Road Traffic (Events on Roads) Regulations 1991

The regulations are structured around a small set of repeatable legal concepts: event categorisation, pre‑application approvals, occupier consent, statutory fees and timing, discretionary police orders, delegated operational delivery to local government, cost recovery, and criminal sanctions for specified conduct. Each of these concepts is given a clear regulatory hook.

Event categories. Applicants must describe and classify the event as category 1 to 4 (regulation 3(1)). The categories are functional: category 1 is events involving large public participation; category 2 is motor vehicle racing without large public participation; category 3 covers non‑motorized racing, athletic events and other events (excluding locality/street events) without large public participation; category 4 covers locality or street events that do not fit the other categories (regulation 3(1)). The Commissioner of Police may recategorise an event (regulation 3(2)) and either refuse the application or proceed to grant under a different category (regulation 3(2)(a)-(b)).

Pre‑application approvals. The application may not be validly lodged unless the applicant first obtains the approval of each local government whose district contains the road and, where the road is vested in the Commissioner of Main Roads, that Commissioner’s approval (regulation 4(1)). Local government and Main Roads may charge an administrative fee in exchange for granting approval (regulation 4(2)).

Occupier consent. For category 4 (street/locality events) applicants must obtain and record the consent of not less than two‑thirds of occupiers of land immediately adjacent to the road proposed to be closed (regulation 5(1)-(2); Schedule 1, Form 1, Requirement (E) and Occupier’s Consent Form). The required form for recording consent is specified in the Schedule.

Statutory fees and timeframes. Applications must be made on Schedule 1, Form 1, lodged at the nearest police station and accompanied by the category fee set in the Table (regulation 6(2)(a)-(c)(i); Table in regulation 6). Minimum lead times are set by category: 6 months for category 1, 3 months for category 2, one month for categories 3 and 4, subject to a shorter period only with the Commissioner’s agreement (regulation 7).

Police discretion and conditions. The Commissioner of Police may refuse an order if the application is procedurally defective, or if there are reasonable grounds to apprehend lack of orderliness, property damage, public nuisance, excessive obstruction, jeopardy to safety, or that the applicant is not of good character (regulation 8(1)(a)-(c)). Orders are issued in Form 2 (Schedule 1), valid only for the day and times specified (regulation 8(3)), and carry the condition that the applicant or nominated responsible person be present for the duration (regulation 8(4)). The Commissioner may adjust or refund assessed fees on making an order if the Commissioner’s categorisation differs (regulation 8(5)).

Operational delivery and cost recovery. Local governments must erect and maintain barriers, signs and other equipment to effect the road closure (regulation 9(1)), the cost of which is payable by the applicant to the local government (regulation 9(2)). Local government may waive such costs and may recover the costs as a debt in court (regulation 9(3)-(4)).

Sanctions and procedural safety. The regulations create offences for removing/interfering with barriers erected under the Act, disorderly conduct intended to disrupt an event conducted on a closed road, and incitement to commit those offences (regulation 10). The prescribed penalty is twenty penalty units (regulation 10). The Form 2 note emphasises additional operational prohibitions, including that the Order does not permit consumption of liquor in any public place during the event and that no person shall obstruct emergency vehicles during the event (Schedule 1, Form 2, NOTE (a) and (b), with cross‑reference to s 81F(1)(a) of the Road Traffic Act).

Documentation and verifiability. The Schedule provides the precise application and order forms, the occupier consent template and instructions, and a statutory warning about false or misleading information per the Road Traffic (Administration) Act 2008 (Schedule 1, Form 1, NOTE). The rules on producing the order when requested are embedded in Form 2 (Form 2(7)).

These concepts combine legal authorisation (the Commissioner’s order), administrative preconditions (approvals, occupier consents), operational delivery (local government barrier erection and signage), and enforcement (criminal offences and cost recovery). The text assigns roles and payments to named actors and creates triggers for discretionary and administrative action.

The regulations name and allocate rights, duties and costs among a narrow set of actors. The principal affected groups are applicants (individuals or bodies organising events), local governments, the Commissioner of Police, the Commissioner of Main Roads, occupiers of land adjacent to proposed street closures, participants and attendees at events, and members of the public and emergency services using the road network.

