Road Charges Legislation Repeal and Amendment Act 2008

The Act introduces or elaborates a small set of legal concepts and mechanisms. Each is described here with reference to the text.

Road user charge rate mechanism (Fuel Tax Act amendments): The central policy instrument is the road user charge rate for taxable fuel. The Act replaces prior wording in s43‑10 and adds a working rule that the amount of road user charge is worked out using a specific rate framework (Schedule 3, new s43‑10(7)). That framework has two branches: where no rate has been determined by the Transport Minister the rate is 21 cents per litre; otherwise the rate is the rate determined by the Transport Minister (s43‑10(7)(a)-(b)). The Act therefore creates a statutory default rate while preserving Ministerial discretion to set a different rate by legislative instrument (s43‑10(8)). The instrument type is specified: "by legislative instrument" (s43‑10(8)).

Public consultation when increasing the rate: The Act imposes a procedural precondition before the Transport Minister determines an increased rate (s43‑10(9)). That precondition requires making the proposed increased rate and any information relied upon publicly available for at least 60 days, and considering comments received within the period the Minister specifies. The Act then permits the Minister to adopt a different rate than the one originally published as the “proposed” rate without repeating the public availability step (s43‑10(10)). This creates a two‑step transparency/decision structure: a mandatory public comment period for the specific proposed increase, followed by a post‑consultation discretion to finalise a different rate.

Limits on frequency and indexing: Two constraints are introduced. First, the Transport Minister must not apply a method for indexing the road user charge when determining the charge (s43‑10(11)). Second, the Minister must not make more than one determination in a financial year if the effect of the determination would be to increase the charge more than once in that financial year (s43‑10(12)). These provisions restrict both automatic adjustments via indexing and multiple increases in a single financial year.

Repeal and consequential amendment approach: The Act repeals a whole Commonwealth Act governing ACT road transport charges (Road Transport Charges (Australian Capital Territory) Act 1993) (Schedule 1), and removes specific references in the Road Transport Reform (Heavy Vehicles Registration) Act 1997 (Schedule 2). The legislative method is repeal in full (Schedule 1, item 1), and selective deletion of paragraphs and a section in the 1997 Act (Schedule 2, items 1-2).

Review requirement: Section 4 requires the Minister to "cause a review" of the Heavy Vehicle Safety and Productivity Program, to commence on the third anniversary of the commencement of section 4 and to be completed within six months. The Minister must cause a written report to be prepared and laid before each House within 15 sitting days after receipt (s4(1)-(4)). This sets a calendarised review obligation and parliamentary reporting duty.

Commencement and application timing: Section 2 sets different commencement dates for the parts of the Act (s2 table). Schedule 3’s amendments to the Fuel Tax Act apply to taxable fuel acquired, manufactured in, or imported into Australia on or after 1 January 2009 (Schedule 3, Application provision). Schedules 1 and 2 are tied to the commencement of another federal Act (the Interstate Road Transport Charge Amendment Act (No. 2) 2008), and are stated to commence immediately before that Act’s Schedule 1 (section 2 table).

Terminology in the text: The Act repeatedly uses the term "*Transport Minister" in the amended provisions (Schedule 3, e.g. the text uses an asterisked reference to the Transport Minister in several places). The Act does not, within its own text, set out a definition of that label; rather it amends the Fuel Tax Act 2006 to provide the Transport Minister with the power to determine the rate (s43‑10(8)) and specifies procedural obligations attached to that power (s43‑10(9)-(12)).

These concepts interact: the repeal items remove a Commonwealth statute governing ACT road charges and make room for the road user charge framework in the Fuel Tax Act to operate with a statutory default and specified Ministerial procedures. The review requirement establishes a timebound monitoring input into the heavy vehicle safety and productivity policy stream.

The Act affects three broad groups of actors, as identified in its text: (1) entities dealing with taxable fuel, (2) the Transport Minister and the executive agencies that support decision‑making and conduct the review, and (3) parties whose rights or obligations relied on the repealed Commonwealth ACT statute or the amended provisions in the 1997 Act.

