Road Management (Works and Infrastructure) Regulations 2015

The Regulations hinge on a small set of statutory concepts that determine administrative obligations and entitlements. Understanding those concepts is the first compliance step.

• Traffic impact works (regulation 5, definition). This is a high‑granularity, compound definition. It includes works on freeways, works on arterial roads that require deviation into on‑coming traffic lanes, works in operating clearways or operating bus lanes, works affecting bridges or structures, works within 20 metres either side of a children’s crossing while it is in operation (with a carve‑out where parking is permitted and works occur on that parking area), works within a road reserve near a level crossing, peak hour traffic works (regulation 7), works that close a roadway to vehicular traffic for specified continuous or aggregate durations, works that cancel or replace public transport services, works in metropolitan/regional urban areas that exceed certain duration and delay thresholds for buses or trams, works that temporarily close or relocate bus/tram stops for more than 15 minutes in urban areas, works on arterial roadways within 100 metres of signalised intersections during certain hours that close one or more through lanes, and works captured by a Ministerial declaration under regulation 9. The practical effect is that a diverse set of activities is captured by a single administrative label that triggers elevated consent/notice requirements.
• Minor works (regulation 6). The Regulations list multiple specific categories as “minor works”: aerial cable/overhead non‑road infrastructure installation, works to enable utility services to a person, repair/maintenance of street lighting, bus/tram stop infrastructure, tram tracks, various excavations (subject to area limits), access hole usage, installation/repair of traffic control devices under the Road Safety Act 1986, pole repair or limited replacement, vegetation pruning or removals under other Acts, and works for testing, inspection or survey. However, the list contains explicit exclusions: if minor works include service extension works, excavations of roadway/pathway/shoulder exceeding 8.5 square metres, decommissioning/removal of certain non‑road infrastructure over longitudinal distances above thresholds, or works affecting road‑related infrastructure, then the works cease to be minor works (regulation 6(2)). This construct creates a default exemption category with narrow triggers that pull works back into the full consent regime.
• Peak hour traffic works (regulation 7). These are a subset of roadway works on arterial roads in urban areas that occur during specified weekday peak windows and meet specific lane and stoppage duration thresholds (continuous stoppages >5 minutes for single‑lane roads; >15 minutes for partial multi‑lane blockages; any stoppage when all lanes for a direction are closed). The definition is time‑ and delay‑sensitive, tying administrative intensity to both time of day and measurable traffic stoppage duration.
• Service extension works (regulation 8 and Table). These are works by a utility to extend non‑road infrastructure or enable a person to be provided a service. The Table creates area and scope thresholds that treat works crossing longitudinal distances or installing more than a set number of poles as service extension works, with different distance/pole thresholds for urban and non‑urban areas.
• Ministerial declarations (regulation 9). A relevant Minister may declare specified circumstances to be traffic impact works after consulting affected road authorities, utilities or providers of public transport or their representative bodies, and where satisfied of significant impacts. The regulation also provides that failure to comply with the consultation requirements does not, by itself, invalidate a declaration (regulation 9(1A)). Declarations may be tailored by road/class of road, area, part of area, times, and described circumstances.
• Procedural periods and notice rules (regulations 14, 20, 21). The Regulations fix the period for notice under clause 13 at 7 business days as a default (regulation 20) while allowing an extended reporting period for utilities/providers (the 14th day of the month following completion, regulation 14). The decision period under clause 17 for utilities is set to 15 business days for service extension works and 3 business days for certain traffic impact works (regulation 21). The Regulations therefore reallocate time pressure between applicants and decision makers in specified categories of works.
• Restrictions on consent conditions (regulation 18). When a coordinating road authority gives written consent under clause 16(5) of Schedule 7 to the Act, it is forbidden from imposing a set of specified classes of conditions, including aesthetic/visual amenity conditions unrelated to road infrastructure, technical specifications for non‑road infrastructure, unrelated conditions, requiring above‑ground infrastructure to be placed underground, broad environmental conditions except those tied to clause 14 matters, indemnities extending beyond a 12‑month warranty, and financial security conditions on certain classes of applicants. Those prohibitions change the bargaining space in consent negotiations.
• Fees and fee units (regulation 22 and Schedule 1; Endnotes). The Regulations set fees for application types by reference to fee units. The Schedule distinguishes works conducted on roadway/pathway/shoulder from works not so conducted, and different road classifications (freeway, arterial, municipal/non‑arterial with speed limit thresholds) yield differing fee unit charges. The Regulations allow coordinating authorities to waive fees (regulation 22(2)). The endnotes supply fee unit dollar values for specified financial years and explain the Monetary Units Act mechanism for future values.