Applicants. Any person not less than 18 years of age, or a body that nominates a person of at least 18 years as directly responsible, may apply (regulation 6(1)). Applicants pay the statutory application fee at lodgement (regulation 6(2)(c)(i) and Schedule 1, Form 1 REQUIREMENT (A)). Applicants must obtain the approvals required by regulation 4 before applying (regulation 4(1) and Schedule 1, Form 1 REQUIREMENT (C)). For category 4 events applicants must obtain a record showing at least two‑thirds of occupiers adjacent to the road consent (regulation 5; Schedule 1, Form 1 REQUIREMENT (E)). The applicant, or nominated responsible person, must be present for the duration of the order (regulation 8(4)).

Local government. Local governments decide whether to grant approval for the closure of roads within their district (regulation 4(1)(a); Schedule 1, Form 1, item 20). They are responsible for erecting, maintaining and removing barriers, signs and other equipment to effect an ordered road closure (regulation 9(1)). They may charge an administrative fee for granting approval (regulation 4(2)), may require payment for barrier/sign costs from the applicant (regulation 9(2)) and may waive such costs at their discretion (regulation 9(3)). The local government’s operational role directly imposes resource costs and potential timing constraints on events.

Commissioner of Police. The Commissioner is the gatekeeper for road closure orders. The Commissioner may refuse to make an order where the application is not in accordance with the regulations (regulation 8(1)(a)), or where there are reasonable grounds to apprehend disorder, property damage, public nuisance, excessive obstruction or safety risk (regulation 8(1)(b)(i)-(iv)). The Commissioner may refuse if there are reasonable grounds to apprehend the applicant is not of good character (regulation 8(1)(c)). The Commissioner may recategorise events under regulation 3(2) and alter fees under regulation 8(5). The Commissioner also controls the time validity of the order (regulation 8(3)).

Commissioner of Main Roads. Where the road is vested in the Commissioner of Main Roads the applicant must obtain that Commissioner’s approval before lodging the application (regulation 4(1)(b); Schedule 1, Form 1, item 21). The Commissioner of Main Roads may charge an administrative fee for approval (regulation 4(2)).

Occupiers and residents. For category 4 events occupiers of land immediately adjacent to the proposed road must be canvassed; consent of not less than two‑thirds is required and must be recorded in the prescribed form (regulation 5; Schedule 1, Form 1 REQUIREMENT (E) and Occupier’s Consent Form). Adjacent occupiers therefore have an effective veto threshold and a procedural role.

Event participants, attendees and the public. Events conducted under an order will temporarily occupy public roads (regulation 8(3)). All persons are subject to the prohibition on removing or interfering with barriers, and to restrictions on disruptive behaviour at a closed road event (regulation 10). The Form 2 NOTE additionally states the order does not permit consumption of liquor in any public place and requires that emergency vehicle paths not be obstructed (Schedule 1, Form 2, NOTE).

Enforcement agencies and courts. Police and officers of local governments and Main Roads can request production of the order at the event (Form 2(7)). Local governments may recover unpaid costs by suing for a debt in a court of competent jurisdiction (regulation 9(4)). The penalty for the specified offences is twenty penalty units (regulation 10).

Third parties and suppliers. Private suppliers contracted to provide equipment or services for the event will be affected indirectly: the local government provides barriers and signage but the applicant pays; logistical coordination with local government is necessary under Schedule 1, Form 1 REQUIREMENT (D).

In short, the regulations create a multi‑party approval and operational regime where applicants carry direct costs (application fee, barrier/sign costs), local governments deliver physical closures, police exercise discretionary authorisations and safety gatekeeping, and adjacent occupiers have prescribed influence over street/locality events.

The regulations allocate explicit duties and establish rights to approve or refuse. Below are the primary duties and rights, linked to regulation numbers and Schedule material.

Duties on applicants

• Classify the event and supply that classification in the application (regulation 3(1); Schedule 1, Form 1, item 6).
• Obtain required approvals before lodging: local government approval for any road in the relevant district and Commissioner of Main Roads approval where the road is vested in Main Roads (regulation 4(1); Schedule 1, Form 1 REQUIREMENT (C)).
• For category 4 events obtain and record consent of not less than two‑thirds of occupiers immediately adjacent to the road (regulation 5(1)-(2); Schedule 1, Form 1 REQUIREMENT (E) and Occupier’s Consent Form).
• Lodge the application on Form 1 at the police station nearest the event and pay the prescribed fee on lodgement (regulation 6(2)(a)-(c)(i); Schedule 1, Form 1 REQUIREMENT (A)).
• Ensure either the applicant or the nominated responsible person (18+) is present during the event (regulation 8(4); Schedule 1, Form 1, item 19 signature and declaration).
• Arrange with the local government for supply, erection and removal of barriers and signs and payment of associated fees (Schedule 1, Form 1 REQUIREMENT (D)).
• Produce the Order on request while the event is in progress (Form 2(7)).

