations and those who are materially affected by the Regulation.

Police and authorised operators. The most immediate group affected are police officers and authorised operators who administer breath and oral-fluid tests. The Regulation requires authorised operators to include their service number and signature in analysis statements (Schedule 1 item 5; Schedule 2 item 4). Operators must also record instrument types, serial numbers and test numbers; self-test activity and results for breath instruments; whether the instrument was in override mode; times and locations; and the analysis result (Schedule 1; Schedule 2). That creates documentary duties for police personnel who operate the instruments and prepare the statements the Act requires (s 4; s 5).

Drivers and persons tested. Persons subject to testing are affected through procedural detail that will appear in the formal statement provided after testing. The schedules require the tested person’s name and date of birth to be included (Schedule 1 item 3; Schedule 2 item 2). For oral-fluid testing, a unique sample identifying number must be recorded (Schedule 2 item 3). These particulars can affect record-keeping and the person’s evidentiary position in administrative or criminal processes that follow.

Device suppliers and manufacturers. The Regulation identifies particular device models that can be used under the Act. Suppliers and manufacturers of the prescribed devices listed in ss 2, 3, 3A and 3B are directly affected because use of non‑prescribed models may not meet the Act’s definitional requirements. Entities that manufacture or supply alternative devices not listed may find their devices excluded from lawful evidentiary use unless the Regulation is amended.

Police service procurement and equipment managers. Because the Regulation prescribes the models that count for statutory purposes, procurement officers must ensure the force’s equipment inventory aligns with the Regulation. The sampling facility provision (s 6) specifies that testing in non-prescribed locations or in police vehicles other than truck, bus or trailer types equipped for tests may not be treated as being carried out at a prescribed sampling facility. That affects decisions about equipping vehicles.

Defence lawyers and compliance advisers. Defence counsel, compliance officers and legal advisers are materially affected because the Regulation determines which devices and which documentary particulars must be present in evidence that supports an adverse administrative action or criminal charge under the Act. The presence or omission of prescribed particular items may be strategically significant in litigation and administrative review.

Laboratories and evidence-handling units. For oral-fluid testing the schedule requires a unique identifying number for the sample (Schedule 2 item 3). That requirement interfaces with laboratory chain-of-custody procedures. The Regulation therefore affects evidence handling and sample-tracking protocols.

Legislative and administrative actors. The Regulation’s lists and documentary requirements mean that the executive agencies responsible for road policing, for procurement, and for operational training must adjust standard operating procedures, training materials and forms to reflect the prescribed particulars and the prescribed devices.

The broader public. The list of prescribed drugs (s 5A) sets the substances for which random and targeted testing regimes will criminalise or punish driving conduct under the Act. Exclusion of certain substances from the prescribed list means those substances will not fall within the Regulation’s testing specification; inclusion brings them into the statutory detection ambit. That affects individuals who use or are suspected of using those substances and shapes the practical reach of roadside and post-arrest testing.

Municipal and commercial transport operators. The sampling-facility restriction to police stations and certain police vehicles has operational implications for how checks are run on large vehicles and public transport. Police may need to plan for appropriate vehicle types and equipment to test drivers at roadside locations without access to police stations. Employers with safety-critical drivers will be affected indirectly by the way police deploy equipment consistent with the Regulation.

Finally, because the Regulation is updated by subordinate instruments and Acts (see legislation history), parties who depend on the regulation for compliance must monitor legislative updates. The republication notes multiple amendments over two decades, culminating in amendments by the Road Safety Legislation Amendment Act 2024 and SL2024-20 effective on specified dates; those amendments changed device lists and added the prescribed-drug provision (endnotes and legislation history).

This Regulation establishes documentary duties and device-use constraints rather than freestanding individual rights. The duties are cast principally as required particulars in statements and as limits on which devices and facilities satisfy the Act’s definitions.