Fuel market actors (suppliers, manufacturers, importers and purchasers of taxable fuel): Schedule 3 expressly applies to "taxable fuel acquired or manufactured in, or imported into, Australia on or after 1 January 2009" (Schedule 3, Application clause). The amended s43‑10(7) alters how the road user charge is worked out for taxable fuel: where no Ministerial rate exists the road user charge is 21 cents per litre; otherwise the rate is the Minister’s legislative instrument (s43‑10(7)-(8)). Any party with obligations to calculate, collect, remit, or pay road user charges for taxable fuel must therefore apply either the default numerical rate or monitor and apply any Ministerial determination. The Act does not set out the operational obligations of particular classes of taxpayers or suppliers; it provides the rate‑setting framework that will feed into those obligations in the Fuel Tax Act 2006.

The Transport Minister and government decision‑makers: The Act authorises the "*Transport Minister" to determine the road user charge rate by legislative instrument (s43‑10(8)), imposes procedural steps that the Transport Minister must follow before determining an increased rate (s43‑10(9)-(10)), and constrains indexing and frequency of increases (s43‑10(11)-(12)). The Act also places a statutory duty on "the Minister" to cause and report a review of the Heavy Vehicle Safety and Productivity Program (s4(1)-(4)). The practical effect is that Ministerial offices and departmental legal and policy units will be responsible for preparing legislative instruments, publishing consultation material and information, considering submissions, making determinations in accordance with the statutory limitations, and commissioning and producing the required review report.

Entities and arrangements relying on the repealed ACT statute: Schedule 1 repeals the Road Transport Charges (Australian Capital Territory) Act 1993 in full (Schedule 1, item 1). Any person or body whose rights, regulatory obligations, compliance arrangements, licences, fees or contracts were linked to that Commonwealth ACT statute will be affected by its removal. Schedule 2 makes targeted repeals in the Road Transport Reform (Heavy Vehicles Registration) Act 1997 (Schedule 2, items 1-2). The text does not itself elaborate transitional arrangements; therefore affected parties (for example, registrants, ACT road‑charge payers, or agencies that administered the repealed provisions) must look to other legislation or administrative instruments for transitional rules.

Parliament and public stakeholders: The Act requires public availability of proposed increased rates and supporting information for at least 60 days (s43‑10(9)). This implicates stakeholders who wish to engage in the consultation process , industry bodies, road freight operators, fuel industry participants, and other interested members of the public , who may choose to make submissions within the period specified by the Transport Minister. The Minister must consider comments received (s43‑10(9)(b)). The review requirement also involves wider stakeholder engagement as part of the review process, because a report is to be prepared and laid before each House (s4(3)-(4)).

Other statutes and administrators: By specifying that the Transport Minister may determine the rate "by legislative instrument" (s43‑10(8)), the Act brings the rate into the delegated‑legislation framework. That will involve legislative‑instrument processes and the administrative procedures required to make such instruments effective, which affects parliamentary officers and officials who process and register legislative instruments; however the Act itself does not set out the registration or disallowance mechanics.

In sum, the immediate, concrete burdens fall on suppliers, importers and manufacturers of taxable fuel (who must apply the rate framework to fuel acquired on or after the application date), on the Transport Minister’s office (which must follow the specified consultative, decision and reporting steps), and on those whose rights or obligations were governed by the repealed Commonwealth ACT statute or the amended 1997 Act.

The Act creates a compact set of statutory duties for the Minister and procedural entitlements for public participation. It does not create new criminal offences or civil penalty regimes in its own text. The principal duties and rights are these.

Ministerial duties and procedural constraints (Fuel Tax Act amendments):