These concepts together determine whether an applicant must apply, what supporting particulars are required (regulation 19 links to Schedule 7 clause 8 and clause 10 consultation/notice particulars), what timeframes apply, and what costs may attach. They also limit the coordinating authority’s conditioning powers and create ministerial power to add circumstances via declarations.

The Regulations identify a targeted set of actors who either benefit from exemptions or are constrained by duties, and they specify who has decision power.

• Utilities and their agents. The Regulations repeatedly address “a utility or an agent of a utility” and provide both exemptions and obligations for them. Utilities are primary regulated parties for minor works, service extension works, and the fee/notice rules. Regulation 10(2) expressly lists utilities and their agents as beneficiaries of the minor works exemption. Regulation 14 sets a bespoke notification period for utilities and providers of public transport. Regulation 21 sets decision periods specifically for applications by a utility or its agent. The Table in regulation 8(“service extension works”) is framed around works undertaken by a utility or agent.
• Providers of public transport and their agents. Providers of public transport are explicitly in the scope of many provisions. They are included in the minor works category (regulation 6 list item (c) referencing tram tracks and bus/tram stop infrastructure), in exemptions (regulation 10), in the regulation 16 exemption from clause 7 notices, and in the reg 18 constraints on conditioning. The traffic impact definition (regulation 5) includes works that delay buses and trams beyond prescribed thresholds, and works that cancel or replace bus or tram services.
• Responsible road authorities and their agents. Regulation 6 and the exemptions in Part 2 apply to responsible road authorities as both duty‑holders and beneficiaries: responsible road authorities can be the applicant for pathway works exempt under regulation 12, and are included in exemptions under regulation 10 and regulation 16 for certain activities. They are also the class of bodies that may act as “coordinating road authority” when giving consent under Schedule 7 to the Act, and therefore have both decision power and constraints under regulation 18 when they exercise that power.
• Fire authorities and water corporations. Fire Rescue Victoria, the Country Fire Authority and certain water corporations (water corporations established under s 85 of the Water Act 1989) are the beneficiaries of the specific exemption in regulation 11 for inspection or maintenance of water valves or fire hydrants that are not traffic impact works. Agents acting on their behalf are also covered.
• Infrastructure managers and works managers. Regulation 19 requires applicants to include particulars of notices given or proposed to be given to other infrastructure managers or works managers and to include consultation particulars under Schedule 7 clause 10 when the proposed works may affect non‑road infrastructure for which a different infrastructure manager is responsible. This brings other infrastructure owners and managers (for example, rail, drainage or utility managers) into the consultative/notice perimeter.
• Coordinating road authorities. These authorities decide on consents under clause 16(5) of Schedule 7 and are the bodies the Regulations both constrain (see regulation 18 prohibitions on certain conditions and regulation 22(2) power to waive fees) and empower (they may exempt applicants from clause 13 notice obligations under regulation 15). They are therefore the central decision makers whose administrative behaviour the Regulations shape.
• Applicants for consent more generally. Any person contemplating works that interact with roads, developers, contractors, surveyors, telecommunication installers, utility agents, local councils, consultants, must classify works against the Regulations’ definitions to determine whether an application under Schedule 7 to the Act is required, what particulars to include, what timing applies, and what fee may be payable.

Who pays. Applicants for consent will pay fees specified in Schedule 1 where consent is required (regulation 22(1)), unless they fall squarely within an exemption (regulations 10-13, 16, 17) or the coordinating road authority waives the fee (regulation 22(2)). Utilities and providers of public transport face both a reporting burden and potential deferred notice timing (regulation 14), while coordinating road authorities bear the decision obligation within prescribed periods (regulation 21).

Who decides. Coordinating road authorities decide on consent applications under Schedule 7 to the Act, subject to the statutory prohibitions on conditions in regulation 18. A Minister may declare additional circumstances to be traffic impact works under regulation 9. The Treasurer (through the Monetary Units Act mechanism) fixes the monetary value of fee units used in the fee schedule (Endnotes).

The Regulations allocate procedural duties and identify a limited set of statutory rights.

