### 30 Evidence as to analyses, &c., inadmissible in certain proceedings
> > (1) [*\[Section 30 Subsection (1) amended by No. 18 of 2005, s. 18, Applied:01 Jul 2005\]*](/view/html/inforce/2005-07-01/act-2005-018#GS18@Hpb@EN) [*\[Section 30 Subsection (1) amended by No. 18 of 2005, s. 18, Applied:01 Jul 2005\]*](/view/html/inforce/2005-07-01/act-2005-018#GS18@Hpa@EN) Except as is otherwise expressly provided in this Act the fact that a person has been convicted of an offence under [section 6](#GS6@EN) , [section 6A](#GS6A@EN) or [section 14](#GS14@EN) is not admissible as evidence in any legal proceedings that that person was, at any time, drunk, or under the influence of intoxicating liquor or a prescribed illicit drug, or incapable of driving, or of exercising effective control over, a motor vehicle.

> > (2) [*\[Section 30 Subsection (2) amended by No. 38 of 2017, s. 52, Applied:03 Dec 2018\]*](/view/html/inforce/2018-12-03/act-2017-038#GS52@Hpa@EN) Notwithstanding anything in this or any other Act where a person, on being notified under [section 13](#GS13@EN) [(6)](#GS13@Gs6@EN) that a sample of his blood has been taken for analysis, objects to the sample being analysed, no evidence as to the analysis is admissible in any legal proceedings to which he is a party.

> > (2A) [*\[Section 30 Subsection (2A) amended by No. 38 of 2017, s. 52, Applied:03 Dec 2018\]*](/view/html/inforce/2018-12-03/act-2017-038#GS52@Hpb@EN) [*\[Section 30 Subsection (2A) inserted by No. 18 of 2005, s. 18, Applied:01 Jul 2005\]*](/view/html/inforce/2005-07-01/act-2005-018#GS18@Hpc@EN) The fact that a prescribed illicit drug has been detected in a person's oral fluid or blood in accordance with this Act is not admissible as evidence in any legal proceedings against the person under the [Forensic Procedures Act 2000](/view/html/inforce/2026-04-12/act-2000-101) or in respect of an offence against [Division 3 of Part 3 of the](/view/html/inforce/2026-04-12/act-2001-094#HP3@HD3@EN) [Misuse of Drugs Act 2001](/view/html/inforce/2026-04-12/act-2001-094) , but is admissible in respect of an offence against [Part 2](/view/html/inforce/2026-04-12/act-2001-094#HP2@EN) , or [Division 4 of Part 3, of the](/view/html/inforce/2026-04-12/act-2001-094#HP3@HD4@EN) [Misuse of Drugs Act 2001](/view/html/inforce/2026-04-12/act-2001-094) and may be taken into account in consideration of an application for a search warrant under the [Search Warrants Act 1997](/view/html/inforce/2026-04-12/act-1997-034) .

> > (3) *\[Section 30 Subsection (3) amended by No. 83 of 1978, s. 6 \]*The provisions of this section have effect notwithstanding any covenant, term, condition, or provision of, or contained in any contract of insurance, and any such covenant, term, condition, or provision therein is, to the extent that the operation of this section is excluded, limited, modified, or restricted, void.

> > (4) References in this section to legal proceedings shall be construed as references to all legal proceedings, whether civil, criminal, or arbitral.