• Power to determine rate by legislative instrument: The Transport Minister has the power to determine the rate of the road user charge for taxable fuel by legislative instrument (Schedule 3, new s43‑10(8)). This is a statutory conferral of executive power to set a monetary administrative rate.
• Default numeric rule: Where no Ministerial determination exists, the amount of road user charge for taxable fuel is worked out at 21 cents per litre (s43‑10(7)(a)). This creates a statutory fallback rate and therefore a right for taxpayers to calculate the charge at that rate absent a Ministerial instrument.
• Pre‑increase public consultation obligation: Before the Transport Minister determines an increased rate, the Minister must make publicly available for at least 60 days the proposed increased rate and any information relied on, and must consider comments received within a period specified by the Minister (s43‑10(9)(a)-(b)). This is a positive duty to publish and to consider submissions. The duty is limited to "determining an increased rate"; the Act does not require the same procedure for a decrease or an initial determination that is not an increase.
• Discretion after consultation: The Minister may, after considering comments, determine a rate different from the proposed rate without making that different rate publicly available in accordance with subsection (9) (s43‑10(10)). This allows the Minister to finalise a different outcome than the one notified, without repeating the publication period.
• Prohibition on indexing: The Transport Minister must not apply a method for indexing the road user charge when determining it (s43‑10(11)). This removes an automatic adjustment pathway for the charge.
• Constraint on multiple increases: The Transport Minister must not make more than one determination in a financial year if the effect would be to increase the road user charge more than once in that financial year (s43‑10(12)). This restricts frequency of increases achieved by multiple determinations.

Duties relating to review:

• Duty to cause review: The Minister must "cause a review of the Heavy Vehicle Safety and Productivity Program to be conducted" (s4(1)). This is a positive administrative duty to initiate and ensure a review takes place.
• Timebound commencement and completion: The review must start on the third anniversary of the commencement of section 4 and be completed within six months (s4(2)(a)-(b)). These are temporal duties that prescribe the review’s schedule.
• Report and parliamentary laying: The Minister must cause a written report about the review to be prepared and cause a copy of the report to be laid before each House within 15 sitting days after the Minister receives the report (s4(3)-(4)). These are duties that create an accountability pathway to Parliament.

Rights and entitlements for third parties:

• Public consultation entitlement: Members of the public and stakeholders gain a statutory right to information and to have their comments considered when an increased rate is proposed (s43‑10(9)). The right is constrained by the period specified by the Minister for receiving comments.
• Application of default rate: Where no Ministerial determination exists, affected taxpayers have a clear statutory right to use the default 21 cents per litre rate in calculating the road user charge for taxable fuel (s43‑10(7)(a)).

Duties the Act does not create explicitly:

• The Act does not itself create a suite of compliance or penalty obligations; it leaves operational obligations (collection, remittance, offences) to the existing framework of the Fuel Tax Act 2006 and other taxation or regulatory statutes. The text provided does not insert new criminal penalties or civil penalties into the amended sections.

Transitional and application duties:

• The Schedule 3 amendments apply to taxable fuel acquired, manufactured or imported on or after 1 January 2009 (Schedule 3 Application clause). That creates an application date duty for parties to calculate road user charge in respect of fuel from that date under the amended rule.

Summary: the Act places defined duties on the Transport Minister about transparency, decision frequency and indexation avoidance when setting the road user charge rate, and provides a numerical default rate that confers a calculation entitlement for market participants. It also imposes a timebounded review and reporting duty on the Minister for the Heavy Vehicle Safety and Productivity Program. The Act does not set out enforcement mechanisms or penalties within its own text.

The text of the Road Charges Legislation Repeal and Amendment Act 2008, as supplied, does not create any new criminal offences, civil penalties, infringement regimes or specific enforcement provisions. The Act’s measures are primarily repeal, amendment and procedural duties. The enforcement landscape must therefore be inferred, within the limits of the provided material, from where substantive obligations remain: principally the Fuel Tax Act 2006 and other existing taxation or transport statutes.

What the Act does and does not do in enforcement terms:

