Road Traffic (Miscellaneous) Regulations 2008

This instrument is short and focused. Its principal concepts, explicitly articulated in the text, are: prescribed form, prescribed monetary amount, prescribed classes of persons, and prescribed classes of vehicles. Each concept is intended to be read in the statutory context of particular sections of the Road Traffic Act 1974, which are referenced in the Regulations.

Prescribed form (r.4; Schedule 1)

• The Regulations supply a completed template labelled “CAUTION (Penalty Enforcement Suspension)” that must be used for cautions under s.49A(3) of the Act (r.4 and Schedule 1). The template includes fields for driver identity and licence details, incident particulars, a restricted permit to drive/travel with a specified expiry and route, explicit conditions, and a warning that driving contrary to the permit or altering the form may give rise to further offences. The Schedule also records administrative points: the caution is to be entered on “Frontline IMS” and contains contact details for the Fines Enforcement Registry (Schedule 1).

Prescribed amount (r.5)

• Regulation 5 prescribes $3 000 “for the purpose of section 56(6) of the Act.” The Regulations do not restate s.56(6); they provide the numerical threshold that the Act’s subsection requires the Governor or a regulation to set.

Prescribed classes of person (r.6A)

• Regulation 6A performs two functions: it defines key terms (contractor, emergency services organisation, FES Act, FES Department) for the regulation’s purposes (r.6A(1)), and it lists classes of person to be treated as prescribed for the purposes of s.64A(4A)(a) and s.64AAA(2A)(a) of the Act (r.6A(2)). The listed classes include officers and members of defined emergency services organisations, employees of local government under Local Government Act 1995 s.5.36, contractors to the FES Department/emergency services organisations/local government, and persons acting under the direction of those persons.

Prescribed classes of motor vehicle (r.6B)

• Regulation 6B prescribes two classes of motor vehicle for s.64A(5)(e) of the Act: vehicles that are “placarded” as defined in the Dangerous Goods Safety (Explosives) Regulations 2007 reg.107(1), and vehicles transporting dangerous goods that must be placarded under the Dangerous Goods Safety (Road and Rail Transport of Non‑explosives) Regulations 2007 reg.110.

Administrative commencement and deletions (r.2 and notes)

• The Regulations set out staged commencement (Part 1 on publication; remainder upon the commencement of s.6 of the Road Traffic Amendment Act 2006) (r.2). The text also records deletions and omitted parts (for example, r.3 deleted; Parts 3 and 4 and Schedule 2 deleted) indicating that the instrument has been pared back by later amending instruments (see compilation table and editorial notes).

Conceptually, the Regulations are delegated detail rather than free-standing policy. The form and thresholds materially affect the administrative operation of statutory provisions in the Road Traffic Act, by standardising how a caution is issued, by fixing the monetary cut-off for a specified defence, and by identifying which persons and vehicles the Act treats specially for sections 64A and 64AAA.

The Regulations affect a narrow set of actors whose rights or obligations are connected to the specific Road Traffic Act sections referenced, and they influence both public officials and private individuals.

Drivers and vehicle operators

• Drivers stopped and issued a caution under s.49A(3) are directly affected because r.4 and Schedule 1 prescribe the exact form and content of that caution. The Schedule’s template sets the permitted journey (start/end by the shortest practicable route), strict time limits, and conditions; it warns that non‑compliance with the permitted time, destination or condition is an offence of unauthorised driving. The Schedule also notifies drivers that a permit will only be granted if immediate cessation of driving is impracticable or would jeopardise safety, and records that the caution will be entered on Frontline IMS. These elements affect drivers’ immediate ability to continue driving following interaction with police and shape subsequent enforcement actions.

Persons potentially relying on s.56(6)

• Regulation 5 prescribes $3 000 for the purpose of s.56(6) of the Act. That figure is material to any person seeking to rely on the defence created by s.56(6): the monetary threshold in r.5 determines whether the statutory defence is engaged. The Regulations do not rephrase s.56(6) but set the numerical parameter the Act requires.

