Road Safety Council Act 2002

This Act revolves around a small set of interlocking legal constructs: the Road Safety Council (the Council), its statutory functions, membership and governance mechanics (Pt 2 provisions, see ss 4-11); the Road Trauma Trust Account (the Account) as an agency special purpose account for financing road safety measures (s 12); the Minister’s direction power to the Council about Account expenditure proposals (s 6A); and administrative and transitional rules that control appointment, tenure and the flow of money (ss 8-9, 12, 16-17). Several defined terms in s 3 and s 12(1A) import definitions from other statutes, binding the machinery of this Act to the Road Traffic (Administration) Act 2008 and related transport, policing, planning, health and school legislation for operational definitions and references.

Core statutory functions are enumerated in s 5. The Council must identify measures to improve road safety and reduce death, injury and property damage (s 5(a)); recommend to relevant bodies the actions needed to implement those measures (s 5(b)); coordinate implementation (s 5(c)); evaluate and monitor the effectiveness of measures and the safety of roads (s 5(d)-(e)); recommend to the Minister how Account funds should be spent to implement measures and facilitate the Council’s functions (s 5(f)); and make recommendations in compliance with directions under s 6A (s 5(g)). The functions combine policy development (identification and recommendation), coordination across agencies, and evaluative monitoring duties.

The Account is an agency special purpose account within the Financial Management Act 2006 framework, so it sits inside the public financial management regime and is administered by the department principally assisting the Minister (s 12(1), s 12(5)). The Account’s revenue streams are specified in s 12(2) and include modified penalties paid pursuant to visual evidence-based infringement notices for offences the regulations specify, parliamentary appropriations, donations, other statutory transfers, and investment income as determined by the Treasurer (s 12(2)(a)-(d); s 12(da) references specific Road Traffic Act provisions). The Governor may make regulations specifying which offences attract the s 12(2)(a) credit (s 12(7)), linking the Account to regulatory detail outside the Act.

Membership structure is prescriptive: 12 members appointed by the Minister under s 6(1)(a)-(l), including the chair, a road users’ representative, a person representing local government (nominated by WALGA), and multiple positions filled by nomination of other Ministers or agencies, such as the CEO under the Road Traffic (Administration) Act, the Commissioner of Police or equivalent police nominees, chief executives or officers from departments responsible for school education, public health, Main Roads, transport planning, planning and development, and the Insurance Commission, (s 6(1)-(7)). The Act differentiates public officer members from external appointees for tenure, remuneration and revocation rules (s 3, s 9, s 10).

The Minister’s powers are central: appointment power (s 6), direction power over Council recommendations about spending proposals (s 6A), tabling obligations for directions (s 6A(3)), and authority to determine application of Account money having regard to Council recommendations (s 12(6)). Administrative overlay includes requirements for minutes and annual reports (s 11(4), s 13), and statutory protections from tort liability for persons acting in good faith under the Act (s 14). Transitional provisions in ss 16-17 control revenue crediting during specified legislative transitions.

Collectively, these concepts create a hybrid body with advisory, coordinative and evaluative roles, embedded within the public finance system, with ministerial oversight of spending proposals and a funding stream partly tied to specified infringement income and appropriations.

The Act creates immediate legal roles and operational consequences for several discrete groups. First, the Council itself and its members are directly affected by the appointment, tenure and conduct provisions: twelve appointed members, including the chair, must perform the statutory functions in s 5 and are subject to procedural rules on meetings, minutes and annual reporting (ss 6, 11, 13). Public officers who are appointed as Council members have different termination mechanics from non‑public officer appointees, because public officer members cease to be members if they cease to be eligible, and the Minister may revoke their appointment but may require the requesting Minister’s concurrence if a nomination is involved (s 9(4)-(5)). Non‑public officer members have fixed-term appointments up to three years and the Minister may revoke appointments for inability to carry out duties, absence without leave from three consecutive meetings, or bankruptcy, (s 9(1)-(3).

Second, a set of Ministers, departments and statutory agencies are implicated because the Act prescribes who nominates members or is eligible to be nominated, including the Minister administering the Road Traffic (Administration) Act 2008, the Minister administering the Police Act 1892, and Ministers responsible for school education, public health, Main Roads, transport co‑ordination, planning and development, and the Insurance Commission of WA Act 1986, among others, (s 6(1)(e)-(l) and ss 6(2)-(7)). These nomination mechanics give government agencies a statutory seat at the Council table and therefore affect executive coordination in practice.