• No new penalties in this Act: The Act does not introduce any penalty provisions or enforcement procedures. The schedules effect repeals and text changes, and section 4 imposes a review/reporting duty, but neither those items nor the added subsections to s43‑10 contain express sanctions for non‑compliance.
• Enforcement of road user charge obligations remains within the Fuel Tax Act framework: The Act amends the mechanism for determining the rate of road user charge in s43‑10 of the Fuel Tax Act 2006 (Schedule 3). The operational obligations to measure taxable fuel, calculate the road user charge, collect, remit and any penalties for failure to comply remain governed by the Fuel Tax Act 2006 and related taxation law, rather than by this amending Act. The amending Act does not alter those enforcement provisions; it only alters the rate‑setting mechanism. A practitioner must therefore look to the Fuel Tax Act 2006 for enforcement, penalty and audit mechanisms applicable to taxpayers and fuel suppliers.
• Ministerial determinations as instruments with legal effect: The Act authorises the Transport Minister to determine the rate "by legislative instrument" (s43‑10(8)). A legislative instrument is a legal form that creates binding obligations or rights once made under the parent Act, and such instruments are generally registered and can be subject to parliamentary processes. The Act itself, however, does not set out the registration, disallowance, or review processes for the instrument; those procedural aspects are governed by legislation that regulates legislative instruments. The presence of "by legislative instrument" is therefore the mechanism by which legal effect will be given to a Ministerial rate decision; it is the instrument that will be relied upon for enforcement actions concerning the correct rate.
• Administrative consequences of failing to follow procedural duties: The Act requires the Transport Minister to follow specified publication and consultation steps before determining an increased rate (s43‑10(9)). The supplied text does not create a private right of action to challenge a failure to follow that procedure, nor does it specify remedies. Remedies, judicial review principles, and any statutory rights to challenge administrative action are not provided in this Act; they would be found in administrative law and in the general legal framework for judicial review. The supplied Act does not itself create an administrative penalty tied to non‑observance of the section’s procedural duties.
• Repeal of the ACT road charges statute: The repeal of the Road Transport Charges (Australian Capital Territory) Act 1993 (Schedule 1) will remove the statutory basis for any enforcement that rested on that Commonwealth Act. The Schedule does not, in its text, set out specific transitional enforcement arrangements; such arrangements,if any, would need to be located in other legislation or administrative instruments, which are not reproduced here.

Practical consequence for practitioners: to identify applicable penalties and enforcement pathways following these amendments, consult the Fuel Tax Act 2006 (as amended by this Act) and the broader taxation enforcement statutes for offences, penalties, and audit powers. Also verify whether any transitional or consequential instruments or regulations were made in connection with the repeal of the ACT statute and the amendments to the 1997 Act; those instruments may contain enforcement and transition rules not present in this amending Act.

The Act is narrowly drafted and explicitly interacts with a small set of other Commonwealth statutes. Those interactions are direct and are effected by repeal, amendment or timing connections.

Fuel Tax Act 2006: The Act amends section 43‑10 of the Fuel Tax Act 2006 (Schedule 3). The amendments change how the road user charge rate is worked out and the process for its determination. Specifically, Schedule 3 adds subsections (7)-(12) to s43‑10, creating a default rate, a Ministerial legislative‑instrument power, consultation obligations for increases, a prohibition on indexing, and a limitation on multiple increases in a financial year. These changes modify the statutory rule that will be applied within the Fuel Tax Act’s existing operational and enforcement framework. To understand compliance and enforcement consequences fully, one must read the amended s43‑10 in the context of the Fuel Tax Act 2006’s definitions (for example, "taxable fuel") and obligations, which the Act assumes remain operative.

Road Transport Charges (Australian Capital Territory) Act 1993: The Act repeals this statute in full (Schedule 1). The repeal removes the Commonwealth legislative framework that previously governed road transport charges in relation to the ACT. The immediate legal effect is the deletion of that statutory source. Any legal obligations, rights, or administrative instruments that were premised on that Act will need to be located in other statutes or instruments if they are to continue. The supplied text does not supply transitional provisions; therefore a careful review of the wider legislative landscape is necessary to determine what replaced the repealed Act, if anything.

Road Transport Reform (Heavy Vehicles Registration) Act 1997: Schedule 2 removes specific paragraphs (9(c), 10(1)(g) and 17(2)(f)) and repeals section 30 of the 1997 Act (Schedule 2, items 1-2). These are narrow, consequential deletions tied to the repeal in Schedule 1. The supplied Act does not set out the content of the removed paragraphs or section 30, so practitioners must check the 1997 Act to identify the substantive provisions removed and the consequent legal effects on registration, enforcement, or administrative processes.

Interstate Road Transport Charge Amendment Act (No. 2) 2008: The commencement timetable ties Schedules 1 and 2 of this Act to the commencement of Schedule 1 to that other Act, stating they commence "immediately before the commencement of Schedule 1 to the Interstate Road Transport Charge Amendment Act (No. 2) 2008" (section 2 table). This timing link establishes an interaction in commencement sequencing, which may be intended to coordinate repeal and amendment effects across related legislative changes. The supplied text does not reproduce the contents of the Interstate Road Transport Charge Amendment Act (No. 2) 2008, so the operational interaction must be verified by reading that other Act.