Emergency services personnel, local government employees, contractors and those acting under direction (r.6A)

• Regulation 6A prescribes classes of person for s.64A(4A)(a) and s.64AAA(2A)(a) of the Act: officers and members of specified emergency services organisations; persons employed by local government under the Local Government Act 1995 s.5.36; contractors to the FES Department, emergency services organisations or local government; and persons acting under the direction of those listed. The effect is to bring those categories within the scope of s.64A and s.64AAA in the circumstances those sections set out. Consequently, employees, contractors and volunteers of the listed emergency service entities and local governments will have rights or exemptions described in the Act as applied to the prescribed classes.

Owners/operators of certain dangerous goods vehicles (r.6B)

• Regulation 6B prescribes placarded vehicles and vehicles transporting loads of dangerous goods that must be placarded under specified Dangerous Goods Safety regulations for s.64A(5)(e) purposes. Owners and operators of such vehicles are affected insofar as s.64A of the Act will treat them according to the categories set by r.6B.

Police and authorised officers

• The Regulations allocate procedural discretion to the issuing police officer. Schedule 1 expressly records that the issuing officer may grant a restricted permit only if immediate cessation of driving is impracticable or would jeopardise safety, and that the officer “will have regard to such matters as the remoteness of the location and the absence of persons (other than police personnel) who can assist and lawfully drive”. This embeds situational officer discretion into the mechanism that permits restricted driving while a licence suspension order applies.

Administrative bodies and registries

• The Schedule directs drivers with licence suspension orders about the Fines Enforcement Registry contact and requires entry of the caution into “Frontline IMS”, affecting administrative records, case management and enforcement workflow for police and enforcement registries.

Regulatory and contractual relationships

• The definition of “contractor” in r.6A(1) includes persons engaged under a contract for services and their employees, thereby bringing contractual relationships within the practical operation of the Act’s sections where these classes are prescribed. That affects employers, prime contractors and subcontractors engaged by emergency services organisations, by making clear which persons are treated as contractors for s.64A and s.64AAA purposes.

Overall, the Regulations affect: individuals stopped by police for unauthorised driving and those who may seek to rely on prescribed defences; emergency services personnel, local government employees and contractors; operators of placarded dangerous goods vehicles; police officers exercising discretion under s.49A(3); and administrative agencies handling enforcement records. The instrument’s reach is therefore narrow but operationally important in specific enforcement and emergency-response contexts.

The Regulations do not themselves create a broad set of new obligations; they supply prescribed particulars that determine the application of duties and rights under the Road Traffic Act 1974. The following duties and rights flow from the instrument as written.

Duty to use the prescribed caution form where s.49A(3) applies

• Regulation 4 prescribes the Schedule 1 form “under section 49A(3) of the Act”. The effect is that where the Act contemplates a caution under s.49A(3), the issuing officer should use the prescribed form. The Schedule structures what information must be recorded (driver details, licence details, vehicle, station and officer details, licence suspension details, restricted permit particulars) and what warnings and conditions must be communicated.

Officer discretion when granting a restricted permit

• Schedule 1 embeds a duty on the issuing officer to assess whether to grant a restricted permit. The form states that “A permit will be granted only if it appears to the apprehending officer that to immediately cease driving would be impracticable or may jeopardise the safety of any person.” It also directs the officer to have regard to factors such as remoteness and absence of persons able to assist and lawfully drive. These directions constrain and guide the exercise of discretion, but leave substantive decision-making with the officer. The officer’s decision, recorded in the form, determines whether an individual is authorised to continue driving temporarily despite licence suspension orders.

Driver obligations when a restricted permit is granted

• The Schedule explicitly conditions any restricted permit: driving/travel is authorised only until the specified time and only for the specified journey “by shortest practicable route.” It warns that driving contrary to specified time, destination or condition will “result in an offence of unauthorised driving”. The Schedule also warns that altering details on the form (except by the issuing officer) “may amount to committing further offences.” These provisions create immediate obligations for a driver who is issued the caution and permit.

Right to rely on the monetary threshold in s.56(6)

• Regulation 5 prescribes $3 000 “for the purpose of section 56(6) of the Act.” While the Regulations do not restate the content of s.56(6), setting the amount is a regulatory act that determines when the Act’s subsection is engaged. Persons interacting with s.56(6) (for example, alleged failures to report damage) have a right to the statutory regime as parameterised by the $3 000 amount.

