31E Persons required to provide certificate of completion of first-stage behaviour change program S. 31E(1) substituted by No. 68/2017 s. 18(2). (1) Before applying for a licence eligibility order, a person to whom this section applies must provide or cause to be provided to the Magistrates' Court— S. 31E(1)(a) amended by No. 49/2019 s. 116(Sch. 1 item 59). (a) a copy of any notice from the Secretary under section 58E relating to the offence for which the person has been disqualified; and (b) if the person is required under section 58C or 58F to complete a first‑stage behaviour change program—a certificate of completion certifying that the person has completed the first‑stage behaviour change program specified in that notice. A notice under section 58E must state the particular behaviour change program that the person is required to complete. (1A) The certificate of completion and notice from the Secretary must be provided, or caused to be provided, to the Court within 28 days before applying for the licence eligibility order. (2) This section applies to a person who has been disqualified under section 50 or 89C in respect of an offence under section 49(1) unless— (a) the person is a person to whom section 31KA applies; or S. 31E(2)(b) amended by No. 49/2019 s. 104. (b) the offence under section 49(1) is a supervising driver offence. S. 31E(3) amended by No. 68/2017 s. 18(3). (3) This section also applies to a person who has been disqualified under section 89 of the **Sentencing Act 1991** if the court on convicting or finding the person guilty of the offence made a finding under that Act that the offence was committed while the person was under the influence of alcohol or a drug, or both alcohol and a drug, which contributed to the offence. Section 28A(2) provides that a person whose driver licence or learner permit is suspended by force of section 89(4) of the **Sentencing Act 1991** is not disqualified for the purposes of this section.