Duties imposed on authorised operators and police personnel:

• Include instrument type, serial number and test number in statements for both breath and oral-fluid analysis (Schedule 1 item 1; Schedule 2 item 1). This is a mandatory documentary duty when a statement is given under the Act, s 12(5) and s 13E(6) (s 4; s 5).
• Record the tested person’s name and date of birth (Schedule 1 item 3; Schedule 2 item 2).
• Provide the name of the police officer who has custody of the person under the Act, s 11, in breath-analysis statements (Schedule 1 item 4).
• Include the authorised operator’s service number and signature (Schedule 1 item 5; Schedule 2 item 4).
• For breath analysis, record whether self-tests were conducted on the instrument before and after analysis, including the time and the result of such tests (Schedule 1 item 6).
• For breath analysis, if the instrument was tested on “override” mode, the statement must record that fact (Schedule 1 item 7).
• For both breath and oral-fluid analysis, record the date and time when the sample was analysed and the result shown by the instrument (Schedule 1 items 8-9; Schedule 2 items 5-6).
• For oral-fluid analysis, include the unique identifying number for the sample taken for analysis (Schedule 2 item 3).

Duties implicit in device prescription:

• Use only prescribed devices and instruments where the Act requires a device that meets the definition. The Regulation prescribes which devices satisfy the Act’s definitional hooks (s 2; s 3; s 3A; s 3B). Procurement, training and operation must align with these lists.

Duties regarding sampling locations:

• Conduct testing at prescribed sampling facilities, defined as police stations or police vehicles that are trucks, buses or trailers and are equipped for testing under the Act (s 6(1)). The defined terms used in s 6(2) are cross-referenced to other instruments.

Rights and procedural expectations:

• The Regulation does not create separate individual rights, but it establishes the procedural particulars that support statutory processes in the Act. The Act’s provisions that require statements (s 12(5), s 13E(6)) are implemented by the Regulation’s schedules, so parties can expect the post-test statement to contain the enumerated particulars.
• The presence of operator service number and signature, instrument serial numbers, unique sample identifiers and recorded self-tests are procedural safeguards for chain-of-custody and instrument integrity. These particulars are therefore necessary for the statutory process and may be relevant to anyone asserting procedural or evidentiary objections.

What the Regulation does not do:

• It does not itself set sanctions or penalties; those are part of the Act and other instruments. The regulation prescribes technical detail and documentary form.
• It does not list all possible psychoactive substances; only the drugs in s 5A are “prescribed drugs” for the Act’s purposes at the republication date. Substances not listed are therefore outside the Regulation’s prescribed list unless changed by amendment.

Operational consequences:

• Failure to include required particulars in a statement given under the Act may have practical consequences for the use of the statement in subsequent administrative or criminal processes under the Act. The Regulation makes compliance straightforward to audit because the particular fields are explicitly enumerated (Schedule 1; Schedule 2).
• Use of an unlisted device may lead to procedural or evidentiary challenges because the device will not meet the Act’s prescribed-device definition.

In summary, the Regulation’s key duties are documentary and technical. Police and authorised operators must record a specific set of items after analysis, and only prescribed devices and specified sampling facilities qualify under the Act’s definitions as implemented by the Regulation.

The Regulation itself does not set specific fines or criminal penalties; rather it prescribes technical and documentary requirements that tie into the enforcement framework established by the Road Transport (Alcohol and Drugs) Act 1977. The republication notes the penalty unit values applicable at the republication date, which set the monetary scale for offences under this subordinate law and the parent Act: a penalty unit is $160 for an individual and $810 for a corporation (Legislation Act 2001, s 133), per the republication front matter.

How enforcement is structured as a matter of statutory architecture:

• The Regulation supplies device and documentary specifics that the Act references. The Act creates the operative offences, powers and procedures for testing, custody and evidence. The Regulation makes certain evidentiary and procedural expectations explicit so that the Act’s enforcement machinery can function. For example, the Act provisions that require statements after breath or oral-fluid analysis are given effect through the schedules that prescribe what those statements must contain (s 4; s 5).
• The Regulation’s device prescriptions limit which instruments qualify as “breath analysis instruments”, “alcohol screening devices”, “drug screening devices” and “oral fluid analysis instruments” as defined in the Act (s 2; s 3; s 3A; s 3B). Enforcement action that relies on instrument readings will be materially affected by whether the device used is among those prescribed.