Duties imposed or modified by the Regulations

• Duty to obtain consent under s 63(1) of the Act (where applicable). The Regulations do not create the s 63(1) duty; rather they specify when that duty is disapplied by exemption. Regulation 10(1)(a) is the starting point for the minor works exemption; other exemptions appear at regulations 11-13, 16-17. Where no exemption applies, an applicant remains obliged to obtain written consent under s 63(1) of the Act and to follow Schedule 7 processes (see multiple cross‑references to Schedule 7 in the Regulations).
• Notice obligations under Schedule 7. The Regulations set the period for notice under clause 13(1) as 7 business days (regulation 20), but provide a special period for utilities and public transport providers to give notice of completion, namely to give notice by the 14th day of the month following completion (regulation 14). A coordinating road authority may itself exempt an applicant from the clause 13 completion notice requirement when it gives consent under clause 16(5) (regulation 15).
• Particulars in applications. Where works may affect another infrastructure manager’s non‑road infrastructure, applications must include particulars of notices given or proposed to other infrastructure managers and particulars of consultations under clause 10 of Schedule 7 (regulation 19). That duty codifies cross‑notice and consultation steps into the application content.
• Timeframes for decision. Regulation 21 prescribes the “relevant period” for clause 17 decisions for utility applications: 15 business days for service extension works, and 3 business days for works that enable service provision and are traffic impact works but not service extension works. Those timeframes place a decision deadline on the coordinating road authority in respect of those application types.

Rights and constraints the Regulations create

• Exemption rights. A person to whom a given regulation applies has the right not to obtain consent or to be exempt from notice obligations as stated. For example, a utility conducting minor works that are not traffic impact works is exempt from the s 63(1) consent requirement (regulation 10(1)(a)) and from notice of completion in many cases (regulation 10(1)(b)). Fire authorities and certain water corporations have exemption rights for valve/hydrant inspection and maintenance (regulation 11).
• Limitation on conditions imposed by coordinating authorities. Regulation 18 imposes substantive constraints on the content of consent conditions that a coordinating road authority may issue under clause 16(5) of Schedule 7 to the Act. The right for applicants or certain applicants (providers of public transport, responsible road authorities, utilities and their agents) is a statutory barrier against particular types of conditions, including financial security demands and indemnities beyond 12 months. This changes the negotiation floor for consent terms.
• Fee waiver discretion. While regulation 22(1) establishes fees for different classes of proposed works, regulation 22(2) gives coordinating road authorities a discretionary right to waive whole or part of a fee when the application and supporting documents demonstrate adequate preparatory arrangements. That discretion is a right the applicant can seek to invoke.

Operational duties left with other instruments

• Enforcement and consequences of non‑compliance with s 63(1) or Schedule 7 procedures are not described in the Regulations; those consequences sit in the Act and its Schedule 7 (which the Regulations repeatedly reference). The Regulations modify who must comply and how, but not the Act’s enforcement architecture as such.

Who decides and who pays

• Coordinating road authorities both decide consent applications and have the discretion to waive fees, but they are legally constrained when imposing conditions (regulation 18) and may exempt applicants from completion notice obligations when they grant consent (regulation 15).
• Applicants pay the fees in Schedule 1 when consent is required (regulation 22(1)), subject to an exemption or a waiver. Fee amounts are expressed in fee units and their dollar value is set under the Monetary Units Act 2004 (Endnotes).

Practical drafting duties and substantive rights appear intertwined: applicants must correctly classify works (minor, service extension, traffic impact, peak hour) to determine duties and may rely on regulation 18 to resist certain consent conditions.

The Regulations themselves do not create a separate catalogue of penalties. Their form is largely procedural and prescriptive: defining exemptions, prescribing timeframes, specifying application particulars, and fixing fees. Enforcement and penalty mechanisms are therefore derivative, tied to the obligations in the Road Management Act 2004 and Schedule 7 to that Act (both repeatedly referenced).

What the instrument states about enforcement‑adjacent mechanics

• Fees. Regulation 22(1) prescribes fees for consent applications; non‑payment or failure to submit the fee would typically affect the acceptance or processing of an application under administrative practice, and a coordinating road authority has discretion to waive fees entirely or in part under regulation 22(2). The Regulations do not themselves specify consequences for unpaid fees.
• Timeframes. The Regulations set decision periods for authorities (for example, the “relevant period” under clause 17 is specified in regulation 21 for utility applications). The instrument’s stated objective includes varying the periods in Schedule 7 within which certain notices must be given or consent is taken to have been given (regulation 1(d)). The Regulations therefore change the timing rules; whether a failure to decide within the prescribed period triggers deemed consent, an administrative remedy, or other sanctions is a matter residing in Schedule 7 and the Act rather than in the Regulations themselves.
• Conditions and prohibited requirements. Regulation 18 places mandatory limits on what a coordinating road authority may impose when granting consent. Enforcement of those prohibitions would be through statutory compliance processes under the Act and through any administrative review or legal remedies available under primary legislation or general administrative law. The Regulations do not spell out appeal or enforcement mechanisms; they define the substance of what is not permitted.
• Exemptions. The Regulations create exemptions from the s 63(1) consent requirement and notice obligations (for example, regulation 10’s minor works exemption and regulations 11-13, 16 and 17). Non‑compliance with an exemption that an applicant incorrectly claims (for example, classifying works as minor when an exclusion in regulation 6(2) applies) will leave the applicant subject to the Act’s original consent and notice obligations and any enforcement provisions in the Act.