Third, agencies responsible for administering the Financial Management Act 2006 and the Auditor General Act 2006 are affected because the Account is established as an agency special purpose account and is to be administered by the department principally assisting the Minister in the administration of this Act for the purposes of those Acts, (s 12(1), s 12(5)). The Treasurer and Governor are affected institutionally: the Treasurer determines the rate at which investment income is attributed to the Account (s 12(2)(d)) and the Governor has regulation‑making power to specify offences to which the visual evidence crediting provision applies (s 12(7)).

Fourth, road users and the general public are indirectly affected through the funding and coordination of road safety measures. The Account is credited with amounts of modified penalties paid under visual evidence-based infringement notices for offences specified in the regulations (s 12(2)(a)), which ties some enforcement revenue to road safety spending. The Act therefore creates a linkage between parking, camera and other visual‑based enforcement revenue flows and the funding available to support road safety measures, subject to regulatory scope and ministerial determination of how Account money is applied (s 12(6)).

Fifth, entities and persons who receive grants or benefit from Account expenditure are affected because the allocation of funds is performed by the Minister having regard to the Council’s recommendations (s 12(6) and s 5(f)), and the Council is obliged to respond to Ministerial directions about specific spending proposals (s 6A). This means prospective recipients must engage both with the Council’s recommendation processes and with ministerial decision-making that can direct Council attention to particular proposals.

Sixth, enforcement agencies and courts are affected indirectly because the Act imports defined terms from the Road Traffic (Administration) Act 2008 (s 12(1A)) and ties the scope of receipts to types of infringement notices; the regulations under s 12(7) further shape which offences feed money into the Account. Finally, auditors and parliamentary officers are affected by reporting and tabling obligations: the Council must prepare an annual report for the Minister, and the Minister must table the report in each House within 14 sitting days (s 13), while directions given under s 6A must be laid before Parliament within 14 days (s 6A(3)), with transmittal rules where Houses are not sitting (s 15).

In short, the Act distributes roles across ministers, departments, enforcement agencies, the Treasurer and Parliament, and links certain infringement revenue streams to a statutory fund whose application is subject to ministerial determination informed by the Council.

The Act delineates a set of statutory duties, procedural obligations and limited rights for actors connected to the Council, the Account, and ministerial decision-making.

Duties of the Council. The Council has a statutory duty to identify road safety measures, recommend implementation actions to relevant bodies, coordinate implementation, and evaluate and monitor both the effectiveness of measures and the safety of roads in the State, (s 5(a)-(e)). The Council also has a duty to recommend to the Minister how Account funds should be spent to implement those measures (s 5(f)). Where the Minister issues a written direction under s 6A specifying a spending proposal, the Council must make a recommendation in compliance with that direction (s 5(g) read with s 6A). The Act imposes procedural duties: the Council must keep accurate minutes (s 11(4)) and prepare an annual report as soon as practicable after 1 July for the previous financial year (s 13(1)).

Duty to give effect to Ministerial directions. Section 6A imposes a specific duty: the Council must “give effect to” a direction by recommending that Account monies should or should not be spent in accordance with the proposal specified by the Minister, or should be spent if modified as recommended by the Council (s 6A(2)). That language compels the Council to produce a recommendation addressing the proposal; it does not, on its face, transfer final spending authority away from the Minister; rather it requires the Council to make a recommendation in a particular form.

Ministerial duties and procedural obligations. The Minister must cause a copy of any s 6A direction to be laid before each House of Parliament within 14 days after the direction is given (s 6A(3)). Section 15 supplements the tabling requirement where a House is not sitting at the relevant time, requiring the Minister to transmit the direction to the Clerk and providing that such transmittal is taken to be laying before that House (s 15(1)-(3)). The Minister is also the appointing authority for Council members (s 6(1)), determines the remuneration of non‑public officer members on the recommendation of the Public Sector Commissioner (s 10), and determines the application of Account money having regard to Council recommendations (s 12(6)). These provisions allocate decision-making rights to the Minister while preserving a consultative role for the Council.

Treasurer and Governor rights. The Treasurer has the right to determine the rate at which income attributable to investment of Account funds is to be credited to the Account (s 12(2)(d)). The Governor has the power to make regulations specifying offences to which the modified penalty crediting provision applies (s 12(7)). These allocate executive financial and regulatory discretions affecting Account revenue.

Membership and nomination rights. The Act gives specified persons and bodies the right to nominate candidates for particular seats on the Council, for example the Western Australian Local Government Association for the local government representative (s 6(1)(c)), and various Ministers for departmental or agency nominees (s 6(1)(e)-(l), and ss 6(2)-(7)). Where nomination is required, the Minister must request written nominations before making an appointment (s 8(1)); but if the Minister is the nominating person, the requirement for a nomination does not apply, though the Minister may only appoint someone who would have been eligible to be nominated (s 8(2)).

