River Murray Waters Agreement Supplemental Agreement Act 1963

The Act and the scheduled agreement introduce several key concepts that modify the pre‑existing River Murray management framework.

Menindee Lakes Storage. This is the connected series of lake storages at Menindee in New South Wales, constructed by that state under its rights under clause 46 of the Principal Agreement. The agreement defines its full supply levels and corresponding capacities: approximately 1,010,000 acre‑feet before Lake Cawndilla is declared effective, and approximately 1,470,000 acre‑feet afterwards (clause 6). The “effective capacity” is not defined in the agreement but appears in clause 9(a) as the condition for the fixed annual payment.

Trigger thresholds. The agreement uses three numeric thresholds: 390,000 acre‑feet, 520,000 acre‑feet, and 600,000 acre‑feet. The first two control when the sharing regime operates. When storage exceeds 390,000 acre‑feet, excess water is shared; when storage falls below 390,000 acre‑feet, the sharing regime is suspended until storage next reaches 520,000 acre‑feet. The 600,000 acre‑feet threshold governs the fixed annual payment: no payment is due for any day effective capacity is below 600,000 acre‑feet, and a proportionate deduction applies.

Sharing regime. The agreement deems water in excess of 390,000 acre‑feet to be “water available for sharing under the provisions of clause 45 or clause 51” of the Principal Agreement, as the case may be. Clause 45 deals with normal sharing of River Murray flows; clause 51 deals with sharing during periods of restriction. The effect is to bring Menindee water into the same sharing pool as other Murray water, subject to a special deduction for NSW’s priority use.

NSW priority usage. NSW may use up to 90,000 acre‑feet per year of the excess water without that use being counted as part of its share under the Principal Agreement. Usage above 90,000 acre‑feet is debited to its share. This creates an incentive for NSW to keep the storage above 390,000 acre‑feet to access both the priority use and the payment, while still retaining control during low‑storage periods.

Payments and cost sharing. The Commission pays NSW a fixed annual sum of £160,000 (in pounds, as the agreement predates decimal currency) plus three‑quarters of operating and maintenance costs. The fixed payment is borne by the three state contracting governments in equal shares; the cost reimbursement is borne by the three state contracting governments in equal shares. The Commonwealth does not contribute to these payments under this agreement, though its commissioner on the River Murray Commission holds a casting vote on directions (clause 7(4)).

Effective capacity. The agreement does not define this term, but it is the metric for the fixed payment. The payment is proportionately reduced for any day the effective capacity is below 600,000 acre‑feet. This creates a financial incentive for NSW to maintain storage above that level, or at least to ensure the works can hold that volume.

The Act and agreement directly affect only the contracting governments: the Commonwealth of Australia and the states of New South Wales, Victoria and South Australia. No private individuals, corporations, water users, or local government bodies are named as duty‑bearers or rights‑holders. However, the agreement indirectly affects anyone who relies on River Murray water allocations, because it changes the volume of water available for sharing among the states and therefore influences state water sharing plans, irrigation allocations, and environmental flows.

New South Wales bears the primary operational duties. It must carry out normal maintenance to keep the Menindee Lakes Storage and associated works in good order and condition (clause 5). It must operate and control the storage in compliance with clause 7, which means releasing water when directed by the River Murray Commission if storage exceeds 390,000 acre‑feet, and refraining from certain uses during sharing periods. NSW also stands to receive the fixed annual payment and cost reimbursement. During low‑storage periods (below 390,000 acre‑feet), NSW gains unrestricted use of storage water, but loses the fixed payment if effective capacity falls below 600,000 acre‑feet.

Victoria and South Australia are affected as downstream states. They benefit from the sharing regime because Menindee water above 390,000 acre‑feet becomes part of the shared pool, potentially increasing their allocations. They bear equal shares of the fixed payment and operating costs. They have no direct operational control; their interests are represented on the River Murray Commission.

