#### 97 Appointment (1) The members of the Tribunal are to be appointed by the Governor‑General by written instrument for a period not exceeding 5 years. (2) The person appointed as the President must also be a Vice President or Deputy President of the Fair Work Commission. (3) The persons appointed for the purposes of paragraph 79(2)(b) must also be Vice Presidents, Deputy Presidents or Commissioners of the Fair Work Commission.