Rights of members concerning tenure and remuneration. Non‑public officer members have the right to a term of appointment up to three years as set out in their instrument of appointment, and may resign by written notice (s 9(1)). They are entitled to remuneration and allowances determined by the Minister on the Public Sector Commissioner’s recommendation (s 10). Public officer members do not have the same entitlement to remumeration under this Act because they are public officers, but they have employment rights under their public service conditions and cease to be members if no longer eligible (s 9(4)).

Liability protection. Section 14 provides persons acting in good faith in the performance or purported performance of functions under the Act with immunity from actions in tort, and relieves the Crown of vicarious liability for those actions. The provision extends to omissions and applies even where the act could have been done had the Act not existed (s 14(1)-(4)). This creates a statutory protection for persons exercising Council or administrative functions under the Act.

Report and tabling obligations. The Council must provide an annual report to the Minister, and the Minister must table it in each House within 14 sitting days of the House after receiving it (s 13(1)-(2)). The Minister must also table directions given under s 6A within 14 days (s 6A(3)). These produce parliamentary oversight rights to receive those documents within a fixed timeframe.

Administrative duties. The department principally assisting the Minister is required to administer the Account for purposes of the Financial Management Act 2006 and the Auditor General Act 2006 (s 12(5)), making the department accountable under public financial management and audit rules.

Notably, the Act does not itself prescribe criminal penalties, civil sanctions or specific enforcement mechanisms for non‑compliance by the Council with its functions other than the statutory duties stated; it establishes obligations but does not expressly specify penalties for failure to perform them. The combination of ministerial appointment and direction powers, audition-style reporting requirements, and public account administration structures are the primary enforcement levers embedded in the Act.

The Act does not create express criminal offences or pecuniary penalties for breaches of the Council’s statutory functions. It contains no schedule of sanctions for non‑performance by the Council other than the statutory mechanics of appointment, revocation and reporting. The principal enforcement and accountability mechanisms provided are institutional and administrative rather than penal.

Key enforcement and accountability mechanisms in the Act are as follows. First, appointment and revocation powers confer removal risk for individual members who fail to meet statutory conditions. The Minister may revoke the appointment of a non‑public officer member under s 9(3) if the member becomes incapable of carrying out duties, is absent without leave from three consecutive meetings of which notice has been given, or is bankrupt or subject to insolvency laws as per the Interpretation Act 1984 s 13D. The Minister may revoke the appointment of a public officer member, but where the appointment required another Minister’s nomination the revocation cannot occur unless requested by that other Minister (s 9(5)). These are internal personnel controls that enforce attendance and capacity standards through removal of office.

Second, the Act requires the Council to prepare an annual report and the Minister to table it in each House of Parliament within 14 sitting days of receipt (s 13). Parliamentary scrutiny via tabling provides an external political and transparency-based accountability mechanism. Likewise, directions given by the Minister under s 6A must be laid before both Houses within 14 days (s 6A(3)), with the supplementary transmittal mechanism in s 15 where a House is not sitting. The requirement to table directions and reports exposes Council activity and ministerial directions to parliamentary oversight and potential public scrutiny, but the Act does not create specified remedies for Parliament to compel particular conduct beyond parliamentary processes and political pressure.

Third, the Account is an agency special purpose account administered under the Financial Management Act 2006 and subject to the Auditor General Act 2006 by being administered by the relevant department (s 12(1) and s 12(5)). This embeds the Account within the state’s financial management, appropriation and audit framework, which includes statutory obligations, audit requirements, and financial controls outside this Act. Compliance with public finance law is enforceable through established mechanisms under those statutes, which may include Auditor General reporting and parliamentary estimates scrutiny. The Act itself relies on those frameworks for financial enforcement rather than creating bespoke remedies.

Fourth, the Minister’s power to give directions to the Council about specific spending proposals under s 6A is backed by the Council’s statutory obligation to “give effect to” such directions by making the required recommendation (s 6A(2)). The operative language creates a mandatory procedural duty on the Council to make a recommendation in response to a direction. The Act does not provide a penalty for failing to comply with that statutory duty, but non‑compliance would expose the Council to administrative and political consequences, and may be amenable to judicial review on public law grounds if a legal obligation is ignored; the Act itself does not provide a statutory enforcement sanction.