The Commonwealth is a contracting government but does not contribute to the payments under this agreement. Its commissioner on the River Murray Commission holds a casting vote on directions under clause 7(4), giving the commonwealth a decisive voice in disputes about releases.

The River Murray Commission (now the Murray-Darling Basin Authority under later changes, but the Act refers to the Commission as then constituted) has a directive role. It may direct the release of water when storage exceeds 390,000 acre‑feet. It must also estimate payments and include them in its estimates under clause 34 of the Principal Agreement (clause 12 of this agreement). The commission’s powers are exercised by majority vote, with the Commonwealth commissioner having a casting vote.

Water users in all three states are indirectly affected. If Menindee water is released, it increases flows downstream, potentially increasing allocations in Victoria and South Australia. If storage is low and NSW uses water for its own purposes, downstream users may receive less. The agreement does not create private rights; those arise under state water legislation.

Duty of New South Wales to maintain. Clause 5 requires NSW to “carry out the normal maintenance necessary to keep the Menindee Lakes Storage and the works associated with it in good order and condition, having regard to the full supply levels and storage capacities” set out in clause 6. This is an ongoing duty for the seven‑year term of the agreement. “Normal maintenance” is not defined, creating some ambiguity about what works are included.

Duty of New South Wales to operate and control. Clause 7(1) requires NSW to operate and control the storage in compliance with the clause. That means when storage exceeds 390,000 acre‑feet, NSW must make water available at the direction of the River Murray Commission, subject to its own right to use up to 90,000 acre‑feet per year. NSW cannot unilaterally withhold releases during sharing periods. When storage falls below 390,000 acre‑feet, the duty to follow commission directions ceases, and NSW may use the water as it requires.

Right of New South Wales to priority use. Under clause 7(2)(b), NSW may use water stored in excess of 390,000 acre‑feet as it requires, but any amount used above 90,000 acre‑feet in a year (commencing 1 May) is regarded as part of its share under the Principal Agreement. This gives NSW a free allowance of 90,000 acre‑feet per year from the excess storage, without that water counting against its normal Murray entitlement. This is a significant right because it gives NSW priority access to Menindee water that would otherwise be shared.

Right of the River Murray Commission to direct releases. Clause 7(2)(a) gives the Commission the power to direct that water stored in excess of 390,000 acre‑feet be made available for sharing. The direction is determined by majority vote of the four commissioners, with the Commonwealth commissioner having a casting vote if equally divided. The Commission cannot direct releases when storage is below 390,000 acre‑feet (clause 7(3)).

Right of New South Wales to payment. Under clause 9, the Commission must pay NSW £160,000 per annum (in quarterly instalments) plus three‑quarters of operating and maintenance costs. The fixed payment is subject to proportionate deduction if effective capacity falls below 600,000 acre‑feet on any day. This right is not unconditional; it depends on storage levels and on NSW performing its maintenance and operation duties.

Right of state contracting governments to share costs. Victoria and South Australia have the right to share the fixed payment equally among the three states (clause 10) and operating costs equally among the three states (clause 11). They do not contribute to NSW’s costs beyond those shares.

Duty of all contracting governments to submit for ratification. Clause 2 requires each government to submit the agreement to its parliament during the present session or the first session after the agreement date. This duty is not enforceable in a court but is a political obligation. South Australia fulfilled it by passing this Act.

Duty of each government to execute and enforce. Clause 3 requires each contracting government, so far as its jurisdiction extends, to “provide for or secure the execution and enforcement of the provisions of this agreement and any Acts ratifying it.” This is a broad obligation that could require states to amend their water legislation or use executive powers to enforce the release directions.

The Act itself contains no penalty provisions. No offence is created, no fine is specified, and no civil penalty regime is established. Enforcement relies on the intergovernmental agreement and the general legal and political mechanisms available to the parties.

Clause 3 of the agreement imposes a duty on each contracting government to “provide for or secure the execution and enforcement of the provisions of this agreement and any Acts ratifying it.” This is not a penalty clause; it is an obligation to take necessary legislative or executive action. If a government fails to comply, the remedy would be political rather than judicial. The agreement is unlikely to be justiciable in a domestic court because it is a treaty‑like compact between sovereign governments, ratified by legislation but not creating private rights.