Matters not specified in this instrument

• The Regulations do not specify fines, infringement notices or criminal offences. The instrument relies on the Act for the underpinning regulatory architecture. Any civil or criminal penalties, regulatory enforcement powers or remedies for non‑compliance with s 63(1) or Schedule 7 procedural requirements are therefore matters for the Road Management Act 2004 and are not restated in these Regulations.
• There is no express enforcement regime in the Regulations for breaches of application particulars or false statements; those matters are governed by the Act or other legislation.

Practical implications for practitioners

• Compliance risk is primarily failure to characterise works correctly (for example misidentifying an excavation that exceeds 8.5 square metres as minor work), failure to include required particulars under regulation 19, missing prescribed notice periods (regulation 20 and regulation 14), or misinterpreting the traffic impact definition (regulation 5 and regulation 7). Enforcement consequences for those failures must be traced back to the Act and any associated administrative processes referenced in Schedule 7.
• Where a coordinating road authority imposes a condition that appears to conflict with regulation 18, the Act’s remedies and any administrative review routes are the pathways for challenge; the Regulations ensure the legal basis for such a challenge exists by proscribing such conditions, but do not set out the litigation or review procedure.

In short, these Regulations shape administrative duties and substantive constraints but leave the penal and enforcement architecture to the parent statute and Schedule 7. Practitioners must therefore locate enforcement mechanisms and remedies in the Road Management Act 2004 and its Schedule 7 rather than within the Regulations.

The Regulations are expressly made under section 132 of the Road Management Act 2004 (regulation 2) and repeatedly cross‑refer to Schedule 7 of that Act. They also reference and interact with multiple other statutes and subordinate instruments. The instrument therefore functions as a subordinate rule set that modifies the operation of the parent Act and coordinates with related road and utility legislation.

Directly referenced statutes and instruments

• Road Management Act 2004 (the Act). The Regulations implement objectives tied to exemptions and procedural variations under the Act (regulation 1(a)-(f) refers to prescribing exemptions under s 63(1), notice obligations under Schedule 7, conditions under clause 16 of Schedule 7, time periods in Schedule 7, particulars for clause 16(3) and fees for applications under Schedule 7). The majority of the Regulations’ operative content is framed as clarifications, exemptions or variations to the Act’s Schedule 7 processes.
• Road Safety Road Rules 2017 and Road Safety Act 1986. Definitions in regulation 5 borrow the meanings of “bus lane”, “children’s crossing”, “clearway” and “service road” from the Road Safety Road Rules 2017. Regulation 6(1)(f) specifically refers to installation, repair or maintenance of traffic control devices carried out in accordance with the Road Safety Act 1986 or its regulations. Those cross‑references ensure consistent meaning for traffic control and road element terminology across instruments.
• Transport (Compliance and Miscellaneous) Act 1983. Regulation 5’s traffic impact works definition references section 221U of that Act for the meaning of “level crossing”, thereby connecting the traffic impact concept to rail crossing definitions in transport legislation.
• Water Act 1989. Regulation 11(2)(c) explicitly includes water corporations established under section 85 of the Water Act 1989 in the class of bodies benefiting from the fire‑related exemption for valve and hydrant work.
• Monetary Units Act 2004. Schedule 1 fees are expressed in fee units and the endnotes explain the fee unit mechanism, including the fee unit dollar values for fiscal years and the Treasurer’s role under the Monetary Units Act to set future fee unit values. Fees in Schedule 1 are therefore variable in dollar terms by reference to another statute.
• Interpretation of Legislation Act 1984 (ILA). The endnotes discuss style, headings and the legal interpretation of notes and examples under the ILA. This signals that the Regulations’ examples and notes form part of the instrument and may be used in its interpretation (Endnotes section 1).