Rights of applicants

• To have the application considered by the Commissioner of Police, subject to procedural compliance and the Commissioner’s discretionary grounds for refusal (regulation 8(1)).
• To have the fee adjusted if the Commissioner recategorises the event , either refund of difference or requirement to pay the higher fee (regulation 8(5)).
• To seek a shorter lodgement period than the minimum where the Commissioner of Police agrees (regulation 7).

Duties of local government

• Erect, maintain and remove barriers, signs and any other equipment the local government considers reasonably necessary to effect the road closure (regulation 9(1)).
• Decide whether to grant approval for the road closure in the local government’s district (regulation 4(1)(a); Schedule 1, Form 1 item 20).
• Record and, if so chosen, collect fees or administrative charges when granting approvals (regulation 4(2)).
• Recover costs from the applicant as a debt if unpaid (regulation 9(4)), unless the local government waives those costs (regulation 9(3)).

Rights of local government

• To demand payment for administrative approvals and to charge for barriers and other closure costs (regulations 4(2) and 9(2)).
• To waive such charges at their discretion (regulation 9(3)).

Powers and duties of the Commissioner of Police

• To refuse to make an order where procedural non‑compliance exists or where reasonable grounds exist under specified safety/public order tests (regulation 8(1)).
• To recategorise events if wrongly categorised by applicant and either refuse or grant under the Commissioner’s categorisation (regulation 3(2)).
• To make orders in Form 2 and set the day and times (regulation 8(2)-(3)).
• To adjust fee outcomes by refund or requiring a top‑up when the Commissioner’s categorisation differs (regulation 8(5)).

Duties and rights of Commissioner of Main Roads

• To give approval where the road is vested in Main Roads (regulation 4(1)(b); Schedule 1, Form 1 item 21).
• To charge an administrative fee for giving approvals (regulation 4(2)).

Obligations concerning conduct, safety and documentation

• Persons must not remove or interfere with barriers, act disorderly to disrupt the event, or incite others to do so (regulation 10).
• The Order does not permit liquor consumption in any public place during the event and requires that emergency vehicles not be obstructed (Form 2, NOTE (a)-(b)).
• Information supplied in the application must not be false or misleading: the application form warns that it is an offence under the Road Traffic (Administration) Act 2008 s 36(1) to give false or misleading information to a person performing a function under a road law (Schedule 1, Form 1, NOTE).

Rights of occupiers

• Occupiers adjacent to a proposed category 4 closure are afforded a consent process; two‑thirds consent is required before the applicant may lodge (regulation 5(1)-(2), Schedule 1, Form 1 REQUIREMENT (E) and Occupier’s Consent Form).

Rights of enforcement officers

• Police officers and officers of the local government or Main Roads can require production of the Order during the event (Form 2(7)) and enforce the offences in regulation 10.

The allocation of duties and rights is concrete: applicants carry procedural, presence and payment obligations; local governments execute closures and may charge for approvals and physical works; the Commissioner of Police retains the last word on authorisation and categorisation; occupiers of immediately adjacent land have procedural influence over locality events.

The regulations prescribe a short, specific set of enforcement mechanisms: criminal liability for particular acts, administrative decision and fee adjustments by the Commissioner of Police, and civil recovery of closure costs by local government.

Criminal offences and penalties. Regulation 10 creates three narrow offences:

• removing or interfering with any barrier, sign or equipment erected under section 81D (regulation 10(a));
• acting in a disorderly manner at an event conducted on a road closed pursuant to an order with the purpose of disrupting the event (regulation 10(b)); and
• inciting others to commit either of those offences (regulation 10(c)).

The prescribed penalty for any of these offences is twenty penalty units (regulation 10). The regulations do not define the monetary value of a penalty unit; the amount of a penalty unit is established elsewhere and is not stated in the text supplied. The offences are therefore straightforward and targeted at protecting the integrity of a legally ordered road closure and the safety and conduct of events.