The River Murray Commission’s direction power is the primary enforcement mechanism during the sharing period. If NSW refuses to release water when directed, the other governments could potentially seek injunctive relief in the High Court under the original jurisdiction for matters arising under an intergovernmental agreement, but the agreement does not specify a dispute resolution mechanism. The casting vote of the Commonwealth commissioner (clause 7(4)) gives the commonwealth a way to break deadlocks, but no penalty attaches to non‑compliance.

Financial penalties are indirect. If NSW does not maintain the storage properly, its effective capacity may fall below 600,000 acre‑feet, triggering a proportionate deduction from the fixed annual payment (clause 9(a)). This is a self‑enforcing economic penalty: NSW loses income if it fails to keep the storage in good order. Similarly, if NSW fails to release water when directed, the other states could withhold their share of payments, but the agreement does not expressly authorise that.

No criminal or civil liability for individuals. The agreement binds the Crown (section 4 of the Act) and is an intergovernmental arrangement. No private party can sue for breach. Any dispute between governments would be resolved through negotiation, possibly by referring the matter to the River Murray Commission or ultimately to the High Court if it involves interpretation of the Principal Agreement or this agreement. Given the age of the agreement and its amendment by the 1970 agreement, no reported litigation under this specific Act appears in the source.

Incorporation with the River Murray Waters Act 1935 (SA). Section 3 of this Act states that it “is incorporated with” the River Murray Waters Act 1935 (SA). That earlier Act ratified the original 1914 agreement and subsequent amending agreements. The effect is that the 1963 supplemental agreement becomes part of the same legislative scheme. This means that references in the 1935 Act to the Principal Agreement are now to be read as including this supplemental agreement, as provided in clause 14(b) of the scheduled agreement.

Relationship with the Principal Agreement. The scheduled agreement expressly amends the Principal Agreement as it applies to the Menindee Lakes. Clause 13 provides that to the extent of any inconsistency, the provisions of this agreement prevail. The Principal Agreement remains in force for all other purposes. The key provisions of the Principal Agreement that are affected are clause 45 (sharing of water in normal times), clause 51 (sharing during restrictions), clause 46 (diversion rights), and clauses 20, 32, 33 and 34 (financial arrangements). This supplemental agreement carves out a special regime for Menindee that overrides the general sharing rules.

Interaction with state water legislation. The Act does not purport to override state water laws directly, but clause 3 of the agreement requires each government to secure execution and enforcement. This likely required NSW to ensure its water legislation permitted the Commission to direct releases and allowed the sharing of Menindee water with other states. In South Australia, the ratification Act gives the agreement domestic force, but the Act does not amend the River Murray Waters Act 1935 textually; it merely incorporates with it.

Amendment by the 1970 agreement. The editorial note in the Act indicates that clauses 4, 7, 8 and 9 of the scheduled agreement have been amended and clause 13 omitted by amendments made to the Principal Agreement by clause 29 of the agreement dated 26 February 1970, contained in the Schedule to the River Murray Waters Act Amendment Act (No. 2) 1971 (SA). This means the current operative provisions are not those in the 1963 schedule but as later amended. The 1963 agreement is a snapshot; subsequent intergovernmental agreements have modified the Menindee regime.

No interaction with general criminal or civil law. The Act does not create offences or affect tort, contract, or property law. It is a public law instrument dealing with intergovernmental water management.

Effect on later basin‑wide agreements. The 1963 agreement was part of a series that eventually led to the Murray-Darling Basin Agreement and the Water Act 2007 (Cth). However, this Act has not been repealed and remains on the statute book, though its provisions have been superseded for operational purposes by later agreements.

The Act itself has undergone minimal formal amendment. The only textual change noted in the legislative history is the omission of section 2, which was deleted under the Legislation Revision and Publication Act 2002 (SA). Section 2 was likely a definitions or commencement provision that became redundant.