Operational interactions and practical cross‑effects

• Schedule 7 of the Road Management Act. The Regulations repeatedly modify or supply particulars for Schedule 7 processes: exemptions to s 63(1) and clause 13 notice obligations (Part 2), particulars required by clause 16(3) (regulation 19), timing periods tied to clause 13 and clause 17 (regulations 14, 20, 21), and constraints on conditions under clause 16(5) (regulation 18). To understand legal obligations and remedies in a specific case, one must read Schedule 7 alongside these Regulations.
• Inter‑infrastructure coordination. Regulation 19 requires applicants to include particulars of notices and consultations with other infrastructure managers or works managers where proposed works may affect infrastructure for which another manager is responsible. This creates a statutory link between the road consent regime and the management regimes of other infrastructure owners and implies practical coordination obligations with, for example, rail, telecommunications or water infrastructure managers.
• Ministerial power and declarations. Regulation 9 gives a relevant Minister the power to declare circumstances to be traffic impact works after considering advice from road authorities, utilities and providers of public transport or their representative bodies. That creates a dynamic interface between executive action and the static definitions in the Regulations. Regulation 9(1A) also states that failure to comply with consultation requirements does not by itself invalidate a declaration, which affects the legal quality of such declarations when challenged.
• Road safety and traffic law consistency. By adopting defined terms from the Road Safety Road Rules 2017 and by cross‑referencing the Road Safety Act for traffic control devices, the Regulations ensure that consent and exemption decisions are aligned with traffic rules and operational traffic controls. This reduces definitional conflict between safety enforcement regimes and the consent regime under the Act.
• Local government and municipal roads. Schedule 1 tiers fees by road class, notably municipal roads and non‑arterial State roads with speed thresholds, which interacts with local government road management responsibilities and finances. Responsible road authorities (including councils) are both decision makers and regulated parties in some contexts under these Regulations.

Limits of interaction within the instrument

• The Regulations do not reproduce the enforcement, sanction or appeal mechanisms found in the Act. Where enforcement or remedies are relevant, practitioners must consult the primary legislation and Schedule 7.
• The Regulations do not alter rights or obligations under other Acts except where expressly cross‑referenced. For example, vegetation removal that is “in accordance with any Act other than the Act” is treated within the minor works definition (regulation 6(1)(k)), but the substantive power to remove vegetation remains with the other Act.

In summary, the Regulations operate as subordinate, complementary rules to the Road Management Act 2004 and are further coordinated with road safety rules, the Monetary Units Act, transport legislation and water and interpretation statutes. Practitioners must read the Regulations in conjunction with Schedule 7 of the Act and the referenced statutes to produce a complete legal picture.

The Regulations were made under section 132 of the Road Management Act 2004 and commenced on 20 June 2015 (regulations 2-3). The instrument revokes earlier subordinate rules, specifically the 2005 Regulations and amendments made in 2007 and 2009 (regulation 4).

Subsequent amendments and document status

• The version provided is identified as Version No. 003, incorporating amendments as at 11 June 2025. That means the text includes changes made up to that date.
• The Table of Amendments recorded in the endnotes lists, inter alia, the Road Management (General) and (Works and Infrastructure) Amendment Regulations 2024, S.R. No. 61/2024, which were made on 25 June 2024 and whose regulations 10-12 commenced on 1 July 2024. Those amending regulations changed definitions in regulation 5 (agent, bus lane, children’s crossing, clearway, service road) and substituted regulation 9(1) with updated text and inserted regulation 9(1A). The endnotes make clear that the 2024 instrument is incorporated into this consolidated version.
• The endnotes also display the standard interpretative statements under the Interpretation of Legislation Act 1984 concerning the legal status of headings, examples, notes and punctuation, which affects the interpretative treatment of the Regulations.
• The endnotes include a sunset provision: the Road Management (Works and Infrastructure) Regulations 2015 will sunset on 14 June 2026 under Subordinate Legislation (Road Management (Works and Infrastructure) Regulations 2015) Extension Regulations 2025, S.R. No. 48/2025. That sunset date means the instrument is time‑limited unless further extended or remade.

Fee unit updates

• The endnotes supply fee unit values for particular financial years. Specifically, the value of a fee unit for the financial year commencing 1 July 2024 is $16.33 and for the financial year commencing 1 July 2025 is $16.81. The endnotes also state that future fee unit values are to be fixed by the Treasurer under the Monetary Units Act 2004 and must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year. The Schedule 1 fees are expressed in fee units and therefore vary in dollar terms in line with these adjustments.

Revocations and legacy instruments

• Regulation 4 expressly revokes the Road Management (Works and Infrastructure) Regulations 2005 and related amending instruments from 2007 and 2009. The present Regulations thus replace those earlier rules and form the operative subordinate instrument subject to the amendment history set out.

