#### 96 Constitution of Full Bench (1) If a function of the Tribunal may or must be performed by a Full Bench of the Tribunal, the Full Bench is to consist of either: (a) 3 members of the Tribunal, being the President, one dual FWC member and one industry member; or (b) 5 members of the Tribunal, being the President, 2 dual FWC members and 2 industry members. (2) The President is to determine how many and which members of the Tribunal form part of a Full Bench. (3) A decision of a majority of the members on the Full Bench prevails.