The substance of the scheduled agreement has been significantly altered by a later intergovernmental agreement. The editorial note appended to the Schedule states: “Clauses 4, 7, 8 and 9 of this Agreement have been amended and clause 13 of this Agreement has been omitted by amendments made to the Principal Agreement by clause 29 of the Agreement dated 26 February 1970 contained in the Schedule to the River Murray Waters Act Amendment Act (No. 2) 1971.” This means the term of the agreement (originally seven years from 1 January 1963 under clause 4) was likely extended or varied. The sharing and payment provisions in clauses 7, 8 and 9 were modified. Clause 13, which gave this agreement precedence over the Principal Agreement, was omitted, perhaps because later amendments integrated the Menindee provisions more fully.

The 1971 amending Act (South Australia) ratified the 1970 agreement, which itself amended the Principal Agreement. That amending Act is not before us, but its effect is that the 1963 agreement as originally enacted no longer represents the current legal position. To know the current sharing rules and payment amounts, one must consult the Principal Agreement as amended by the 1970 agreement and any later instruments.

There is no indication in the source of any other amendments to this Act. The legislative history table shows only the omission of section 2. The Act remains in force but is effectively a historical shell, with the operative detail located in later agreements.

The source does not record any litigation directly concerning this Act or the scheduled agreement. No cases are cited in the Act’s text, editorial notes, or legislative history. Given the intergovernmental nature of the agreement, any dispute would likely be resolved through negotiation or, if necessary, by reference to the High Court of Australia’s original jurisdiction under section 75 of the Constitution for matters between states or between a state and the Commonwealth. No such reported case appears in the public record accessible through this source.

It is possible that disputes over Menindee water sharing have arisen but were settled politically or through the River Murray Commission (later the Murray-Darling Basin Authority) rather than through litigation. The agreement itself provides no dispute resolution mechanism beyond the Commission’s voting procedure in clause 7(4). The omission of clause 13 in 1970 may reflect a desire to avoid conflicts of interpretation.

The absence of litigation history is itself notable. It suggests that the agreement’s terms, combined with the political and financial incentives (the fixed payment and cost reimbursement), have been sufficient to ensure compliance without judicial intervention. The proportionate deduction for low effective capacity acts as a built‑in penalty that reduces the need for court enforcement.

Any litigation that might have occurred would likely involve interpretation of the Principal Agreement, the 1963 supplemental agreement, and the 1970 amending agreement. Without a specific case, we cannot confirm whether courts have considered the meaning of “effective capacity,” “normal maintenance,” or the threshold triggers. The absence of case law means the precise legal effect of these terms remains untested.

The Act is a ratification shell; the detail is in the schedule, which has been amended. Practitioners who rely on the Act as printed may be misled. The scheduled 1963 agreement is not the current law. Clauses 4, 7, 8 and 9 have been amended and clause 13 omitted by the 1970 agreement, ratified by the River Murray Waters Act Amendment Act (No. 2) 1971 (SA). Anyone analysing water entitlements must consult the Principal Agreement as amended, not the 1963 text.

No private rights of action. The Act binds the Crown and operates between governments. A water user or irrigator cannot sue NSW or the Commission for failing to release water or for making a bad decision under this agreement. Only the contracting governments can enforce the agreement, and even then only through political channels or possibly the High Court.

The payment threshold is ambiguous. The fixed annual payment under clause 9(a) depends on “effective capacity” being less than 600,000 acre‑feet. The term is not defined. Is it the same as the total storage capacity from clause 6? Is it the actual volume stored on a given day? The distinction matters because a storage with a capacity of 1.47 million acre‑feet might have an effective capacity below 600,000 acre‑feet if siltation or operational constraints reduce usable space. The proportionate deduction provision creates a financial risk for NSW if capacity is impaired, but without a clear definition, disputes are possible.