Production and policing of orders. Form 2, item 7 expressly states the Order must be produced upon request of a police officer, an officer of the local government, or Main Roads Western Australia. This creates an on‑the‑spot enforcement lever: authorised officers may demand the instrument be produced to confirm authority for the road closure (Schedule 1, Form 2(7)). The Form 2 NOTE further references s 81F(1)(a) of the Road Traffic Act in relation to non‑obstruction of emergency vehicles, signalling that other penal provisions in the Act interact with ordered events.

Administrative enforcement and fee remedies. The Commissioner of Police has administrative power to refuse to make an order where grounds in regulation 8(1) obtain; that power serves as a preventive enforcement mechanism. On making an order the Commissioner may adjust the applicant’s fee (refund difference or require payment of higher fee) if the Commissioner’s categorisation differs from the applicant’s original classification (regulation 8(5)). That is an administrative financial enforcement tool rather than a sanction imposed after a breach.

Cost recovery by local government. Regulation 9(2) makes the applicant liable for costs of erecting, maintaining and removing barriers, signs and other equipment. Regulation 9(4) provides that any such costs may be recovered as a debt due to the local government in a court of competent jurisdiction. This turns unpaid costs into a civil debt enforceable by legal proceedings; the local government also has discretion to waive payment (regulation 9(3)).

Cross‑reference to false information offence. The Schedule 1, Form 1 NOTE warns that under the Road Traffic (Administration) Act 2008 s 36(1) it is an offence to give information that is false or misleading in a material particular to a person performing a function under a road law. The note operates as a statutory reminder that misstatements on the application may attract separate criminal liability under the cross‑referenced Act.

Operational enforcement points. The Form 2 NOTE includes operational prohibitions: the Order does not permit liquor consumption in any public place while the event is in progress, and no person shall obstruct the free passage of emergency vehicles during the event (Schedule 1, Form 2, NOTE (a)-(b)). Those instructions are couched as notes to the Order but are enforceable by reference to the broader Act provisions (e.g. s 81F(1)(a) reference).

Enforcement architecture summary. Enforcement under the instrument mixes preventive gatekeeping (Commissioner discretion), real‑time policing (order production and on‑site policing of offences), civil debt recovery (for fees and costs owed to local governments) and cross‑referenced statutory offences for false information and obstruction to emergency services. The available punitive remedies are limited in type and scale: specified conduct attracts a fixed penalty of twenty penalty units, and unpaid costs may be recovered civilly.

The regulations operate as subordinate legislation under the Road Traffic Act 1974 (the Act) and reference provisions within that Act and another road administration statute. They establish procedural detail that works within the Act’s Part VA road closure regime and cross‑refer to enforcement provisions and offences in other statutes. The instrument therefore functions as an administrative complement to the primary Act and related road laws.

Reference to the Road Traffic Act 1974. The regulations are made under the Road Traffic Act 1974 and expressly refer to Part VA and specific sections in the Act. Regulation 9(1) identifies that a road closure ordered under Part VA of the Act must be effected by the erection and maintenance by the relevant local government of barriers and signs. Regulation 9(1) also uses the phrase "section 81D" in the heading of regulation 10 (offences) and in regulation 9(1) it references barriers erected under section 81D; while the regulations do not reproduce section 81D or other clauses of the Act, they implement procedural and operational requirements for an order made under the Act.

Cross‑references within the Road Traffic Act. Form 2 NOTE explicitly references section 81F(1)(a) of the Road Traffic Act in the context of ensuring free passage of emergency vehicles during an event. The effect is that behaviour that interferes with emergency services may engage separate penal provisions in the Act, in addition to the offences in regulation 10.

Reference to the Road Traffic (Administration) Act 2008. Schedule 1, Form 1 includes a NOTE stating that it is an offence under the Road Traffic (Administration) Act 2008 s 36(1) for a person to give information known to be false or misleading in a material particular to a person performing a function under a road law. That cross‑reference alerts applicants to criminal liability beyond the regulation for misstatements in the application process. The regulations operate in the shadow of that offence to promote truthful applications.

Administrative law and local government powers. The regulations require local government approval (regulation 4(1)(a)), vest responsibility for physical works (regulation 9(1)) and allow local governments to charge fees and recover costs (regulations 4(2), 9(2)-(4)). These provisions interact with local government governance, budgeting and debt recovery mechanisms. Local governments must exercise their existing statutory powers to contract, procure and, where necessary, bring a civil claim to recover unpaid costs.

