49 Conditional registration (1) If a vehicle does not comply with the standards for registration and any circumstance in regulation 32(a) to (d) applies, the Secretary may register the vehicle conditionally. (2) The Secretary may refuse to register a vehicle conditionally if— (a) the vehicle does not bear an operations plate or identification plate relating to the vehicle; or (b) a certificate of approved operations has not been issued for the vehicle; or (c) the vehicle is not entered on the RAV. (3) In determining any conditions to impose on the registration of a vehicle, the Secretary must take into account the nature and extent of the vehicle's non-compliance with the standards for registration. (4) The Secretary may vary any conditions that the Secretary has imposed on the conditional registration of a vehicle. (5) The Secretary must give the registered operator of a conditionally registered vehicle written notice of the conditions and any variation of the conditions imposed under this regulation.