The 90,000 acre‑feet priority use is not absolute. NSW’s right to use up to 90,000 acre‑feet per year of excess water is subject to the Commission’s direction power. If the Commission directs water to be released for sharing, NSW must comply, but its priority use is presumably satisfied before releases. The interaction between the direction power and the priority use is not spelled out.

The agreement’s term was seven years, but it continued. Clause 4 originally said the agreement “shall remain in force for a period of seven years from that date” (1 January 1963). The 1970 amendment likely extended or replaced this. Anyone assuming the agreement expired in 1969 would be wrong; the regime continued under the amended Principal Agreement.

Financial provisions are denominated in pounds. The fixed payment of £160,000 per annum was set in pre‑decimal currency. The 1970 amendment may have altered the amount or converted it to dollars. The current payment amount is not in this source.

Compliance burden falls on NSW alone. The other states have no operational duties; they only pay their share of costs. NSW bears the entire burden of maintenance, operation, and following Commission directions. If NSW fails to maintain the storage, it loses payment but Victoria and South Australia may suffer reduced water availability without direct recourse.

The casting vote gives the Commonwealth effective control in disputes. If the four commissioners are equally divided, the Commonwealth commissioner’s casting vote decides. This means the Commonwealth can force a release direction even if the three states disagree, as long as the commissioner votes with the commissioner of one state. Centralisation of decision‑making is a risk for state autonomy.

Compliance under this Act is the responsibility of the contracting governments, not private parties. For a state government or the Commonwealth, compliance involves the following steps.

For New South Wales (as operator): Ensure that the Menindee Lakes Storage and associated works are maintained in good order and condition (clause 5). This requires a maintenance program that considers the full supply levels and storage capacities in clause 6. Keep records of maintenance activities and costs, because three‑quarters of those costs are reimbursable under clause 9(b). Monitor storage levels daily. If storage exceeds 390,000 acre‑feet, be prepared to release water at the direction of the River Murray Commission. Track NSW usage of water from the excess storage; ensure that usage above 90,000 acre‑feet in a year (commencing 1 May) is correctly debited to NSW’s share under the Principal Agreement. If storage falls below 390,000 acre‑feet, cease releases and note that the sharing provisions are suspended until storage next reaches 520,000 acre‑feet. During that period, NSW may use water as it requires but must deem that use as water under clause 46 of the Principal Agreement. Maintain effective capacity above 600,000 acre‑feet to avoid proportionate deduction from the fixed payment. If effective capacity drops, calculate the proportionate reduction for days below the threshold and adjust the quarterly claim accordingly.

For the River Murray Commission: Prepare estimates under clause 34 of the Principal Agreement that include the moneys payable under this agreement (clause 12). Include the fixed annual payment (clause 9(a)) in the estimates dealing with moneys payable by the contracting governments under clauses 20 and 32 of the Principal Agreement. Include the cost reimbursement (clause 9(b)) in the estimates dealing with moneys payable by the state contracting governments under clause 33. Issue directions under clause 7(2)(a) when storage exceeds 390,000 acre‑feet, by majority vote with the Commonwealth commissioner holding a casting vote. After the 1970 amendments, consult the amended text of clauses 4, 7, 8 and 9 to ensure correct current provisions are applied.

For Victoria and South Australia: No operational duties. Each state must pay its equal share of the fixed annual payment and of the operating costs, as determined by the Commission’s estimates. Payments are due at the same time as payments under clauses 20, 32, and 33 of the Principal Agreement (clause 12(4)). Ensure that internal budgeting and appropriation processes account for these amounts.

For the Commonwealth: No payment obligation under this agreement, but the Commonwealth commissioner must participate in Commission meetings and exercise the casting vote when needed. The Commonwealth must also ensure its legislation is consistent with the agreement (clause 3).

General compliance note: The 1970 amendments must be consulted. The 1963 schedule is not current. Any compliance plan should refer to the Principal Agreement as amended by the 1970 agreement and any later instruments. Government lawyers should verify the current version of the River Murray Waters Agreement before advising on water sharing obligations.