Practical enforcement implications:

• Police must ensure that authorised operators use prescribed devices and record the particulars required by the schedules. If an authorised operator uses a non-prescribed device or omits required particulars, that may affect the evidentiary weight of the statement provided under the Act. The Regulation makes the documentary baseline explicit for assessing such compliance.
• The Regulation requires that the breath-analysis statement record whether the instrument was in “override” mode and whether self-tests were performed (Schedule 1 items 6-7). These particulars provide an administrative trail relevant to instrument reliability. An absence or inconsistency in those particulars may be raised in enforcement or defence arguments about the integrity of a test.

Who enforces compliance:

• Enforcement of the Act (and thus de facto enforcement of compliance with the Regulation’s prescriptions) will be undertaken by the police and prosecuting authorities under powers in the Act. The Regulation itself is administered as part of the statutory framework operating through police practice, regulatory agencies and courts. The Regulation does not create a separate inspectorate or compliance agency.

Remedial and evidentiary consequences:

• The Regulation’s documentary requirements create a checklist that agencies and courts may use to evaluate whether a test conforms to the statutory scheme. Missing or incorrect particulars may be material to admissibility or weight in prosecutions and administrative proceedings that rely on statements required by the Act.
• Penalties for offences against the parent Act or related road transport offences will be quantified using the penalty unit values stated in the republication cover (Legislation Act 2001, s 133). The Regulation itself does not provide alternative sanction schedules.

Amendment and retrospective effect:

• The republication notes the Regulation incorporates amendments to 1 January 2025, including SL2024-20 and A2024-20. Any changes to device lists or prescribed drugs effected by such instruments will alter which tests and devices are treated as compliant in subsequent enforcement actions. Practitioners must therefore keep regulatory lists up to date when assessing enforcement prospects.

In short, the Regulation is enforcement-facing in that it supplies the details enforcement actors will use to determine whether testing and statements conform to the Act. Monetary penalties remain a function of the Act and the Legislation Act penalty unit regime; the Regulation supplies the operational criteria enforcement officers and courts will apply.

The Regulation is explicitly drafted as an implementation instrument for the Road Transport (Alcohol and Drugs) Act 1977. Its headings make cross-references to specific Act provisions it serves. The Regulation also cross-references other subordinate instruments and statutes for defined terms. The legal interaction operates on a definition and evidentiary axis.

Direct interaction with the parent Act:

• Each prescribing provision has a heading linking it to the Act’s definition it supports: the alcohol screening device provision refers to Act, s 7; the breath analysis instrument provision refers to Act, s 7A; the drug screening device provision to Act, s 7B; the oral fluid analysis instrument provision to Act, s 7C (ss 2-3B). The breath and oral-fluid statement provisions refer to Act, s 12(5) and s 13E(6) respectively (s 4; s 5). The sampling facility provision uses the Act’s dictionary concept (s 6). Thus the Regulation functions as a subordinate-definition instrument: it fills out the Act’s definitional text with specific device lists and documentary particulars.

Cross-references to other statutory instruments:

• The sampling-facility definition refers to the Road Transport (Vehicle Registration) Regulation 2000 and Road Transport (General) Act 1999 for the defined meanings of “bus”, “police vehicle”, “truck” and “trailer” (s 6(2)). It refers to the Crimes Act 1900, s 185, for the meaning of “police station” (s 6(2)). These cross-references mean that the Regulation’s scope depends on the definitions in other legal instruments. Changes to those instruments could affect which physical locations or vehicles qualify as sampling facilities.

Interaction with Legislation Act 2001:

• The republication notes editorial changes made under the Legislation Act 2001, part 11.3, and cites Legislation Act ss 115 and 117 in relation to editorial amendments (About this republication). The Regulation’s present text therefore incorporates both substantive amendments and authorised editorial adjustments made to maintain drafting practice. Practitioners should note that editorial changes have effect as if made by an Act commencing on the republication date (per the Legislation Act references in the republication notes).

Operational interface with evidentiary law and criminal procedure:

• The schedules prescribe particulars to be included in statements required by the Act. Those statements are instruments of administrative evidence. The Regulation therefore interacts with rules of evidence and procedure in courts and tribunals, because the statutory statement forms and their completeness will be relevant to admissibility and weight in prosecutions for driving offences under the Act. While the Regulation does not purport to displace evidentiary rules, it creates statutory documentary expectations that lawyers and courts will consider in practice.