Delegated legislation framework: The Act expressly provides that the Transport Minister may determine the road user charge rate "by legislative instrument" (s43‑10(8)). That places the Minister’s rate determination within the delegated legislation system; the Act thereby interacts procedurally with the statutes and rules that govern legislative instruments (for example, an Instrument Act or the Legislation Act), though those statutes are not reproduced here. The legal effect is that the Minister’s rate will be made by instrument rather than by primary legislation.

Administrative law and judicial review: The Act imposes procedural duties on the Minister (publication and consideration of comments prior to determining an increased rate: s43‑10(9)-(10)). Failure to comply with procedural statutory duties can give rise to administrative law remedies, but the Act does not itself specify remedies. The interaction with judicial review principles and remedies will therefore be resolved by reference to general administrative law rather than within the text of this Act.

Taxation and customs law: The Schedule 3 application clause specifies that the amendments apply to taxable fuel acquired, manufactured or imported on or after 1 January 2009 (Schedule 3, Application clause). That application date intersects with customs and excise entry processes and tax accounting periods; the practical effect is that importers and manufacturers must apply the amended rate framework from that date forward. The Act does not modify customs or excise procedural rules; those remain in their own statutes.

In short, this Act interacts directly with the Fuel Tax Act 2006 by changing the rate‑setting mechanism, with the Road Transport Charges (ACT) Act 1993 by repealing it entirely, with the Road Transport Reform (Heavy Vehicles Registration) Act 1997 by deleting provisions, and with an Interstate Road Transport Charge Amendment Act for timing purposes. The Act also presupposes the delegated‑legislation and administrative law frameworks for implementation and review, but does not itself restate those frameworks.

The Road Charges Legislation Repeal and Amendment Act 2008 is a single amending statute composed of four numbered sections and three Schedules. The Act as supplied shows the original enactment content and the commencement table; it does not itself record subsequent amendments made after assent. The textual amendment history recorded within the Act is limited to the specific changes it makes to existing Acts and the commencement sequencing. The components of this Act and what they change are set out below.

Key elements of this Act as enacted:

• Short title (s1): The Act is cited as the Road Charges Legislation Repeal and Amendment Act 2008.
• Commencement (s2): The Act contains a commencement table establishing that sections 1-3 and anything not elsewhere covered commence on Royal Assent (11 December 2008), Schedules 1 and 2 commence immediately before the commencement of Schedule 1 to the Interstate Road Transport Charge Amendment Act (No. 2) 2008 (reference date given as 12 February 2009) and Schedule 3 commences on 1 January 2009. The Act includes a note that the table deals only with provisions as originally passed and will not be expanded to deal with later insertions.
• Schedules (s3): Declares that each Act specified in a Schedule is amended or repealed as set out in that Schedule.
• Review (s4): Imposes the review requirement for the Heavy Vehicle Safety and Productivity Program with timing and reporting duties.

Schedule 1,Repeal (Road Transport Charges (Australian Capital Territory) Act 1993):

• Item 1 repeals the whole of the Road Transport Charges (Australian Capital Territory) Act 1993.

Schedule 2,Consequential amendments (Road Transport Reform (Heavy Vehicles Registration) Act 1997):

• Item 1 repeals paragraphs 9(c), 10(1)(g) and 17(2)(f) of the 1997 Act.
• Item 2 repeals section 30 of the 1997 Act.

Schedule 3,Amendment of the Fuel Tax Act 2006:

• Item 1 omits ", determined by the *Transport Minister" from subsection 43‑10(3) and substitutes "for the fuel" (Schedule 3, item 1).
• Item 2 repeals subsection 43‑10(5) (Schedule 3, item 2).
• Item 4 adds new subsections 43‑10(7)-(12) (Schedule 3, item 4) to set out the determination framework and procedural constraints described above.
• Application clause in Schedule 3 states the amendments apply to taxable fuel acquired, manufactured or imported on or after 1 January 2009 (Schedule 3, Application).