Classes of person and vehicle treated as prescribed for ss.64A and 64AAA

• Regulation 6A(2) prescribes classes of person for the purposes of sections 64A(4A)(a) and 64AAA(2A)(a) of the Act, including officers/members of emergency services organisations, local government employees under the Local Government Act 1995 s.5.36, contractors to the FES Department/emergency services organisations/local governments, and persons acting under direction. Regulation 6B prescribes two classes of motor vehicle for s.64A(5)(e). The Regulations thus create the right for those persons and vehicles to be treated under the specific provisions of ss.64A and 64AAA where the Act confers particular privileges, immunities or defences on prescribed classes. The substantive nature of those rights will be found in the Act; the Regulations determine the composition of the prescribed classes.

Administrative recording and public notice

• The Schedule requires entry of the caution on Frontline IMS, which imposes a recordkeeping duty on the arresting or issuing agency to maintain the electronic record of the caution. The Schedule also gives notice about contacting the Fines Enforcement Registry regarding licence suspension orders, directing the driver to a specific administrative avenue.

Constraints on alteration and misuse of the prescribed form

• The Schedule’s warning that alteration or addition by anyone other than the issuing officer may constitute further offences places a legal constraint on third parties, protecting the integrity of the form and the exercise of officer decision-making.

In sum, the Regulations generate duties mainly in two realms: procedural duties for police officers in how cautions and restricted permits are issued, and compliance duties on drivers who receive them. They also fix definitional boundaries, via r.6A and r.6B,that determine who has rights or exemptions under the Act’s specific sections. The Regulations thereby shape the scope of statutory protections and obligations without altering the principal Act’s substantive criminal or civil penalties.

The Regulations themselves do not create new standalone criminal penalties or enforcement mechanisms beyond what is already contained in the Road Traffic Act 1974. Instead they prescribe administrative detail that interacts with the Act’s enforcement provisions. The following enforcement-related consequences are explicit in the Regulations:

Driving contrary to a restricted permit is an offence of unauthorised driving (Schedule 1)

• The Schedule cautions that “Driving contrary to a time, destination or condition specified on this form by the issuing officer will result in an offence of unauthorised driving.” That statement is an express linkage between non‑compliance with a Schedule 1 restricted permit and the offence of unauthorised driving under the Act (Schedule 1). The Regulations do not themselves specify the penalty quantum for that offence; the substantive offence and penalty remain contained in the parent Act.

Altering the form may amount to committing further offences (Schedule 1)

• The Schedule warns that “Any alteration, deletion or addition made to any details in this form, other than by the issuing officer, may amount to committing further offences.” The Schedule is performing two functions: preserving evidentiary integrity for enforcement and signalling that unauthorised manipulation of the instrument can have separate criminal or regulatory consequences under the Act or other laws.

Entry into enforcement records (Schedule 1)

• The form requires the caution to be entered on Frontline IMS. Entry in an enforcement information management system has enforcement and administrative consequences, including traceability, continuity of enforcement action, and a basis for decision-making on subsequent actions (for example, further charges or court proceedings). The Regulations do not articulate retention periods or disclosure rules; they simply prescribe the data capture point.

Monetary threshold for s.56(6) (r.5)

• Regulation 5 prescribes $3 000 for s.56(6) of the Act. Although the Regulations do not specify the enforcement action arising from exceeding or not exceeding that threshold, the figure is decisive in whether the statutory defence or limitation in s.56(6) applies. Enforcement consequences (criminal charges, fines, or other penalties) tied to the statutory provision will therefore be affected by the $3 000 prescription.

Officer discretion and enforcement risk (Schedule 1)

• The Schedule emphasises the issuing officer’s judgment about whether a restricted permit should be granted, including having regard to remoteness and availability of persons able to assist. That discretion is material to enforcement outcomes: the officer’s decision determines whether the driver is lawfully permitted to continue driving or becomes immediately subject to enforcement action for unauthorised driving.