Interaction with procurement, standards and technical regulation:

• The device prescriptions tie statutory compliance to particular manufacturers’ models. That interacts practically with procurement law and technical safety standards. If the Regulation lists only specific models, agencies must procure those listed models or ensure their devices are functionally equivalent and listed via amendment. The Regulation does not itself set technical performance standards; it does, however, lock the statutory definitions to named models.

Amendment pathway and legislative layering:

• The legislation history shows multiple amendments by Acts and subordinate instruments across 2000-2024, including major changes implemented by the Road Safety Legislation Amendment Act 2024 and SL2024-20. The Regulation therefore sits in a layered legislative environment; changes in higher-level Acts or in other subordinate instruments (for example, definitions in vehicle-registration regulations) will affect the Regulation’s practical scope.

In summary, the Regulation is not standalone. Its legal operation is integrally linked to the parent Act’s definitions and procedural sections, the vehicle and criminal statutes that define certain terms, and the Legislation Act provisions that govern republication and editorial amendment. Practitioners must read the Regulation in that statutory context to determine legal effect.

The Regulation’s text, schedules and definitions have been amended repeatedly since its original making in 2000. The endnotes provide a detailed chronology of legislative and subordinate-instrument changes. The republication available is effective 1 January 2025 and incorporates amendments to that date. Below are the key milestones recorded in the legislation history and the amendment history within the republished law.

Original making and early activity:

• The Road Transport (Alcohol and Drugs) Regulation 2000 was notified 29 February 2000 and commenced in its initial form on 1 March 2000 for most provisions (legislation history). The Regulation was originally called the Road Transport (Alcohol and Drugs) Regulations 2000 and was renamed under the Legislation Act 2001.

Major amendment waves:

• The Road Transport Legislation Amendment Act 2001 (A2001-27) amended the Regulation and commenced on 24 May 2001 for named sections and 24 May 2001 for schedule 4 (legislation history).
• The Legislation (Consequential Amendments) Act 2001 (A2001-44) and the Statute Law Amendment Act 2003 (A2003-41) made further changes, with commencement dates in 2001 and 2003 respectively (legislation history).

Device- and testing-related amendments:

• The Road Transport (Alcohol and Drugs) Legislation Amendment Act 2010 (A2010-47) inserted significant changes, including detailed schedules and device lists that were consolidated into the regulation, with a formal commencement of the schedule on 1 December 2010 (legislation history).
• The Regulation was amended by subordinate instruments in 2011, 2012, 2013 and 2014 (SL2011-11, SL2012-35, SL2013-7, SL2013-27, SL2014-1), which adjusted device lists and schedules (amendment history).

Introduction and replacement of drug and oral-fluid instrument lists:

• Section 3A (drug screening device) was inserted by SL2011-11 and later substituted by SL2024-20 (amendment history). Section 3B (oral fluid analysis instruments) was inserted by SL2011-11 and substituted by SL2013-27 (amendment history). The effect is that the lists have been remodelled over time to reflect changing device technologies and policy decisions.

Recent amendments and the 2024 package:

• The Road Safety Legislation Amendment Act 2024 (A2024-20) made notable changes and is recorded in the legislation history. Part 3 of that Act and related amendments were notified 24 May 2024, with s 41 commencing 1 January 2025 (legislation history). The Regulation’s republication includes amendments by A2024-20 and SL2024-20. Notably, s 5A (prescribed drugs) was inserted by A2024-20 s 40 and amended by s 41, with commencement recorded in the legislation history and amendment history (amendment history).
• The Road Transport (Alcohol and Drugs) Amendment Regulation 2024 (No 1) (SL2024-20) was notified 29 August 2024 and its remainder commenced 1 January 2025 (legislation history). SL2024-20 substituted the drug screening device provision (s 3A) and made other updates to align with the 2024 Act amendments (amendment history).

Editorial and republication notes:

• The republication notes that the Parliamentary Counsel’s Office has made editorial amendments authorised by the Legislation Act 2001, part 11.3. These editorial changes do not alter substantive effect but are recorded in the republication endnotes.
• The republication history includes a sequence of republications (R1-R15) which show when the instrument was reissued or recompiled with amendments. The most recent republication number R15 is effective 1 January 2025 and incorporates amendments up to that date.