Other historic markers in the Act:

• The Act records the Minister’s second reading speeches were made in the House of Representatives on 25 September 2008 and in the Senate on 10 November 2008 (printed note at the end). The Act was assented to on 11 December 2008 (opening paragraphs).

The supplied text does not record any later amendments to this Act, nor any repeals or judicial alterations. For a full legislative history post‑assent, one must consult the official consolidated statute database or legislative instrument registers to see whether subsequent amending Acts or disallowances have altered these provisions. The Act itself contains its own commencement schedule and specifies the initial application date for the Fuel Tax amendments.

The supplied text contains no recorded litigation history. There are no cases, declaratory judgments, injunctions, or judicial interpretations referenced in this Act. The Act records only parliamentary steps (short title, commencement, schedules) and the Minister’s second reading speeches dates, but does not include any judicial materials.

Practical consequences of the absence of litigation material in this text:

• No precedents cited within the Act: Because the statute text here contains no case references, any legal questions about the interpretation or application of the new subsections (for example, the meaning of "increased rate", the scope of the Transport Minister’s power to determine a rate different from the proposed rate without republishing, or the interpretation of the no‑indexing rule) will need to be resolved by reference to administrative law principles, the Fuel Tax Act 2006 as a whole, and any subsequent case law not reproduced here.
• Potential for future litigation: The Act establishes procedural duties (s43‑10(9)-(10)) and grants an administrative decision‑making power (s43‑10(8)). Typical areas where litigation might arise, although not recorded here, include judicial review challenges to Ministerial failure to observe the consultation obligations, challenges to the substantive rationality of a rate determination, or disputes about the retrospective or application scope of an instrument. None of these appear in the supplied text.
• No transitional adjudications recorded: The repeal of the Road Transport Charges (Australian Capital Territory) Act 1993 could generate disputes about continuity of rights or regulatory obligations. The supplied Act does not include recorded litigation or transitional adjudications.

If litigation has arisen since enactment, or if decisions have interpreted the new s43‑10 subsections, those materials are not included in the supplied text and must be obtained from a case law database or tribunal decisions. The absence of litigation in the Act text itself is not an assurance that no litigation exists; it only means the Act document as provided contains no litigation history.

The Act is compact, but it contains a number of drafting and practical features that may produce traps for practitioners and stakeholders. Each "gotcha" below is grounded in the Act’s text and flags consequences that require attention.

Commencement sequencing and application dates: The commencement table in section 2 splits timing. Sections 1-3 and anything not elsewhere covered commence on Royal Assent (11 December 2008), whereas Schedules 1 and 2 commence "immediately before the commencement of Schedule 1 to the Interstate Road Transport Charge Amendment Act (No. 2) 2008" (table entry), with a date given as 12 February 2009. Schedule 3 commences on 1 January 2009. Practitioners must be careful about these different dates: the default rate and Ministerial determination regime in the Fuel Tax Act applies to fuel acquired on or after 1 January 2009 (Schedule 3 Application clause). Parties with transactions near those dates need to verify which legal regime applies to each taxable fuel acquisition.

Default rate versus Ministerial determination timing: The Act sets a default 21 cents per litre rate where "no rate has been determined by the *Transport Minister" (s43‑10(7)(a)). That raises two operational points. First, it is necessary to know whether a prior legislative instrument exists at a given point in time; where none exists, the default applies. Second, the Act does not specify a sunset for the default or criteria for when a Ministerial determination is considered to exist or to have been superseded. Firms must track the existence and commencement timing of any legislative instrument under s43‑10(8) to know whether to use the default rate or the Minister’s rate.

Scope of the 60‑day consultation requirement: The consultation duties apply "before the *Transport Minister determines an increased rate of road user charge" and require making the proposed increased rate and information relied on "publicly available for at least 60 days" and considering comments received (s43‑10(9)). The Act, however, does not define "increased rate" within the subsection. It is unclear whether the requirement applies to any Ministerial determination that is higher than the immediate prior rate, or whether specific baselines apply (for example, the default 21 cents). The Minister retains discretion to specify the period for receiving comments within the public availability window (s43‑10(9)(b) refers to "the period specified by the Transport Minister"), which affects stakeholders' ability to plan responses.