Interplay with other statutory enforcement regimes

• The Schedule refers drivers to the Fines Enforcement Registry and to the Fines, Penalties and Infringement Notices Enforcement Act 1994 for resolving outstanding licence suspension orders. This cross-reference ties enforcement under the Road Traffic Act to administrative enforcement systems managed under the Fines Enforcement regime, affecting how licence suspensions are cleared and how enforcement proceeds administratively.

No penalties are specified in the Regulations themselves

• Beyond the warnings in the Schedule and the prescription of a monetary threshold, these Regulations do not set specific penalty amounts, custodial terms or administrative sanctions. The actual penalties for offences referenced (for instance unauthorised driving or altering official documents) are governed by the Road Traffic Act and other statutory instruments mentioned in the Schedule and r.6A/6B references.

Practical enforcement implication

• The Regulations assign significant operational effect to the issuing officer and to the record entry (Frontline IMS). Enforcement outcomes will therefore depend on (a) correct use of the prescribed form; (b) whether the officer grants a restricted permit; (c) accurate recording in the enforcement information system; and (d) the application of the Act’s substantive penalty provisions in the event of non‑compliance. The Regulations standardise certain enforcement inputs and thresholds but do not themselves define penalty metrics.

The Regulations are expressly drafted as delegated particulars for the Road Traffic Act 1974 and they reference multiple other statutes and subordinate instruments, creating a web of cross-references that determine practical effect.

Connection to the Road Traffic Act 1974

• The Regulations operate as subordinate detail for specific sections of the Road Traffic Act. Regulation 4 prescribes the form under s.49A(3); regulation 5 prescribes an amount for s.56(6); regulations 6A and 6B prescribe classes of person and motor vehicle for the purposes of ss.64A and 64AAA. The Regulations therefore cannot be read independently of the substantive provisions of the Act; they parameterise and implement selected Act provisions.

Cross-reference to the FES Act and emergency services legislation (r.6A)

• Regulation 6A defines “FES Act” as the Fire and Emergency Services Act 1998 and “FES Department” as the department principally assisting in its administration. It prescribes classes of person that include FES Units, SES Units and VMRS Groups “as defined in the FES Act section 3” and other entities defined in the Bush Fires Act 1954 and the Fire Brigades Act 1942. By doing so the Regulations import definitional boundaries and organisational structures from those Acts into the road traffic context, thereby aligning emergency services personnel and units under the Road Traffic Act’s prescribed classes where s.64A and s.64AAA are engaged.

Interaction with Local Government Act 1995 (r.6A)

• Regulation 6A(2)(b) prescribes as a class any person “employed by a local government under the Local Government Act 1995 section 5.36.” This links road traffic regulation treatment to employment relationships defined under the Local Government Act, ensuring local government employees identified by that employment section are within the prescribed class for the specified Road Traffic Act sections.

Cross-reference to Dangerous Goods Safety Regulations (r.6B)

• Regulation 6B prescribes classes of motor vehicle by reference to the Dangerous Goods Safety (Explosives) Regulations 2007 reg.107(1) and the Dangerous Goods Safety (Road and Rail Transport of Non‑explosives) Regulations 2007 reg.110. This means the road traffic treatment of certain vehicles depends on their classification under the Dangerous Goods Safety regulatory framework. Operators of placarded vehicles or those required to placard dangerous loads will therefore be treated as prescribed motor vehicles under s.64A(5)(e).

Interaction with Fines and Infringements enforcement (Schedule 1)

• The Schedule directs persons subject to licence suspension orders to address those orders through the Fines Enforcement Registry and cites the Fines, Penalties and Infringement Notices Enforcement Act 1994 as the enforcement context for licence suspensions. This indicates administrative interoperability: enforcement of unpaid fines and licence suspension orders under the fines enforcement regime will have immediate consequences for Road Traffic Act enforcement and the operation of the Schedule’s restricted permit.

Recordkeeping system integration (Schedule 1)

• The Schedule requires that the caution be entered on “Frontline IMS”. This links the use of the prescribed form to police information systems, creating a datum that can be accessed for cross-agency decisions (for example, later court proceedings, administrative reviews, or fines enforcement). The Regulations, therefore, do not just prescribe paper forms; they specify data capture points that interact with enforcement IT systems.