Examples of amendments incorporated into the current text

• Amendments in 2024 adjusted several definitions to mirror changes in the Road Safety Road Rules 2017 and inserted a qualification that a Minister’s failure to comply with consultation requirements does not automatically invalidate a declaration under regulation 9(1) (regulation 9(1A)). These textual changes have operational effects on the Ministerial declaration power (regulation 9) and on definitional alignment with road rules.

Practical effect of amendment history for users

• Users must pay attention to the consolidated version date (11 June 2025) and the sunset date (14 June 2026). Fee calculations must use the applicable fee unit value for the financial year, and the scope of obligations may have changed with the 2024 amendments (notably expanded definitional links to the Road Safety Road Rules 2017 and the change to regulation 9). Any historical compliance or contractual arrangements that relied on earlier versions should be rechecked against the consolidated text to identify material differences introduced by amendments.

The Regulations and the accompanying endnotes do not reference any litigation, judicial decisions or tribunal rulings interpreting the provisions of the Road Management (Works and Infrastructure) Regulations 2015. The instrument’s endnotes provide interpretative guidance, amendment history and cross‑references to other legislation, but make no mention of cases, appeals or judicial review outcomes.

What that absence means in practice

• There is no jurisprudence cited in the consolidated text that clarifies contested terms such as “minor works”, “traffic impact works” or the proper construction of the restrictions in regulation 18. Consequently, administrative interpretation and practice by coordinating road authorities, utilities and providers of public transport may govern how ambiguous points are treated in day‑to‑day decision making until and unless contested and litigated.
• The absence of recorded litigation in the instrument does not necessarily mean there has been no legal contest about these provisions in courts or tribunals; it means the Regulations themselves do not contain a litigation history. Legal research beyond the text of this instrument would be required to identify any judicial treatment of these Regulations or relevant parts of Schedule 7 to the Road Management Act 2004.

Points that are likely to generate disputes, if litigated

• The definitions in regulation 5 and the thresholds in regulation 6 and regulation 8 are technical and fact‑sensitive (for example, whether an excavation exceeds 8.5 square metres, whether works span more than 100 or 300 metres, or whether a temporary bus delay exceeds the 2‑minute/5‑minute thresholds in regulation 5(e)-(f)). Those factual thresholds are the kind of matters that often provoke disagreement between applicants and coordinating authorities.
• Regulation 9(1A) explicitly states that a declaration is not invalidated solely by a failure to comply with the consultation requirement under regulation 9(1)(a). That clause may be a point of judicial interest if a Ministerial declaration has significant impact on a class of works and affected parties argue the process was defective.
• Regulation 18 limits the classes of conditions that a coordinating road authority may impose. Disputes could arise where an authority imposes a condition that an applicant argues is outside the permitted scope; the Regulations provide a statutory ground for such a challenge but not the remedy , the Act and administrative law processes would supply enforcement and review mechanisms.

Practical approach for practitioners

• Because the Regulations do not supply litigation history, practitioners should assume contested points remain susceptible to interpretation and administrative discretion and that authoritative resolution rests with judicial or tribunal decisions (if any). They should document compliance steps meticulously, use the consultation and notice mechanisms set out in Schedule 7 and regulation 19, and retain correspondence with coordinating authorities as evidence should a review or challenge be necessary.

The Regulations include several technical thresholds, carve‑outs and discretion points that can catch practitioners and applicants if not read closely.

Classification traps

• Excavation area threshold in minor works (regulation 6(1)(d)(ii) and regulation 6(2)(b)). Excavations of roadway, pathway or shoulder are included as minor works in regulation 6(1)(d)(ii) but regulation 6(2)(b) pulls excavations exceeding 8.5 square metres out of the minor works category. Practically, failing to measure or document excavation area accurately can inadvertently convert an otherwise exempt minor work into a work that requires written consent under s 63(1) of the Act.
• Service extension works and overlapping categories (regulation 6(2)(a) and regulation 8). If a purported “minor work” also constitutes service extension works as defined in the Table in regulation 8 (for example, installation of non‑road infrastructure under a road over distances exceeding the thresholds or installing more than the permitted number of poles), the minor works exemption is lost. Careful mapping of work scope against the Table is required.
• Peak hour thresholds and continuous stoppage measurements (regulation 7). The peak hour traffic works definition is time‑sensitive and depends on measuring continuous stoppage durations (>5 minutes on single‑lane roads, >15 minutes on partial multi‑lane blockages). Practically, projects that intermittently stop traffic or cause rolling delays may be difficult to classify; an underestimation of stoppage time can reclassify a work as a peak hour traffic work, triggering stricter consent requirements.
• Bus/tram delay thresholds and urban area time bands (regulation 5(e)-(f)). The traffic impact tests for bus/tram delays depend on precise time periods (6 a.m.-9 a.m., 3 p.m.-7 p.m. and 9 a.m.-3 p.m.) and delay thresholds (2 minutes for shorter works, 5 minutes for longer works). Project managers and traffic engineers must model and document anticipated delays to support an exemption or to prepare for the consent process.