Fifth, section 14 grants protection from tort liability to persons acting in good faith in the performance or purported performance of functions under the Act and relieves the Crown of vicarious liability for such acts (s 14(1)-(2)). That provision reduces civil litigation risk for Council members and associated officials, effectively limiting one form of enforcement against wrongful conduct to the extent that conduct is done in good faith. The protection extends to omissions and applies even if the act could have been done irrespective of the Act’s existence (s 14(3)-(4)). This is a legal limit on civil enforcement, not an enforcement tool.

Sixth, the Act gives the Governor regulation‑making power to specify offences to which the Account’s visual evidence crediting provision applies (s 12(7)). The regulations that flow from that power determine which infringement revenue feeds the Account, and regulations breach is enforceable under the Statutory Instruments Act and the offences those regulations create, as appropriate. The Act itself does not create those enforcement instruments, but vests executive authority to determine the revenue base.

In sum, enforcement is primarily administrative and political: appointment and revocation, ministerial directions and parliamentary tabling obligations, public finance controls through the Financial Management Act and audit mechanisms, and potential public law review of administrative obligations. The Act eschews express penal measures for breaches of Council duties, and provides immunities that limit civil enforcement for good‑faith acts under the Act.

The Act is heavily cross‑referenced and operationally connected to multiple other statutes and public finance instruments. It imports definitions from the Road Traffic (Administration) Act 2008 by reference in s 12(1A) for key terms such as infringement notice (alleged offender), infringement notice (visual evidence), modified penalty, and notice requesting information, which ties the Account’s revenue rules to the enforcement architecture of the Road Traffic (Administration) Act 2008. Section 12(1A) also defines the term visual evidence‑based infringement notice by reference to that Act and certain specified circumstances. Those references mean changes to the Road Traffic (Administration) Act 2008 definitions or procedures can affect which penalties are credited to the Account under s 12(2)(a).

The Account itself is established under the Financial Management Act 2006 as an agency special purpose account (s 12(1)). Consequently, the Account is governed by public finance law, including appropriation, investment, accounting and audit obligations in the Financial Management Act 2006 and obligations under the Auditor General Act 2006, because the Account is to be administered by the department principally assisting the Minister for the purposes of those Acts (s 12(5)). The Treasurer determines the rate of investment income attributed to the Account (s 12(2)(d)), linking the Account to state treasury investment decisions.

The Governor’s regulation power under s 12(7) interacts with statutory rule‑making powers: regulations may specify the offences to which the modified penalty crediting to the Account applies. Those regulations must be read and administered alongside offences and infringement notice regimes contained in the Road Traffic Acts and any consequential amendments made by the Road Traffic Legislation Amendment (Infringement Management Reform) Act 2024, which in turn trigger transitional provisions in s 17. Section 17 explicitly deals with the impact of the 2024 amendment on crediting of prescribed penalties and on photograph‑based vehicle infringement notices, indicating that the Act anticipates interplay with amendment programs to the road traffic infringement framework.

Membership nomination cross‑references require consultation with Ministers and agencies responsible for other Acts. Section 6(1)(e)-(l) prescribes nominations by the Ministers administering the Road Traffic (Administration) Act 2008, the Police Act 1892, the School Education Act 1999, the Public Health Act 2016, the Main Roads Act 1930, the Transport Co‑ordination Act 1966, the Planning and Development Act 2005, and the Insurance Commission of Western Australia Act 1986. The qualification rules for these nominees are spelled out in ss 6(2)-(7), tying the Council composition to a broad network of departmental responsibilities and ensuring representatives with road safety-related duties under other legislation participate in the Council.

The Act also interacts with amendments and transitional instruments. Section 16 is a transitional provision related to the Road Safety Council Amendment Act 2011, adjusting credits of prescribed penalties to the Account for a specified period in 2011. Section 17 is a transitional provision for the Road Traffic Legislation Amendment (Infringement Management Reform) Act 2024, dealing with prescribed penalties and photograph‑based vehicle infringement notices and preserving former s 12(2)-(4) for specified transactions. The compilation table lists a history of amendments, indicating successive interactions with Public Sector Reform Act 2010, Road Traffic Amendment Act 2012, Public Health (Consequential Provisions) Act 2016, and other statutes, reflecting the Act’s embeddedness in ongoing legislative change processes.

Section 14’s protection from tort liability interacts with general civil liability law. It provides immunity for persons acting in good faith in performance or purported performance of functions under this Act, and relieves the Crown of liability for such acts. This provision modifies the scope for civil litigation that could otherwise arise under general tort principles.

