What it does
The River Murray Waters (Dartmouth Reservoir) Act 1971 (SA) ratifies and approves a single intergovernmental agreement dated 26 February 1970 between the Commonwealth, New South Wales, Victoria and South Australia. The agreement provides for Commonwealth financial assistance to each state for its share of the construction cost of the Dartmouth Reservoir on the Mitta Mitta River. The Act itself does not impose any operational duties beyond approving that agreement and binding the Crown in right of South Australia (s 3). The scheduled agreement becomes legally effective only when the Act commences, which by s 2 is fixed by proclamation. The Governor must first be satisfied that the Commonwealth Parliament has passed its own ratifying Act. Commencement occurred on 30 March 1972 (Gazette 16 March 1972 p 889).
The substantive financial arrangements are contained entirely in the schedule. The Commonwealth agrees to pay each state up to $7,837,500, being one-half of the amounts the state is required to contribute to the River Murray Commission under clause 32 of the River Murray Waters Agreement for Dartmouth construction (clause 4 and 5(1)). These payments are not outright grants. They are advances that the state must repay with interest over a fixed schedule: 30 equal half-yearly instalments commencing ten years after each Commonwealth payment, with interest accruing from the date of payment at the yield rate on long-term Commonwealth securities (clauses 7 and 8). The agreement also contains a cost-escalation review trigger: if the revised estimated cost exceeds $62,700,000, the Commonwealth and state must review the arrangements, and unless otherwise agreed the Commonwealth is not obliged to make payments in respect of costs above that sum (clause 5(2)). The state must use payments exclusively for its Dartmouth construction obligations, maintain auditable records, and supply documents and information to the Commonwealth Treasurer on request (clauses 6, 9, 10). The Act therefore functions as a conditional appropriation authority and a statutory ratification of a contract that places the state under debt and compliance obligations to the Commonwealth.