Post‑consultation change without republishing: Subsection (10) allows the Minister to determine a rate different from the proposed rate after considering comments without making that different rate publicly available in accordance with subsection (9). Practically, this means the Minister can publish a proposed number for consultation but adopt a different final number without triggering another mandatory 60‑day public consultation. That reduces the formal requirement for public re‑notification, and stakeholders should be aware they may need to respond during the initial consultation period to influence the final outcome.

No indexing permitted: The Act expressly bars the Transport Minister from applying a method for indexing the road user charge in determining the charge (s43‑10(11)). Where past practice or modelling assumed an indexing arrangement, such arrangements are foreclosed in the Minister’s decision‑making under the amended s43‑10. Parties that budget on indexed adjustments must adjust models accordingly.

Limit on increases per financial year: Subsection (12) provides the Minister must not make more than one determination in a financial year if the effect would be to increase the charge more than once in that financial year. The wording focuses on the effect "to increase the *road user charge more than once in that financial year" , that is, even if the Minister makes multiple determinations, their cumulative effect must not be to increase the charge more than once in the same financial year. Careful chronology and legal drafting analysis is required where multiple instruments or amendments are made within a financial year.

Legislative instrument as the vehicle: The Act requires determinations be made "by legislative instrument" (s43‑10(8)). A legislative instrument will follow the processes and registration requirements applicable to delegated legislation. Practitioners must monitor the registration of such instruments and their commencement notices to identify the operative rate, and anticipate parliamentary scrutiny or potential disallowance mechanisms that attach to legislative instruments, though those mechanisms are outside the text of this Act.

Ambiguity of the asterisked term: The text as supplied uses "*Transport Minister" in several places. The Act itself does not define that expression; practitioners should confirm the statutory definition in the Fuel Tax Act 2006 or the relevant administrative statute to understand which portfolio Minister is intended and whether multiple Ministers or delegations can exercise the power.

Repeal of entire ACT statute without transitional provisions in this text: Schedule 1 repeals the Road Transport Charges (Australian Capital Territory) Act 1993 in full. The Act contains no transitional or saving provisions in the supplied text. Parties who relied on that Commonwealth ACT statute should check for separate transitional instruments or related Commonwealth/ACT arrangements to understand whether rights, obligations, licences, or previously imposed charges remain in force by other legal mechanisms.

No penalties or remedies in this Act: The Act imposes procedural duties on the Minister but does not provide statutory remedies for non‑compliance with those duties. Parties concerned with procedural compliance should consider general administrative law remedies but must be aware those remedies are not specified in this Act.

In short, the main practical "gotchas" are the staggered commencement dates and their interaction with the default rate; the limited but precise consultation duty and the Minister’s retained ability to change the final rate without republishing; the explicit prohibition on indexing; the instrument type (legislative instrument); the absence of definitions and transitional provisions in the supplied text for the repeals; and the lack of express enforcement or remedial provisions in the Act itself.

This section sets out concrete operational steps for the principal affected actors to comply with the changes effected by the Act, based strictly on the statutory text.

For fuel suppliers, importers and manufacturers (parties dealing with taxable fuel on or after 1 January 2009):

1. Identify the application date for each acquisition: Schedule 3 expressly applies to taxable fuel "acquired or manufactured in, or imported into, Australia on or after 1 January 2009" (Schedule 3, Application clause). For each fuel transaction, determine whether it falls on or after that date to know whether the amended s43‑10 rule applies.

2. Determine which rate to apply: For taxable fuel covered by the application clause, calculate the road user charge using:

   • 21 cents per litre if no rate has been determined by the Transport Minister (s43‑10(7)(a)); or
   • the rate specified in the Transport Minister’s legislative instrument if such a determination exists (s43‑10(7)(b) and (8)). Monitor the Register of legislative instruments or the official government notifications for any s43‑10 instruments.

3. Track Ministerial instruments carefully: Because the Transport Minister determines the rate "by legislative instrument" (s43‑10(8)), compliance requires checking for published instruments and their commencement details. Ensure internal accounting systems can switch from the default 21 cents to the Ministerial rate from the instrument’s commencement date.