Operational interlock with Main Roads. Where a road is vested in the Commissioner of Main Roads, the applicant must obtain Main Roads’ approval before lodging (regulation 4(1)(b)). Main Roads may charge an administrative fee (regulation 4(2)). This creates an interface between statewide road asset management (Main Roads) and localised event authorisations.

Ordering, discretion and broader criminal law. The Commissioner of Police’s discretion to refuse orders where there are reasonable grounds of public safety, nuisance or applicant character (regulation 8(1)(b)-(c)) links the regulatory ordering regime to common policing functions and standards. The regulations do not displace other criminal or public order laws; they add a targeted offence set (regulation 10) but rely on other statutory provisions (for example, s 81F) for complementary prohibitions.

Debt recovery and civil court jurisdiction. Regulation 9(4) states that costs payable to a local government may be recovered as a debt due to that local government in a court of competent jurisdiction. That provision interacts with civil procedure and local government finance law by converting unpaid closure costs into recoverable civil claims.

In sum, the regulations are procedural, and their legal effect depends on interplay with the primary Road Traffic Act 1974, the Road Traffic (Administration) Act 2008, local government legal frameworks, Main Roads’ governance and the ordinary criminal and civil law. The instrument allocates roles and references external enforcement provisions without restating their substantive content.

The compilation table in the instrument records a regular sequence of amendments since the regulations were first made in 1991. The chronology in the Schedule is the primary source for the amendment history contained in the text.

Initial enactment and early amendments. The Road Traffic (Events on Roads) Regulations 1991 were published 1 February 1991 and commenced the same day (see r 2 and Gazette citation in the compilation table). An amendment instrument followed quickly on 22 February 1991 (Amendment Regulations 1991). Later amendments were made in 1997, 1998, 2000 and 2001, with the 1997 Amendment Regulations coming into force 1 January 1998 (compilation table entries).

Reprints and continuing updates. The instrument was reprinted as at 1 February 2002 and again as at 2 February 2007, reflecting the accumulation of changes up to those dates (compilation table). Substantial periodic updating continued through the 2000s and 2010s.

Notable later amendments and modernisation. The compilation table lists a sequence of amendment instruments that updated the regulations: 2002, 2003, 2004 and 2005 amendments; two instruments in 2006 (including one recorded as Amendment Regulations (No. 2) 2006 and another 28 November 2006 entry); a consequential amendment in 2008 (Road Traffic Consequential Amendment Regulations 2008 Pt. 3); a set of repeals and amendments in 2014 with Part 6 of the Road Traffic (Repeals and Amendment) Regulations 2014 (Gazette 23 December 2014) which had a commencement date noted as 27 April 2015 for some parts (compilation table); and a steady stream of annual or near‑annual amendment regulations from 2015 through 2025 (2015, 2016, 2018, 2019, 2020, 2021, 2022, 2023, 2024 and 2025 as listed).

Recent entries and ongoing currency. The latest entries in the compilation table indicate amendments by SL 2024/87 (12 June 2024) and SL 2025/136 (23 July 2025) with associated commencement notes. The compilation table records that the version included is current to 2025 and that the work is a compilation including amendments made by other written laws. Those amending instruments are listed by citation, Gazette or SL entry and commencement date where provided.

Regulation‑level amendments recorded in the text. The regulations themselves indicate amendments in their marginal annotations. For example regulation 3 has marginal notes showing amendments in 2006, 2008 and 2016; regulation 4 shows amendment note for 23 December 2014; regulation 6 shows a sequence of amendment annotations including 2006, 2014-2025 multiple instruments; regulation 7 shows amendment note for 10 June 2008; regulation 8 shows 2008 and 2014 amendments; regulation 9 shows 2008 and 2014 amendment notes; and regulation 10 shows an amendment in 1997. Schedule 1 shows insertion in 1991 and amendments in 2014. These marginal notes record the points at which individual regulations were altered and indicate an ongoing program of technical updates to the instrument.

Practical reading of the history. The compilation table is the authoritative source for dates and amending instrument citations provided in the schedule. The table shows periodic adjustments: administrative and fee updates, changes to forms, and housekeeping changes aligning the regulations with broader amendments to the Road Traffic Act and related instruments. The Schedule does not summarise the substantive content of each amending instrument; the compilation table is a record of provenance and chronology.