Consequences for practitioners:

• The device lists and prescribed-drug list are dynamic and have been changed by subordinate instruments and Acts. Practitioners should consult the legislation history and the current version of the Regulation on the ACT legislation register to ensure they are relying on the up-to-date lists. The republication makes clear which instruments and Acts most recently amended the Regulation, and which commencement dates applied.

In short, the Regulation has been updated repeatedly over 25 years. The most recent substantial changes are those effected by the 2024 legislative package (A2024-20 and SL2024-20), which added the prescribed-drug provision and modified device-prescription provisions. The legislative history in the republished law records each amendment, notification and commencement date for reference.

The republished Regulation and its endnotes do not contain reported case law or litigation decisions addressing the Regulation itself. The text and endnotes provided include legislation history, amendment history and republication notes, but they do not record judicial determinations interpreting the Regulation or the Act in relation to the Regulation. Therefore, within the source supplied there is no litigation history to summarise.

What the absence of recorded litigation in the republished instrument means in practice:

• The Regulation is an evidentiary and definitional instrument used by police and prosecuting authorities in implementing the Act’s testing and statement requirements. Litigation testing the Regulation’s technical prescriptions, admissibility of statements prepared under the schedules, or the status of specific devices may exist in court records, but none is reproduced or summarised in the republished law document provided here.
• Practitioners seeking precedential material on how courts have treated missing particulars in a breath-analysis statement, the admissibility of results from particular device models, or legal challenges to the prescribed-device lists will need to search case law databases and tribunal decisions. Those materials are outside the scope of the republished Regulation text which contains only legislative history and not judicial commentary.

Where the Regulation is likely to intersect with litigation:

• The Regulation’s schedules prescribe the particulars that must be included in statements required by the Act (Schedule 1 and Schedule 2). Disputes in criminal or administrative proceedings may centre on whether those particulars were recorded accurately, whether an instrument used was a prescribed model, whether a device was in override mode, whether self-tests were performed and logged, and whether chain-of-custody identifiers are present for oral-fluid samples. Such issues commonly form the factual and legal substrate of litigation under the parent Act, but again, no such cases appear in the republished instrument provided.

Recommended practical steps for lawyers looking for litigation guidance:

• Search criminal and administrative decisions under the Road Transport (Alcohol and Drugs) Act 1977 and relevant courts for rulings mentioning the schedules’ particulars, the prescribed devices named in the Regulation, or procedural defects linked to s 12(5) and s 13E(6) of the Act.
• Check whether device manufacturers, suppliers or police procedural manuals have been subjects of litigation, particularly where device reliability or calibration has been contested.

Conclusion for the legal record:

• The provided text contains no litigation history. It records only the Regulation’s legislative and amendment history. To assess how courts apply the Regulation’s prescriptions, one must examine external case law resources. The Regulation itself, as republished, supplies the normative content that such litigation would engage.

This Regulation contains several precise drafting choices that produce discrete operational hazards or traps for the unwary. These are concrete items to watch for in practice because small differences matter under the Regulation’s prescriptive scheme.

Device-model specificity. The Regulation lists device brand names and model numbers exactly. Where an instrument is not the exact model prescribed it will not satisfy the Regulation’s named definition as set out in the headings referencing the Act (s 2; s 3; s 3A; s 3B). Examples:

• “Alcolizer LE” and “Alcolizer 5 Series” are separate entries (s 2). A variant not named is not listed.
• Dräger instruments are listed with alternate spellings of the manufacturer name, e.g. “Dräger Alcotest 7110 MKV, also known as the Draeger Alcotest 7110 MKV” (s 3). Failure to match the model identification used in the Regulation could be contested in evidence-oriented disputes.

Alternate naming conventions. The Regulation sometimes gives an instrument “also known as” an alternate name (s 3; s 3A; s 3B). Practitioners must record the instrument exactly as prescribed in statements. Recording an alternate or truncated label that does not match the prescribed name may create ambiguity when assessing compliance.