Amendment and repeal instruments (Compilation table)

• The compilation table shows the Regulations have been amended by specified instruments and that parts have been repealed (for example, various amendment regulations listed and Part 3 and Part 4 deletions). Those amending instruments and the Repeals and Amendment Regulations 2014 (Pt. 7) indicate ongoing regulatory refinement and remove earlier provisions, demonstrating operational interaction across subordinate instruments over time.

Limits on independent operation

• Because the Regulations reference other Acts and subordinate regulations for definitions and classificatory determinations, their practical application depends on the status and content of those other instruments. For instance, whether a vehicle is “placarded” will depend on compliance with the Dangerous Goods Safety regulations; whether a person is an employee under s.5.36 of the Local Government Act will depend on that Act’s definitions and employment law. The Regulations thus function as a nexus, aligning road traffic enforcement with multiple statutory regimes.

In short, these Regulations are integration points: they embed Road Traffic Act operational detail into broader legislative frameworks that govern emergency services, local government employment, dangerous goods transport and fines enforcement, and they impose recordkeeping integration with police information systems.

The compilation table and the marginal notes in the Regulation text record the instrument’s amendment chronology and the dates on which particular changes took effect. The key milestones contained in the source document are:

Initial enactment and commencement (2008)

• The Road Traffic (Miscellaneous) Regulations 2008 were gazetted on 10 June 2008 (see compilation table). Part 1 came into operation on 10 June 2008 (r.2(a)); the rest of the Regulations commenced on 30 June 2008, tying commencement to the coming into operation of s.6 of the Road Traffic Amendment Act 2006 (r.2(b)).

Novice driver penalties and early amendments (2008-2009)

• The compilation table records the Road Traffic Amendment (Novice Driver Penalties) Regulations 2008 Pt. 4 (gazetted 27 June 2008) which commenced 1 July 2008. The Regulations were subsequently amended by Road Traffic (Miscellaneous) Amendment Regulations 2009 (gazetted 24 April 2009; commenced 24 April 2009).

2011 amendments and insertion of 6A/6B (2011 and 2013)

• The Road Traffic (Miscellaneous) Amendment Regulations 2011 were gazetted 18 March 2011 and most provisions commenced 19 March 2011. Two amendment instruments in 2011 are recorded: an amendment on 18 March 2011 and a second amendment instrument (No. 2) gazetted 30 August 2011. Regulation 6A and 6B were inserted with Gazette references: r.6A inserted 30 Aug 2011 p.3513‑14 and amended 19 Feb 2013 p.996; r.6B inserted 30 Aug 2011 p.3514. The marginal notes for r.6A state the regulation was inserted on 30 Aug 2011 and amended 19 Feb 2013; r.6B was inserted 30 Aug 2011.

2012/2013 amendment and reprint

• The compilation table records an amendment instrument in 2012 (gazetted 19 Feb 2013 p.995‑6), with those changes commencing 20 Feb 2013. A Reprint 1 incorporating amendments as at 10 May 2013 is recorded in the compilation table.

Repeals and deletion of parts (2014-2015)

• The compilation table records the Road Traffic (Repeals and Amendment) Regulations 2014 Pt. 7 (gazetted 23 Dec 2014 p.4913‑38) with commencement on 27 Apr 2015. In the body of the Regulations several editorial deletion notes appear: r.3 was deleted (Gazette 23 Dec 2014 p.4934), and Parts 3 and 4 (rr.6‑11) were deleted (Gazette 23 Dec 2014 p.4934). Schedule 2 was deleted (same Gazette note). Those deletions show that the instrument has been streamlined and some provisions removed by later amending regulations.

Inserted and amended content dates (r.6A and r.6B)

• Regulation 6A includes an insertion note: “Regulation 6A inserted: Gazette 30 Aug 2011 p. 3513-14; amended: Gazette 19 Feb 2013 p. 996.” Regulation 6B includes a similar insertion note: “Regulation 6B inserted: Gazette 30 Aug 2011 p. 3514.” These marginal notes provide the explicit amendment provenance for the definitions and prescribed classes introduced in 2011 and modified in 2013.