For a practitioner needing to trace a specific textual change or to confirm whether a particular provision was present at a given historical date, the compilation table provides the citations and commencement dates by which the relevant amending instrument may be located and read in full.

The text supplied contains no record of judicial decisions interpreting these regulations. There are no cases cited in the Schedule, in any marginal notes, or in the forms appended to the regulations. The instrument therefore does not, within its own text, identify any litigation that has tested or clarified its provisions.

Practical implications of an absence of recorded litigation in the text. The absence of a litigation history in the compiled regulation text does not mean these rules have never been litigated; it only means that the compilation itself does not include or summarise case law. Subordinate legislation frequently receives limited direct judicial attention unless a dispute reaches a court on specific factual or legal grounds, such as the scope of police discretion, the interpretation of "reasonable ground for apprehending" under regulation 8(1), or disputes over cost recovery under regulation 9(4). Those potential lines of litigation would require searching case law databases and decisions beyond the material provided here.

Likely litigation themes if disputes arise. Based solely on the regulatory text, if judicial attention were to occur it would most plausibly focus on:

• scope of the Commissioner of Police’s discretion to refuse or recategorise an event under regulation 3(2) and regulation 8(1) , e.g. what the phrase "reasonable ground for apprehending" means in context;
• interpretation of the two‑thirds occupier consent requirement (regulation 5) and what constitutes an "occupier" or "immediately adjacent" land;
• the legal status and enforceability of conditions appearing in Form 2, including the NOTE concerning liquor consumption and emergency vehicles, and their interaction with s 81F(1)(a) of the Act;
• disputes over whether local government correctly recovered costs under regulation 9(2) and the procedural fairness of any fee waiver or non‑waiver decision; and
• challenge to administrative fee decisions by local government or Main Roads when granting approvals under regulation 4(2), or disputes about the adequacy of notice and lead times under regulation 7.

Absence of case law in the text places greater weight on careful compliance. In the absence of consolidated judicial interpretation cited in the regulation, practitioners and applicants must follow the clear textual requirements (forms, approvals, timing and occupier consent) and engage proactively with local government, Main Roads and the police to reduce the risk of discretionary refusal or later enforcement action.

If litigation arises, the primary authorities to consult would be decisions that interpret the Road Traffic Act 1974, the Road Traffic (Administration) Act 2008, and cases concerning administrative discretion, local government cost recovery and statutory forms. Those materials are not included here.

The regulations contain a number of operational traps and points where procedural non‑compliance or uncertainty can frustrate an application or expose the applicant to penalties or additional costs. Each of these "gotchas" is grounded in the text.

1. Timing requirements are rigid unless the Commissioner agrees to a shorter period (regulation 7 and Schedule 1, Form 1, REQUIREMENT (B)). Category 1 requires at least six months’ notice and category 2 three months. Late lodging without prior agreement from the Commissioner risks refusal under regulation 8(1)(a) because the application will not be made "in accordance with these regulations".

2. Pre‑application approvals are mandatory (regulation 4(1)). Applicants must obtain local government approval and, where the road is vested in Main Roads, the Commissioner of Main Roads approval before lodging. Failure to secure these approvals is a grounds for the Commissioner to decline to make an order because the application was not properly made (regulation 8(1)(a); Schedule 1, Form 1, REQUIREMENT (C)).

3. Occupier consent threshold for category 4 is a high‑bar procedural precondition (regulation 5). The applicant must obtain and record the consent of not less than two‑thirds of occupiers immediately adjacent to the proposed closure. If the occupier consent form is incomplete, out of date, or fails to meet the two‑thirds threshold, the application is defective. The occupier form and the precise meaning of "occupier" or "immediately adjacent" are not further defined, which creates room for dispute.

4. Commissioner recategorisation can change fees and conditions and create financial uncertainty (regulations 3(2) and 8(5)). The Commissioner may reclassify an event and either refund or require the payment of the difference in fees; this can produce unanticipated top‑up charges or administrative refunds depending on the Commissioner’s view of the proper category.

5. Local government carrying out physical closures does not mean the applicant controls technical standards (regulation 9(1)). The local government decides what barriers, signs and other equipment it considers "reasonably necessary", subject to regulation 9(1)(a)-(c). Applicants must arrange with the local government to supply and pay for these items; the scope and cost can therefore vary by local government and are subject to local discretion.