Serial numbers and test numbers required. Schedules require instrument serial numbers and test numbers (Schedule 1 item 1; Schedule 2 item 1). An operator’s failure to record or to retain these identifiers may be significant for chain-of-custody and device identification purposes.

Self-tests and override mode. For breath analysis the schedule expressly requires recording whether self-tests were conducted before and after the analysis and whether the instrument was on override mode (Schedule 1 items 6-7). If an instrument was operated on override and that fact is omitted from the statement, that omission may be material. Operators must be trained in how to detect and record self-tests and override settings.

Unique sample identifying number for oral fluid. Oral-fluid analysis statements must include a unique identifier for the sample (Schedule 2 item 3). Failure to provide that unique identifier will leave a formal gap between the sample taken and the laboratory result reported.

Service number and signature of authorised operator. Both schedules require the authorised operator’s service number and signature (Schedule 1 item 5; Schedule 2 item 4). A signature without a service number, or vice versa, leaves a formal incompleteness in the compulsory particulars.

Sampling facility limitation. The Regulation restricts sampling facilities to police stations and police vehicles that are a truck, bus or trailer and are equipped for testing (s 6(1)). Testing conducted at other locations, or in other vehicle classes used by police that are not specified, may raise questions about whether the location qualifies as a sampling facility under the Act’s dictionary. Practically, that limits mobile testing options unless the police vehicle fitted for testing is of a prescribed class.

Chemical name for MDMA. The prescribed-drug list uses the chemical nomenclature “N, α-Dimethyl-3,4-(Methylenedioxy)phenylethylamine” (s 5A(c)). That formulation is technically precise but may be less recognisable in routine documents than a common name such as MDMA or “ecstasy.” Practitioners should note the exact text rather than assume colloquial names suffice.

Reliance on cross-referenced definitions. The sampling-facility provision refers to other instruments and Acts for defined terms (s 6(2)). Changes elsewhere might affect the meaning here. Checking only the Regulation without the cross-referenced definitions could lead to misapplication.

Amendment timing. Recent amendments are incorporated as of 1 January 2025 (legislation history). Practitioners must check commencement dates carefully: some changes or particular sections may have different commencement dates (legislation history records separate commencement dates for different provisions).

Document completeness as evidentiary lever. The Regulation’s schedules create a clear checklist. A missing field in a statement is an easy point for a defence challenge or for administrative criticism. That is not to assert a particular legal outcome, but to note that omissions are procedurally material given the Regulation’s explicit list.

In short, the “gotchas” are the Regulation’s precision, cross-references and narrowly drawn lists. Small differences in nomenclature, failure to record required identifers, omission of self-test or override data, and testing outside prescribed facilities are concrete pitfalls under the Regulation that have practical evidentiary consequences.

This section gives a practical, compliance-focused checklist grounded in the Regulation’s text. It is written for operational managers, police training officers, procurement officers, authorised operators and legal advisers to implement and audit practices in line with the Regulation.

Device and instrument compliance

• Inventory check. Ensure every alcohol screening device, breath-analysis instrument, drug screening device and oral-fluid analysis instrument in active service is one of the models prescribed by the Regulation. Check s 2 (alcohol screening devices), s 3 (breath analysis instruments), s 3A (drug screening devices) and s 3B (oral-fluid analysis instruments) and map each item in stock to the precise model and serial numbers.
• Procurement. When procuring new devices, procure only models that are listed in the Regulation, unless an amendment adding a new model has been made. Update procurement specifications to require conformity with the Regulation’s current lists.

Operator training and forms

• Statement template. Create or update standardised statement templates used under Act, s 12(5) and s 13E(6) to include each field required by Schedule 1 (for breath) and Schedule 2 (for oral fluid). The templates should prompt for: instrument type and serial number; test number; date, start time and location; tested person’s name and date of birth; police officer informant name; authorised operator service number and signature; self-test results and times; override status; analysis date/time; unique sample ID (for oral fluid); and result shown by the instrument.
• Training. Train authorised operators to complete every field accurately and contemporaneously. Emphasise the need to record self-test results and override status for breath devices (Schedule 1 items 6-7), and the unique sample identifying number for oral-fluid samples (Schedule 2 item 3).
• Authentication. Ensure operators sign and include their service number on each statement (Schedule 1 item 5; Schedule 2 item 4). Where digital signatures or electronic records are used, ensure they capture the equivalent of a service number and an authenticated operator identity.

