#### 137 Information to be furnished 137 Information to be furnished > > (1) For the purposes of this Act, the Minister, the Secretary, a board or a committee may, by notice in writing served on the person to whom it is addressed either— > > > > > (a) personally, or > > > > > (b) by post at the person’s last-known place of abode or business, > > > > require a person to furnish in writing to the Minister, the Secretary, the board or the committee, within the time specified in the notice, such information relating to any primary product or other product as is specified in the notice. > > > (2) A person shall not, without reasonable excuse, fail or refuse to comply with a requirement under this section. > > > (3) A person is not excused from furnishing information that the person is required to furnish under this section on the ground that the information might tend to incriminate the person or make the person liable to a penalty, but any information so furnished is not admissible in evidence against the person in proceedings other than proceedings for an offence against subsection (4). > > > (4) A person shall not furnish under this section information that is false or misleading in a material particular. > > > (5) A board or committee may not require information to be furnished under this section except in relation to the commodity. > > **s 137:** Am 1998 No 45, Sch 3.4 \[3\].