6. Administrative approval fees by local government and Main Roads are possible additional costs beyond the statutory application fee (regulation 4(2) and regulation 6(2)(c)(i)). Applicants should not rely on the application fee alone; they must budget for administrative fees and the barrier/sign costs recoverable by local government.

7. Presence requirement for the nominated responsible person is absolute while the order is in force (regulation 8(4)). If the responsible person is not present, the applicant is in breach of a condition of the order. The order itself is conditioned on presence, not merely recommended presence.

8. On‑site proof requirement and enforcement risk (Form 2(7)). The order must be produced upon request by police, local government or Main Roads personnel. Failure to produce the order may impede the operation of the event and expose the organisers to enforcement; it is not an optional administrative convenience.

9. Narrow but meaningful criminal offences (regulation 10). Anyone who removes or interferes with barriers, acts disorderly to disrupt the event, or incites such conduct faces criminal sanction up to twenty penalty units. These offences operate even where the removal was asserted to be an emergency or protest; the regulations do not specify defences beyond "without lawful excuse", which is fact‑sensitive and could lead to disputes.

10. Cross‑statutory false information offence (Schedule 1, Form 1, NOTE). The application form warns applicants that providing false or misleading information to a person performing a function under a road law is an offence under the Road Traffic (Administration) Act 2008 s 36(1). An apparent administrative error on the application that is deemed materially false could therefore attract separate criminal liability.

11. Liquor and emergency vehicle constraints embedded in Form 2 NOTE. The Order does not permit liquor to be consumed in any public place while the event is in progress (Schedule 1, Form 2, NOTE (a)). It also emphasises non‑obstruction of emergency vehicles (NOTE (b)), referencing s 81F(1)(a) of the Road Traffic Act. Organisers must design crowd control and site layout to protect emergency access and avoid alcohol consumption in public places even if an event has a separate liquor licence.

12. Vague standards and "reasonable ground for apprehending" (regulation 8(1)(b)-(c)). The Commissioner’s refusal tests use standard phrases open to interpretation (e.g. "may not be conducted in an orderly manner", "public nuisance", "obstruction that is too great or too prolonged", "place the safety of any person in jeopardy", and "not a person of good character"). These standards can be applied differently across events and locations, producing administrative uncertainty.

13. Fee table changes. The fee amounts are specified in the regulation (regulation 6(c)(i) and Table) and have been changed over time by the numerous amending instruments listed. Practitioners should verify the current applicable fee values at the time of lodgement since the compilation shows frequent updates.

14. Civil enforcement of unpaid costs (regulation 9(4)). Local government recovery of unpaid costs via court action can introduce additional legal costs and delay. The ability to waive fees is discretionary (regulation 9(3)), and applicants should formally secure any waiver agreement in writing.

Each of these points follows directly from the text. Practitioners and organisers should treat these as concrete compliance and operational hazards to be managed by planning, budgeting and early engagement with police, local government and Main Roads.

Below is a practical, text‑grounded compliance checklist and recommended process aligned to the regulations’ requirements. Each step cites the controlling regulation or Schedule entry.

1. Determine the event category and read regulation 3.

   • Classify the event as category 1-4 per regulation 3(1) and record the classification on Form 1 (Schedule 1, Form 1, item 6 and item 11 where relevant). Remember the Commissioner of Police may recategorise the event under regulation 3(2).

2. Engage with local government and Main Roads early (regulation 4(1)).

   • Before lodging, obtain the approval of each local government whose district contains the road (regulation 4(1)(a)) and obtain Main Roads’ approval where the road is vested in the Commissioner of Main Roads (regulation 4(1)(b)). Ask the approving bodies whether they charge an administrative fee (regulation 4(2)) and secure written evidence of approval and any fee schedule. Complete the relevant approval sections on Form 1 (Schedule 1, Form 1, items 20-21).

3. For category 4 events, secure occupier consent (regulation 5).

   • Obtain and record the consent of not less than two‑thirds of occupiers immediately adjacent to the road (regulation 5(1)-(2)). Use the Occupier’s Consent Form in Schedule 1, and attach it to the application (Schedule 1, Form 1 REQUIREMENT (E)). Confirm the total number of occupiers and consent numbers on Form 1 (item 11(a)-(c)).

