46A Driving disqualification notice S. 46A(1) amended by No. 49/2019 s. 116(Sch. 1 item 88). (1) If the holder of an overseas licence or an unlicensed driver incurs the number of demerit points specified in subsection (2), the Secretary must— (a) serve a notice (a ***disqualification notice***) containing the prescribed particulars on the person; and (b) in accordance with section 46B, disqualify the person from driving a motor vehicle in Victoria and from obtaining a Victorian driver licence or learner permit. (2) For the purposes of subsection (1), the number of demerit points are— (a) in the case of the holder of an overseas licence or an unlicensed driver who is 22 years of age or older—12 or more demerit points within any 3 year period; and (b) in the case of the holder of an overseas licence or an unlicensed driver who is under 22 years of age— S. 46B inserted by No. 74/2013 s. 4.