Overall amendment character

• The amendments recorded in the compilation table and marginal notes are focused on adding, refining and removing delegated administrative content, forms, definitions, prescribed categories and deleted parts, rather than wholesale policy reform. The instrument’s amendment history shows iterative updates to definitions (for example, classes of person and vehicle) and removal of entire Parts and Schedules where no longer required, reflecting administrative housekeeping and targeted regulatory tuning over a period of 2008-2015.

For precise legislative history beyond the compilation table entries and the marginal notes, the source indicates which Gazette notices to consult for the inserted and repealed provisions; those Gazette references are included in the Regulations (see compilation table and insertion notes for r.6A and r.6B).

The Regulations text and the accompanying compilation table supplied here record no judicial decisions, reported cases or litigation that interpret these particular Regulations. The instrument itself contains no case law citations, and no litigation history is appended in the compilation notes provided.

What the source does record is the legislative amendment and repeal history (see compilation table and insertion/deletion marginal notes), but it does not document any court challenges, appeals, or judicial construction decisions. It therefore appears that any judicial interpretation relevant to the content of these Regulations would be contained in authorities that address the principal provisions of the Road Traffic Act 1974 (for example, s.49A, s.56, s.64A, s.64AAA) rather than in the Regulations alone. The Regulations function mainly as prescribed administrative detail; disputes about their operation would most likely arise in cases concerning the application of the parent Act’s offences, defences and exemptions where the Regulations determine a critical parameter (for instance, the $3 000 threshold or the composition of prescribed classes).

Implication for practitioners

• Because the Regulations do not list any litigation or case citations, users requiring judicially settled positions should consult reported decisions concerning the Road Traffic Act 1974 sections referenced in the Regulations. Any judicial consideration of the prescribed caution form, the $3 000 figure for s.56(6), or the classes prescribed under r.6A/r.6B would typically appear in decisions analysing the application of the Act’s substantive provisions in individual prosecutions or civil matters. That case law is not included in this instrument and must be sourced separately.

In short, the provided text contains no litigation history; it is a regulatory prescription and not a repository of judicial interpretation. Practitioners should therefore treat the Regulations as a statutory input to litigation rather than as itself the subject of recorded judicial rulings within this compilation.

Several operational and compliance pitfalls are embedded in the Regulations’ text and the prescribed caution form. These are concrete mechanics and not speculative assertions; they are derived from the Regulations and Schedule wording and are material to enforcement, evidentiary integrity and administrative process.

$3 000 threshold is decisive and fixed (r.5)

• Regulation 5 prescribes a single amount, $3 000, “for the purpose of section 56(6) of the Act.” If a practitioner is relying on the s.56(6) defence,or opposing its use, attention must be paid to that precise figure. The Regulations do not provide rounding rules, variations, or indexing. Because the number is fixed in subordinate legislation, it will govern any factual inquiry into whether the prescribed threshold is met or exceeded. Failure to check whether the damage amount is above or below $3 000 will be a pivotal evidentiary point in any charge or defence tied to s.56(6).

Strictness of the restricted-permit conditions (Schedule 1)

• The Schedule restricts permitted journeys to the “shortest practicable route” and sets an explicit expiry time for the permit. Driving beyond the specified destination, time or condition is expressly stated to be an offence of unauthorised driving. Officers and drivers must therefore ensure the permitted journey is captured precisely on the form; vague descriptions may create enforcement disputes later. Likewise, any deviation from the route or time window exposes the driver to an offence that the Schedule itself highlights.

Altering the form is warned against (Schedule 1)

• The Schedule warns that any alteration, deletion or addition to the form other than by the issuing officer “may amount to committing further offences.” This creates a risk where forms are held by persons other than the issuing officer, or where typographical corrections are made post‑issue. Maintaining the original, officer-signed form and the integrity of entries is important for evidentiary and enforcement reasons.