4. Nominate an accountable person (regulation 6(1) and regulation 8(4)).

   • Ensure the applicant is at least 18 years old or, if the applicant is a body, nominate a person of 18+ to be directly responsible for the conduct of the event (regulation 6(1)). That person must be present for the entire time the order is in force (regulation 8(4)). Record the nominated person’s details on Form 1 (items 1-5).

5. Respect lead times and seek prior agreement if necessary (regulation 7; Schedule 1, Form 1 REQUIREMENT (B)).

   • Lodge a category 1 application no later than six months before the event, category 2 at least three months before, and categories 3 and 4 at least one month before (regulation 7). If you cannot meet the minimum period, obtain agreement in writing from the Commissioner of Police to a shorter period prior to lodging.

6. Complete Form 1 accurately and attach approvals and consents (regulation 6(2)(a)-(c)).

   • Use Schedule 1, Form 1. Provide full event details, participant estimates, route, start/finish points and previous event history (Form 1, items 6-18). Attach the local government and Main Roads approvals (regulation 6(2)(c)(ii)) and occupier consents if applicable (regulation 6(2)(c)(iii)). Be aware of the NOTE about false or misleading information (Schedule 1, Form 1, NOTE) and the cross‑reference to the Road Traffic (Administration) Act 2008 s 36(1).

7. Pay the prescribed fee on lodgement (regulation 6(2)(c)(i) and Table).

   • Pay the fee corresponding to the event’s category at lodgement (Table in regulation 6): Category 1 $235.40; Category 2 $140.80; Category 3 $93.50; Category 4 $93.50. Retain receipt details and ensure Form 1 item 23 is completed at the police station.

8. Lodge at the nearest police station (regulation 6(2)(b)).

   • Lodge the completed application and attachments at the police station nearest to the event (regulation 6(2)(b)).

9. Coordinate barrier/sign logistics and costs with local government (regulation 9 and Schedule 1, Form 1 REQUIREMENT (D)).

   • Arrange with the local government for supply, erection and removal of barriers and signs (Schedule 1, Form 1 REQUIREMENT (D) and regulation 9(1)). Budget for costs payable to local government (regulation 9(2)). Confirm whether the local government will waive costs (regulation 9(3)) and request written confirmation of any waiver. Keep documentation showing payment or waiver.

10. Prepare for the Commissioner’s possible recategorisation and fee adjustment (regulation 3(2) and regulation 8(5)).

• Anticipate that the Commissioner may recategorise the event and either refund a difference or demand a top‑up fee. Keep financial buffers and be ready to respond quickly to a fee adjustment.

11. Be ready to produce the Order at the event (Schedule 1, Form 2(7)).

• If an Order is granted, ensure a printed copy (Form 2) is available on site and can be produced on request by police, local government or Main Roads officers.

12. Comply with conditions in the Order and relevant Act provisions while the event is in force (regulation 8(3)-(4); Schedule 1, Form 2 NOTE).

• The Order will specify dates and times; the responsible person must be present for the entire period (regulation 8(3) and (4)). Note that Form 2 includes a NOTE indicating the Order does not permit liquor consumption in any public place during the event and that emergency vehicles must not be obstructed (Schedule 1, Form 2, NOTE (a)-(b)). Plan crowd control, emergency access routes and any liquor management consistent with these instructions.

13. Avoid prohibited conduct and educate staff/volunteers (regulation 10).

• Ensure staff and stewards are instructed not to remove or interfere with barriers and to manage the crowd to prevent disorderly disruption. Be aware that interference, disruptive disorderly conduct and incitement are offences (regulation 10) with a penalty of twenty penalty units.

14. Keep records and receipts for cost recovery and potential disputes (regulation 9(4)).

• Retain all approvals, consent forms, receipts for fees, invoices for barriers/signs, and correspondence with local government and police. If fees are disputed, these materials will be necessary for negotiation or court proceedings where the local government seeks to recover unpaid costs as a debt (regulation 9(4)).

15. Seek clarification from police where standards are unclear.

• If in doubt about the Commissioner’s likely assessment under regulation 8(1)(b)-(c) (orderliness, safety, public nuisance, applicant character), consult early with the local police station where the application will be lodged to reduce the risk of discretionary refusal.

This compliance checklist follows directly from the text of the regulations. It should be adapted to the particular context of the event, the local government’s procedures, and any additional statutory or licensing requirements that may apply (for example, liquor licensing or public liability insurance obligations which are outside this instrument but relevant in practice).