Finally, the Act’s administrative procedures, reporting and tabling requirements interact with parliamentary standing orders and parliamentary practice regarding tabling of documents. Sections 6A(3) and 13(2) require the Minister to cause documents to be laid before each House within 14 sitting days; s 15 provides transmittal rules where a House is not sitting. Those provisions must be implemented consistent with parliamentary procedure.

In short, the Act operates as an interface statute, tying together road traffic enforcement law, public finance law, public sector governance, and sectoral departments through formal nomination and reporting links. Its efficacy and operation depend on how those interconnected statutes and instruments are configured and amended.

The Act’s compilation table records multiple formal amendments since assent in 2002. The main chronological changes and relevant mechanics are summarised below in the statutory terms recorded in the Act’s compilation notes; the section references indicated in the Act text document show where particular amendments were made.

• Road Safety Council Act 2002, No. 5 of 2002: Assent 4 June 2002; operative provisions other than s 1, s 2 and s 12(4) commenced 1 July 2002 with s 1 and s 2 commencing on assent, and s 12(4) having a separate commencement tied to the Road Traffic Amendment Act 2000 (see s 2(1)-(2) and compilation table). The original Act established the Council, Account and functions.

• Local Government Amendment Act 2004, s 13 (No. 49 of 2004): amendments commenced 1 April 2005. The Act notes s 6 was amended (see note after s 6) to change nomination mechanics relating to local government representation.

• Planning and Development (Consequential and Transitional Provisions) Act 2005, s 15 (No. 38 of 2005): commenced 9 April 2006. Amendments relevant to nomination by the planning Minister are reflected in s 6 amendments noted.

• Financial Legislation Amendment and Repeal Act 2006, Sch. 1 cl. 151 (No. 77 of 2006): amendments commenced 1 February 2007. Section 3 definition changes noted in the Act indicate modifications to defined terms followed from that amendment.

• Acts Amendment (Bankruptcy) Act 2009, s 76 (No. 18 of 2009): commenced 17 September 2009, adjusting disqualification mechanics for bankruptcy under s 9(3)(c) incorporating Interpretation Act 1984 s 13D references.

• Road Traffic Amendment (Hoons) Act 2009, Pt 3 (No. 23 of 2009): commenced 1 January 2010. The compilation shows adjustments relating to s 12(2)(da) later referencing Road Traffic Act provisions.

• Public Sector Reform Act 2010, s 89 (No. 39 of 2010): commenced 1 December 2010, with effect on remuneration and recommendation processes for non‑public members noted in s 10.

• Road Safety Council Amendment Act 2011 (No. 30 of 2011): assent 16 August 2011, substantive parts commenced 17 August 2011. This amendment inserted s 6A (Minister may give directions) and transitional provision s 16, reflecting a shift to allow the Minister to require the Council to consider specific spending proposals and the government to adjust Account crediting arrangements for 2011 (see ss 6A, 16). Section 5 was also amended to add s 5(g) requiring the Council to make recommendations in compliance with direction.

• Road Traffic Legislation Amendment Act 2012, Pt 4 Div 46 (No. 8 of 2012): the Act lists amendments that commenced 27 April 2015; s 3 was amended in 2012 per note. The amendments updated cross‑references to revamped road traffic statutes.

• Public Health (Consequential Provisions) Act 2016, s 101 and Pt 5 Div 20 (No. 19 of 2016): commenced on varying dates in 2017, reflected in s 6 nomination changes to include a public health representative (s 6(1)(h) and s 6(4) amendments).

• Road Traffic Amendment (Impounding and Confiscation of Vehicles) Act 2016, Pt 3 Div 2 (No. 51 of 2016): commenced 14 January 2017; the compilation notes changes concerning s 12 and revenue crediting references to the Road Traffic Act.

• Road Traffic Legislation Amendment (Infringement Management Reform) Act 2024, Pt 4 Div 3 (No. 15 of 2024): assent 14 May 2024, commenced 7 October 2024. This amendment modified s 12 and introduced the transitional provision s 17 to manage the transition of prescribed penalties and photograph‑based vehicle infringement notices, indicating a legislative overhaul of the infringement management and revenue crediting mechanics (see s 17).

Other specific amendments are recorded in the marginal notes of sections where applicable. For example, s 6A was inserted by the Road Safety Council Amendment Act 2011 (No. 30 of 2011 s 5) and s 15 was inserted by the same Act (No. 30 of 2011 s 7). Section 12 has been amended multiple times, with insertions of new defined terms and revenue categories such as s 12(da) which refers to particular provisions in the Road Traffic Act 1974 as updated by later road traffic amendments (s 12 notes show amendments by Nos 23 of 2009, 30 of 2011, 8 of 2012, 51 of 2016 and 15 of 2024). Section 3’s defined terms have been amended on multiple occasions (see s 3 note referencing No. 77 of 2006 and No. 8 of 2012), which affects the Act’s interpretation.