Officer discretion creates variability (Schedule 1)

• The Schedule makes clear that a restricted permit is discretionary (“A permit will be granted only if it appears to the apprehending officer that to immediately cease driving would be impracticable or may jeopardise the safety of any person.”). This leaves substantial situational discretion with the officer, who must consider factors such as remoteness and available assistance. The discretion can produce inconsistent outcomes between otherwise similar factual scenarios and creates a potential ground for challenge if a permit was refused or inappropriately granted.

Data capture and recordkeeping (Schedule 1)

• The requirement to enter the caution on Frontline IMS is an administrative imperative. Failure to enter the instrument or incorrect entry may affect later prosecutions or administrative actions under the Road Traffic Act or related enforcement regimes. Practitioners should check that Frontline IMS entries align with the completed Schedule 1 form and retain copies where necessary.

Interaction with external regulatory classifications (r.6B)

• Regulation 6B prescribes classes of motor vehicle for s.64A by reference to placarding requirements in the Dangerous Goods Safety regulations. Determinations about whether a vehicle is “placarded” will depend on compliance with those other instruments. Parties may incorrectly assume a vehicle is prescribed under r.6B without verifying placarding obligations under the Dangerous Goods regulations, which could affect claims or defences tied to s.64A.

Contractor/employee status matters (r.6A)

• Regulation 6A’s definition of “contractor” includes both persons engaged under a contract for services and persons employed or engaged by such contractors. Whether a person falls within a prescribed class for s.64A/64AAA may depend on contractual arrangements and employment status. Mischaracterising a worker’s legal relationship (employee vs contractor) could produce unexpected exposure or loss of protections.

Cross-agency dependencies (Schedule 1 and r.6A)

• The Schedule points drivers to the Fines Enforcement Registry and the Fines, Penalties and Infringement Notices Enforcement Act 1994 for resolving licence suspension orders. Effectively resolving a driver’s immediate legal status may require engagement with separate administrative regimes; failing to do so could mean a driver remains subject to suspension or further enforcement despite having a temporary permit.

Deleted provisions and historical variants (compilation notes)

• The Regulations have had parts deleted (for example, Parts 3 and 4 and Schedule 2), and r.3 is deleted. Reliance on older versions of the Regulations without checking the current consolidated text could lead to compliance errors. Practitioners should rely on the current reprint and check the compilation table for amendment dates.

No penalties stated in the instrument itself

• Because the Regulations do not specify penalty amounts or ranges, parties must go back to the Road Traffic Act and other referenced Acts to determine sanctions for breaches flagged by the Schedule (for example, unauthorised driving, altering forms). Misunderstanding which instrument sets the penalty could lead to incorrect legal advice or tactical errors.

In short, the principal “gotchas” are tied to the fixed $3 000 threshold, strict and officer‑determined conditions on restricted permits, the evidentiary and data‑entry requirements attached to the prescribed form, the necessity to verify external classifications (placarding and employment status), and the need to work across multiple administrative regimes (fines enforcement and police records). Each of these arises directly from wording in the Regulations and Schedule.

Compliance under these Regulations requires attention to form, recordkeeping, definitional boundaries and cross-agency administrative processes. The following checklist is grounded in the Regulation text and Schedule and is intended to be practical for police officers, local government and emergency services employers, contractors, drivers and legal advisers.

For police officers and issuing authorities (Schedule 1 and r.4)

• Use the Schedule 1 form where a caution under s.49A(3) of the Road Traffic Act is required. The instrument prescribes the exact layout and fields; using a different or partial form risks procedural invalidity.
• Complete all required fields accurately: driver identity, DOB, address, licence details (MDL No., issued in, expiry), vehicle registration and make/model, precise time/date stopped, location, officer name/rank/REG/station and phone, licence suspension details (start date, case number), and driver signature/time signed.
• When granting a restricted permit, record the authorised expiry time and specify the journey with explicit origin and destination and note that the route must be the “shortest practicable route.” The Schedule requires these particulars; ambiguity undermines the permit’s enforceability.
• Grant a restricted permit only if, in your assessment, immediate cessation of driving would be impracticable or may jeopardise safety, and document the factual reasons. The Schedule states the permit will be granted only in those circumstances and that the officer should have regard to remoteness and absence of persons who can lawfully assist.
• Warn the driver of the consequences specified in the Schedule: driving contrary to the permit is an offence of unauthorised driving; altering the form (other than by the issuing officer) may constitute further offences.
• Ensure the caution is entered on Frontline IMS as required by the Schedule. Maintain a copy of the completed form in the case file and verify that the Frontline IMS entry matches the paper/electronic form.