Ministerial declaration scope and limited invalidation remedy

• Regulation 9(1A) provides that a declaration is not invalidated solely by a failure to comply with consultation requirements. That reduces a procedural challenge option and means stakeholders must engage proactively before a declaration is issued rather than rely on post‑hoc invalidation arguments.

Notice timing quirks

• Prescribed periods vary by actor (regulation 20 and regulation 14). The default clause 13 period is 7 business days, but utilities and providers of public transport may instead use the period ending on the 14th day of the month following completion under regulation 14. That alternative reporting cadence may be less intuitive: one could mistakenly give notice within 7 business days when the Regulation permits a different routine, or vice versa. Check which period applies carefully.
• Coordinating authority exemption power (regulation 15). A coordinating road authority may exempt an applicant from giving completion notice when it grants consent. Parties should not assume a notice obligation where a consent explicitly exempts it.

Conditions prohibited but superficially reasonable

• Regulation 18 forbids certain conditions a coordinating road authority might commonly try to impose, such as requiring undergrounding of non‑road infrastructure that is normally above ground (regulation 18(1)(d)), imposing technical design requirements for non‑road infrastructure (regulation 18(1)(b)), or seeking financial security from providers or utilities (regulation 18(2)). Applicants should be ready to identify and contest condition types that are expressly prohibited by the Regulations; conversely, authorities must craft conditions that are “reasonably relevant to the conduct of the proposed works” (regulation 18(1)(c).
• Indemnity duration cap. Regulation 18(1)(f) prohibits conditions requiring an indemnity that extends beyond a 12‑month warranty period. Applicants that agree to longer indemnities without noting the prohibition may inadvertently accept unlawful contract terms.

Fees and fee unit mechanics

• Fee units and dollar variability. Schedule 1 fees are expressed in fee units; their dollar value changes by financial year under the Monetary Units Act 2004 (Endnotes). Using an outdated fee unit value will miscalculate the fee payable. The endnotes give fee unit values for 1 July 2024 and 1 July 2025 only; for other years check the Treasurer’s Gazette notice.
• Complexity of the fee table. The Schedule differentiates fees by road class and whether works are conducted on the roadway/pathway/shoulder or not, and whether works are minor traffic impact works or other works. Mistakes in categorisation produce incorrect fees and might delay applications.

Inter‑infrastructure consultation particulars

• Regulation 19 ties application particulars to notices and consultations with other infrastructure managers (clause 8 and clause 10 of Schedule 7). Applicants who omit or under‑document those particulars risk their application being considered incomplete. The requirement creates coordination effort and potential delay if third‑party infrastructure managers need to be notified or consulted.

Sunset and temporal risk

• The Regulations are scheduled to sunset on 14 June 2026 (Endnotes). Practitioners should track any further extension or replacement instrument because expiry could change consent and exemption landscapes mid‑project.

Examples and notes are part of the instrument

• Endnotes draw attention to the Interpretation of Legislation Act 1984 which treats examples and notes as part of the instrument’s text. Examples supplied in the Regulations (for instance, in regulation 9) therefore may influence interpretation, so do not treat them as mere commentary.

Compliance requires an initial classification exercise followed by procedural steps tailored to the classification.

1. Classify the works precisely

• Determine whether the planned works fall within the detailed definition of “traffic impact works” in regulation 5, “minor works” in regulation 6, “peak hour traffic works” in regulation 7, or “service extension works” in regulation 8. Pay particular attention to numerical thresholds: 8.5 square metres for excavations (regulation 6(2)(b)); longitudinal distances of 100 metres (urban) and 300 metres (other areas) for certain decommissioning works (regulation 6(2)(c)(i)); service extension distances/pole numbers in the Table in regulation 8; peak time windows and stoppage durations in regulation 7. Where the works might fall into multiple categories, treat the more restrictive applicable category as likely to govern consent requirements.
• If a Ministerial declaration covers the circumstance (regulation 9), check the Government Gazette notice for the exact scope, times, and geographic coverage of the declaration.