The compilation table records reprints at particular consolidation dates: Reprint 1 as at 16 April 2010, and Reprint 2 as at 17 July 2015, incorporating the listed amendments to those dates. The Act also contains transitional provisions (ss 16-17) addressing the practical treatment of penalties across amendment points to preserve equitable crediting when the revenue rules change.

Overall, the amendment history documents an accretive process: membership and nomination adjustments, clarification of definitions in line with reformed road traffic legislation, insertion of the Minister’s direction power in 2011, and a 2024 infringement management reform with transitional rules. Each change reconfigures the interplay between enforcement revenue, ministerial control and the Council’s advisory role.

The Act text and its compilation notes do not record any litigation history, and the instrument itself names no court decisions. There are no cases identified or referenced in the statute or in the compilation table included in the provided text. The Act establishes administrative duties, reporting and tabling obligations and ministerial powers, but it does not include a schedule of judicial remedies or litigation outcomes within its text.

That absence of embedded litigation references is unsurprising for a statute of this character; the Act creates institutional arrangements and cross‑statutory links rather than prescribing adjudicative processes that would generate statutory appellate rulings. Where legal challenges could arise, they would be external to the Act’s text and would typically concern standard public law grounds such as jurisdictional error, ultra vires action, procedural fairness or statutory interpretation. The Act does contain mandatory statutory duties, which in practice may be amenable to judicial review; for example, the Council’s obligation to give effect to directions under s 6A(2) and the Minister’s tabling obligations under s 6A(3) and s 13(2) create specific administrative duties that a litigant might theoretically assert in a judicial review application if the duty were breached. The Act does not itself create a private right of action for those duties, but administrative law remedies in the Supreme Court would remain a potential avenue, subject to standing, any applicable prerogative bars, and public law principles.

Section 14’s immunity from tort actions for persons acting in good faith in the performance or purported performance of functions under the Act limits a class of civil liability claims for acts done under the Act. That statutory protection would be a defence in tort litigation where applicable, and could influence the practical litigation landscape for claims arising from Council activity.

Because the statute links its financing rules to the Road Traffic (Administration) Act 2008 definitions and to regulations under s 12(7), litigation concerning which offences feed the Account, or whether a particular payment should have been credited to the Account during a transitional phase, would depend on the content of those cross‑referenced statutes and regulations and not on the Road Safety Council Act’s text in isolation. Transitional provisions in ss 16-17 explicitly preserve former crediting rules for specified periods, which may reduce uncertainty and litigation risk during legislative changeover.

In short, the Act itself contains no recorded litigation history in the provided compilation text. Legal challenges that might implicate it would likely arise under public law principles concerning administrative obligations and the exercise of statutory discretions, or under disputes shaped by the cross‑referenced road traffic and financial management statutes.

The Act contains several practical traps and operational frictions for practitioners and agencies that flow from its structural choices and cross‑statutory links. These are concrete implementation and legal points that stakeholders should handle deliberately.

1. Ministerial direction plus Council duty to “give effect to” directions. Section 6A(1)-(2) permits the Minister to specify a spending proposal and requires the Council to make a recommendation in response, and s 6A(2) requires the Council to give effect to the direction by recommending for, against, or with modification. “Give effect to” is mandatory as phrased; however, the statute stops short of removing final spending authority from the Minister, because s 12(6) makes application of Account money a matter for the Minister having regard to Council recommendations. The operational gotcha is that the Council cannot decline to consider a ministerial proposal and must make a recommendation in the form the Minister seeks, but the Minister retains decision rights to apply funds. Practically, this concentrates procedural control in the Minister and places the Council in a reactive position when directions are issued (see s 6A and s 12(6)).

2. Funding tied to particular enforcement revenue streams. Section 12(2)(a) credits the Account with the total amount of each modified penalty paid pursuant to a visual evidence‑based infringement notice for offences specified in regulations. The Governor’s regulation power under s 12(7) determines the scope of offences. Because the crediting applies to “the total amount of each modified penalty paid” for such notices, a change to either the regulatory specification of offences or to the road traffic enforcement model can materially alter the Account’s revenue base. The transitional provisions in ss 16-17 attempt to manage change, but stakeholders must track amendments to the Road Traffic (Administration) Act 2008 and any regulations under s 12(7) closely to anticipate revenue volatility.