4. Maintain records of reliance on the rate: For auditing and recordkeeping, keep documentation showing which rate was applied to each batch of fuel and the basis (default vs instrument), including copies of instruments and notices of commencement.

For stakeholders wishing to influence or respond to a proposed increased rate (industry bodies, freight operators, public interest groups):

1. Monitor proposed increased rate publications: The Transport Minister must make the proposed increased rate and any information relied on publicly available for at least 60 days prior to determining an increased rate (s43‑10(9)(a)). Identify where the Minister publishes such material and set internal processes to review and respond within the period specified by the Minister.

2. Submit comments within the Minister’s period: The Minister must consider "any comments received, within the period specified by the Transport Minister" (s43‑10(9)(b)). The Minister’s public notice may specify a shorter or different comments period within the 60‑day availability window, so confirm the exact deadline and tailor submissions accordingly.

3. Anticipate post‑consultation outcomes: Subsection (10) allows the Minister to adopt a different final rate after considering comments without republishing. Therefore submissions should address alternative outcomes and provide evidence or arguments that bear on a range of possible rates, not only the initially proposed figure.

For the Transport Minister’s office and departmental officials:

1. Follow the public availability requirement precisely: Before determining an increased rate, ensure the proposed rate and the information relied upon are made publicly available for at least 60 days (s43‑10(9)(a)). Record publication dates and make material accessible for the entire period.

2. Specify the comment period and manage submissions: The Minister must consider comments received within the period specified by the Minister (s43‑10(9)(b)). When publishing, specify clear submission timelines and put in place procedures to collect, collate and consider comments within statutory requirements.

3. Prepare the legislative instrument: If a rate is to be determined, prepare the required legislative instrument under the delegated‑legislation framework, ensuring it complies with instrument‑making procedures and that its commencement is communicated to stakeholders.

4. Observe frequency and indexing constraints: Do not apply an indexing method in determining the charge (s43‑10(11)). Also ensure multiple determinations within a financial year do not cumulatively increase the charge more than once in that financial year (s43‑10(12)).

For parties affected by the repeal of the Road Transport Charges (Australian Capital Territory) Act 1993:

1. Identify dependencies on the repealed statute: Audit contracts, licences, fee schedules and regulatory instruments to find references or operational dependencies on the repealed Commonwealth ACT statute; the Schedule 1 repeal is absolute ("The whole of the Act. Repeal the Act.").

2. Seek replacement authorities or transitional rules: Because this Act does not include transitional provisions in the supplied text, check other Commonwealth, ACT or administrative instruments that may preserve continuity or provide replacement mechanisms.

For those involved in the Heavy Vehicle Safety and Productivity Program review:

1. Note the review timetable: Section 4 requires the Minister to cause the review to start on the third anniversary of the commencement of section 4 and to be completed within six months (s4(2)). Section 4 commenced on Royal Assent under the commencement table (sections 1-3 and anything not elsewhere covered commence on assent, s2). Parties that wish to contribute to the review should monitor announcements and be prepared to provide submissions within the review’s timeframe.

2. Prepare for parliamentary reporting: The Minister must cause a written report to be prepared and laid before each House within 15 sitting days after receipt (s4(3)-(4)). Stakeholders should therefore factor in a defined review period and possible opportunities to contribute any input sought by the Minister’s review process.

Cross‑cutting compliance tips:

• Check definitions in the Fuel Tax Act 2006: Terms such as "taxable fuel" and the precise legal identity of the "*Transport Minister" will determine who has obligations and who must be monitored for instruments and notifications. The supplied Act amends the Fuel Tax Act but does not restate its definitions; obtain the consolidated Fuel Tax Act 2006 as amended to confirm definitions and operational obligations.
• Recordkeeping and audit readiness: Keep contemporaneous evidence of rate calculations, the instrument used (or the default basis), and any submissions made during the public availability period for increased rates.
• Watch for delegated instruments and commencement notices: Instruments typically specify commencement and may interact with other tax or customs dates; ensure systems are aligned to commence applying new rates on the legally effective date.

Following these steps will align operational practice with the statutory rate‑setting regime introduced by Schedule 3, the repeal and consequential amendments in Schedules 1-2, and the review obligation in section 4.