2. Identify exemptions that you may rely on

• If the works fit the “minor works” list and do not trigger the exceptions in regulation 6(2), the applicant is exempt from s 63(1) consent and, in many cases, from completion notice (regulation 10(1)). Confirm that the works are not traffic impact works; if they are, the exemption in regulation 10 does not apply.
• Check for other specific exemptions: fire authority valve/hydrant maintenance (regulation 11), pathway works by responsible road authorities (regulation 12), works under clause 18 agreements (regulation 13), clause 7 notice exemption under regulation 16, and driveway/mowing exemptions (regulation 17).

3. If consent is required, prepare the application with prescribed particulars

• Include the particulars required by regulation 19 where proposed works may affect non‑road infrastructure under another infrastructure manager’s responsibility: particulars of notices given or proposed to be given under clause 8 of Schedule 7 and particulars of consultations conducted under clause 10 of Schedule 7. Even where regulation 19 does not apply, follow Schedule 7’s clause 16(3) for general application content.
• Compile evidence of preparatory arrangements, traffic modelling, plans showing impacts to roadway/pathway/shoulder, and documentation of consultations with other infrastructure managers. This supports both the application and any fee waiver request under regulation 22(2).

4. Observe timing and notice obligations

• If not exempt, give notice under clause 13(1) of Schedule 7 within the prescribed period: the default is 7 business days (regulation 20). If you are a utility or provider of public transport that is exempt from s 63(1) but still has a completion notice obligation, use the alternative period ending on the 14th day of the month following completion (regulation 14) where applicable.
• For applications by utilities or agents, expect the coordinating road authority’s decision period under clause 17 to run for 15 business days for service extension works and 3 business days for specified traffic impact works (regulation 21). Factor those periods into project scheduling.

5. Budget for and pay fees, or seek a waiver

• If consent is required, calculate the fee using Schedule 1, noting the applicable road class, whether the works are conducted on roadway/pathway/shoulder, and whether the works are “minor works conducted by a person referred to in regulation 10(2) that are traffic impact works” (special cells in the Schedule). Convert fee units to dollars using the current fee unit value fixed under the Monetary Units Act 2004 (Endnotes provide values for certain years). Round to the nearest 10 cents where directed (Endnotes).
• If you can demonstrate satisfactory preparatory arrangements in the application and accompanying certificates/endorsements, request a waiver under regulation 22(2) and include evidence justifying the waiver.

6. Expect and review proposed consent conditions

• If consent is granted, review conditions against regulation 18’s list of prohibited condition types. Conditions relating to visual amenity are prohibited unless they relate to road infrastructure (regulation 18(1)(a)). Conditions about technical design of non‑road infrastructure are disallowed (regulation 18(1)(b)). Indemnities extending beyond a 12‑month warranty period and financial security conditions for providers/utilities are also prohibited (regulation 18(1)(f) and regulation 18(2)). If a proposed condition appears to conflict with regulation 18, document the inconsistency and consider raising it with the coordinating authority as part of the consent negotiation or review process.
• Note that a coordinating road authority may exempt you from completion notice when granting consent (regulation 15). If you wish to rely on that, secure an express written exemption in the consent.

7. Coordinate with other infrastructure managers

• When works may affect other infrastructure managers’ assets, include particulars of notices and consultations in your application (regulation 19). Early engagement reduces the risk of late objections or requirement changes and supports a fee waiver request.

8. Keep records for audit and potential dispute

• Maintain records of measurement calculations (excavation areas, stoppage durations), traffic modelling assumptions, notices, consultation minutes, and correspondence with the coordinating road authority and other infrastructure managers. Those records will be central if a condition or classification is disputed.

9. Monitor regulatory and fee changes

• Track announcements of fee unit values under the Monetary Units Act 2004 and any Government Gazette notices, and note the Regulations’ sunset date (14 June 2026 per Endnotes). Where a project spans the sunset date, confirm whether the Regulations remain in force or have been remade or replaced.

10. Practical sequencing checklist

• Step 1: classify work against regulation 5-8.
• Step 2: check exemptions (regulations 10-13, 16-17).
• Step 3: if consent needed, prepare materials per clause 16(3) and regulation 19.
• Step 4: calculate and pay fee or apply for fee waiver (regulation 22 and Schedule 1).
• Step 5: submit application and required notices within the prescribed period (regulations 14, 20, 21).
• Step 6: review consent and conditions for conflict with regulation 18; secure written exemption from completion notice if desired (regulation 15).
• Step 7: retain all documentation for compliance evidence.

Adherence to these steps aligns the applicant with the procedural architecture the Regulations create and reduces the practical risk of being treated as non‑compliant under the Road Management Act 2004 and Schedule 7.