3. Mixed composition of public officers and external appointees with differing tenure rules. The Act makes a distinction between public officer members and non‑public officer members. Non‑public officer members have fixed terms up to three years and are entitled to remuneration under s 10, while public officer members cease to be members when they cease to be eligible and the Minister may revoke their appointment subject to nomination mechanics (s 9). Practically, this can produce turnover timing mismatches and governance continuity risks, and may complicate quorum, decision-making and institutional memory if multiple public officer members are rotated out with departmental reorganisations.

4. Limited liability protections. Section 14 provides a statutory bar to tort claims for acts done in good faith in performance or purported performance of functions under the Act, and relieves the Crown of vicarious liability (s 14(1)-(3)). That protection can be invoked by members and officials, but it does not protect against acts that are not in good faith, nor does it extinguish other legal accountability measures such as judicial review for jurisdictional error or statutory breach. Actors should be cautious not to assume blanket immunity simply because they are acting under the Act.

5. No express penalties for non‑performance of duties. The Act sets out duties for the Council and for the Minister in tabling documents, but it does not create specific penalties for failure to perform these duties. Enforcement is largely political and administrative, relying on revocation powers, public finance controls and parliamentary oversight. That design could create enforcement gaps where political or administrative incentives to enforce are weak.

6. Cross‑statutory definitional dependencies. Key terms used for revenue crediting and notice types are defined by reference to the Road Traffic (Administration) Act 2008 (s 12(1A)), meaning that any changes to that Act or its enforcement mechanisms can change the scope of what credits the Account receives. The transitional provision in s 17 shows that reform to infringement management required special savings and transition rules, but these are finite and may require frequent legislative maintenance when the enforcement landscape shifts.

7. Remuneration decision process reliant on Public Sector Commissioner recommendation. Section 10 provides that remuneration and allowances for non‑public officer members are determined by the Minister on the recommendation of the Public Sector Commissioner. Delays or disputes in that administrative process can affect recruitment and retention of non‑public members.

8. Secretary/Clerk transmission mechanism when Parliament is not sitting. Section 15 provides that where a House is not sitting the Minister may transmit s 6A directions to the Clerk and that such transmission is taken to be laying before the House. Practitioners should ensure accurate prescription of timing and record-keeping because the Act ties compliance to transmission and recordation in Minutes or Votes and Proceedings (s 15(1)-(3)).

9. Transition complexity for 2024 infringement reforms. Section 17 preserves former s 12(2), (3) and (4) in relation to prescribed penalties paid or photograph‑based notices served before commencement day for the Road Traffic Legislation Amendment (Infringement Management Reform) Act 2024 (s 17(2)-(3)). Implementing agencies should track the exact dates and definitions captured by “commencement day” in s 17(1), to avoid double-crediting or failure to credit the Account during the transition.

10. Administrative concentration of the Account. The Account is to be administered by the department principally assisting the Minister (s 12(5)), bringing financial management, audit and administrative functions under a single departmental roof. This can be efficient, but it also concentrates operational responsibility and may create single points of failure if the department’s systems are not robust.

These practical issues require active administrative attention: monitoring of regulatory changes affecting the revenue base, disciplined record-keeping for tabling and transmittal obligations, clear internal governance to manage public officer turnover, and an awareness that political and audit mechanisms are the primary levers for enforcement rather than statutory penalties.

For entities interacting with the Council, the Minister, the Account, or the enforcement regimes that feed the Account, compliance is primarily administrative and procedural. The following checklist maps statutory duties to practical steps, citing the relevant sections.

1. For Ministers and officials issuing or receiving Ministerial directions under s 6A:

   • When the Minister gives a written direction specifying a proposal for how Account money should be spent, ensure the direction is in writing and a copy is retained (s 6A(1)).
   • The Minister must cause the direction to be laid before each House of Parliament within 14 days after it is given (s 6A(3)). If a House is not sitting and will not sit within that 14 day period, transmit a copy to the Clerk of that House to be taken as laid (s 15(1)-(2)). Record the Clerk’s receipt and ensure the laying is recorded in Minutes or Votes and Proceedings on the first sitting day after receipt, per s 15(3).
   • The Council must respond in the form required by law: it must give effect to the direction by recommending whether the Account should or should not be spent in accordance with the Minister’s proposal or should be spent with modifications (s 6A(2)). Establish procedures to produce that recommendation within any expected timeframe and preserve records to demonstrate compliance.