Device operation and maintenance

• Self-tests. Establish procedures to run and record instrument self-tests before and after each session where the instrument is used, and log the time and the result as Schedule 1 requires. Maintain an instrument logbook linking serial numbers and test numbers to self-test records.
• Override procedures. Define clear operational rules for when override mode may be used. If override mode is used, operators must record that fact in the breath-analysis statement (Schedule 1 item 7). Ensure override is limited and subject to supervisory review.
• Calibration and maintenance. Keep manufacturer calibration and maintenance records associated with each instrument serial number. Although the Regulation does not expressly require these records, they support compliance with the Regulation’s documentary framework and are likely to be relevant in evidentiary review.

Sampling facility compliance

• Location policy. Conduct testing at prescribed sampling facilities only: police stations or police vehicles that are a truck, bus or trailer and are equipped for alcohol or drug testing (s 6(1)). Confirm whether vehicles are classified as truck, bus or trailer under the referenced instruments (s 6(2)). Document the designation of vehicles equipped for testing.
• Mobile testing. If mobile testing is needed, ensure the police vehicle used meets the Regulation’s prescribed vehicle classes and is equipped appropriately for the tests. Maintain vehicle equipment manifests showing suitability.

Sample identification and chain of custody

• Unique identifiers. For oral-fluid samples, assign and record a unique identifying number for each sample and maintain a log linking that number to the sample’s custody path and test result (Schedule 2 item 3).
• Chain-of-custody protocols. Ensure chain-of-custody steps are documented, from sample collection to laboratory analysis, and link these records to the unique sample number and the authorised operator’s statement.

Document retention and records management

• Retention policy. Maintain statements and instrument logs for retention periods appropriate for anticipated legal and administrative processes. Ensure statements include all Schedule 1 and Schedule 2 particulars to avoid record gaps.
• Audit trails. Conduct periodic audits against the Regulation’s checklist to confirm that statements consistently include the required particulars and that instruments in use match the prescribed lists.

Legal and procedural monitoring

• Monitor amendments. Regularly check the ACT legislation register for amendments to the Regulation and to the parent Act. The legislation history shows multiple amendments over time, including the 2024 changes; maintain a process to update equipment, forms and training within the commencement timelines of new amendments.
• Legal review. Where a device model not listed in the Regulation is under consideration, seek legal advice on whether it may be used, and on whether procurement should wait for an amended Regulation or seek formal prescription via legislative amendment.

Interface with prosecuting authorities

• Evidentiary completeness. Coordinate with prosecuting authorities and internal legal teams to ensure statements contain every schedule field; incompleteness is an avoidable evidentiary risk.
• Pre-charge review. Implement a pre-charge checklist that verifies the presence of Schedule 1 or Schedule 2 particulars, the prescribed device’s identity and the sample’s unique identifier for oral-fluid analysis before charges are finalised or statements are relied upon.

Practical checklist summary (minimum compliance items)

• Confirm instrument is prescribed (s 2; s 3; s 3A; s 3B).
• Record instrument type, serial number and test number (Schedule 1 item 1; Schedule 2 item 1).
• Record tested person’s name and DOB (Schedule 1 item 3; Schedule 2 item 2).
• For breath: record self-tests before and after with times and results, and specify if override mode was used (Schedule 1 items 6-7).
• Record date/time/location of test and analysis, authorised operator’s service number and signature (Schedule 1 items 2, 5, 8; Schedule 2 items 3-6).
• For oral-fluid: record unique sample identifying number and retain chain-of-custody (Schedule 2 item 3).
• Conduct testing at prescribed sampling facilities only (s 6).

By implementing standardised forms, training authorised operators, tying device inventory to the Regulation’s lists, logging pre- and post-use self-tests and maintaining chain-of-custody identifiers for oral fluids, agencies will align operational practice with the Regulation’s specific prescriptions. Regular audits and legal monitoring will reduce the risk of documentary gaps that the Regulation explicitly enumerates.