For drivers stopped while licence suspension orders apply (Schedule 1 and r.5)

• If issued with the Schedule 1 caution and a restricted permit, comply strictly with the time, destination and route conditions set out on the form. The Schedule warns that non‑compliance is an offence of unauthorised driving.
• If relying on the statutory defence in s.56(6), be aware that regulation 5 fixes the monetary amount used for that purpose at $3 000. Obtain and preserve evidence of the extent of damage or loss that would be relevant to any s.56(6) inquiry.

For emergency services organisations, local governments and contractors (r.6A)

• Review employment contracts, engagement letters and contractor arrangements to determine which persons will fall within the prescribed classes in r.6A(2). Regulation 6A(1) defines “contractor” for these purposes to include persons engaged under contracts for services and persons employed/engaged by such contractors; r.6A(2) then lists prescribed classes.
• Confirm that officers, members and volunteers of listed emergency services organisations (as defined in the FES Act s.3 and the other enumerated Acts) are properly documented so that when sections 64A and 64AAA of the Act apply, the prescribed class status is established.
• Where persons act under direction of an officer or a listed class, ensure that direction and role are documented to evidence that they fall within r.6A(2)(d) when necessary.

For operators of dangerous goods vehicles (r.6B)

• Verify placarding obligations under the Dangerous Goods Safety (Explosives) Regulations 2007 reg.107(1) and the Dangerous Goods Safety (Road and Rail Transport of Non-explosives) Regulations 2007 reg.110 to determine whether a vehicle is a “placarded vehicle” or carries a load that must be placarded. If so, that vehicle is a prescribed class under r.6B for s.64A(5)(e) purposes.
• Keep placarding documentation, certificates and manifest records readily available to demonstrate the vehicle’s status if questions arise about its treatment under s.64A of the Road Traffic Act.

Recordkeeping and cross-agency action

• Ensure that entries in Frontline IMS are timely, accurate and consistent with the Schedule 1 form. Maintain backups or local copies where organisational policy requires.
• For drivers seeking to resolve licence suspension orders, follow the Schedule’s direction to the Fines Enforcement Registry and the administrative procedures under the Fines, Penalties and Infringement Notices Enforcement Act 1994. Advise drivers about that route as part of the caution process.

Legal advice and evidentiary preparation

• When preparing a defence or prosecution linked to s.56(6), quantify damage carefully and document valuations and evidence that establish whether the $3 000 threshold in r.5 is met.
• When challenging or defending decisions about restricted permits, focus on the officer’s recorded reasons in the Schedule 1 form and the described factual matrix (remoteness, availability of other lawful drivers, immediate safety risks).
• For disputes about whether a person falls within r.6A(2) (for example, contractor status), assemble contractual documents, engagement letters, employment records and delegation or direction evidence to show the relevant relationship.

Administrative review and staff training

• Police and agencies should train authorised officers on the narrow circumstances in which a restricted permit may be granted and on completing the Schedule 1 form to ensure consistency with the Schedule’s warnings and requirements.
• Emergency services organisations, local governments and contractors should brief staff and contractors about the interface between their operational roles and the Road Traffic Act’s prescribed classes (r.6A) so that staff know when statutory protections or responsibilities may attach.

Compliance with amendments and current text

• Because the Regulations have been amended and parts deleted (see compilation table), ensure you are using the consolidated version of the Regulations current at the time of action. Do not rely on older printed copies that predate the deletion of Parts or insertion of r.6A/r.6B.

In sum, compliance requires strict form use, accurate fact-based recording of officer discretion and reasons, careful valuation where monetary thresholds matter, and attention to cross-regulatory classifications for people and vehicles. The Regulations prescribe the mechanics; correct procedural adherence and robust recordkeeping will secure compliance with their requirements.