2. For the Council and its members:

   • Maintain accurate minutes of all meetings (s 11(4)). Minutes should record attendance, motions, recommendations to the Minister, and any responses to s 6A directions.
   • Prepare and deliver the annual report to the Minister as soon as practicable after 1 July for the previous financial year (s 13(1)). Coordinate with the Minister’s office to ensure the Minister tables the report in each House within 14 sitting days of receipt (s 13(2)).
   • When a member is absent, ensure deputy arrangements comply with s 7. If a deputy is appointed, verify nomination eligibility in cases where nomination is required by s 7(2)-(3).
   • If acting under s 6A, the Council should document the basis for recommendations and any proposed modifications so the Minister can exercise s 12(6) decision-making with a clear record.

3. For departments administering the Account:

   • Administer the Account as an agency special purpose account under the Financial Management Act 2006 and for the purposes of the Auditor General Act 2006 (s 12(1) and s 12(5)). Ensure accounting, investment and audit practices comply with those Acts.
   • Record credits to the Account in accordance with s 12(2): modified penalties from applicable visual evidence‑based infringement notices (as specified by regulation), parliamentary appropriations, donations and other lawful receipts, statutory transfers referred to in s 12(da), and investment income as determined by the Treasurer (s 12(2)(a)-(d); s 12(da)).
   • Coordinate with the Treasurer’s office to apply the rate for attributing investment income to the Account, as the Treasurer determines the rate (s 12(2)(d)). Ensure investment accounting follows Treasury direction.

4. For agencies involved in infringement processing:

   • Understand which offences are specified by regulation under s 12(7) such that the total amount of modified penalties paid under visual evidence‑based infringement notices are to be credited to the Account. Ensure payment processing and ledger entries reflect the statutory requirement.
   • During transitions mandated by ss 16 and 17, follow the transitional rules meticulously. For payments or notices that fall into the transitional time windows, apply the former or amended s 12 rules as required by ss 16-17.

5. For appointing authorities and nominees:

   • When nominations are required for appointments to the Council, comply with s 8: the Minister must request written nominations and cannot make the appointment until a nomination is received. If you are a nominating body, ensure timely written nominations are provided. If the Minister is the nominating person, the nomination requirement does not apply but appointment must still meet eligibility tests (s 8(2)).
   • Check eligibility rules in s 6(2)-(7) for specific categories of nominees. For example, nominations under s 6(1)(e) must be either the CEO as defined in the Road Traffic (Administration) Act 2008 s 4, or specified officers in departments administering the Road Traffic (Authorisation to Drive) Act 2008 or the Road Traffic (Vehicles) Act 2012 (s 6(2)); similar eligibility tests apply for police, school education, public health, Main Roads, transport, planning, and Insurance Commission nominations (ss 6(3)-(7)).

6. For members (non‑public officer) regarding tenure and conduct:

   • Be aware that terms are for up to three years as specified in the instrument of appointment and resignation is by written notice to the Minister (s 9(1)). Avoid being absent from three consecutive meetings without leave, as this can trigger Ministerial revocation (s 9(3)(b)). Ensure compliance with insolvency rules as disqualification can arise under Interpretation Act 1984 s 13D (s 9(3)(c)).

7. For entities seeking funding from the Account:

   • Recognise that the Minister determines how Account money is applied having regard to Council recommendations (s 12(6)). Build engagement strategies that target the Council’s recommendation process and the Minister’s decision-making channels. If the Minister issues a direction under s 6A about a particular proposal, expect the Council to produce a recommendation in response; align submissions to address both the Council’s evaluative criteria and the Minister’s specified proposal parameters.

8. For auditors and parliamentary officers:

   • Ensure audits and reviews of the Account are performed under the Financial Management Act 2006 and Auditor General Act 2006 rules, consistent with the Account’s status as an agency special purpose account administered by the relevant department (s 12(1), s 12(5)). Track tabling deadlines and ensure the parliamentary records note tabling of directions and the Council’s annual report as required (s 6A(3), s 13(2), s 15).

9. Document retention and transparency:

   • Retain written records of Ministerial directions, Council recommendations, minutes, nominations, appointment instruments and remuneration determinations to demonstrate compliance with statutory duties and to provide an audit trail for parliamentary and public scrutiny.

10. Seek legal review for ambiguous transitions or unusual factual circumstances:

• Because the Act relies heavily on cross‑statutory definitions and transitional provisions (ss 16-17), obtain targeted legal advice where there is ambiguity as to whether a particular payment or notice falls under the former or amended regime, especially around commencement days tied to other Acts.

Compliance is thus a mix of public finance discipline, administrative procedure, record-keeping, inter‑agency coordination on nominations, and attention to tabling and transmittal obligations. Practitioners should map statutory timelines against parliamentary sittings and legislative commencement days to avoid inadvertent non‑compliance with tabling or transitional rules.
