97 Removal of commodity or area from control of marketing order
> > (1) Where the Minister—
> >
> > > (a) is satisfied that—
> > >
> > > > (i) votes have been cast in a poll referred to in section 96 by a majority of the persons who are enrolled in the roll for the poll, and
> > >
> > > > (ii) a majority of the votes cast at the poll are in favour of the removal of a commodity or part of an area from the control of a marketing order, and
> >
> > > (b) certifies to the Governor that the Minister is satisfied as to the matters mentioned in paragraph (a),
> >
> > the Governor may, by proclamation, direct the relevant committee to wind up so much of its affairs as relates to the commodity or the part of the area, as the case may require.
>
> > (2) Upon a proclamation under subsection (1) taking effect, the committee shall proceed to wind up its affairs to the extent that the direction so provides.
>
> > (3) A proclamation under subsection (1) may revoke a declaration of a primary product as a commodity for the purposes of this Act or reduce the area for which a marketing order is in force, or both, as the case may require, and may contain such provisions of a savings or transitional nature as the Governor thinks appropriate in consequence of such a revocation.
